Affidavit The 1.u'idersigned affiant, being duly sworn, deposes and says:

That, the undersigned Affiant, Officer Arthur Walkley, is a member of the Southington Police

Department, presently assigned to the Patrol Division and has been a member of said department since March 14th, 2018. Prior to Southington Police Department your affiant was a sworn member of the Connecticut State Police, from January 1998 through March of 2018. That the following facts and circumstances are stated from personal knowledge and/or observations and includes information received from fellow police officers, acting in their official capacity, witnesses, and credible persons with knowledge of the facts and or circumstances contained herein. 2)

That, on 02/16/2019, at approximately 1845 hours, this affiant, along with Officer Ayotte and

Sergeant Wilk, was dispatched to the area of #30 Center Street, in the Town of Southington, for two (2) belligerent individuals. Southington Police Dispatch advised that they were on "911" calls from both parties involved in the incident. Officers were able to locate all the parties involved in the incident on Liberty Street two (2) blocks away from where the incident occurred. The involved parties were separated and identified as being the owner of Anthony Jack's Restaurant, Cheryl Moran (dob: 07/01/1969), Jessica Glodek (dob: 12/31/1984) and her husband, Miran Glodek (dob: 11/01/1975). 3)

That, Moran verbally stated to Officer Ayotte on scene that the couple were at Anthony Jack's and

Affidavit - Continued gone to the sixteen (16) year old hostess to voice his displeasure. Moran stated that the male began using obscenities at the hostess, stating that the service was terrible, then the male and female left the restaurant. Moran described how she had overheard this and that her hostesses do not get paid enough to be spoken to in this manner. Moran went on to state how she exited as well, in an attempt to speak with the male. Moran stated that as she attempted to speak to the male party, the female party began to push her back. Moran described how she had to!d the female to stop pushing her and how she had advised them that she was calling the police. Moran stated that it was at this point that the female grabbed her (Moran's),cellular phone. Moran described how she grabbed onto the female's hair and began to try to get her phone back. Moran stated that the female threw her down to the ground, got on top of her and began choking her. 4)

That, I spoke with both Jessica and Miran on scene. Jessica verbally advised me that she and her

husband had been visiting the town and how they had gone to Anthony Jack's Restaurant for dinner. Upon entering they were asked if they had a reservation. Jessica stated that they advised the hostess that they did not and were informed the earliest they may be able to get a table for dinner would be 8:15pm. They were directed to the bar area if they wished to wait and if a table became available any earlier, they would be notified. Jessica describes how she and Miran were seated in the bar area for approximately twenty (20) minutes. During that time, Jessica stated that they were not asked if they wanted water, a drink, an appetizer, etc. Jessica stated that customers waiting around them were being provided with drinks, etc. and that nobody had approached them, so they decided to leave. Jessica describes how she left first, followed by her husband. Jessica described how after exiting the restaurant she heard a female yelling obscenities. When she turned around, she observed a female yelling and pushing her husband in the back. Jessica described how she had gone back and stepped between both of them and directed the female to go back to the restaurant and finish her meal and how she had directed Miran to keep walking away. After she turned and began walking, Jessica described how she was forcefully grabbed and pulled by her ponytail. Jessica stated the female had her hair and would not let go. Jessica described how she attempted to walk away and how the female would not let go of her hair. Jessica described how she had put her cellular phone in her left front jacket pocket, was pulled to her right and was then pulled to the ground by the female who still had her hair. Jessica advised that after being pulled down, she remembers landing on the female. She recalled that it was at this time that she felt the lady's phone with her left hand and maintained a firm grip on it. Jessica stated that the female was yelling for her phone and how she (Jessica) had told the lady that she would give it back once she let go of her hair and head. Jessica described she had soreness and pain to her ear, neck and right leg, but that she did not need medical (This is page 2 of a 10 page Affidavit)

Affidavit - Continued attention. I advised Jessica that I would contact her the following day to obtain statements from her and Miran. I further advised her that once her adrenaline subsides, if she had any further complaints of injury, to notify me.

