ust as China is trying to know more about other parts of world, the world also wants to know about China. When we started to publish a Chinese magazine (Zai Sheng Shi Dai) for the Chinese-speaking audience in the remanufacturing industry in 2007, we aimed to bring the information from the world to our Chinese readers. After three years, our Chinese edition has gained wide recognition and has become one of the most important publications for the printer supplies industry. However, we are so often asked the question “Do you also provide English language information on the Chinese market?” Now we are ready. We are presenting to the remanufacturing industry an English publication providing information mainly from China and Asia. Located in China and in the “Capital of Printer Consumables” - Zhuhai, Recycling Times can report with first-hand information as we are experiencing the dynamics of the industry ourselves. With our connections in the industry, we will also bring opinions from different perspectives. Many say that China is a market with a lot of potential. Yet it is also a market that greatly differs from those of Europe and the US. So in this issue we would like to give you a general idea of China’s printer market using information and statistics provided by CCID, a renowned market research company in China. April 23-24, we are going to host CIFEX in Handan, a city in the North of China. North China is a sprouting market as it is the most populous area in the country and close to Beijing. Handan is already a base for OPC drum and laser toner manufacturing. If you want to explore further into China’s market, you are welcome to attend this one-day conference and two-day exhibition. This is the first issue of The Recycling Times English edition. We would appreciate your comments and suggestions, so that we can make continuous improvement. Don’t hesitate to let us know your opinions.

HP sues ink cartridge suppliers from Taiwan and Hong Kong

H

ewlett-Packard has taken thirdparty inkjet cartridge manufacturer MicroJet from Taiwan and a few other companies from Hong Kong to the U.S. District Court, Northern District of California (San Francisco), alleging six of their product patents were infringed. In the 28-page complaint filed on March 5, HP claimed that these companies's HP-compatible inkjet cartridges infringed six of HP’s patents: US patent Nos. 6,234,598; 6,409,053; 6,398,347; 6,481,817; and 6,402,279. These patents apply mainly to the HP 27/28 and HP 56/57 cartridges and other similar models. Hewlett-Packard says Taiwan's MicroJet manufactured and sold the allegedly infringing ink cartridges not only under its own brand name, but also sold generic and/or madeto-order products and printheads to other companies, including Mipo and PTC. It claims Mipo and PTC then resold the accused products to the markets, including the US.

4

1-19.indd 4

Sinotime is accused of selling the allegedly infringing products on Amazon under the name "All Colors" and advertising the products as "remanufactured" cartridges. Facing the infringement accusation, MicroJet responded in a press release, "All products manufactured by us are created with our own research and development efforts." MicroJet says they currently own 251 patents with another 213 patents under examination. In a telephone interview, Alex Chuang, president of PTC from Hong Kong, pointed out, "PTC was established less than two years ago. PTC stands for Professional Toner Cartridges. We mainly carry laser cartridges, OPC drums and toner. We have never sold a single HP compatible inkjet cartridge to the US market. We take no interest whatsoever in the production of compatible inkjet cartridges. As for the cartridges we resell, they are remanufactured products" Mipo defended by saying, "We have no business relations with Microjet. It has never happened

that Mipo purchased any of the allegedly infringing products from Microjet." HP also claimed that Mipo and MicroJet converted more than 300,000 "genuine HP printheads from HP facilities in Asia" HP reported that in 2006 and early March 2007 certain component parts appeared to have been unlawfully taken from its facilities in Asia. And it is reported that trucks carrying HP parts were hijacked while en route from the Singapore factory to a Malaysian assembly plant in March and September 2007. HP says that each genuine HP printhead is marked with a unique product identifier FID. And such an identifier was found in the "Mipo"cartridges acquired by HP from Amazon. Mipo reponded to this in a statement, "HP's accusation is groundless. Mipo is a professional remanufacturer of printer cartridges. We never converted any cartridges." Some media have given misleading information about the leaking accidents taking place in HP Asian facilities. MicroJet clarified in its statement that it has had absolutely no involvement in any thefts of HP components. Mipo also expressed its resentment against the misleading information given in the media. The companies being sued by HP include MicroJet from Taiwan, Mipo and its subsidiaries, PTC Holdings Ltd from Hong Kong and Sinotime Technologies Inc. located in Miami. HP seeks a court order blocking infringement plus triple the damages caused by the infringement as well as other monetary awards. MicroJet stated that the compensation would not be determined until the court starts its hearing of the case and comes to a decision. According to their current estimation, this incident will not influence the company’s operations and finances. MicroJet, Mipo and PTC are now seeking legal advice. And will closely follow the development of the case. Recycling Times will also give timely coverage of this case.

