Investing in your political action committee (PAC) is an insurance investment in your business and in the industry as a whole. PACs are nonpartisan entities. Their purpose is to raise funds to give home industry professionals a voice, to protect private property rights for everyone in Texas, and to support political candidates who have similar goals and opinions on
issues that affect homeownership, homebuilding and real estate. Both the Texas Association of REALTORS (TAR) and the Texas Association of Builders (TAB) are dedicated to creating a positive environment in the housing industry by addressing the housing issues of Texans. Both organizations have an affiliated PAC – TREPAC for REALTORS, and HomePAC for builders.

TREPAC The Texas Real Estate Politcal Action Committee (TREPAC) is a voluntary, nonprofit, unincorporated group built of REALTORS and other interested parties who share a common goal of protecting and preserving private property rights. TREPAC fights hard to ensure that your interests as a REALTOR or broker, as well as the interests of all homeowners, are protected on the local, national and state level. TREPAC provides REALTORS with proactive insurance against bad policies that would undermine property rights and constrain REALTORS in conducting their business. The Austin Printed on recycled paper.

Every two years, TREPAC visits the state legislature with over 70,000 REALTORS in attendance. As the advocacy muscle behind ABoR, TAR, and National Association of REALTORS (NAR), TREPAC has defeated proposals to implement a transfer tax, helped lower property taxes and exempt personal autos from ad valorem (property) taxes, as well as block a tax on commissions. Among other recent major TREPAC accomplishments are clarifying an exemption for real estate brokerage in the Deceptive
Trade Practices Act (which means that if you’re an honest and ethical REALTOR, you can no longer be held liable under the DTPA and are awarded the same rights as other professionals), making the Texas Real Estate Commission a self-directed, semi-independent state agency, and increasing c o n s u m e r protection standards by amending the TREC education and licensing g u i d el i ne s . After interviewing political candidates on local, state, and national levels, respectively, local boards such as ABoR and WCAoR, as well as TAR and NAR make recommendations to TREPAC for endorsement; in turn, TREPAC’s financial contributions help elect political candidates who support private property rights. Many of the issues affected by PAC lobbying have less of a direct impact on the industry itself and are more about assuring that in an economy of budgetstrapped government entities and rising taxes, Texans can continue to buy and sell without being overtaxed. Many victories, such as protection of the Homestead Act, have helped keep the cost of

TREPAC: Invest a Little Now or Pay a Lot Later!
I
n every Texas Legislative session, there is some threat to the real estate industry. Fortunately, because of our strong Political Action Committee at the local, state and federal levels, REALTORS have been able to rally against legislation that negatively affects home owners' property rights. As members of the Williamson County Association of REALTORS, and the REALTOR family, we need to do our part. As an individual REALTOR it is difficult to have your voice heard in the crowd of others wanting to push their agendas. But united as REALTORS behind an issue, we have the ability to affect change, fight against transfer taxes, needless inspections and other issues that may cost your prospective seller or buyer huge amounts of money in order to sell or buy their home. One of the other benefits we enjoy in Texas is that we do not have sales-price disclosure. Yet each and every year there is a group lobbying for sales price disclosure on properties sold in Texas. Your investment
keeps that information private and is also the first step in preventing a tax on real estate transactions. You’ll also remember that this year there was discussion regarding Mortgage Interest Deduction (MID). Your investment also works on the national level by getting your message out to your representatives and senators to make sure they are working to protect property rights. So let’s consider the matter of your hard earned commission. In the last session of Congress there was a lot of discussion regarding putting a tax on your services. Should your buyers and sellers be required to pay a tax on your commission one of two things may happen: 1) They would choose not to use a REALTOR or 2) you would need to lower your commission to absorb the tax. These are only a few of the areas where legislators have looked to gain funds to make up the budget deficit. Thanks to TREPAC dollars, none of these items have come to pass, but don’t think they are off the table. Each year as members of Congress look for ways to
www.myRealtyLine.com gain new streams of income for government spending, these items resurface and the fight begins again. Now, you read the part about not doing it alone – that’s right. We need to do it together and that means investing in TREPAC, yes, investing in TREPAC. Too often we let the investments of others fight the way for us. But today, it’s time for each member to do their “fair share.” Imagine if each and every member gave their “fair share.” Our goal as an association would be met just through dues billing. Instead of removing the checked TREPAC box – leave it checked and do your “fair share” to help your clients, the community and the real estate profession. If everyone would make their “fair share” investment of $35 (yes that’s right only $35),

our association would meet its goal for the year and then work towards putting plans in action, interviewing candidates, learning the issues, getting the vote out, and promoting the real estate profession. The TREPAC committee needs your help to reach its 2011 goals. If you have not invested your fair share in TREPAC, please consider doing so before Sept. 30, 2011. You can invest through your TAR profile on the TAR website or call the association and make an investment today. As far as 2012 – Don’t uncheck the box and do your “fair share” as a REALTOR member of the Williamson County Association of REALTORS. To make your contribution for 2011, you can attend a fun-filled TREPAC fundraiser on Sept. 15 called “Cheeseburgers in Paradise.” RL

