Mr. Scaife: It is my understanding that you have asked Majority Leader Lowell a question regarding the "shall execute a release" language in the last paragraph of the Termination Resolution; specifically, what this language means. The Council is opting to separate you using the "no cause" provision of your contract instead of terminating you for cause, which they would have the right to do upon the showing of a for cause reason. As the City will be paying you 6 months of severance, we are insisting that a release be signed by you in consideration for handling your termination in this manner. Attorney Dugas and I are concerned about protecting the City's interests, so in consideration for the council not pursing a for cause termination, which arguably is in your best interest, we are stipulating that a release be signed.