Suzhou Goldengreen Technologies IPO halted

T

he initial public offering (IPO) of Suzhou Goldengreen Technologies Ltd. (SGT) was stopped at the Second Board level in China’s stock market. SGT was expecting to be listed on March 17. According to the report of 21 Century Business Harald, a leading business newspaper in China, SGT has lost major patents. This contradicts an announcement made on Jan.22, where China Securities Regulatory Commission said that Suzhou Goldengreen

Technologies Ltd. (SGT) was approved for IPO on the Second Board in China’s stock market. On February 24, the State Intellectual Property Office announced on its website that four patents concerning OPCs were all expired. The expiration of patents was due to the fact that “The annual fee is not paid as prescribed”. After the first seven companies won the preliminary approval, they will get feedback opinions from inspectors and then issuers, sponsors, accountants and lawyers need to implement this feedback and replay to the inspecting authorities, if the feedback is found to have been implemented after being reexamined, then the procedure of implementing the approval will recommence. SGT projected to release the public offering of 20 million (the total issued share capital of 80 million shares, after). It is understood that the investment will be invested

into two projects: an organic photo-conductor (OPC) project and the construction of a GST Organic Optoelectronic Technology Center. The total investment is set to be 205 million Yuan. An amount of 194 million Yuan of raised capital is needed. According to the public release of March 10, an amount of 58.07 billion Yuan capital had been frozen. What to do with the blocked funds is still under discussion. We will follow up the news as it develops. About SGT

SGT is a key consumable component of laser imaging output equipments and widely used in laser printers, copiers, laser fax and laser MFPs. SGT enjoys strong design and R&D capability. On the foundation of success in developing OPC for monochrome laser printers, SGT became the first company in China that have ever succeed in manufacturing precision OPC for color laser printers. SGT is now a leading company and the largest professional manufacturer in producing high-end OPCs in China.

Recycler China promotes on ITEX 2010

B

etween March 3 and March 4, 2010, Recycler China promoted at ITEX (the Information Technology Education & Exposition 2010), which was hosted by Imaging Network, a subsidy of Questex. ITEX 2010, witnessing its tenth birthday, was held in the Las Vegas Convention Center. It focused on products such as office supplies, printer/copier machinery and services like document solutions, print management systems etc. There were more than 160 corporation exhibitors at the show, most of which were from America. It is estimated that the two-day show paid host to more than 2,500 visitors, most of whom were dealers and distributors in America. Some of the visitors were from Canada, Mexico and other South American countries. During the fair, buyers who were interested in printer supplies flocked to the Recycler China stand and the 2010 China Imaging Industry Map, published by Recycler China,

6

1-19.indd 6

drew large audience. The map shows the world a clear picture of the status in the remanufacturing consumables industry of Zhuhai, so that buyers can better understand the strategic position of the RemaxAsia Pacific show. The 2010 Global Imaging Industry Year Planner, again, published by Recycler China, showed that the timing of RemaxAsia Pacific 2010 was also advantageous. A creativelydesigned Passport to RemaxAsia Pacific 2010 also won the visitors’ attention and admiration. Many visitors who came to the booth made inquiries about the preparations for RemaxAsia Pacific 2010. A large proportion of those who came to say “hi” were Recycler China clients. They sang highly of previous Remax shows and expressed an intention to come to RemaxAsia Pacific 2010. RemaxAsia Pacific comes at a good time, allows participants a chance to experience Zhuhai – the World Consumables Center – and offers advantages in terms of both

geographical position and scale. All these are reasons why visitors are eagerly anticipating the up-coming RemaxAsia Pacific 2010. Recycler China concluded ITEX with the intention to cooperate with powerful media such as Imaging Source Magazine, InfoTrends, Questex Corporation, Lyra Research and ENX Magazine, all of which are influential figures in the printer/copier supplies, office equipment and document management industry. They will join hands to promote RemaxAsia Pacific 2010. Recycler China has always made an effort to maximize value for RemaxAsia Pacific exhibitors and reach out to explore promotional opportunities. In the next few months, Recycler China will tour other exhibition shows and trade fairs to promote RemaxAsia Pacific 2010. You can download a PDF version of the 2010 China Imaging Industry Map and 2010 Global Imaging Industry Year Planner at the official site of RemaxAsia Pacific at www.visitremax. com.cn.

