That the undersigned, Officer Marcus Artaiz, being duly sworn does depose and state that he is a
member of the North Haven Police Department and has been since January of 2014. At all times mentioned herein he was acting as a member of said department. The following facts and circumstances are stated from personal knowledge and observations as well as information received from brother police officers acting in their official capacity and from official police reports and statements made by prudent and credible witnesses. The undersigned has received training from the Institute of Police Technology and Management (IPTM) in At-Scene Traffic Accident Investigation and Advanced Accident Investigation. 2. That on March 11, 2019 at 5:33pm, members of the North Haven Police Department, the North Haven Fire Department, and American Medical Response were dispatched to the area of Ridge Road and Hickory Hill Road for the report of a pedestrian struck by a motor vehicle. Police dispatch relayed that the involved vehicle was a red Ford Taurus or similar type vehicle that had left the scene and was last seen traveling Northbound on Ridge Road. 3.
That upon arrival to the scene by responding emergency services, a woman was observed laying
prone and unresponsive in the Northbound lane of Ridge Road just South of the intersection with Hickory Hill Road. The woman was accompanied by three other parties who were identified as her family members. The family had reportedly been walking North on Ridge Road when the woman was struck

Affidavit - Continued Northbound vehicle on Ridge Road. The female was identified on scene as Maureen E Munzner (DOB: 02/20/1962) of 28 Norway Road, North Haven, CT. Munzner was treated on scene by members of the North Haven Fire Department and was transported to Yale New Haven Hospital by AMR. Shorty after arrival to Yale New Haven Hospital, Munzner was pronounced deceased as a result of the injuries she sustained from being struck by the vehicle. 4.
That due to the severity of the collision and the fact that it now involved a fatality, members of the
South Central Connecticut Traffic Unit (SCCTU) responded to the scene to conduct further investigation. The SCCTU consists of Police Officers employed by the East Haven Police Department (EHPD), the North Branford Police Department (NBPD), the Madison Police Department (MPD), the Branford Police Department (BPD), and the North Haven Police Department (NoHPD) operating under a police mutual assistance compact pursuant to C.G.S. 7-277a. 5.
That Ridge Road in the area of the crash is a two lane roadway with one lane for Northbound
vehicular traffic and one lane for Southbound vehicular traffic. The North and Southbound lanes are separated by a painted double yellow line. Ridge Road is a relatively busy road through the town of North Haven but is primarily a residential area. The roadway appeared to be composed of asphalt and was dry at the time of Sergeant Spose's arrival, which was approximately 5:49 PM according to police computer dispatcher records. No major defects or deformities were observed in the roadway leading up to the area of impact. Ridge Road is relatively flat and straight in the area of the collision and there were no line of sight issued noted. Hickory Hill Road intersects with Ridge Road on the East side of the road and is a residential street. Ridge Road in the area of the collision is a 30 MPH speed limit zone. Ridge Road in the area of the collision was photographed, video taped, and scanned via the SCCTU's Faro Scanner. 6.
That initial Officers on scene identified numerous witnesses to the crash. The first statement was
from witness and 911 caller Jennifer Judkins (DOB: 09/15/1979). Judkins relayed verbally and in writing that she was at her residence. located at 1560 Ridge Road in the garage with the door open. Judkins' residence is located approximately 170 feet from where the pedestrian was struck. Judkins stated she heard a loud bang and ran to the end of her driveway to observe a woman lying in the roadway, face down. A male, later found to be the victims husband, was kneeling next to the female. Judkins stated she approached the male and asked "who did it?". The husband, identified as Steven Munzner, indicated the vehicle involved in the collision was a red vehicle, which was now stopped at the red traffic control signal at the intersection of Ridge Road and Dixwell Avenue. Affidavit - Continued to catch up to the evading vehicle on Ridge Road but was unable to reach the intersection prior to the traffic control signal turning green and then red again. Judkins stated while trying to catch up to the evading vehicle she observed it pass another Northbound vehicle by crossing into the Southbound travel lane. Judkins stated the vehicle appeared to be red in color with a cracked windshield, and to have a Connecticut registration plate. During Judkins' recorded emergency 911 call, she indicated the vehicle appeared to be similar to a red Ford Taurus. During Judkins' statement she also indicated she believed the vehicle was occupied by two people. 7.