HomePAC is the Political Action Committee (PAC) of the Texas Association of Builders. HomePAC closely follows all the races, and invests in those leaders who have a proven voting record or have demonstrated their commitment to a strong private enterprise system and to protecting private property rights. HomePAC is bipartisan and funded by voluntary member contributions. HomePAC is active in a five-county area around Austin, and is one of the few organizations that supports elected officials in the surrounding area. Because only 25 percent of new construction in Central Texas is actually in the City of Austin, it’s critical to support homeowners and the building community in the locations where houses are being built, and that means ensuring that responsible candidates are elected. Whether you’re a REALTOR, builder, or other home industry professional, you benefit from the work pushed through by any and all of the industry PACs. Your involvement gives you a seat at the table in an industry that’s constantly on the legislative chopping block. When state and local coffers run low, budget cuts are proposed and failing those measures, taxes and fees come into play. Or as Christy Gessler puts it, “If you’re not at the table, you’re probably on the menu.” The client—the homeowner—is at the center of the transaction that supports our industry. “Anything that adds to the cost of homeownership is not going to be good for the first time homebuyer,” says Daniel Gonzales, state lobbyist for TAR. And then the entire market suffers. Even though REALTORs and builders, lenders, apartments, and other professional associations have their own PACs, these organizations work closely together.
“We’re all in the same industry, so it’s important that we build these coalitions with other groups toward the goal of the American dream of homeownership,” says Leslie Cantu, Director of TREPAC.

hey say that with age comes wisdom. In my early years as a REALTOR, I remember seeing my ABoR bill that included an option to make a contribution to TREPAC. My uneducated opinion at the time was to refrain from paying this optional fee because I simply did not see the value. I didn’t know what TREPAC really was, or what it really did. After a few years, I began to hear more and more about TREPAC and realized that this group is integral to protect my livelihood and they fight vigorously to do just that. The beauty of TREPAC is that it brings one collective loud voice to our industry. They speak on behalf of more than 90,000 Texas REALTORS, according to ABoR. TREPAC contributes to REALTOR friendly political candidates who support the protection and preservation of private property rights, as well as a strong, healthy business environment for real estate professionals. In reviewing the accomplishments of TREPAC in the recent 82nd regular session of the Texas Legislature, Texas REALTORS benefited in several major areas:

It is a centralized source for breast cancer information, education and support. What you Need to Know When Closing a Commercial Property Transaction
I
f you are an experienced residential broker and have been approached to list a commercial property you may find that your new job description is not in any way similar to the work required for listing and selling residential real estate. There is no commercial multiple listing service for marketing your property and substantial networking may be required on your part to connect with a potential buyer. In commercial real estate, co-brokerage is not assumed; many times the buyer will pay his own broker and use this as a negotiation tool before finalizing the purchase agreement. Any agreement must be in writing. The commercial broker will have less control over the process than a residential agent has. Lending and financing are different and contract to close can take from three months to a year or two. During this time the feasibility or option period may be extended in order for the buyer to be satisfied that the property will be sufficient for the intended usage. If the property is raw land that will be
sold for development or if the land usage will change for the new purchaser, there could be layers of governmental requirements to be dealt with as well as environmental and land usage issues. Consideration includes flood plain locations, proximity to major roadways and areas to be dedicated for school facilities and park land. When selling office buildings and retail centers, considerations include rents, utilities and tenant finish out. Hotels, hospitals and other industries have issues unique to that particular industry. Once the price has been agreed to, the Purchase Money Agreements are generally prepared by attorneys representing the parties. At this point confidentiality is extremely important. Feasibility periods could last from 90 days to several months and may be extended several times. During this time anything could stop the transaction and there is no road map to piece it back together. Economic conditions may change; politics can interfere and financing approval is lengthy. Depending

on the type of transaction the financing may be difficult to obtain. Appraisals are more subjective and values are harder to determine. When the purchase money agreement has been signed and escrowed with the title company the clock begins to tick. At this point it is critical to note and be sensitive to time deadlines as outlined in the purchase agreement. The title commitment and title exception documents must be delivered to the purchaser within the time frame allowed. If a new survey is required or if the seller is to deliver an existing survey, the contract will specify a period of time for delivery. The seller must also deliver any information required by the contract such as engineering and environmental studies, existing leases, and property tax information during the time set out in the purchase agreement. The purchaser may be allowed a period of time to conduct his own inspections during the feasibility or option period in order to determine if the property will actually meet the needs of his intended use. The purchaser must make any objections to the due diligence items within the time frame allowed under the contract.
If the attorneys or other broker do not prepare one, ask your escrow officer to prepare and circulate a “Critical Date Letter” outlining the dates as set out in the purchase agreement. Title issues become critical at this point and will be reviewed by the attorneys who represent the buyer. During the feasibility period any title objections voiced by the buyer and not addressed by the seller may cause the contract to terminate. An experienced escrow team will help address any title objections raised. Any notices must be given in strict compliance with the contract. Once all hurdles have been cleared and all contract stipulations have been met the closing will be scheduled. At this point the seller or his agent will need to provide amounts for any items to be prorated, including rent, security deposits, management agreements and utility bills to the escrow officer for inclusion on the closing statement. All parties should review the closing documents and settlement statement in advance of closing. Attorneys generally need advance notice and adequate time for review. There also may be post closing agreements or other items to be dealt with after the closing. RL