Nukote files complaint against Clover

O

n February 26, Nukote filed a petition with the Dallas County Court claiming that Clover’s “unfair and illegal business practices” caused Nukote to suffer damages in excess of $100 million. The claim is in relation to Nukote’s contract with Office Depot which Nukote claims it lost due to a “plot” devised and carried out by Clover. Clover Technologies has reacted strongly to the accusation .In a press release, Clover stated: “After careful review by our legal counsel, it is abundantly clear that once again, Nukote is abusing the court system in a transparent and desperate effort to raise capital for a business that is on the verge of collapse.”

“The complaint is as empty as the shell corporation Nukote incorporated just this past week to initiate the suit. Nukote’s demise has been obvious to an industry of hundreds of competitors many of whom, like Clover, have been receiving daily letters, e-mails, and phone calls from Nukote customers looking to secure a new supplier and Nukote employees desperately seeking job opportunities.” Nukote spokesman, Russell Mack, stated that “Nukote's formal plan to emerge from Chapter 11 was approved by the court on December 15, so our company is no longer in Chapter 11. We are operating normally, producing products and serving our customers, who loyally stood by us during our reorganization last year. We are headquartered in Dallas, TX and our production centre is in Monterrey Mexico. We also have facilities in Nashville, TN, Rochester, NY and Bardstown, KY. Having emerged successfully from reorganization, Nukote is alive and well and our sales are robust.” Mack concluded “One final point I would make is that we understand this lawsuit will be a long process. We are ready for it, however long it takes to get justice. We look forward to presenting the facts to a judge and jury.”

Print-Rite listed on remanufacturing pilot enterprise list

R

ecently, Print-Rite was listed on the Mechanical and Electrical Products Remanufacturing Pilot Enterprise List. As the only one enterprise in Guangdong Province in the list, PrintRite is among the 35 pilot entities which are the first approved to remanufacture mechanical and electrical products. The list will be released by the Ministry of Industry and Information Technology of China. According to a spokesperson, the Chinese government sets up the remanufacturing pilot sites in order to push forward the efforts of remanufacturing industry. It is hope that the pilot entities will explore basic practices, related policies, and management regime and supervision mechanism of remanufacturing mechanical and electrical products. Print-Rite is included in the list for its accomplishment in remanufacturing industry and green practices in business operation and production. The company is expected to provide reliable and typical statistics to promote printer consumables industry. Print-Rite advocates a green recycling industry and emphasizes the improvement of key parts and components. All the plastic parts used in Print-Rite products are made of PP, ABS and other reusable materials, so that discarded products can be easily recycled. The packaging material is also made of recycled paper. To remind customers with green approaches, the products bear “recycle” marks. Print-Rite promotes refill ink through sales networks around the globe. According to Arnald Ho, Chairman of the Board of Print-Rite Holdings Ltd., Print-Rite will strive for self-innovation and promote the remanufacturing industry. As an Academician-expert station enterprise enjoying intellectual property and R&D advantages it is ideally placed to do this.

UTec introduces new Ease-FiL products

U

nion Technology International ( M C O ) C o. , L t d . ( U Te c ) h a s introduced its new line of refillable toner and ink cartridges. The new Ease-FiL line features remanufactured toner and inkjet cartridges designed to be refilled easily without any mess or requiring any tools. In addition to easy-to-refill cartridges, Ease-FiL bundles include high-quality replacement ink and toners to refresh the cartridges so they can be fully utilized through their complete lifecycle. “Our new Ease-FiL products benefit both our customers and the planet,” says Iris Ngo, general manager of UTec. “ We have increased the toner and ink loads in our remanufactured EaseFiL cartridges so they deliver significantly more pages than other remanufactured cartridges on the market.” Each Ease-FiL remanufactured cartridge ships with a premeasured container of either

ink or toner with which to refresh spent cartridges quickly and easily. Iris estimates consumers save between 150% and 200% by using the new replacement cartridges and refilling them when they are empty. “Not only do our Ease-FiL customers dramatically lower their printing costs, they also feel good knowing that by refilling and reusing

spent cartridges, the cartridge remains useful until the end of its life and it is not discarded prematurely,” says Iris. It takes just minutes to refill Ease-FiL inkjet and toner cartridges. The inkjet cartridges consist of a recycled print head guaranteed for a minimum of three full cycles and three replaceable ink tanks. When empty, the fresh tanks snap back into the cartridge after the spent tank is removed. The new Ease-FiL line includes three different kits for refilling Hewlett-Packard’s CB435A, CB436A, and Q2612A monochrome cartridges, which are used in the LaserJet 1012, P1005/1006, and P1505 printer and all-in-one families. FGIC releases matched system for HP P3015

