It’s that time again...Register for the 2009 TREPAC Golf Tournament today! Calling all golfers! Registration for the annual Texas Real Estate Political Action Committee (TREPAC) Golf Tournament is now underway. The tournament will be held on Friday, May 1 at the award-winning Falconhead Golf Club, located at 15201 Falconhead Blvd. in South Austin. With a registration fee of just $99 per person, this event is sure to sell out. If golf isn’t your sport, you can still show your support for TREPAC by purchasing a $25 dinner ticket.

The 2009 TREPAC Golf Tournament begins at 10 a.m. with check-in and practice. Lunch will be served from 11 a.m. to 12:30 p.m., at which time the tournament will begin. Be sure to stay for the awards ceremony and dinner at 5:30 p.m. Prizes will be awarded for putting, men’s longest drive, women’s longest drive and more. Registration fee includes lunch, range balls, green fees, golf cart, beverages and dinner. Payments are accepted via cash, check or credit card. All payments are a direct investment in TREPAC. ABoR Foundation helps students pursue goals ABoR Foundation chair Carol Medley Parker listens intently as ambitious and academically talented high school seniors tell her why he or she is deserving of a scholarship. She is both filled with sorrow and pride, as these teenagers share their stories of dedication amid a variety of strife. One works long hours to pay his own college expenses because his father is incarcerated and won’t be able to help. Another lives with her elderly grandfather because her mother recently died from breast cancer. Another is so focused that he has already accumulated 20 hours of college credit by taking dual credit courses while in high school, and hopes to be an engineer. Another works diligently as a volunteer at a local vet clinic to prepare herself for her goal of becoming a veterinarian. “They are really incredible kids,” Parker says. “You always need a box of tissues when you conduct the interviews. They deserve these scholarships.” More than 300 students each year submit applications and the Foundation selects 25 to 30 for personal interviews, after which 10 to 12 are awarded $1,000 scholarships to attend a Texas college or university. Established in 1978, the ABoR Foundation has awarded nearly 250 scholarships and now hopes to grow its funds to increase the number of scholarships granted each year or increase the amount of each scholarship. “One of our goals is to create an endowment where enough interest would be generated to pay for the scholarships,” Parker says. “In addition, some REALTORS have created Individual scholarships and we would like to encourage endowments through trusts or other legal avenues.” Parker works with six other directors: vice chairman Cathy Coneway of Stanberry Commercial REALTORS, John Horton of John Horton Realty, Carol Dochen of Carol Dochen REALTORS, Leonard Guerrero of JB Goodwin REALTORS and Kara

To increase reserves for the scholarships, the directors hope to make more REALTORS aware of the Foundation and its purpose, in hopes of shoring up donations. A mix of residential and retail buildings, the project seeks to create a sustainable neighborhood built on the principles of New Urbanism. The event lasts from 11 a.m. to 2 p.m. and includes a tour of model homes, lunch at the Old Mueller Hangar and an address by Austin Mayor Will Wynn. Chartered buses will pick up attendees between 11-11:45 a.m. in the Mueller Development retail center. The $10 fee also includes registration for more than $1,000 in giveaways. The Foundation is an independent 501(c) nonprofit organization so tickets fees and donations are tax deductible. “The Mueller community has committed to providing the ABoR Foundation with a matching donation for each attendee, so this is a great opportunity to maximize your contribution,” Parker says. Three ABoR Members honored by State Association

The Austin Board of REALTORS® (ABoR) congratulates Sytha Gustafson Minter, Charles R. Porter and James A. Reed for the honors they received at the 2009 Texas Association of REALTORS® (TAR) Winter Meeting this month. Garnering awards in both political involvement and education, these individuals exemplify the diversity and dedication of our

membership. Sytha Gustafson Minter of Horizon Realty received the Strike Force Award for her contributions to TAR’s grassroots initiatives. Minter was awarded this honor based on her involvement in the opportunity race program, her service as a legislative liaison and her participation in various TAR Political Affairs programs.

Visiting at the Highland Homes “There’s no place like a Highland Home” REALTOR luncheon held at Cool River Cafe was Highland Homes’ Ron Glenn, division vice president and Jean Ann Brock, executive vice president/co-owner and Mark Sprague of Residential Strategies.