5) That, I responded to Anthony Jack's Restaurant to speak with Cheryl Moran. Moran was located in the bar area of the restaurant. Upon approaching Moran, she immediately asked if an arrest had been made. I told Moran that an arrest had not been made as of yet. Moran stated, "Why not, she assaulted me, she slammed me to the ground and strangled me!" I then advised Moran that I was investigating the incident and needed to speak to her to find out her side of the story. At this point Moran stated, she had just arrived at the restaurant and that she was in the entrance area of the restaurant by the hostess station, when a male walked up to the station and caused a disturbance. Moran described how the male party began directing obscenities towards her sixteen (16) year old hostess. Moran then stated, "I'm not going to allow anyone to talk to my young employees like that, they are young and don't make enough money to put up with that, so I went out after him!" I advised Moran that in the future, for her safety, if she believes that an individual is under the influence and causing a scene by acting in a threatening or disorderly manner, it is best to call the police to deal with the situation and not to follow the individual(s) outside, after they have left. I went on to advise that she could be putting herself in harm's way by doing so and that she could be assaulted, the individual(s) may have a weapon such as a gun or knife. Moran responded by stating, l<I don't care if I get stabbed!" Moran then went on to tell me that she is the owner of the establishment, as well as several others in town and that she is an attorney and has been for approximately twenty-five (25) years. Moran felt it was important to have to re-iterate this statement to me several times during our brief conversation. Moran's disposition lightened temporarily and she then stated that being the owner of the establishment, she followed the male outside to inquire as to the reason for his displeasure. When I advised Moran that that was not how she initially described the incident, Moran became increasingly frustrated and belligerent. The general manager of the restaurant, Anthony DePaolo (who is Moran's godson), directed Moran and law enforcement to the kitchen area to continue the conversation. Upon arriving in the kitchen area, Moran stated that she wanted an arrest to be made and stated, "She took me by the hair and threw me on the ground!" I attempted to explain to Moran that I needed to conduct an investigation and if probable cause existed, then an arrest would be made and that I could not make an arrest just because she was telling me to. Moran advised me that she understood. Moran then stated, "What I'm telling you is that I'm filing a complaint that she be charged with assault and I understand that you have to do your job and .. , and that your opinion about whether I should have gone out there or not has nothing to do with it and the fact of the matter is she grabbed me, took my phone, we could call that theft (This is page 3 of a 10 page Affidavit)

She was going to kill me!" At this point I asked Moran if it was her professional opinion that her (Jessica Glodek) intent was to kill her. To this Moran responded by stating, "She would have, what I'm telling you is that I lost breath. She was strangling me!" Sergeant Wilk then advised Moran that the other individual involved was providing a different version of events. than hers. To this Moran stated, "Of course she is, look at them, they're fucking pieces of shit, they don't even live in the area, they've never been here before." 6)

That, on 02/16/2019, I spoke with the hostess Moran had pointed out as being the person the male

party (Miran Glodek) had directed his outburst towards. The hostess was identified as being Madison Penna (dob: 09/26/2000). Penna verbally stated that earlier In the evening a couple had arrived and were looking for a table for dinner. Penna had inquired as to whether or not the couple had a reservation. The couple did not have a reservation so she had advised them that the earliest they would be able to get a table for dinner would be about 8:30 PM. Penna advised them that they could wait in the bar area if they wanted. Penna stated that the couple made their way to the bar area. Penna verbally stated that she was at the hostess station with Moran, who had just arrived, Anthony DePaolo (manager) and Melissa Massicott (dob: 05/25/2001) who was a server. Penna described how they were all standing by the hostess stand when the male approached the hostess stand and in a general manner and directed at nobody specific, stated something to the effect of "we are leaving" and "the service here fucking sucks." I asked Penna again if the statement was directed at her, to which she responded "no". Penna stated that the statement was not yelled. Penna denied that the male caused a disturbance and advised that she had not felt threatened by the male (Miran). Penna described how the male then left the restaurant and Moran went out after him. 7)