O

n March 8, Future Graphics Imaging Corporation (FGIC) announced the release of a superior matched system for the HP P3015 remanufactured cartridge. Released in the autumn of 2009, the 42 ppm P3015 replaced the P3005 series while utilizing the same basic engine technology. Aspects of the cartridge architecture, however, are slightly different. For example, the OPC for the P3015 has a similar drive gear element to the P2055, but the two are not interchangeable. Only six months after the OEM release, FGIC is offering a specially designed MK Imaging toner that shows exceptional ID, lower backgrounding and better toner consumption, even lower than the OEM. The new MK Imaging toner for P3015 remanufactured cartridges is available for both the standard (CE255A) and high yield (CE255X) cartridges. FGIC has also developed a lightweight, easy to use tool ( patent pending) that quickly removes the OEM drum drive element and

easily reinstalls it onto the MK Imaging drum without damage. The MK Imaging toner, OPC, compatible wiper blade and drum drive gear tool are in stock now and ship from convenient locations

around the globe. To see test data, please contact the FGIC sales representatives or download a detailed “Engine Overview” on the website: www. fgimaging.com.

Epson introduces new color inkjet printer with high-yield cartridges

E

pson America is introducing two new color inkjet printers, the B-310N and B-510DN, for high-volume printing in small and mid-size businesses. Both of the new printers may be equipped with the highestyield ink cartridges in the SMB ink-jet printer/ All-in-One segment. The B-510DN may be equipped with the highest-yield cartridges – a black extra high-yield cartridge ($69.99) that makers say will yield 8,000 pages, and cyan, yellow, magenta cartridges ($59.99 each) that are each estimated to yield 7,000 pages, at a cost per page of approximately 0.8 and 2.5 cents for black and color respectively. Epson rates both the B-310N and B-510DN at 33 ppm in black and color in draft mode (and at up to 18/19 ppm in ISO mode). Maximum paper size is 8.5" x 14" (21.6cm x 35.6 cm) and both are Energy Star qualified. The printers are equipped with a 500-sheet paper drawer, and are designed for color business users.

The B-310N lists at $399, and has a maximum monthly duty cycle of 10,000 pages (2,000 pages is recommended). The B-310N's ink cartridges consist of a black ink cartridge ($39.99) and rated to yield 3,000 pages, and cyan, magenta, and yellow ink cartridges ($49.99 each) rated to yield 3,500 pages each. For black and color the cost per page is approximately 1.3 and 5.5 cents respectively. The B-510DN is essentially the same as the B-310, but adds automatic duplexing, and its 500-sheet paper drawer accepts up to legal-size paper. The B-510DN also adds a rear-located 150-sheet paper tray that accepts up to letter-size paper. With an optional support, the rear paper tray can accept legal-size paper (up to 60 sheets). Additionally, it has a higher maximum monthly volume (20,000

▲ Epson B-310N

pages) and higher recommended monthly volume (4,000 pages). Epson is distributing both printers via direct market resellers, online resellers, and at its retail site, www.epsonstore.com.

HP settles printer ink cartridge patent dispute

H

ewlett-Packard announced on March 18 that it has reached resolution on the investigation by the United States International Trade Commission (ITC) into the importation and sale of patent infringing HP 02 inkjet ink cartridges. The investigation, based on a complaint filed by HP on September 23, 2009, alleged violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of HP 02 compatible inkjet ink supplies that infringed patents asserted by HP. HP reached settlement agreements with two ink cartridge suppliers InkPlusToner.com and Comptree Ink. These companies agreed to cease and desist from selling the cartridges in question. And they must pay HP an undisclosed

amount of money. HP is still expecting to settle with SmartOne Services. The specifics of that settlement were not announced. The Administrative Law Judge has approved Zhuhai Gree Magneto-Electric Co. Ltd.'s motion to terminate the investigation as to Zhuhai Gree based on entry of a consent order in which it agrees not to engage in the future importation of the relevant products. “We fully respect HP’s patent rights and we wish to reach a resolution with HP. After much deliberation, we agreed to stop importing relevant cartridge products,” said a spokesman of Zhuhai Gree Magneto-Electric. The Administrative Law Judge has entered default judgment against the remaining seven respondents. HP anticipates the ITC will issue an Exclusion Order against the products at

issue from the accused companies. These seven companies include: ABCInk, EZ Label, and CDR DVDR Media; Mipo International; Mextec Group; Shanghai Angel Printer Supplies; Shenzhen Print Media; Zhuhai National Resources & Jingjie Imaging Products; Tatrix International; and Ourway Image. "HP is pleased with the outcome on these matters, and remains committed to vigorously pursuing legal enforcement against practices that do not respect HP's IP rights," said Stephen Nigro, senior vice president, Inkjet and Web Services Business, Imaging and Printing Group, HP. HP is a major supplier of ink cartridges for printers. During the first financial quarter of 2010, HP’s imaging and printing division saw revenues of about $6.2 billion.

