lthough the 82nd Texas Legislative Session officially begins on Jan. 8 of 2013, political action committees and government affairs offices in our industry’s associations are gearing up. The general election will be in November, and there are plenty of issues on the table that affect REALTORS, builders, brokers, and other industry professionals. It’s up to organizations such as ABoR, WCAoR, TREPAC, HBA of Greater Austin, and on the state level, Texas Association of Builders and Texas Association of REALTORS, to keep the path

to homeownership clear from unnecessary legislation and overregulation. Realty Line spoke with the leaders of some of these organizations to get the scoop on the important issues and policies they expect will be discussed in the upcoming session, as well as why your support is needed.

Infrastructure “I think you’ll see TAR step out on some infrastructure issues,” says Emily Chenevert, director of government affairs and community relations with the Austin Board of REALTORS. “Specifically finding sources of revenue for the statewide water plan.” In the past, ABoR has focused mostly on typical private property rights and REALTORrelated issues, but water in the state of Texas is

such a growing concern that REALTORS and builders have to take part in the conversation. The state has not yet funded the water plan, and in light of the drought, it is of serious concern as our area continues to grow and builders and developers look for new sources of water to supply the homes. The Texas Association of Builders is also heavily involved, working with business and cities to make headway toward making the water plan a reality. Road infrastructure is likely to be an issue up for discussion. As the Texas Department

of Transportation runs out of funds, after next year, it may be unable to properly maintain existing roads, much less build new ones. There are on average over a 1,000 people per day moving to Texas. In order to build homes to house them, transport needed materials, and get people to work, road infrastructure should be an obvious concern.

Politics is your business

I

f real estate is your profession, then politics is your business. That is a simple yet powerful statement. For those of you who know me personally, you know that I am passionate about the Texas Real Estate Political Action Committee (TREPAC) and I am not afraid to have a conversation about politics. For those of you who do not know me personally, allow me a moment of your time to highlight the importance of TREPAC. It's easy to be cynical about politics. Anytime a politician takes an ethical misstep or an election turns into an expensive mudslinging contest or an issue deteriorates into an ugly partisan battle, it makes some people want to disengage from the process. But disengaging only makes things worse. Voting, getting involved in campaigns, voicing your opinion on issues to your elected officials— these are the ways to make a difference. That's why I'm proud to be part of an organization that has such strong political grassroots. This is not a legislative year, but an election year. We are in the throws of a

heated presidential race. You can’t turn on the television, radio or go online without being bombarded with information about the election, and it’s only going to escalate in the coming months. If you listen closely to these reports or tune-in to one of the many debates taking place, you’ll hear a lot of talk about the real estate market. With budget shortfalls, many politicians look to the real estate market, and REALTORS, to find sources of revenue. Texas has one of the strongest real estate markets in the nation for several reasons including carefully crafted home equity lending laws and the absence of a transfer tax on real estate transactions. Why is this? TREPAC! The Williamson County Association of REALTORS holds various TREPAC fundraising events throughout the year including TREPAC Bowling and Cheezburgers in Paradise, which supports local issues. At the state level, the Texas Association of REALTORS (TAR) keeps a close eye on a variety of issues that affect property owners and the real

www.myRealtyLine.com estate industry—including water rights and conservation efforts, mineral interests, energy production, transportation, taxation, real estate valuation and development, regulatory oversight of free enterprise, private-property rights, and more. A list like that can make for a wide legislative agenda.  Because of that, the association usually enters legislative sessions with a defensive posture. However, this year, the association pursued an aggressive agenda centered on four specific issues—all of which passed. It’s not always about getting bills passed. TAR staff helped kill numerous pieces of legislation dealing with county rulemaking authority, sales-price disclosure, and homeequity lending, as well as an insurance bill that would have been detrimental to homeowners. In fact, at the end of the session, the association opposed 95 bills—and not one of them became law. NAR also has a program for brokers called the Broker Involvement Program. NAR's

