“...A home that maintained the integrity of the neighborhood...” The quaint area known as “West of Trail”, closely and quietly neighboring downtown Sarasota is full of charming homes of varied styles. The area ranges from small salt box homes to mansions, many new, many dating back almost a hundred years. The charm of this neighborhood is amplified by a mixture of the softly dominating style of Spanish Revival, to a drop of a contemporary home here and there. Most of the homes are outlined by the city sidewalks, creating a sort-of ‘Welcome’ mat for residents to enjoy their community as well as visitors. The sidewalks lead to adventures through the neighborhood parks, restaurants, and shops. John Cannon embraced the neighborhood aura in developing the Macalla, an architecturally pleasing gem nestled in the heart of Desota Park on the corner of South Osprey Avenue & Wisteria Street. Making a conscious decision to play to the neighborhood’s characteristics he set the tone with a Spanish Revival style quietly blending the home into its surroundings. “It was important for me as a builder to design a home that maintained the integrity of the neighborhood, and I believe that we achieved that with our Spanish style of architecture, courtyard and mature landscaping,” he shares.

From the street the Macalla has aged beauty. This is due to the little details; the cap on the chimney, lighting fixtures, use of brick, but more importantly the mature, lush tropical landscaping framing the Macalla emulates a sense of longevity. Walking up the motor court another key characteristic of the home catches my attention, the front door. The door, framed by a simple cast stone moulding entryway, is striking. A true craftsman piece constructed from solid pecky cypress, it even has an operable speak easy. I push the latch on the door and it gently glides open. Stepping in my eyes immediately dart to the distressed wood beam volume ceiling cresting at 22 feet ringed by simple clerestory windows. Set back into the depth of the wall, the windows softly filter light into the room highlighting the beams and crown molding. Gazing back down I am taken back by the beautiful decorative cast stone fireplace gently reaching far up into the heights of the great room which is surrounded by a sea of chiseled edge stone flooring in a regal cascade gold color. Off to the right of the amber glass tiled hearth sits a window box, a cozy nook where one can envision curling up against the arched window and reading a book. French doors to the side of the room open to a large outdoor kitchen with its own dining table and additional seating area. Passing the outdoor kitchen I step onto a large deck circling a lagoon style pool, with a pulsating bubbling water feature and circular hot tub. Ringing the deck is a manicured lawn leading to very tasteful

landscaping, once again mature, providing total privacy for one to enjoy this outdoor area. Looking into the pool it captivates me casting an inviting deep blue glow like I’ve never seen before. Inquiring about it John explains, “This pool has a BeadCrete finish. BeadCrete is the latest development in pool finishes and contains glass spheres that create a 3-dimensional effect. The pool finish is designed to catch your attention.” Moving past the brick inset outdoor shower, I step under the arched portico and through double French doors into the master bedroom suite. This spacious retreat offers a sitting area, large dual walk-in closets and a sunlit master bath that includes dual sinks with custom arches above, a large soaking garden tub and a walkin Roman dual head shower. This is a very cozy, personal space. I next take the contrasting saddle-finished Eucalyptus species engineered wood stairs and head up finding myself in a large bonus room. Built in cabinets with book shelves, an entertainment center, tray ceiling and custom wrought iron railing opening to the great room below define the space. An arched hallway leads to two spacious ensuite bedrooms. However, another unique design feature of the Macalla interests me, a large veranda with a circular staircase leading down to the pool area. A perfect place to gaze up into starry nights. I head back down to explore the kitchen. As a kitchen designer I appreciate well executed kitchens and the Macalla doesn’t disappoint. There is the expansive Colonial Gold granite topped island, sitting on maple cabinets finished in a soft, creamy beige with a coffee glaze, complete with a wine cooler. It is a focal point unto itself. Across sits the Wolf gas range with a custom stone hood mirroring