That while on scene Officers also spoke with Pheobe French (DOB: 05/22/1994), who provided a
written statement. Pheobe stated she was driving Southbound on Ridge Road near Norway Road when she observed a family walking Northbound on the side of the road. Pheobe stated the family was outside of the roadway but that the female was observed walking in the area where the Eastbound side of Ridge Road meets the grassy area between the roadway and the sidewalk. Pheobe could not be sure if the female was in the roadway or on the grass. Pheobe stated she observed a red four (4) door vehicle traveling Northbound on Ridge Road and it appeared this vehicle was traveling close to the center of the road in a way that it was over the double yellow line. Pheobe said this red vehicle then veered to the right side of the road as the red vehicle approached the family from behind. Pheobe indicated that it also appeared the vehicle sped up prior to the collision as she remembered hearing the engine rev. Pheobe indicated the red vehicle struck the women, causing the woman to be thrown in the air, flipping several times before landing in the road. Pheobe stated after striking the women the red vehicle sped off Northbound. Pheobe stated the windshield was completely shattered but that she was able to observe the operator of the red vehicle and described him to be a tan white male wearing a flat brim baseball cap. Pheobe only observed the operator of the vehicle and did not see a passenger but noted she could not see the passenger seat clearly due to the shattered windshield. 8.
That upon observation of the roadway in the area of the collision, numerous items were determined
to be of evidentiary value. Articles of clothing and shoes worn by Maureen Munzner were scattered along the Northbound lane of Ridge Road and off the East side of the roadway. A number of these items were removed from Munzner after being cut off by emergency medical responders treating Munzner on scene while some of the items were believed to have been thrown as a result of the collision. An additional evidentiaiy item located was a piece of a black license plate frame with the white letters "GoJDI". This piece appeared to be the lower left portion of a black license plate frame and was observed in the Southbound lane near the intersection with Hickory Hill Road. Affidavit - Continued dirt area where the asphalt of Ridge Road meets a grassy area along the Eastern portion of the roadway. The tire marks were observed in the same area in which the vehicle was believed to have contacted Munzner. There is no asphalt curb in this area on the East side of Ridge Road. 9.
That while evaluating the scene, North Haven Police Dispatch was contacted by the Hamden
Police Department regarding a 911 phone call they had received at approximately 6:02 PM. Hamden Police relayed they received a call from an individual who was actually in North Haven on Mount Carmel Avenue, near the town line. The male reported he had struck a deer and was in a red Ford Fusion. Officer Opuszynski and I were dispatched to meet with the subject on Mount Carmel Avenue. Upon arrival, the undersigned observing a red Ford Fusion, bearing CT Reg AK25694, with damage to the hood and roof of the car in addition to a completely shattered windshield with a hole near the center. The undersigned observed a white male standing at the rear of the vehicle who was wearing jeans, a grey hoodie, and a blue baseball hat which appeared to be consistent with the description provided by the witness, Pheobe French. The male was identified via his CT Drivers License (026904334) and proved to be Mark Rubino (02/12/1979) of Wallingford, CT. Rubino stated he had been at Metro PCS in Hamden, CT which is located in the Hamden Plaza. Rubino stated he was traveling home to Wallingford and explained he traveled North on Dixwell Avenue, to Whitney Avenue, to Mount Carmel Avenue in Hamden. Rubino stated he traveled East on Mount Carmel Avenue until he entered into North Haven towards Ridge Road. Upon approaching Ridge Road Rubino stated he collided with a deer that ran into the roadway. Rubino stated he stopped immediately and observed the deer stand up and run away. Rubino provided this statement verbally, and in a written statement. It should be noted that when questioned about the truthfulness of his statement Rubino responded with "I'm almost positive." 1O.