Broker Involvement Program empowers broker owners to alert their agents to key REALTOR issues. When brokers speak, agents listen and respond. By urging REALTORS to respond to NAR's calls for action, we can shine a bright light in Congress on important real estate issues. The more agents that take action, the more Congress will know the voice of the REALTOR party and will respond to our industry's needs. We must approach the 2013 legislative session together—united

s we get ready for the 2013 legislative session, it is truly important that, as REALTORS, we preserve and restore the integrity of the home buying process. It is equally important that we protect private property rights. There are several issues that we must address and with a united voice. It is very important to support your local, state and national PACs to make your voice heard. There is indeed strength in numbers. First of all, we must pre s e r ve   t he   mor t g age interest de duc tion. The interest deduction for interest paid on a debt secured by a first or second home must not be removed or restricted. There is already in place a cap on the mortgage interest deduction. Complete removal of the mortgage interest deduction would have a devastating impact on real estate. Second, Fannie Mae and Freddie Mac need to be reformed. NAR’s position is that the federal government must play a continued role in the secondary mortgage market. I am

not suggesting a bailout, just some guidance and control. Third, there needs to be some control of short sales. Delays in approving requests for a short sale remain a significant impediment to this option as a way to avoid foreclosure. Streamlining short sales will improve the likelihood of the transaction ever closing. (As I write this article, I have had an offer submitted on a short sale for over two months. There is no indication of a decision or counter any time soon.) Reducing the time for banks to approve short sales to 45 days or less will reduce the number of foreclosures. Everyone will benefit— lenders, sellers, and buyers. These are just a few of the issues that need to be addressed in the upcoming legislative session. As REALTORS, we need to be informed, stay connected and let our legislators know where we stand on issues impacting real estate. Support the PACs and make your voice heard. RL

ur Austin Chapter of the Women’s Council of REALTORS is proud to support an organization created by breast cancer survivors that benefits all women and men in Texas that are facing the breast cancer challenge. Breast Cancer Resource Centers of Texas (BCRC) is a non-profit grassroots organization. It is a centralized source for breast cancer information, education, and support for the victims of this terrible disease. They help people of any age, gender, culture, education, profession, or financial status. They aid those navigating the condition from diagnosis through recovery at no charge. On Oct. 2, 2012, Austin WCR will hold the second annual Bras for a Cause event. It will be held at Maggiano’s Little Italy at The Domain and will benefit the Breast Cancer Resource Center of Texas. It will feature bras

decorated by partners and modeled by some very handsome men volunteers. There will be a silent auction including decorated bras, door prize drawings, food, a cash bar and lots of fun and laughter for everyone. The master of ceremonies will be Mark Chapin, an Austin TV personality. econd generation Austinite Ron Urias says it’s all a matter of attitude. He embodies the dynamics that characterize Austin—progressive, independent, eclectic, creative and accepting the culture of artistic and individual expression. For Urias, there is no place like home. Urias has operated his Farmers Insurance agency for more than 36 years. He followed in his uncle’s footsteps, who started with Farmers in 1957. He met his wife, Sandy, at Farmers and now his son Russell has joined the family business. The multiline agency offers personalized coverage for families and businesses throughout the Austin area. The agency is growing and will be adding a few staff members to help customers with their insurance and financial needs. A member of the top three percent of Farmers agents’ Toppers Club, Urias is dedicated and passionate about a higher standard of customer service. With most insurance companies, a customer with a claim calls a 1-800 number reaching a faceless person in a call center. If one of his customers has a claim, Urias and his team are there for them, literally. “When customers lost homes in the Oak Hill fires it was a traumatic experience. We were there to walk

hand-in-hand with them through the details, helping plan for all the things that need to be done, whether it was finding a post office box, a kennel for the pets, or a contractor to rebuild,” he says. “Customers don’t come to us by accident, but we handle that too.” Urias grew up in an era when speaking Spanish was frowned upon so he learned Spanish as an adult. He is passionate about