the fireplace. A large window over the sink fills the room with natural light and spotlights the balance of the Colonial Gold granite countertops and maple cabinets stained in a dark cocoa finish. A glass tile back splash blends into chiseled stone, complimenting the chiseled stone floor. A disappearing panty and aquarium glass window with a view of the tantalizing pool are the finishing touches. Complete with a study and oversized laundry room, every aspect of the Macalla was well thought out and has a purpose. One of the many things I most appreciated is the subtleness of the details, and how well each worked together in the home’s composition. 1950’s The 1950’s were a time defined by tremendous social and political change as women challenged nonsensical ideas about their role in society and AfricanAmericans spoke out against inequality. Factor in the introduction of more television sets into households and the widespread emergence of rock ‘n roll, and it’s no wonder we refer to this decade as the “Booming 50’s”. In the 50’s, it was mostly the teenage girls that were exploring new trends. One trend was to bleach their own hair with Ivory Snow Flakes and peroxide. That’s right, they mixed up the laundry detergent with peroxide and lightened their hair that way. Another trend that began was for young girls to wear their hair in ponytails; the hair was combed back and fastened by a rubber band. There wasn’t any of the protected bands that we have today. those rubber bands and no one thought anything about it. For the slightly older set, the poodle haircut became stylish as ladies would have all their hair cut off to about one to two inches all over their head and get a permanent. Straight hair was given permanents as straight hair was considered taboo at the time, unless of course you were a teeny bopper and had a ponytail. The older women used rinses instead of tinting their gray hair and would go to the “beauty shop” on a weekly basis to have their hair rolled. Hairdressers were called “Beauticians” and they wore white uniforms with a girdle, stockings and nurses shoes. What we call clients today were called patrons back then. The permanents were harsh with ammonia, unlike the alkaline and acid waves we know of today. 1960’s Everything was extreme in the sixties. One of the more popular new extreme hairstyles, especially popular with young women, was to grow their hair

extremely long and keep it “natural”, whether straight or curly. They would brush their hair back and place a headband on it, both for decoration and to keep their hair in place. The more daring bleached their hair with colors that were either platinum, beige, high fashion light pink or lavender! Another hairstyle that was so prominent in the sixties was the “bee hive” and the “bubble do”, otherwise known as the bouffant hairstyle. For this hair style, the hair was clipped shorter on the bottom and became longer as you worked your way up. The longest section was in the crown and top area for height. Everyone wanted height in the 1960’s, thinking that the more height they would have on the top of their head, the slimmer their body would look. There was, however, only one way to accomplish this; and it was to backcomb the hair until all of the hair was like a birds nest close to the scalp. Avoiding the pitfalls and detecting the guide posts for success in personal injury claims As an experienced court certified forensic expert, I am often retained by personal injury and construction litigation attorneys. As an architect, they seek my opinion regarding potential design errors and omissions, code violations, as well as any and all construction defects that may have contributed to a premises liability claim. These claims are filed in order to seek recovery for slip and fall victims, injuries sustained by construction workers, and other injuries or wrongful deaths stemming from the construction environment. Personal injury claims can range from a few thousand dollars to well over several million dollars. The diverse and unique circumstances range across the board from dangerous and unsafe conditions to minor deficiencies that the vast majority of users and patrons easily negotiate every day. In today’s litigious environment it is important to distinguish the former from the latter. There are some conditions that jeopardize the health, safety and welfare of the public to such an extent that serious injury is inevitable. There are other conditions that are simply so minor that any accidents occurring in the nearby vicinity of these small anomalies can only be attributable to the victims’ incompetence and/or attitude to seek a financial windfall. I. foretell success or failure in filing and or defending a personal injury claim. I have identified procedures that will cover and better apportion liability without the expert needing to rely on his relative expertise in opining on such matters. The first measure and some attorneys tell me probably the most effective, is to establish a timeline for any and all critical decisions that led to the alleged premises deficiency. This timeline should include the following: (1) The year the building was designed and constructed; (2) The entities involved in creating the built environment; (3) The policies and procedures in place at the time of the alleged injury and when were they established; (4) Whether individuals involved in the alleged incident have knowledge of the actual condition of the premises that may have contributed to the accident; (5) The parties involved in improving and permitting the design and construction required to obtain occupancy of the premises. Once dates are assigned to all the above, a sequence of events in the form of a timeline is identified and created. Typically I respond to the circumstances surrounding each milestone event that may be a contributing factor, by offering a concise assessment of the following: (1) Were the circumstances code compliant or code deficient? (2) Did the actual as built condition conform to the permit design documents submitted to the building department? (3) Did the actual as built condition reflect work that meets, exceeds, or fails to achieve industry standards? II. Code Applicability Most improved environments fall under the jurisdiction of many federal, state, or local land use control codes e.g. zoning, building codes, as well as fire protection and the Americans with Disabilities Act governing legislation. In addition, during construction the Occupational Safety Hazard Act governs. With these governing codes and regulations, it is increasingly likely that most environments will violate one or many codes and/or regulations. The litigators are acutely aware that a