That, on or about 02/17/2019 I interviewed and obtained a sworn written statement from Jessica

Glodek. Jessica stated that after having left the restaurant, "I heard yelling coming from behind me. I turned to my left and observed Miran behind me outside of the exterior door. There was a red haired lady standing behind and to the left of Miran yelling at him. She was directly off of his left shoulder yelling at the left side of his head. Miran was not looking at the lady but towards me. I never saw this lady before. I then observed the lady push Miran in the back. I realized the ladywas irate and yelling at Miran so I stepped between Miran and the lady. Miran told the lady, 'All I said was the service was terrible', then she yelled 'what was so terrible about it?' The lady kept attempting to get to Miran so I lifted my left arm in front and across my torso as a shield, because the lady was still yelling and trying to get to Miran. Affidavit - Continued calm down and to go back inside and enjoy her meal. While this was going on the lady continued to attempt to push through me to get to Miran. With my right hand I was waving at Miran to keep going to the car. Jessica then went on to state that she turned and started walking away. After turning and beginning to walk away, Jessica stated," I felt someone grab onto my pony tail and my head jerked back with a lot of force. The lady had grabbed my hair from behind and was pulling my pony tail. The force of the pull on my head caught me by surprise and I lost my balance, which caused me to lean to my rear. I remember that I still had my cell phone in my left hand, because I had been using my pop socket, which is attached to it. After I put the phone in my pocket, I was pulled forcefully again, which caused me to turn to my right. The lady still had my pony tail and was pulling me. I then remember getting pulled to my right and having to bend down because this lady was still forcefully pulling on my head and would not let go. I was yelling at her to let go of my head and she wouldn't. It was at this point that I began losing my balance. I was trying not to go down to the ground. My right hand was in close to my chest and I was trying to maintain my balance with my left hand out stretched to my left. I then realized I was going down, so I recall bringing my arms in towards my center. I went down and my right hand hit the ground. I felt the pain in my right palm and thumb when I fell. I recall my left hand came in and landed on the lady's hand. My face landed on her chest area and my left hand felt her hand holding her phone. I grabbed her hand, which was holding her phone. The lady was screaming for me to give her phone. I was still holding her hand and phone and was telling her to let go of my hair and I would let go of her phone. It was during this time that-Miran was attempting to get me up. I remember him yelling for me to get up and how I was trying to tell him that I couldn't because the lady was still pulling my hair and head down. I remember trying to push myself up with my right hand. My hand was on the lady's upper chest area and my left hand was still holding her hand and phone. The lady then let my hair and head ·loose and I was able to get off of her and get up. I remember feeling scared and anxious throughout this part of the incident because I could not leave the area because this lady had my hair and was not letting me leave with my husband. Jessica described the lady (Moran) as acting "Crazy". Jessica stated that during the ride home, after the incident, her left ear was throbbing, she had pain in her neck, her right wrist, right thumb, right ankle and her right big toe. Jessica stated that on 02/17/2019 she decided to go to the walk-in clinic because of the way she felt. Jessica went to PhysicianOne Urgent Care, located at

#78 Pershing Drive in Derby, Connecticut. Jessica was treated by Tamikque Escourse, APRN. Jessica was diagnosed with a neck sprain/strain due to the whiplash effect from the lady pulling her hair from behind, a laceration to the cartilage on her left ear from her earring getting pulled, a contusion to her right thumb and hand, and a sprain to her right great toe and ankle. (It should be noted that Jessica's statement is consistent with the verbal statement provided to this affiant on the night of the incident)