Canon declares public offer for Océ

fter a slow expansion in business in 2009, Fuji Xerox said it anticipates a "double-digit" growth in its Chinese revenue this year. Japan-based Fuji Xerox's business turned stagnant in November 2008 because of the financial crisis before hitting bottom in June last year, Masataka Jo, president and chief executive of Xerox China, said in an interview yesterday. ''But we have seen strong recovery (in business) in the past three months, in line with the growing Chinese e c o n o m y, " s a i d J o w h o forecast "double-digit" rise in business in the country this year. Fuji Xerox, which sells printers, copiers and multi-function machines, predicts that color machines in the office automation market and the commercial printing market will drive growth in 2010. The color machine segment will be a fast-growing sector this year, the firm said. According to a company official the firm plans to sell entry-level products designed for small firms in China.

O

n March 4, 2010, an announcement was jointly made by Canon, Canon Finance Netherlands B.V. and Océ that there will be a fully self-funded public cash offer on all the issued and outstanding ordinary Océ shares at an offer price of EUR 8.60 per Share. Canon announced that 71% of Océ’s shares have been tendered to Canon, which is below the 85% that Canon required to go ahead with the deal. Thus far, some Océ shareholders have been refusing to accept Canon's offered share price, stating that it is too low. In November 2009, Canon had offered to purchase Océ for some 987 million US dollars (730 million euros). Canon will give these Océ shareholders another opportunity to accept its bid (8.6 euros per share) between March 5-19, 2010. Canon will also shortly decide whether to accept the 71% stake in Océ. With this announcement, Canon and Océ have successfully taken an important first step in their aim to create a number one presence in the printing industry.

Chinese consumers disappointed with HP products

O

n Mar. 15, China Central Television (CCTV ) disclosed consumer complaints against HP laptop

products. The General Administration of Quality Supervision, Inspection and Quarantine said in a statement on its website (www.aqsiq.gov.cn) that after consumer complaints, it had found several models were affected by defective video cards and display screens. CCTV reports, there are serious problems with HP laptops, specifically with such models as DV2000 and V3000. What is worse, HP does not follow the regulations of China’s

Three Guarantees, which is the after service standard in China. HP ignored rules to protect customers with "Three Guarantees" of a refund, replacement or repair. The television station has received a lot of complaints concerning HP laptops since early last year. Most of the complaints are about faulty video cards that have caused overheating, crashing of computers and black screens on some HP Pavilion DV2000 and Compaq Presario v3000 laptops, the report said. Six models including the HP 541 also had problems with their screens, the findings added. The statement did not say how many computers were affected overall. CCTV also points out that HP fails to provide a “qualified” after-sales service to Chinese consumers. It is stipulated in China’s national standard that consumers are entitled to a two-year warranty upon replacement of key components of a laptop. However, HP only allows a three month warranty once the key part is replaced. But HP spokesman had other opinion. When responding to the journalist from CCTV, HP denied any quality problem

with HP laptops, and added that the malfunction of laptops was caused by the misuse of the products. “The quality of HP laptops is in question. This is relevant to the interests of many consumers. The China Consumers’ Association (CCA) will take actions to protect consumers’ rights and interests and promptly respond to the complaint”, said Yang Hongcan, secretary-general of the CCA. HP is now working with a Chinese government agency to resolve issues that customers have raised. Its statement came one day after China's General Administration of Quality Supervision, Inspection and Quarantine said it had received a complaint about quality problems in HP laptops, filed by a lawyer on behalf of 60 consumers. The agency is organizing an investigation, it said on its Web site. HP extended the warranties on motherboards in certain laptops in China as it came under increasing criticism. More details are under discussion. HP generates more than three-fifths of its revenue outside its U.S. home base. Last month, it said sales from fast-growing emerging countries Brazil, Russia, India and China leapt 41 percent from a year ago. I have made a change to the beginning of one paragraph simply because in my opinion it doesn’t look very stylish to start 3 paragraphs in a row with the same word, but feel free to change back.

Dell Taiwan R&D centre cuts jobs

O

n March 9, Dell Taiwan’s R&D centre announced that it is to lay off 10 percent of its research and development staff. This latest move came in spite of the company's previous announcement that it would continue expanding its R&D operation in Taiwan in order to branch into the 'cloud computing’ market . It is reported that the lay off has come about mainly because of Dell’s aim to focus more

16

resources in the Chinese mainland. Dell's decision to cut personnel at its 600-member research and development centre was also prompted by a plan to let contractors carry out more of the company’s R&D work. The company last month reported that its fourth-quarter profits slipped five percent year on year.