That while speaking with Rubino, he was advised there was no deer fur observed embedded in his
vehicle or windshield which is highly common in collisions with deer. Instead, the undersigned observed what appeared to be consistent with longer human hair embedded in the windshield near the hole in the windshield. While with Rubino on Ridge Road, the undersigned spoke with Sergeant Spose who was on the scene of the collision. Sergeant Spose relayed that a piece of black license plate frame with the white letters "GoJDI" had been located in the roadway of the crash scene. The undersigned observed the front license plate frame of the Ford Fusion and noticed it was missing the bottom left portion of the frame. The frame on the Ford Fusion had J.D.BYRIDER imprinted on the top of the frame and what appeared to say "3.com" imprinted on the bottom of the frame. After the undersigned observed a photograph of the piece of frame located on scene it was evident that it was the missing piece of the front license plate

Affidavit - Continued currently affixed to the Ford Fusion. It was learned the full bracket frame was imprinted with "GoJDB.com". Further, the undersigned observed the passenger side front and rear tires appeared to have traveled through mud or dirt that was now dried on the tire. These dirt marks on the tire were consistent with the vehicle travelling off of the paved roadway. Additionally, tire marks were located off of the pavement at the crash scene on the dirt berm that separates Ridge Road and the grassy area on the East side of the roadway. No mud or dirt was observed on the driver side tires of the Ford Fusion. 11.
That based on the above mentioned circumstances it was believed Rubino had been operating the
red Ford Fusion on Ridge Road and collided with Maureen Munzner. Sergeant Decrosta of the East Haven Police Department and SCCTU responded to the scene to assist in the interview of Rubino. At this time Rubino was advised of his Miranda Rights and Sergeant Decrosta advised Rubino he could stop the questioning at any time. The interview with Sergeant Decrosta was recorded on Officer Opuszynski's body worn "Axon 2" camera. Rubino was advised that there was physical evidence linking his vehicle to the collision. Rubino then went on to state that he was driving on Hartford Turnpike and that he looked down briefly to change his radio and felt that he "hit" something. Rubino stated he did not know what he had hit and that he had stopped "a little bit" and looked behind him but did not see anything. Rubino stated he "honestly thought it was a deer" and continued driving. Rubino stated that once he had time to think about it he contacted the Police by calling 911 and advising them that he had hit a deer on Mount Carmel Avenue. Rubino was then questioned about his route that he had taken after leaving Metro PCS in Hamden. Rubino now changed his route from the route he indicated he had traveled in his original verbal and written statement. Rubino now stated he traveled from Dixwell Avenue in Hamden until he reached North Haven. Rubino stated he traveled East on Dixwell in North Haven and made a left hand turn onto Ridge Road where he traveled to and made a left turn onto Hartford Turnpike. Rubino stated he believed he struck the deer a short distance North after the intersection of Hartford Turnpike and the Route 15 (Merrit Parkway) Exit 63 On/Off Ramps. Rubino stated throughout the interview that he was almost certain he was not on Ridge Road in an area that is South of Dixwell Avenue, which is the area in which the collision had occurred. Rubino also made statements throughout the interview indicating he has a lot to lose, did not want to lose his job, and did not want to spend the rest of his life in jail. 12.
That a COLLECT inquiry for Connecticut Registration AK-25694 showed the vehicle to be a 2008
Ford Fusion S, registered to Mark Rubino. Insurance for the vehicle could not be confirmed via NCIC/COLLECT and Rubino indicated the vehicle was insured through Progressive. The undersigned contacted Progressive to verify insurance and learned that Progressive cancelled the policy in Se (This is page 5 of a 1O page Affidavit

Affidavit - Continued of 2017 after not receiving payment for the policy. It was believed the vehicle was not insured at the time of the crash. After speaking with Rubino, his vehicle was seized as evidence and was towed to a secure holding area located at the East Haven Police Department by Nelcon Service Center. Numerous items of evidence were also seized from the original crash scene including clothing and a towel located on Ridge Road near the area of impact and the broken piece of license plate bracket. 13.
That on March 13, 2019 a Search and Seizure Warrant for the 2008 Ford Fusion bearing
Connecticut passenger registration AK25694, (VIN: 3FAHP06Z88R209444) was presented to and signed by Meriden Superior Court. In the following days, the warrant was executed and the vehicle was thoroughly photographed, video taped, and scanned. Additionally, two (2) samples of hair fibers were pulled from the windshield of the Ford Fusion and three (3) DNA source sample swabs were taken from the interior of the vehicle along with the steering wheel cover and two (2) Metro PCS receipts. The undersigned took two more source sample swabs from the edges of the hole in the windshield and the exterior windshield near the hole in the windshield along with glass fragments from said windshield. The undersigned also cut a large section of the windshield out which was logged into evidence should additional swabs need to be taken. 14.