His connections with the real estate community include providing specialized services such as a MCE approved course for REALTORS on the Comprehensive Loss Underwriting Exchange or CLUE report that provides claims histories. He is a member of the Austin Board of REALTORS and several other organizations but is especially proud of belonging to the National Association of Hispanic Real Estate Professionals (NAHREP). Members of the organization are trusted advisors and advocates who help more Hispanic families achieve the American dream of home ownership—in a sustainable way—that empowers them for generations to come. Urias believes in a more traditional approach to insurance sales—one that relies on personal contact with the customer. “When insurance met the Internet the business changed,” he says. “While it provided more information, it was difficult for people to get exactly the coverage they needed.” Urias likes to say he started in the insurance business before the Internet, in an age of old-fashioned personal connections. Urias believes in giving back to the community. “We have to do the right thing,” he says proudly. “We volunteer our time, talents and resources for Habitat for Humanity and just recently finished a school supply fundraiser for three underprivileged schools in East Austin.” He also works with the Housing Authority of the City of Austin, helping

Budget ABoR will again be playing defense on the budget. “There are some structural deficits on the budgets that have to do with the franchise tax, but also some of the tricks that they played to balance last sessions’ budget will catch up to this session,” Chenevert says. “Anytime there is a deficit we fear transfer tax and a tax on commission or services to make up for it.”

Rules and Regulations Each session, the Home Builders Association of Greater Austin looks at what’s happening in the regulatory environment, with a focus on vested rights (to ensure that once rules are put in place they are not changed in process), blocking unnecessary builder licensing initiatives, and watching for expanding county authority. “The counties often go after ordinancemaking authority,” says Harry Savio, executive vice president of the HBA. “But there are reasons people live in these counties—specifically not to have to deal with more government.” For example, Travis County has been given water quality authority and has used it in an expansive manner to regulate tree mitigation and impervious cover, which is inconsistent with the authority of any other county. Scott Norman, executive director of the Texas Association of Builders, says that his organization is always concerned about regulation when it becomes a detriment to homeownership and is used for political purposes, such as using environmental regulation or land use controls

Taxes The Texas Association of Builders expects that there is likely to be some tax reform in the special session. “We’re always concerned every session with making sure decision makers keep the impact of the decisions in mind on housing and affordability,” Norman says. “Taxes are always a big issue because any increase raises the cost of housing and makes it more difficult for folks to buy.” Taxes on real estate transactions and REALTOR services will be an ongoing concern for the Williamson County Association of REALTORS, according to Chrissly Gessler, 2012 president. “Requiring consumers to pay a tax on REALTOR fees and commissions would discourage use of real estate professionals and increase housing costs,” Gessler says. “Increasing the cost of housing with such a tax burdens consumers and hurts the state's economy.” For the same reason, mandatory sales price disclosure will also be watched closely by WCAoR, because providing full disclosure of real estate sales to appraisal districts is usually the first step toward taxing real estate transactions.

Good advice for your buyers with credit issues

M

ost industry experts agree that mistakes, usually slight, exist on almost everyone’s credit report, and the prevailing wisdom is that borrowers should carefully review their credit report and note any inaccuracies. Often, it is advisable that the borrower write a letter to the credit agency, noting the inaccuracies and copying the Federal Trade Commission. The credit bureau may write a letter asking the borrower to call. Most credit experts I’ve spoken to advise strongly against calling. The best advice is to simply write back with copies of their original letters, telling them of the original date they submitted the initial request. Keep a file of all correspondence to and from the credit bureau and follow through continually. The process is that credit bureaus forward the dispute to the individual creditors, who have

45 days to respond. If they do not respond within the allotted time, the item must be removed. However, if they do respond at a later date with information that documents the credit report is correct, the item will be placed back on their credit report. For those borrowers who have filed bankruptcy in the past, the items that were discharged will normally show up as a charge-off or uncollected debt. They should write to the credit bureaus, providing a copy of complete bankruptcy papers and request that they show the debt as "discharged in bankruptcy." This looks better and can raise FICO scores. FICO scores above 700 make it easier to obtain mortgage loans. While a borrower may not be able to clean up every item on their credit report using these methods, they will certainly be able to improve the way it looks to potential creditors. RL