Review on the OA printing market of 2009 by Zhenzhi Yao, CCID Consulting Influenced by the international financial crisis, the OA printing market prices in China decreased as a whole in the first half of 2009, making the market value decrease in comparison with the same month of the previous year. User demand also reduced, making it harder for the manufacturer to promote their products. The market competition became fiercer, adding some warmth to the cold market. In the present article, Mr. Zhenzhi Yao, analyst of Computer Industry Research Center of CCID Consulting analyzes the general situation of the OA printing market in the first half of 2009. According to CCID Consulting statistics, OA printing market sales stood at 10,459,000 units in 2008, increasing by 1.9% compared with the previous year. The market witnessed a sharp drop. The sales in the first quarter of 2009 were 2,218,000 units, down 7.3% compared with the same quarter of the previous year, and the sales in the second quarter were 2,515,000 sets, decreasing by 2.2% compared with the same quarter of the previous year. Full swing in the field of commercial inkjet printing

printing. Another thing to factor in is that inkjet printing is superior to laser printing in terms of environmental considerations and energy saving. Firstly, ink cartridges do not create dust pollution like toner cartridges and they create less noise. Secondly, the power consumption of inkjet printing is only one twentieth of that of laser printing. These aspects not only contributed to the well-being of users but also saved on cost. Such advantages meant the commercial inkjet printing product became the choice for users under the financial crisis. Manufacturers took this opportunity to launch new products in succession to enhance their competitive power in the field. Canon (China) launched PIXMA MX868 (multifunctional) for the corporation department and group users, PIXMA MX328 (multifunctional) and PIXMA MX338

The international financial crisis brought great impact on the market, but provided a good chance for commercial inkjet printing to stand out. According to the statistical reports development chances and new vitality to the MFP market. According to CCID Consulting predictions, sales of MFPs of manufacturers such as HP, Canon, Epson and Fuji-Xerox, although the printing peripheral market was weak as a whole in the second half of 2009 would keep increasing and the in 2008, sales of MFPs all increased to some extent compared growth amplitude would also be enlarged. It was predicted with the same period of the previous year. According to CCID that the sales in the whole year would increased 16.1% Consulting statistics, the sales of both inkjet and laser MFPs compared with the previous year. increased by 38.5% and 12.3% respectively compared with the same period in the previous year. Due to the strong growth of the MFP market, the main inkjet printer manufacturers including HP, Canon and Epson increased their investment in the MFP market, enhanced promotion, significantly reduced the prices of low-class products and further promoted the development of the market. This meant market of MFPs continued to grow in the first half of 2009, but the growth was reduced to some extent by the onset of the international financial crisis. Seen from the perspective of different industry sectors, sales in the governmental sector increased significantly in the present quarter, due to the national policy of enlarging domestic demand, which also led to growth in the demand created by industries such as medicine, railways and environmental protection. Gradual variation of the situation of consumable industry

In 2009, the printing consumable industry was faced with great upheavals and challenges. In Zhuhai, which was dubbed the Global Centre of Printing Consumables, about one third of its consumable corporations went bankrupt in the first half of 2009, and the Zhuhai consumable industry, which had the annual sales of over ten billion(CNY ), was seriously hit for the first time. The influence of the international financial crisis on the Chinese consumable market came not only in terms of blocked exports and bankrupted corporations but also changed the industrial structure. On one hand, the manufacturers began to transfer their investments. Due to the increase in the costs of raw materials and labour and the complex procedures of import and export, many consumable

corporations began to invest in the emerging markets and the fields that were demonstrating an upwards trend. For example, Handan (which gathered Handan PhotoC Technologies Co., Ltd., Handan Hanguang OA Toner Co., Ltd., Beijing Laser Hi-Technology Co., Ltd., Tianjin Zhonghuan TCOA Eletronics Company Limited, Shandong Forever Technology Co., Ltd.) was striving to create a new consumables manufacturing base. On the other hand, the financial crisis resulted in a reshuffle of the industry, promoted industry reform and brought about the survival of the fittest among the corporations. The tide of reorganization and mergers of consumable corporations emerged again. Increasing demand for A3 size color printing

