In addition, I am responsible for attending the NAR Mid Year meetings in Washington, D.C. David Burton, governor in May and the WCR Texas Chapter NAR Annual Convention in November. This year it is being held in San Diego. I was first asked to join the Austin Region of Lone Star CRS as a committee chair. From there I went on to become the Regional Director for Austin. I then proceeded to go onto the Lone Star Board of Directors, Carrie Weikert, president serving as Lone Star CRS Chapter Treasurer. The rest is history. RL: What was the induction ceremony like? WTP4 Receives Go Ahead from City Council By Jay Gohil • Jay Gohil Realty

In last month’s column, I stressed the importance of the construction of Water Treatment Plant 4 (WTP4) to help sustain our quality of life and address the city of Austin’s growing water needs. On Thursday, Oct. 22, the Austin City Council took the first steps to proceed with the construction of WTP4. The vote was close with 4-3 in favor of the project. Austin Mayor Lee Leffingwell and Mayor Pro Tem Mike Martinez were among those that voted yes to giving the project the green light. Construction is expected to begin with the clearing of land and the excavation of tunnels that would draw water from Lake Travis. In addition to helping meet the increasing water needs, WTP4 is expected to create thousands of jobs in the Austin area.

Green Real Estate Course Offered ABoR offers an extensive variety of mandatory continuing education (MCE) courses for both members and the general public. TAR Conference and it was nice to have several representatives from Austin in attendance and to have Becky Hill the National WCR President preside over the ceremony. CARRIE: Very, very nice. It was held in Dallas at the TAR Convention during the TAR Education Luncheon that Lone Star sponsors each year. I had the honor of having Avis Wukasch do my installation for me. There were nearly 300 people from all over the state in attendance. RL: How do you find time for a leadership role? DAVID: Having gotten to real estate by way of mortgage and title, the last 10 years have been amazing and I could not imagine doing anything other than being a REALTORŽ. The volunteering takes time, but I learned early on to make it part of my business plan. The experience and knowledge I gain from volunteering and serving in leadership roles is truly priceless‌that and the fact that the involvement provides me with many referral opportunities. It truly is a win-win! CARRIE: By being organized! I use Top Producer as my contact data manager. RL: How did you get started in real estate? CARRIE: I started in real estate in 1993 when I wanted to get out of the corporate world where I worked in sales for a Fortune 500 company. I had always had a wonderful experience with the agents that my husband & I had used, so I thought that this might be something that I would enjoy & allow me to still have to time to be involved with my young children at the time. RL: What keeps you in the profession? DAVID: The satisfaction I receive from helping an individual or family achieve their real estate goals is what makes all the hard work worthwhile! CARRIE: I enjoy working with clients and helping them with all their real estate needs. It is very satisfying to see the results! RL: If you could have any other job, what would it be? DAVID: Along with giving back to our industry I make time to volunteer in the community. If money was not a concern, I would do charity work full time. CARRIE: Charitable work. RL: Can you share an interesting tidbit about yourself that people might not know? DAVID: Reading murder mysteries on my back deck is my way of getting lost for a few hours. CARRIE: People pretty well know me. Maybe that I can actually be quiet at times!

Outgoing HBA President Urges Community to Work Together to Maintain Region’s Quality of Life By Wes Peoples • WP Investments

Well, it’s finally here. This is my last President’s column after two separate terms as President of the Home Builders Association (HBA) of Greater Austin. This last year has been both rewarding and tough. Through all of the trials and tribulations of these economic times over the past 12 months, one thing resonated time and time again: we are extremely fortunate to be in Austin, Texas. According to the October 2009 issue of Trends magazine, the Lone Star State created 70 percent of all new jobs in the United States (and we still have a budget surplus). Considering that statistic, I am not surprised to see so many people moving here from California where they are currently in a $26 billion fiscal budget shortfall and recently paid their bills with IOU’s. According to Trends, over 100,000 people a year are fleeing California. Trends states that migration from California will be followed by venture capital leaving the state and heading to Texas. To make the business climate even friendlier, the magazine states that Texas should “invest heavily in secondary education and work hard to attract the best talent to its research universities.” Through our recent election on constitutional amendments, we have accomplished this. The fact is we are lucky to be where we are but there are issues we must address to maintain our quality of life. First, as pointed out by State Senator Kirk Watson at a recent Capitol luncheon, transportation continues to loom as one of our biggest challenges. After the legislative special session and the federal stimulus funding, the Texas Department of Transportation’s (TxDOT) biennial budget for general transportation needs is about $17.7 billion. Sounds like a lot of money doesn’t it? Well, once you cut out the money that goes to maintaining highways, debt service, administration, planning, reimbursing local jurisdictions for projects that have been built, and the money set aside for projects already identified, you have about $1.7 billion left for new projects for the next two years. According to projections, the rising cost of debt service and maintenance may cut this to zero. To make things more difficult, the legislature will likely focus on the budget and redistricting next session rather than transportation issues. If we