New Law Means Big Changes for Brokers
A
s I am sure all of you are aware, Senate Bill 747, the Texas Real Estate Commission bill became law on Sept. 1, 2011. Of the 11 provisions set out in this bill, one is of particular importance for those brokers who have agents managing residential properties. “A person who controls the collection or acceptance of rent from a single family residence for a third party will be required to have a broker or sales license.” Let’s take a closer look at this provision. On the surface this seems to be pretty apparent. If you have a REALTOR who is collecting or accepting rent for a single-family residence for a third party, it is obvious that they are acting as a property manager and now need to be licensed. In the past this was not necessarily so. If you’re a broker with agents in your office that are acting as property managers then you are responsible for their knowledge of property management and their adherence to all of the laws. In the May and June editions of the TREC
Advisor, disciplinary actions were taken against 13 brokers, agents or companies for property management issues. Two fines of $60,000 each were levied against a company in Arlington and a broker in Euless. Another fine of $15,000 was levied against an agent in Fort Worth. Plus, all three had their brokers or real estate licenses revoked. The fines were levied primarily for required steps not taken as opposed to what they did wrong. Nonetheless, a hefty price was paid. For example, said company failed to file within a reasonable time to properly account for or remit money received by the license holder that belonged to another held in trust. Nor did they maintain a trust account as required. The company was also commingling money belonging to another with their own money. Further, the company was paying operating expenses or making withdrawals for other than proper disbursements and engaging in conduct that was dishonest or in bad faith. Look real close brokers. is $135,000. In light of these hefty fines, as a broker, you should think about: 1. Do I want the liability of property management in my office? 2. Where can I go to gain the knowledge necessary to educate myself and/or the property managers in my office? 3. Are there trade organizations that support residential property managers? In the next several months, the Austin Board of REATLORS (ABoR) Broker Forum is going to present a four-person panel on property management. The four members on this panel are all professional property managers and TREC instructors. This presentation will avail the broker considering property management an opportunity to ask direct questions. Hopefully the answers to these questions will assist in this decision making process. In the meantime, ABoR has several property management courses. Sally Yaryan is the staff director for education and will be glad to guide either agents or brokers toward quality education in property management. Also, the Texas Association of REALTORS (TAR) is currently developing a 30-hour core

course on property management. Contact Deb Waldman, TAR Professional Development at 480-8200. She will be able to tell you when this course will be offered. There are several organizations that deal with property management, however, in my opinion, the best trade organization for residential property management is the National Association of Residential Property Managers (NARPM). This organization was developed to assist residential property managers in their day-to-day job. For membership information contact Marc Witmer, Austin NARPM chapter president at 794-8171. Of course, there is another option. Suggest to your agent, who is managing a minimal amount of properties, to sell those management agreements to a professional property management firm. This is a winwin situation where the agent receives funds for their work, the broker no longer has the liability and the new property manager will acquire another property. Many property management companies will refer the property investor back to the original agent when the time comes to sell. RL

The homesites, which range from 90 to 100 feet wide and average 140 feet deep, are located in Teravista’s Vista Pointe neighborhood. Homebuilders Village Builders and Wilshire Homes are actively selling executive, semicustom homes with prices ranging from the $350,000s to $500,000s, and floor plans ranging from 3,000 to more than 5,000 square feet. Many of the homes feature luxury touches like outdoor living areas, gourmet kitchens, and expansive, upgraded garages. Appropriately for the community’s highest-end neighborhood, Vista Pointe has homesites with views of the championship Teravista Golf Club and community green space. Sales are now under way, with both builders marketing the 90-foot product from
their existing models. Vista Pointe adds a new higher-end price point to Teravista, which has seen its newhome sales increase by 12 percent for the first six months of 2011. “At Teravista, we are seeing a return of move-up buyers, both from the local Austin area and also from the national relocation market,” said Vaike O’Grady, marketing director for the Austin division of Newland Communities, developer of Teravista. “Vista Pointe bolsters the upper end of our price bracket, while the most affordable end was strengthened with the addition of new homes priced from the $150,000s last year.” Located at I-35 North and University Blvd., Teravista was named one of the top 20 master-planned communities in the nation for new-home sales in 2010.