She is also a committed investor in the Texas Real Estate Political Action Committee (TREPAC) and a registered voter. Charles R. Porter, 2007 ABoR Chairman and owner of Bryker Properties, received this year’s Ethics Program Award for his course “Basic Water Rights of Texas,” which premiered in June 2008. This class explores the important role water rights play in Texas real estate brokerage, touching on topics including the founding principles of Texas water law, the “Rule of Capture” and how it impacts aquifers, and riparian rights and “flowing water.” James A. Reed of James A. Reed and Associates received the Sales and Marketing Program Award for his “Short Sales 101” course. In this class, agents are provided with a fuller understanding of the process involved in negotiating “short sale” transactions. First taught in July 2008, the course educates students on what constitutes a short sale, how the foreclosure process is handled in Texas, how to successfully negotiate a short sale and common problems with these transactions. New MCE Courses offer a Real Estate Reality Check By Jay Gohil • Jay Gohil Realty 2009 Chairman • Austin Board of REALTORS To help you better understand all aspects of the real estate industry, the ABoR Academy has added two new MCE courses: Real Estate Reality — Property Management and Real Estate Reality — Leasing. Each class carries three hours of Mandatory Continuing Education (MCE) credit (TREC approval pending) and costs $27 for ABoR members and $33 for non-members. Both courses will premier on Thursday, April 2 and will be taught by Bill Evans. Real Estate Reality — Property Management will last from 8:30 to 11:30 a.m. Students will learn how the Code of Ethics applies to property management, how to communicate with owners and tenants, which forms are currently used in these transactions and how the Texas Property Code comes into play. Real Estate Reality — Leasing covers who may lease properties, how to attract clients, which party the leasing agent represents, no-fault advertising and the realities of property leasing. Update to Property Forms – Don’t Miss These Changes!

Recommendations from ABoR’s Risk Reduction Task Force and mandates from the National Association of REALTORS® have prompted changes to the Seller ’s Disclosure and Exclusive Right to Sell Agreement forms. Agents are encouraged to review these new forms, which are available at https://www.abor.com/mls/pforms.cfm and through the Texas Association of REALTORS® (TAR) ZipForm library, available at www.texasrealtors.com under the “Legal Tools” heading. The Seller ’s Disclosure form now features several new checkboxes, as well as verbiage to address the City of Austin’s Energy Audit requirement and the installation of smoke detectors for the hearing impaired. Additionally, a new form titled

“Addendum Updating Seller ’s Disclosure Notice” has been created. This form eliminates the need for the “Seller ’s Disclosure Notice of Changes to Property Condition” box from the Seller ’s Disclosure notice. A sentence concerning IDX options has been added to Item 7E of the Exclusive Right to Sell Agreement: “I understand and acknowledge that, if I have selected option (b) above, consumers who conduct searches for listings on the Internet will not see information about the Property in response to their search. (Seller ’s initials required.)” If you have questions or concerns regarding changes to the Seller ’s Disclosure or Exclusive Right to Sell Agreement forms, please contact ABoR’s MLS Support Team at mlssupport@abor.com or 454-7636.

Future projects under consideration are a Fun Run in the fall and possible involvement with area food banks and Habitat for Humanity. These would support the Foundation’s goal of developing strong ties to the community to foster positive relations between REALTORS and consumers. Dear members, The Executive Officers and I had an opportunity to represent the Austin Chapter at the TAR/WCR Winter meeting. The WCR State Chapter had another opportunity to raise money for TREPAC with a top-notch “Celebrity Waiter Dinner” evening event. WCR National President Becky Hill, as Sonny, and TAR Trustee, David Burton, as Cher, rocked through the night. The event was so much fun and the State Chapter was able to raise $11,000 for TREPAC through its members and guests. I also had an opportunity to see the NAR President, Charles McMillan, at the meeting. He has been actively supporting our Texas REALTORS by attending every session. New Homebuyer Tax Credit is Bigger and Better; Now is the Time to Buy By Wes Peoples • WP Investments 2008-2009 President • Home Builders Association of Greater Austin On February 17, President Obama signed the American Recovery and Reinvestment Act of 2009 into law. As part of $787 billion in economic stimulus measures, the legislation created a home buyer tax credit that is bigger and better than the previous credit that was implemented in July 2008. The Web site www.FederalHousingTaxCredit.com explains in detail the provisions of the new tax credit. In a nutshell, it: • Provides a tax credit equal to 10 percent of the sale price of the home, up to an $8,000 maximum. • Is a true tax credit. It does not need to be repaid, unless the home owner sells the home within three years of the purchase. • Can only be used with the purchase of a home that will be the buyer’s principal residence. It cannot be claimed for the purchase of a vacation home or property to be used as a rental. • Available to anyone who has not owned a principal residence for three years or more. • Applies to homes purchased by qualified buyers between January 1 and November 30, 2009. The purchase date is the date when closing occurs and the title transfers. This new tax credit provides an unprecedented opportunity for people looking to buy a new home. Plus, buyers will be taking advantage of recordlow interest rates and competitive home prices. These opportunities won’t be around forever. Keep in mind that your clients have to close on their house on or before November 30 to take advantage of the new tax credit and the Federal Reserve can not possibly sustain record low interest rates for very long. So when your clients ask what does it really mean when we say it’s a buyers’ market? Tell them to expect to find many builders who have inventory