That, on 02/17/2019 I interviewed and obtained a sworn written statement from Miran Glodek

regarding the incident. Miran stated that as he was leaving and passing the hostess stand, he thanked them for ignoring them and stated, "This place sucks." Miran denied getting in anybody's face, he denied yelling it, and stated it in a matter of facVdisappointed manner to nobody specific. Miran stated that he made the comment by the exit door, then continued out of the restaurant. Miran goes on to state, "While I was exiting the second door, I felt a forceful push to my back. This was followed by several more pushes and grabs, which were forceful enough to start to turn my body. At the same time I heard a female yelling, "You can't speak to my employees that way!" I was really caught off guard and continued to try to walk away from the restaurant. I did not respond to the lady in any way. The next thing I know is that this lady who had been pushing me had Jessica by the back of the head. I believe that the lady diverted her anger from me, because I was not responding to her, to my wife Jessica." Miran then explained that the two (2) females ended up on the ground with Jessica on top of the other female. Miran stated, "I attempted to help Jessica up, but I couldn't get her up because the lady had her by the hair. Jessica was yelling for her to let go of her hair and the lady was yelling for Jessica to let go of her phone." Miran stated that while they were again attempting to leave the area, "She continued to follow us, which made me very nervous, since nothing observed in her behavior was rational. I had no idea what this lady was capable of since she had just attacked me then my wife." Miran denied that he or his wife, Jessica, threatened or assaulted anybody and that they had not acted in a violent manner to anybody. Miran explained that all they wanted to do was leave the restaurant because they were disappointed in the lack of any type of service after having waited for twenty (20) or so minutes. (It should be noted that Miran's statement is consistent with the verbal statement provided to this affiant on the night of the incident) 9)

That, as part of the investigation, closed circuit television (CCTV) security video was seized from a

local business (The Fire Place restaurant) in the area of the incident. The video captured a portion of the incident, which had occurred in the area of #30 Center Street. The video depicts Jessica Glodek attempting to walk westbound on the southern sidewalk, while Moran is violently pulling the back of Jessica's head/hair with her left hand and attempting to grab her left arm with her right hand. Moran is then observed grabbing the left side of Jessica's head and begins to turn Jessica. Moran then is observed going down to her left knee while attempting to pull Jessica down. Jessica is observed bending at the waist, while attempting to maintain her balance with an extended left arm. Jessica then appears to lose her balance and topples on top of Cheryl Moran. Miran Glodek is observed attempting to separate the two (2) females. An Anthony Jack's employee, identified as being Anthony DePaolo (dob: 02/09/1990), is then observed running to the females on the ground. DePaolo is observed assisting Miran with the females. Affidavit - Continued Once the femaies are separated, DePaolo is observed physically restraining Moran, who appears to be attempting to re-engage with Jessica again. Jessica is observed getting off the ground and fixing her hair. Neither Jessica nor Miran appear to be acting in a violent or threatening manner. Jessica and Miran are then observed walking west on center street away from the restaurant. Moran then appears with her cellular phone in hand walking after the couple, with DePaolo standing on the sidewalk watching. It should be noted that injuries sustained by Jessica are consistent with the events captured by the closed circuit television (CCTV) security video, which was seized from The Fire Place restaurant. 10)

That, after viewing the closed circuit television (CCTV) security video, which was seized from The

Fire Place restaurant I verbally spoke to Anthony DePaolo who is the manager of Anthony Jack's. DePaolo advised that he had been working at the restaurant during the incident. DePaolo confirmed that he had been at the hostess stand with Moran, Penna and Massicott when the male came to the stand and stated, "We are leaving" and something to the effect of "the service here fucking sucks" and "fuck you". DePaolo advised that Moran went out after the male and that a short time later he was told about the altercation by the hostess. De Paolo explained that when he got outside, he observed the larger female on top of Moran. DePaolo stated that he went over and assisted the male party with separating the two (2) females. I described to DePaolo that the surveillance video observed shows him physically restraining Moran from breaking away from him and that it appeared that he was attempting to carry Moran away from re-engaging with the other female. I asked him what was being said, if anything, and why it was that he did not follow Moran when she left the scene to follow the couple. DePaolo simply stated that he had a restaurant to manage, so he went back to work. 11)