That as part of the warrant execution Kenneth Schurk, an ASE certified mechanic, assisted in a
mechanical inspection of the Ford Fusion on March 18, 2019,. As a result of the inspection, Schurk determined that the inspection did not reveal any abnormalities or mechanical defects that would have been a causative or contributing factor to the collision. Officers attempted to obtain data from an Event Data Recorder (EDR) ("black box") from within the vehicle. It was learned that the vehicle was not equipped with a EDR capable of providing any crash data. 15.
That on March 19, 2019 at approximately 12:00pm this Officer met with Steven Munzner at North
Haven Police Headquarters. The interview was captured on this Officer's body worn Axon 2 camera. Munzner stated that on March 11, 2019, he arrived home from work at approximately 5:00pm and that the family decided to go for a walk. Steven stated that he and his Sons, Alexander Munzner (12/30/2003) and Zachary Munzner (10/17/2001), took their family dog and began walking East on Hickory Hill which is a relatively steep hill. Steven explained his wife did not wish to climb the hill so walked her own route in the neighborhood on the West side of Ridge Road. Steven stated their route eventually lead them to be walking South on Marlbourough Road. Steven stated they then turned right onto Homewood Avenue followed by another right on to Ridge Road where they began walking Northbound. Steven e

Affidavit - Continued this point he now observed Maureen on the East side of Ridge Road, in close proximity to the intersection of Ridge Road and Homewood Avenue. Steven guessed that Maureen likely crossed Ridge Road after walking up Sunset Road. Steven explained at this point his older son, Zachary, was lagging behind the rest of the family, walking a short distance behind them. 16.
That Steven explained he and his family all began walking towards Hickory Hill Road and began to
notice that the sidewalk had snow on it and that the grass between the sidewalk and roadway was muddy. Steven explained that he and Alexander walked through the muddy grass but explained that Maureen began walking on the edge of the east side of Ridge Road. Steven stated he suddenly heard a loud thump and turned to notice something in the air which then hit the ground when he realized it was his wife, Maureen. Steven stated he approached his wife and saw that Maureen was bleeding from her leg which he attempted to control by tieing her sweat pants around her leg. Steven stated his neighbor called 911 and that he had observed a red car leaving the scene, traveling North on Ridge Road towards Dixwell Avenue. Steven stated that first responders then arrived on scene. 17. That further questioning revealed that Steven did not observe any occupants inside the red vehicle as he observed it leaving the scene. Steven explained that as the family was walking North on Ridge Road, he and Alexander were in front of Maureen and Zachary was behind Maureen. Steven had estimated that Maureen had been walking on the edge of Ridge Road for approximately 30 seconds prior to hearing the "thump" of the vehicle colliding with Maureen and believed she stepped into the roadway somewhere in the area of the apron to the driveway of 1559 Ridge Road. It should be noted that this driveway apron is approximately 156 feet North of the intersection of Hickory Hill Road. 18.
That on March 21, 2019 at approximately 4:14pm, I responded to 28 Norway Road to speak with
Zachary Munzner. Zachary stated he began walking with his father and brother and that Maureen took her own route and began walking West from her residence which is away from Ridge Road. Zachary explained that once he turned onto Ridge Road from Homewood Avenue he saw his Mother who was now on Ridge Road near the intersection with Homewood Avenue. Zachary explained that they began walking North on Ridge Road and approached an area on the side of the road that was covered in snow and ice. Zachary indicated that his Mother did not want to fall so she began walking on the dirt area where the East side of Ridge Road meets the grass separating the road and the sidewalk. Zachary added that he did not believe his Mother was on the paved section of the roadway and that she was "mostly on the grass." Affidavit - Continued Zachary stated he observed what he believed to be a red Ford vehicle traveling at a high rate of speed and noticed that the vehicle appeared to be slowly veering towards the right hand side of the roadway. Zachary stated he began running forward and yelled out as he feared the vehicle may strike his Mother. 19.