don’t start now, we won’t have an opportunity to affect any positive changes to our transportation woes. I would urge the business community to engage in the Capital Area Metropolitan Planning Organization’s (CAMPO) 2035 Planning process with the understanding that the money isn’t there to continue doing things the way we always have. We must focus our limited resources in a way to get the most “bang for the buck.” Efficiency, not pet projects, will be the key. Additionally, everyone needs to let their state leadership know that we are in dire need of transportation funding. Tell them they must provide us with more tools to develop local funding because we are drowning in congestion. Also, it is important that we all work together to improve our environmental policies and quality of life through conservation and the promotion of sustainability. As our Mayor, Senator Watson acquired water rights for Austin for the next century. It is our job to ensure that we don’t waste it. I applaud the Austin City Council’s recent vote to build Water Treatment Plant #4, but that only addresses one issue. We must ensure that our region protects that resource through conservation programs similar to what San Antonio has enacted recently. Next we must continue to address our energy needs. Conservation gives us the biggest and most immediate value for our collective dollars. In a recent issue of Environment and Climate News it was noted that Austin Energy’s Green Choice program in which buyers pay more for energy from renewable sources is “99 percent unsold after seven months on the market.” Does this mean we stop this program? Absolutely not! We do however need to ensure that our policies bring forth results that the general public can not only embrace, but can afford. How can we cut our energy consumption through conservation methods? New homes are held to much higher energy standards today than they were just a decade ago. They are very energy efficient and the law of diminishing returns is kicking in on adding new requirements. The issue is what to do with the existing housing stock. Former Mayor Will Wynn tried to address this issue but was met with severe opposition for various good reasons. I would challenge our current leaders to come up with a fair and equitable way to bring the current housing stock up to a higher energy standard without making it completely the burden of the homeowner. We need to ensure, like transportation, that our environmental policies give us the best return on our investment and are not reflective of unproven technologies or pet projects. The bottom line is that while we are extremely lucky to be in Texas and in particular, Central Texas, let’s ensure we work together so that we remain that way for generations to come. The Williamson County Association of REALTORS® annual Installation and Awards Banquet is coming Thursday, Dec. 3. Themed “Everyone’s a Star: Denim, Diamonds and Dreams,” the event is being held at the star-studded Reunion Ranch in Georgetown, Texas. Emceed by Jay Pearce, the gala “kicks off” with country and western flair at 5:30 p.m. Bennie Wheels will pay tribute to Johnny Cash as the event’s live music entertainer. During the celebration, WCAoR’s newest governing body will assume their officer and director roles as the 2010 representative voice of our organization. In addition, industry awards recognizing the contribution of WCAoR members will be presented to our “REALTOR® of the Year,” “Rookie of the Year,” and “Affiliate of the Year.” Applaud your peers for their achievements throughout 2009. The event begins at 6 p.m. The mission of the WCAoR Scholarship Foundation is to honor our Central Texas community by awarding educational scholarships to graduating high school seniors in Williamson County. Since 2002, the Scholarship Foundation has annually gifted awards to four to six high school seniors with financial needs in order to help further their formal educational and academic excellence. Time Warner Cable (TWC) recently launched the REALTOR Partner Program, which real estate agents will want to know about because it helps them infuse an additional revenue stream into their business. Realty Line recently visited with Central Texas Account Executive Danette Tidwell to find out how this new and valuable program works. Why did TWC start the REALTOR Partner Program? TWC wants to help real estate agents pave the way for their clients to have an easy and smooth transition to their new home. TWC wants to help REALTORS add an edge to their businesses and help their clients, all at the same time. When did it start? The REALTOR Partner Program was started in July of this year primarily as a way for Time Warner Cable to partner with local Real Estate Agents and help them during the economic downturn. Since local new build has slowed down, Real Estate Agents are even more important to home buyers who are looking to make smart purchases. Has it been successful? More than 900 REALTORS have signed up for the program in the first 120 days with over $5,000 in commissions paid out to date. How do the financial rewards work? REALTORS and Brokers who sign up with Time Warner Cable’s REALTOR Partner Program will earn commissions and their clients will receive special package rates on their Digital Cable, Road Runner High Speed Online and Digital Phone services. Homebuyers will also enjoy the concierge level service they will receive from Time Warner Cable and their Realtor will enjoy having a Time Warner Cable Account Executive they can count on to take care of their clients. Buying a home and moving is a stressful time. What are some tips you can offer to help real estate professionals convince their clients to make their cable decisions when so much is on their plate? Through the TWC REALTOR Partner program, the REALTOR’S client will be serviced by our Five Star Sales Support Team. This team is reserved solely for VIPs and only Real