That, a few days after the incident, I spoke with Melissa Massicott (dob: 05/25/2001) and her

mother about the incident. Massicott confirmed that she had been working the evening of the incident. Massicott described how she had been at the hostess stand with Moran, DePaolo and Penna when a male came up to the stand and stated that he was leaving and something to the effect of, "the service here fucking sucks". Massicott stated that the male did not direct the comment to anybody specific, he did not yeli it or make a scene in the restaurant and that he ieft after making the comment. Massicott stated that Moran then went out after the male. Massicott stated that she did not feel threatened by the male. 12)

That, on 02/21/2019 Cheryl Moran provided a sworn written statement to Sergeant Wilk of the

Southington Police Department. Moran stated that she had been standing at the hostess stand by the entrance of the restaurant, when a male came from the lounge area with a female behind him. The male (This ls page 7 of a 10 page Affidavit)

Affidavit~ Continued slapped his hand down on the stand and stated, "We've been fucking ignored." Moran stated that she had just walked in and had no idea what was going on. Moran states that she was trying to ask the male what the problem was and that the male turned his back and began walking away. Moran described how she walked after him, while asking him what was going on. Moran describes herself as being very protective of her employees, because they are young and don't deserve that kind of treatment. Moran states that she was trying to find out what he was so upset about. Moran describes how they were now outside the front door and how she was about to start her spiel. Moran states that the male (Miran) was in her face when she stated to him, "Get out of my space" and something like, "You're way too close" as she put her hands up. Moran goes on to state, "She came around his left side and shoved me in my right shoulder with her left hand. I said, "Don't fucking touch me." It was like she then pushed him back and she was now in front of me. As soon as I said don't touch me it was like, "boom" and she shoved me with open hands in my shoulders. I said, "Now I've got to call the fucking cops." I reached into my back, right pocket. I brought my right hand around to the front of me with my Samsung Galaxy 8 cell phone in my right hand. She (Jessica) immediately snatched my phone from my hand with her left hand. I immediately reached for my phone with my right hand towards her hand or arm or shoulder or whatever I could grab. At about this time we begin to move in to view of the Fireplace surveillance video. She was kind of turning and walking away from the front door of my restaurant with my cell phone. I thought her intention was to steal my cell phone. Now I was kind of facing the camera and I was reaching across her chest and shoulders, reaching for my cell phone which was in her left hand. I was just trying to grab whatever I could to stop her from getting away with my cell phone. There was a tussle or a wrestling match between her and me at this point. She was a much bigger and stronger girl than me. I felt the strength of her right arm and I thought I went down with one, fell swoop. After watching the video it looks like it took her two times to knock me down. On the video it looks like I first went down to one knee. I remember feeling like a rag doll after she slammed me down to the ground. The back of my head hit the concrete when she slammed me to the ground." Moran states that she was aware that her cellphone was in the lady's left hand and remembers reaching for her left hand or anything in that direction. Moran states, "She was pushing me on the ground. She had her right hand around my throat while she was holding my cell phone in her left hand with her left arm extended away from me. She never let go of my cell phone. There was a couple of seconds, at least, when I felt my windpipe being cut off. Once her hand was on my neck she was pushing straight down towards the ground. I literally couldn't breathe. It may have been two or three seconds, it may have been three or four. I was yelling for my phone whenever I could, but not while her hand was on my throat. I really thought she was going to kill me. When she was finally coming off of me I was just able to just start to get up and I was able to recover my cell phone." Affidavit - Continued speaking about the case with Moran. Sergeant Wilk advised Moran that both parties involved in the case had a lot at stake due to the nature of the incident. Moran agreed and after some thought, Moran advised Sergeant Wilk that if the other party involved was willing to drop the issue, she would be willing to do the same. 13}