clear code violation that can be proven as contributory typically spells victory for the plaintiff. Therefore, determining and assessing code applicability is crucial in premises liability claims. III. Discovery We, as designers and experts, must read all depositions and testimony by those identified in the timeline as well as those who had any knowledge of the accident, with the same diligence as the attorneys. The testimony rounds out and contributes to the preparation of the timeline. My firm has been able to create threedimensional depictions of the actual premises site before, during, and after the accident. Leading forensic experts are now moving into animation and depicting not only the static setting, but also the moving kinetic man-made showing human motions before, during, and after the accident. Animation recreations are the most compelling exhibits if executed accurately and professionally. I have observed opposing counsel struggle when presented with graphic illustrations that they cannot counter with their legal argument. I have also found opposing counsel flounder when confronted with the fact that they cannot understand construction plans when presented in front of a jury. It is at this point that the tables turn on testimony. With complete factual and accurate disclosure and preparation of all the elements enumerated and described above, it has been my experience that the actual contributory causes and liability can be properly assigned to the parties. With thorough research and documentation, the expert’s opinion almost becomes anticlimactic. Therefore, if you form your expert opinion by following the process of timeline, code applicability and discovery, your role as the expert witness becomes relevant and extremely beneficial to the liability determination of the claim.

When buyers embark upon the search for a new home, they usually have an idea of the kind of property they want to purchase, the size, location and some key features that are important to them. Basic decisions such as a condo or single family home are usually made early, and a budget for the purchase is established by deciding how much cash is available and going through a mortgage qualification process if financing is needed. Then what? Statistics and experience in the marketplace tell us that most buyers (around 99%) start their search for a home on the internet. However, internet searches alone cannot provide all of the facts needed to make an informed purchasing decision, and most buyers eventually look to work with a real estate agent to assist in the search for a home. Identifying the right agent is key to the success of any real estate transaction. So how can you identify the right agent for you? Here are six questions you should ask a prospective agent. Are you a real estate agent or a Realtor®? Only members of the National Association of Realtors® (NAR) may use the term Realtor®. This is an important differentiation, as Realtors® are bound by a Code of Ethics over and above the real estate licensing law. This means added protection for you as the buyer. How long have you been in the business, and is this your full-time job? This is a good indication of the agent’s experience and dedication to their profession. Generally, agents who have

made real estate their full time career are more likely to be knowledgeable about the latest laws, standards of practice, trends in the market and how they may affect you. Which real estate designations or certifications do you hold? Designations and certifications indicate that the agent has undergone training developed by the State and National Associations of Realtors® and are an indication of how seriously they take the profession. S

he grew up in Sarasota, and for real estate professional Pamela Hagan, there’s no place like home. As the broker/owner of Waterfront 7 Realty, she is sharing her knowledge and skills with clients and agents alike, enthusiastically assisting them in realizing their individual goals. Pamela launched her real estate career in 1982, while studying Economics in Gainesville. “I wasn’t the greatest student,” she recalls with her trademark smile, “but I aced the state licensing exam!” It was, she says a natural fit. “It clicked right away,” Pamela asserts. “I was born to be in real estate.” Her early years were spent selling timeshares; her ability to successfully – and consistently – close some of the most challenging transactions in the business gave Pamela insight into her unique strengths and talents. “I love the opportunity to create individual relationships, and to tap into what each person wants and needs,” she explains. “Not only am I helping others, but I am also always in a position to learn something new. There’s nothing more rewarding.” Pamela transitioned into a corporate

position with Arvida as the company developed communities throughout the Gulf Coast region. Watching her hometown grow and change offered her a powerful insider’s knowledge of the big-picture real estate market, and she utilized that when she made the move to the residential resale market. Armed with a comprehensive understanding of an array of real estate transactions, she has successfully assisted a diverse clientele in the purchase and sale of primary, investment and vacation properties.

Her longevity in the field isn’t the only measure of Pamela’s success. She reports that in 1990, she sold the highest-priced home on Siesta Key. “My career has evolved,” she reflects. “With Arvida, I was selling high-end homes on Longboat Key, which really

established regional market price points.” It was a natural transition, she adds, to sell homes throughout the area’s luxury communities. Service, says Pamela, is an issue independent of price point. So whether she is working with firsttime buyers in a waterfront condo community, assisting a family in moving up to a larger home, or representing an individual who is downsizing , she offers nothing less than excellence throughout every phase of the transaction. Her clientcentric model has her focusing on individual needs, with an emphasis on cultivating longterm relationships rather than closing transactions. “It can’t be about a commission,” she explains. “I always operate with my clients’ best interests at the forefront of my actions.” She has expanded this business model with her brokerage, Waterfront 7 Realty. The boutique office has attracted like-minded agents whose distinct backgrounds and skills add value to the group as a whole. “We have a wonderful office, with agents acting like an extended team in their level of support and collegiality,” Pamela reveals.


