PURSUANT TO SECTION 7 -471 (5) OF THE MUNICIPAL EMPLOYEE RELAnONS ACT THE UNDERSIGNED ALLEGES THAT THE ABOVE-NAMED RESPONDENT HAS ENGAGED IN AND IS ENGAGfNG IN PROHIBITED PRACTICES WITHIN THE MEANING OF SECTION
7-470 OF SAID ACT, IN THAT:
Respondent has refused to bargain collectively in good faith with the Complainant Union which has been designated as the exclusive representative of employees employed by Respondent_ Said action constitutes a violation of but not limited to Section 7-470 (a) (4) of the Act. Further, the Respondent has violated Section 7-474(b) of the Act. Specifically, the parties concluded negotiations for a successor contract by reaching a tentative agreement on July 15, 2009. Said agreement was subsequently ratified by the Board of Education. On September 8, 2009 the Wallingford Town Council voted to reject the agreement. The
Respondent has failed to implement the negotiated agreement.
Said rejection occurred outside timeframes prescribed in the Act, and constitutes a prohibited practice. Complainant seeks comprehensive statutory remedy including but not limited to an order to cause Respondent to immediately implement the agreement; and pay to Complainant all costs borne by Complainant in pursuance of this Complaint and compliance therewith.