That, on or about 02/21/2019 i requested a copy of the closed circuittelevision (CCTV) security

video from the interior of Anthony Jack's Restaurant. Moran initially reported to investigators that the interior cameras of the restaurant did not cover the area in question and that she has provided videos to Bristol Superior Court in the past and that they have been useless. When advised that the video was wanted anyway, Moran stated that she would review the video to see if there was anything of value and that she would advise us. 14)

That, on 02/22/2019 I contacted Jessica Glodek in reference to Moran's willingness to drop the

issue if she would be willing to do the same. Jessica advised me that she had done nothing wrong, that she was a "Victim" and that Moran had attacked her. Jessica advised me that she was not willing to drop the issue and that she wished for me to continue with the investigation. 15)

That, on or about 02/25/2019 I interviewed and obtained a sworn written statement from a Cary

Shaw (dob: 12/09/1955). Shaw had been parked in front of Anthony Jack's, awaiting a curbside pickup, during the time of the incident. Shaw explained how he was seated in his vehicle in front of the restaurant when he heard and saw the restaurant door slam open. Shaw stated, "I overheard the smaller female yelling _obscenities at the male, she was yelling, 'Who the fuck is disrespecting you' and 'Why the fuck are you like that'. I did not observe or hear the male yelling back at the female. The male appeared to be ignoring the female and walking away. The smaller female was loud, obnoxious and appeared to be acting irrational." Shaw expressed that it was his belief that it was a "Domestic Incident" between the smaller female and the male. Shaw went on to state, "At this point I observed the larger female come back to the pair and step between them. The larger female appeared to be acting as a peacekeeper. She had directed the smaller female to walk back to the restaurant and for the male to continue down the sidewalk. She directed them in her actions, by pointing and verbally directing them because I heard her directing the smaller female to head back to the restaurant and for the male to continue down the sidewalk." Shaw stated, "The larger lady was not acting aggressive, but had separated the two (2) when she stepped between them. The larger lady again was not aggressive or threatening in her behavior. Affidavit ~ Continued described that he had received his order from the hostess. Shaw explained that the individuals were separated at this point. Shaw described how he thought the incident was over, so he drove away from the scene. 16)

That, on 02/26/2019 Detective Arma ck, of the Southington Police Department, responded to

Anthony Jack's Restaurant to inquire about the video. Moran was not on scene and was contacted by telephone. Moran refused to provide Detective Armack with the necessary access codes to secure the video. Moran responded to the scene and the video was secured from the establishment. The video, depicts Jessica leaving the restaurant while Miran walks over to the hostess stand. Miran remains at the hostess stand for approximately two (2) seconds then turns and leaves the restaurant. Miran does not display any animated, threatening or violent actions, Miran appears to be calm during the two (2) second interaction. None of the patrons observed in the vicinity of the hostess stand appear to be disturbed by the brief encounter Miran had at the hostess stand. Once Miran turns and exits the establishment, Moran is then observed quickly following after Miran. 17)

That, on 06/27/2019 I received a copy of the medical paperwork Jessica had received after having

been treated at PhysicianOne Urgent Care, located at #78 Pershing Drive, Derby, Connecticut. The medical professional who had treated Jessica was a Tamikque Escourse, APRN. Jessica was diagnosed and treated for a neck sprain/strain, a contusion of the right hand, an unspecified sprain of the right great toe and a laceration to her left ear. 18)

That, based on the above mentioned information, I believe probable cause exists for the arrest of

Cheryl Moran (dab: 07/01/1969) for the crime(s) of Breach of peace in the second degree (2 COUNTS), 53a-181, Assault in the third degree, 53a-61, Unlawful restraint in the first degree, 53a-95 and False statement, 53a-157b, in violation of the Connecticut General Statutes. Thafthis application has not been submitted before any other Judge or Magistrate