Zachary stated he observed the vehicle's passenger side tires travel off the road onto the grass
and dirt on the east side of Ridge Road and strike his Mother causing her to be thrown approximately ten ( 10) feet in the air and then strike the ground face first. Zachary stated the vehicle left the scene and that a person in the area tried to chase after it. Zachary stated while he was walking behind his Mother he was approximately five or six feet behind her and indicated that his Mother stepped onto the edge of Ridge Road a short distance after the driveway apron to the residence of 1559 Ridge Road. Zachary explained that his Mother was walking on the edge of Ridge Road for approximately 5 seconds prior to being struck by the vehicle. Zachary indicated Maureen was struck somewhere between the apron of the driveway to the residence of 1559 Ridge Road and the Snet Utility Pole 1343. 20.
That on March 21, 2019, Detective Michael Harton of the North Haven Police Department
transferred evidence items seized during the execution of the search warrant for the Ford Fusion from the North Haven Police Department property room to the Connecticut Forensic Laboratory for DNA analysis. 21.
That on 5/24/19 at 10:46 AM Lieutenant Andrew Stavrides of the North Haven Police Department
Investigative Services Division received an e-mail from Cheryl Carreiro of the Department of Emergency Services and Public Protection Division of Scientific Services. The e-mail contained a DNA Report for Laboratory Case DSS-19-001584, North Haven agency case # 1900004413. The report included several conclusions, which are as follows: Conclusion 1, item #6S1 (Swabbing of steering wheel cover) The results are consistent with the DNA profile from item #6S1 being a mixture of two contributors with at least one of them being male. Maureen Munzner is eliminated as a contributor to the DNA profile from item #6S1. Conclusion 2, item #7S1 (Swabs- "edge of hole in windshield") The results are consistent with the DNA profile from item #7S1 originating from a single female individual. Assuming one individual, the DNA profile from item #7S1 is at least 100 billion times more likely to occur if it originated from Maureen Munzner than if it originated from an unknown individual.

Affidavit โ ข Continued Conclusion 3, item #8S1 (Swabs- "exterior windshield near hole") The results from item #8S1 are identical to the results from item #7S1. Therefore, assuming one individual, the DNA profile from item #8S1 is at least 100 billion times more likely to occur if it originated from Maureen Munzner than if it originated from an unknown individual. 22.
That several other remarks, such as untested, consumed, and returned items are listed on the DNA
report as well. The electronic DNA report was printed, stamped, and filed with this case jacket to be preserved for further review if necessary. 23.
That on April 24, 2019 Officer Esterby and I responded to GA-07 to presented a search and
seizure warrant to Meriden Superior Court for Mark Rubina's cell phone records and cell tower "hits" related to Mark Rubina's cell phone stored by Metro PCS. Said warrant was signed and later faxed to Metro PCS. On May 2, 2019 the undersigned received cell phone records related to Mark Rubina's cellular account with Metro PCS in response to the search warrant. The records were seized as evidence and later faxed to the Federal Bureau of Investigation (FBI) for assistance. At the time of this warrant this agency is awaiting an official report regarding the results of the cell tower hits of Mark Rubina's cell phone from the FBI. However, Sergeant Decrosta was able to, contact the FBI and learn that it was determined the information received from Metro PCS proved to be insufficient in determining Rubina's location, specifically if he was on Ridge Road in an area South of Dixwell Avenue, near the area of the collision. 24.

License (CTOL 026904334) with no history of motor vehicle violations. An SPRC inquiry for Rubino showed one prior arrest by the North Haven Police Department for a Larceny charge in 2000. A "Triple I" inquiry for Rubino revealed one arrest from 2009 in New York for Driving while intoxicated. 25.
That wherefore, the undersigned represents that the above facts and circumstances give him
probable cause to believe that Mark Rubino (DOB: 02/12/1979) of 200 Cook Hill Road Apt 13 in Wallingford, CT did commit the crime(s) to wit; CGS, 14-236, Failure to Drive in Proper Lane; CGS 14-213b, Operating a Motor Vehicle without Insurance; CGS 14-224(a)*, Evasion of responsibility in operation of motor vehicles, and CGS 53a-37, Misconduct with a motor vehicle in violation of the Connecticut General Statutes in the Town of North Haven, CT on or about March 11, 2019 and the undersigned requests the issuance of an arrest warrant.