Estate agents who have signed up for the REALTOR Partner Program can receive this level of specialty service for their clients. Do real estate professionals need to know the differences between cable, satellite and other services? No, our REALTOR partners will benefit from the experience of our sales specialists and their clients will receive the best advice on their television, Internet and home phone services at the best prices to achieve their Total Digital Home.” What if clients are an existing customer? Are there any rewards for getting them to transfer service to their new address? What if the customer has already initiated a change in service to their new address? Is there a way to participate in the partner program? The REALTOR’S clients are only able to receive Partner Program benefits through our Partner Program sales avenue. Using other Time Warner Cable sales avenues to set up service is great, but those do not have the same level of service that we can offer our VIP referrals. In addition, our REALTOR partners will not receive commission payments for their referrals if their clients do not use the Time Warner Cable Realtor Partner Program sales avenue. Does the client have to purchase a bundle? No, our Five Star Sales Support Team will work to tailor each Total Digital Home to each new subscriber. Does the client have to sign a contract, and if so, how long is it for? The best offers are on bundle packages that are Two-Year Price Lock Guarantees. These keep prices at a lower cost and can transfer from home to home. We also never charge full price if, for some reason, the homeowner has to terminate their contract. We prorate out the term for them. What else would you like to share about the program or Time Warner Cable? Bednar Receives distinguished Service Award

By Larry Molinare Chairman of the Board Gracy Title Company Most Texas underwriters will insure through the use of a Power of Attorney to close a sale, a purchase or a refinance of real property. Texas has a statutory form that, when appropriately filled out and notarized, will suffice for most insurance purposes. This form can be seen online at www.texasprobate.com/forms/poa.htm. While the Texas Statutory form is widely accepted, you may find that your party has executed a different form. If that is the case, the insuring company should be given that form as soon as it is known and available. This will bring other concerns into play: specificity as to legal, specificity as to the power(s) granted and durability, to name some. That is why the Texas Statutory form is always preferred and safest to use. These same underwriters will not allow this power to be given to any party that might have a financial interest in the transaction other than the spouse. For example, they will not approve any real estate agent involved in that particular transaction to act in that capacity, nor any employee or representative of the lender or of the Title agency involved in that closing. As with most facets of a real estate transaction, there are exceptions to the above rules. Here are two of those exceptions you may regularly encounter. 1) Some lenders may not accept use of a Power of Attorney for their borrower and others may require that the Power of Attorney be property-specific. When specificity is required, the legal description and possibly the street address will need to be incorporated. Always ask the lender, as early in their process as possible, what their specific requirements are and obtain their approval to use the Power of Attorney. 2) When use of a Power of Attorney is desired on any form of a Home Equity Loan, the Power of Attorney must be very specific as to the type of loan, amount of loan, interest rate and name of the lender. Underwriters will only allow Powers of Attorney to be given from one spouse to the other on these types of loans because of the very specific Texas Home equity law requirements. Once these hurdles have been cleared, the person signing the Power of Attorney must be available at closing to verify that they are alive. Some underwriters will accept an affidavit from the attorney in fact that the grantor of the Power of Attorney is alive to their knowledge. Make sure one of these two options is addressed prior to closing. Lastly, the original Power of Attorney should be recorded in the Real Property records.