Although the market of A3 printing in the professional field was still small compared with that of A4 printing, some industries which needed A3 printing such as the financial industry, manufacturing industry and financial departments of government offices and large corporations began consuming more A3 printing in printing report forms, drawings and posters. Moreover, with the growth of the advertisement and printing business in our country, came new opportunities for A3 size printing. In March 2009, Brother (China) launched 14 kinds of color inkjet MFPs including four kinds of A3 size inkjet MFPs – DCP-6690CW, MFC-5890CN, MFC-6490CW and MFC6890CDW. This series was the first series of A3 size color inkjet MFP in the world. It not only satisfied the demand of the user but also filled the gap in the market for an A3 size inkjet MFP.

forced consumers to pay more attention to environmental protection. The development of the OA printing industry became healthier. It was the responsibility of manufacturers to reform products and the techniques to revitalize printers which were big consumers of energy and great polluters in the office. As printing equipment stands unused for long periods of time, one way of increasing environmental credentials was to ensure machines consumed less energy when standing by. For example, the Canon LBP series laser printer and HP OfficeJet series commercial inkjet MFP consumed no more than 3 Watt in standby mode. As well as energy consumption in standby mode, faster startup speeds also saved energy, which was important for medium and small scale corporations with less batch printing and more single printing. For example, zero-second startup printing in the standby mode would not only save energy but also improve the output speed of the first page. Although various manufacturers took different approaches, the similar rapid startup techniques had already been used by most of the large manufacturers and became a standard configuration prevalent in contemporary printing products. Duplex printing further reflected energy saving and environment protection, which not only prevented the possible errors involved in manual operation but also finished duplex printing with a speed close to that of the printing engine. Both the efficiency and accuracy were much higher than those of manual duplex printing. For a group which needed to print more than 10 thousand pages within a month, automatic duplex printing was a particularly efficient way to improve the working efficiency, make energy savings and increase environmental protection.

Energy saving drawn more attention

Under the international financial crisis managers of corporations were forced to think about the way they used resources. Operation and procurement sections in companies became more pragmatic. It became a prevailing trend to invest their limited capital in the places which needed capital most and to select products offering high cost performance, technical content, energy saving, environmentally friendly features and reasonable running costs. Saving energy saves costs, so the financial crisis www.recyclingtimes.com.cn | April 2010

Apart from printing speeds, first page rapid startup, total costs and duplex printing, each manufacturer paid attention to other aspects. For example, Lenovo concentrated on saving on consumables and launched the long-life toner cartridge and toner separation technique, largely reducing the losses made in consumable packages and toner cartridge exchanges. Samsung paid more attention to appearance and quiet design, enhancing the application experience by saving space and reducing noise pollution. OKI focused on LED printing techniques and saved energy in the printing process. With the increasing attention on energy saving and the environment from users and manufacturers alike, the OA printing market has become significantly greener. Diversity in user demand

Printers and MFPs were always the products with briskest demand in OA and belonged to a market drawing the most attention in the industry. In the first half of 2009, seen from the development of printing products, demand is more and more diversified. Actually, the printing peripheral market

became more mature thanks to competition on technical specification and price, the quality of the products became more uniform and the profit margins lowered. In 2009, with most industries and corporations reducing procurement, it became the key point of the competition among manufacturers and ways to enhance the service and costomer loyalty Therefore, it became the competition strategy in the printing peripheral market to provide multilevel, multi-price and diverse products and to design different solutions according to the demand of the Chinese users. Products would sell well if they satisfied user demand in photo printing, tag printing and disk printing. Canon again launched the update to photo printer CP76 SELPHY CP780 - with richer external color and advanced usability. Brother (China) launched the first tag printer, PT2430PC with plug-and-play function in the industry and Epson launched a new product, Epson Discproducer™ PP100 disk printing CD writer. Photo printing, tag printing and disk printing not only enrich the product line but also satisfy the diverse demands of the users. After the first half of 2009, the OA printing market was really in a difficult situation under the impact of international financial crisis. However, the rapid growth of commercial inkjet printing, the continual growth of MFP products and the diversity of user demands brought about hope for the industry. Under the stimulus of national policies to enlarge domestic demand and other policy measures and with the efforts of all the manufacturers it is believed that the OA printing market will recover from the financial crisis in 2009.

Zhenzhi Yao Zhenzhi Yao is an analyst at the Computer Industry Research Center of CCID Consulting, mainly engaged in the analysis and research on the OA peripherals market. The research fields include MFP, fax machine and printing consumables. He has led and participated in many projects including market consultation and monitoring on OA peripheral products, analysis on user demand, corporation development strategy, etc.