The synergy within Waterfront 7 Realty wasn’t a stroke of luck; it reflects Pamela’s professional diligence and her unwavering dedication to her profession. “I’ve managed real estate offices throughout my career, and have learned how an environment can impact the business that is conducted within the brokerage,” she says. “I designed a model and business plan that works, but it takes a great group of people who buy into my vision to make it a success.” Quality, she adds, is a critical element. “I’m not changing my business model so that I can fill my office with agents. I have hand-selected the individuals here, and am honored to work with them. They are all about good business.” That model, Pamela says, is about putting relationships first. “I utilize technology to communicate and to systematize my processes, but there is no substitute for face-toface conversations,” she explains. This, she notes, is imperative to establishing a solid rapport not only with clients, but with other agents. Her collaborative approach has earned her the confidence of consumers and real estate professionals alike. She describes her business model as “putting the handshake back in the deal.” It emphasizes, she says, accountability and trust. “I follow through on my commitments,” states Pamela, “and I expect nothing less than that from other agents and industry-related professionals.” There’s a sense of something bigger, too. Be realistic; if you haven’t worn it for the past 2 years, you are not likely to, so get rid of it. Take it to the thrift shop, give it to charity – or, if you must keep it for sentimental reasons store it away out of sight.

What’s In Your Closet? Ring out the old, ring in the new, and get REAL with your Closet in 2014. If de-cluttering your closet is on your New Year’s to-do-list it’s time to do some spring cleaning. In this issue REAL Style will help you obtain a workable, wearable wardrobe, a wardrobe that expresses your best self. How would you like to open your closet and have everything in it match your fashion personality, lifestyle, and your body type? It’s possible by taking a long, critical look at what’s in your closet. Someone once observed that women wear only 10 percent of the items in their closets 90 percent of the time! While you may claim a better record, most of us have stood in a closet full of clothes more than once and said, “I don’t have a thing to wear!” How can you have a closet full of clothes and nothing to wear? Perhaps the clothing in the closet no longer fits your

body or lifestyle; maybe items are outdated or not suitable for a specific occasion. Probably some items were buying mistakes in the first place! Often the reason is we simply have a collection of garments, purchased to meet an immediate need, accumulated without adequate thought to an overall plan. Comfortable and flattering clothing that is appropriate for a variety of needs is an important part of our lives. Clothing provides comfort and protection, influences our acceptance by others, impacts relationships and the way we feel about ourselves, and is a source of enjoyment and recognition. In view of these implications, the effort to plan an adequate wardrobe is worthwhile. First consider what you have. What do the clothes in your closet tell about you? Take everything out of your closet and try it on; check for fit, suitability, design and color. Then sort all garments into three groups: Group 1 - Clothing that is unusable because it no longer fits you or your lifestyle, is out of date, too worn or faded,

Group 2 - Clothing that fits and looks good but needs minor alteration, repairs, or cleaning. This is the “maybe” pile. If an item needs major restyling or alteration – is it worth the cost, and will you really wear it. If you haven’t had it altered within a year, assign it the same fate as Group 1. Again be realistic. Group 3 - These are the “keepers” – items you actually wear and can work with to organize your “new” wardrobe. Start by separating them into colors, dividing clothes that have good lines and colors for you from those that don’t. Some may not be your “best” colors, but you can use them until ready to replace. Experiment by combining pieces in new and different ways with each other and with accessories. It is often surprising how many outfits you can now coordinate! Keep in mind if you can coordinate for more than 2 weeks in advance without using the same items, you probably have too many clothes, and are they what you need? Think about your activities and time spent with each activity. Do you have too many for one activity and not enough for another? Also take a look at textures (too many polyesters, not enough silk?); at color (too many neutrals, not enough bright); at personality (too many tailored suits, not enough softness?). You may need more variation. Look at Group 1 and ask yourself why some items were not worn. Maybe they were mistakes in the first place, but evaluating could keep you from repeating the mistakes. Spending time to analyze why you dislike certain garments and why you look and feel better in some outfits, will help in selecting good wardrobe pieces that will be worn time and again.