that is “move-in ready,” and may offer upgrades or other incentives to seal the deal. But don’t expect the inventory to last very long. In fact, because builders in Central Texas began in 2007 reducing the number of new houses built, our region does not have an oversupply of housing inventory. Metro Study, a firm dedicated to tracking the new home market, showed that as of the end of 2008 our region had just over two months of supply in finished, vacant newly built homes. And, Metro Study expects builders to continue to reduce the number of homes built this year by another 25%. In addition, in January Metro Study also noted that for the last 10 consecutive quarters, builders in Central Texas have continued to close more homes than they have started. This indicates people are currently buying much of the inventory builders are putting on the ground. In testimony before Congress recently, Federal Reserve Chairman Ben Bernanke added that he saw the end of the recession in the fourth quarter of 2009 and the recovery to begin in 2010. But if your clients are taking a “wait and see” approach to buying a home, remind them that in order for them to reap the benefits of the current buyers’ market, they have to actually buy. Sitting on the fence, waiting for bigger and better deals, trying to time the market and shuffling your feet will likely get you no where. Housing markets are cyclical and this cycle too will pass. All in all, people who know enough to recognize they are in a buyers market and buy when opportunities are there are the smart ones. These are the folks who know that those who “make a killing” on a home purchase are just very lucky. They realize that trying to time when the market will “bottom out” is unrealistic. Currently, Metro Study predicts the local housing market will begin to rebound at the end of this year or in early 2010. This means that for those considering buying a new home, NOW IS THE TIME TO BUY. Austin Inspectors Exchange By Linda McNabb CONTRIBUTING WRITER Realty Line recently visited with Billy Meyerdirk of Austin Inspectors Exchange to find out more about how this company aims to help REALTORS find a qualified and dependable inspector with ease and confidence. He first filled us in on how the company emerged. Billy Meyerdirk: The owner of The Exchange, Betsy Hodge, had the vision and insight to recognize the major needs in our industry. She also had the determination to put the Exchange in the right place at the right time. What a great time to build Austin’s premier inspection company during the worst time for real estate since the 80s. I think we both love swimming upstream when you can see the calm waters just ahead. Betsy’s Exchange allows us to pool our resources and cut our overhead but also enables us to multiply our marketing money, add additional services for agents and enjoy camaraderie and fellowship. Realty Line: Austin Inspectors Exchange specializes in bringing together quality inspectors and individuals in need of inspection services. What criteria must these inspectors meet? Billy: The majority of inspectors are from the old Home Critic. I have personally worked with them, in some cases as many as 15 years. The newer inspectors were hand picked and trained in house by our more experienced inspectors. RL: How do you match home buyers and the real estate community with your inspectors? Billy: Most of the agents have built working relationships with one or more of our inspectors and have had a proven successful track record. We do match sometimes when we need certain specific expertise upon request from a buyer or we need a bilingual inspector. RL: What services other than home inspections do you offer buyers and REALTORS? Billy: I can not think of any service in our industry we do not offer. We hold numerous licenses in multiple disciplines. RL: Why would an inspector want to become a member of the exchange and how can they do so? Billy: Because we are so big and so diverse we have the ability to cut any inspector’s overhead, double (at a minimum) their advertising reach, and offer each other to consult

Keller Williams Realty Climbs to Third-Largest Real Estate Franchise in United States

Keller Williams® Realty Inc., announced last week at its annual convention in Orlando, Fla. that it is now the third-largest real estate franchise in the United States, surpassing RE/MAX® International. According to Steve Murray of REAL Trends, a leading source of analysis and information in the residential real estate industry, the Austin based company claimed the number three spot with 72,794 U.S. associates at the end of 2008. “The success of Keller Williams Realty can be directly attributed to the hard work and perseverance of our associates and the soundness of our economic and organizational models,” said Mark Willis, CEO of Keller Williams Realty, Inc. “While others might be looking at this market and seeing fear and uncertainty, we have always approached it as our opportunity to shine and grow. And that mindset has paid off.” The company has been gaining ground for the last three years, outpacing pervasive downward trends in the real estate industry. From 2006 to 2008, Keller Williams Realty increased its associate count by 52 percent, market share for its offices increased 83 percent and agent gross commission income went up 35 percent. Currently, the company has 679 offices operating in the United States. The company also shared more than $30 million in profits with its associates in 2008 through its company-wide profit sharing program. “Through profit share, our phenomenal coaching and training and our technology offerings, we are offering agents their own ‘bailout plan’ for this market.” Willis added. The company also announced that after years of searching for a partnership to provide its associates with affordable health insurance, they are moving forward with a solution. The soon-to-be-launched Keller Williams Health Providers Program will include options for major medical, limited medical, catastrophic coverage and a separate cancer plan.