Renovation financing: a quicker, easier path to the dream home

H

ow many times has your client regretfully passed up that cute little house in the perfect neighborhood because it was going to be “too much work” or too hard to finance the repairs and updates? How many more as-is properties could have been dream homes if the home purchase and renovation process were easier for buyers and sellers? Now you can greatly expand options for your buyers and sellers with renovation financing. Renovation financing is a little-known home loan for all types of “fixer-uppers”, and it makes things easier for sellers and for buyers looking for an affordable alternative to new construction. In our current market where there is an inventory shortage of available properties, it is a practical but underutilized way to get homebuyers into their dream home. With a renovation loan, a homebuyer can finance the purchase price of the house and the cost for repairs with one application, one approval process, one loan

closing and one monthly payment. The loan amount is based on the lesser of acquisition costs or after-improved appraised value of the property. After the single close, fully amortized transaction is completed, a buyer-selected contractor begins work. Renovations covered by the loan can include required repairs to bring the property up to code or satisfy appraisal requirements, such as roof replacement, plumbing repairs, “invisible” structural repairs such as foundation, electrical upgrades, or termite damage repair. Obviously, a home inspection is an essential part of the process. Renovation loans also cover optional repairs to update a home or increase its resale value. These improvements could include kitchen updates, room additions, pool, bathroom remodels, new paint, new carpet or flooring, landscaping, energy efficiency improvements, and much more. Benefits to REALTORS: • Overcome the challenges of selling a

With renovation financing as an option, you may also feel more comfortable extending your buyers’ search by including distressed properties and foreclosures. Some lenders specialize in renovation financing and provide a range of products to choose from. The Streamline 203(K) is just one kind of renovation loan, intended for minor repairs and requiring little expertise to manage. This loan is

convenient for common minor repairs such as HVAC systems, weatherization, minor remodels such as kitchens, roofs, plumbing, new flooring, and deck/patio repairs or additions. Seventy percent of the homes in the U.S. were built before 1992. In today’s Austin area market, the inventory of new homes has not yet caught up to the high demand. “We expect that here will be a lot of new people coming into the market in the next two to three years,” says Krista Corkill, home mortgage consultant and renovation specialist at Wells Fargo. “Renovation is going to be a smart option for buyers to get the home they want now and see the most resale value later.” Renovation financing tips To prevent closing delays in a renovation loan, ensure that your buyers have a pre-approval letter to submit with their purchase offer. Most renovation loans need between 45-60 days to close. Be sure the purchase price of the home and the cost of renovations, when added together, do not over-improve the home and move it out of the neighborhood price range. Corkill believes that every property is a potential renovation loan: “I tell the students in my renovation loan MCE course that when your seller says, ‘I’d repair that, but I don’t have the funds,’ or your buyer says, ‘I love this house, but…’,just know that whatever that ‘but’ is, a renovation loan can take care of it.” She adds, “REALTORS stand to close a lot more deals with this in their bag of tricks.” Talk to your lender about renovation loans today. Five tips to shooting better video

U

sing video to help sell your listings and gain new clients is an invaluable tool. Not only is this tool invaluable, with so few professionals in the real estate industry using video, it is one that offers dramatically less competition when it comes to getting your message through the clutter of information on the world wide web. I encourage you to start using video in smart and create ways and here are a few tips: 1. Just do it. Polls show that 78 percent of sellers want their agent to have a video internet presence, yet only 12 percent of agents nationwide have a video channel. Video is your unique selling proposition (USP) to get more business. Video is cheap and easy. YouTube is free. Your smartphone most likely has a great on board video camera and you can load videos directly to YouTube right from your phone. Quick and easy! 2. Do video e-mail. Right now very few people use video e-mail. Take the advantage and differentiate yourself from the crowd. Clients love to see you face-to-face (on video).

It’s great for a pre-listing appointment or a buyer “hello” communication. Video files are large so sending video as attachments doesn’t work very well. Use a free or inexpensive video e-mail service such as Eyejot or BombBomb. Video e-mail will also help you overcome common camera shyness. 3. What to shoot? There are 10 types of videos that make you money. They are: a. Property b. Neighborhood c. Branding d. Testimonial e. Educational / How To f. P.R. g. Transactional h. Co-Branding i. Sandwich Video j. Lifestyle My favorite is the testimonial. This is one where your clients talk about what a great REALTOR you are. Shoot it at the closing table (that’s where we all want to be, right?) Ask them their experience with you.

Were there any challenges you helped them solve, etc. Ask how they found you and chose you to become their agent (maybe through a video?) Send them the testimonial video link and ask them to post it to their Facebook, Twitter, etc. 5. Social media quality is fine. Agents will sometimes avoid video because they want to make them perfect. Keep in mind we are not producing a Super Bowl ad. In the Internet w or l d ,   y ou r audience w a n t s authenticity over perfection. In fact, if your videos are to o “s l i c k” and over pro duced,  p eople won’t trust them. You obviously don’t want to put out garbage, but   d on’t   wor r y   ab out   l itt l e mistakes—it shows you are real. People like the “real you.” 5. Google loves video – Can you say search engine optimization? Video is your wild card to rank on the search engines. Google owns YouTube and favors video. Google searches for relative content to display as search results to its users. It pulls from millions

of websites but only dozens or hundreds of videos offering relevant content. You have an exponentially easier chance of being found on the internet by your video content as opposed to your website content. Try it! Post a video of your listings with the address, MLS number, neighborhood name, etc. in the YouTube title, tags, and description. Impress your sellers with your search engine savvy when their home video pops up on the top of the search engines. Your video will rank higher than your competitors and the national search s i t e s .   Ta k e your leads back, start shooting and posting video today. Teravista, Falcon Pointe mark 10th birthdays What a difference a decade makes. When Teravista opened 10 years ago, the intersection of I-35 North and University Blvd. was not yet a dynamic retail hub, home to everything from the Round Rock Premium Outlet Malls to IKEA. And the stretch of University right across from Teravista was not yet a burgeoning educational and healthcare corridor. And when Falcon Pointe opened “way back” in 2002, the Texas 130 and Texas 45 tollways were just a gleam in planners’ eyes, not yet superconvenient expressways that connected Pflugerville’s small-town charm to the energy of greater Austin. Nor had a public-private partnership between the city and developer created several extremely popular parks in Falcon Pointe. This fall, as Teravista and Falcon Pointe both celebrate their 10th birthdays, the communities are planning festivities including live music concerts and groundbreaking ceremonies. For example, both Falcon Pointe and Teravista will pause to commemorate the ground-

breaking for an important new project in the region – the new HomeAid Family Cottage that will soon be under construction and open next year at the Texas Baptist Children’s Home. At 10 years old, the 1,550-acre Teravista community is far from done. In fact, we’ll soon be unveiling more details about our exciting new phase of development, which will include an awesome new recreational amenity that celebrates the region’s beautiful natural environment and its special affection for wildflowers. And while Falcon Pointe is a bit smaller than Teravista—at 710 acres—the community also has a bright future ahead, with a major new roadway that will improve connections for hundreds of new homeowners. We hope REALTORS, residents and future homeowners will join us for the 10th anniversary festivities in store for Falcon Pointe and Teravista this fall. Austin Board of REALTORS reveals new look and improved functionality to Austinhomesearch.com The Austin Board of REALTORS (ABoR) launched its revamped consumer property search website, AustinHomeSearch.com. Updates to the design and functionality of the website were integrated using input from ABoR REALTOR members and prospective homebuyers. Upon visiting the restructured website, users will discover an overall improvement in website navigation, search functionality and real estate tools. “As trusted resources for accurate and timely Austin area real estate market information, the members of the Austin Board of REALTORS are pleased to offer a public website that will more effectively meet the needs of those who are contemplating steps to buy or lease property,” says Angela Brutsché, ABoR director of marketing and communications. “Visitors will enjoy identifying REALTORS and properties that match a multitude of preferences using the available AustinHomeSearch advanced search features.” “Rather than competing with member websites, this portal ensures that consumer