The cartridges’ remanufacturing industry in Brazil by Flavio Oliveira Recycler China presents you with an overview on the state of the Brazilian cartridge industry, the obstacles experienced by a few players and how they have overcome them plus an outline of its prospects for 2010. Brazil, an immense country and full of contrasts

Brazil, or as it is officially named, “The Federal Republic of Brazil” is not only the largest country but also the largest economy, population and consequently aftermarket in South America. It is flanked by the Atlantic Ocean on the east and shares a border with every country in South America, except for Ecuador and Chile. Size, relief, climate, and natural resources are as diverse in Brazil as its culture, ethnical and social characteristics. Brazil is a country full of contrasts. It is possible to visit high mountains with cold temperatures and within a 1 or 2 hour flight be in a totally different region with tropical settings and exotic beaches. Brazil is considered to be the fifth-largest country in the world in terms of land surface and in number of inhabitants, with a population of more than 190 million people. It is the world's tenth largest economy in terms of market exchange rates and the ninth largest when measured by purchasing power parity. In the last couple of years the Federal Government has brought into effect measures to open its market and to stimulate foreign investment. These actions have directly affected the country’s economy in a quite positive way. Brazil has been showing noteworthy monetary growth and was the first emergent country to receive a positive credit rating after the world economic crisis. Brazil is also home to a varied assortment of flora and fauna, natural environments, and extensive natural resources. It shares some characteristics with its neighbors in South America, such as: most of its populace is catholic and extremely urbanized (around 85%). Strong social contrasts also exist. Brazil has an astounding coastline with over

24

1-19.indd 24

4,655 miles (7,491 kilometers), bounded by the Atlantic Ocean. It boasts all kinds of picturesque landscapes, from amazing beaches to deep forest sites. Add to this a friendly populace and a considerable growing economy and you have some worthy motives to get to know this country better. Cartridge remanufacturing in Brazil

Brazil has a giant cartridge remanufacturing industry, encompassing more than 10,000 formally registered companies within the printer and cartridge sector (there is no specific sector for cartridge remanufacturing under Brazilian working laws, at least not yet). This sector directly employs nearly 100,000 people who are getting organized in terms of creating new syndicates, and getting more engagement from the sector’s businessmen. The Brazilian remanufacturing industry has been gaining strength and respect in the last few years due to continued work from associations (ABRECI and AGRECI) and companies and remanufacturers that have been offering high quality services through the usage of the right techniques.

The other is Brazil’s South Region Cartridge Remanufacturers Association, named AGRECI (www.agreci.com.br). Some new improvements have been made, like the creation of support for the day-to-day employers and employees from Sao Paulo State and two syndicates have been created in Sao Paulo, in the last 18 months. The first of these is SINTERCISP, the Printer Cartridge Recycling Companies’ Employees Syndicate from Sao Paulo which aims to provide support to professionals working within the cartridge remanufacturing industry – for more information, please visit SINTERCISP’s website: www.sintercisp.org.br. The second, SERCISP, is the Printer Cartridge Recycling Companies Syndicate from Sao Paulo and it intends to give assistance to the companies. This syndicate is still in its early stages of creation, therefore there is not much information on its actions and projects yet – follow activities through its webpage: www.sercisp.org.br. So far these two syndicates are active only in Sao Paulo state. However, the creation of other syndicates around the country is very likely to be seen in the near future as there is now a model to follow from now on. Brazilian companies and society trust remanufactured goods more, Consequently, more and more consumers are changing from the OEMs to use remanufactured cartridges. Market, quality management and reliability

The aftermarket in Brazil is starting to mature. Labour syndicates, remanufacturers’ associations, events like ReBrasil and ReciclaMais, techniques shared between suppliers and remanufacturers are evidence of how the industry is endeavoring to progress. Quality is a still a theme that deserves great attention in Brazil. There is a considerable slice of the market that is deficient in professionalism, technical know-how and quality control when talking about cartridge remanufacturing. The credibility of the remanufactured products in Brazil is partially affected because of those companies that are not technically prepared to work with cartridge remanufacturing. However, there is another serious and competent segment of the industry that does exactly the opposite, executing the right techniques and using high quality supplies, providing a good service and products. These serious companies are

working very hard to change the whole scenario: making clients satisfied through offering quality products, changing people’s minds about remanufactured goods and sharing technical know-how. Companies offering low quality services do not last, the companies that have been in the market for more than 10 years in Brazil are usually those who have been providing good products and/or services. It is important to remark that the share of market of remanufactured cartridges in relation to OEM’s was 25% at the end of 2008, though some professionals said at the time the research was done that it was only around 20%. Anyway, what is clear is that there is a large slice of the market waiting to be conquered by remanufacturers in the Brazilian printing industry. Corporate and public buyers are not regular buyers of remanufactured goods as some old laws forbid public institutions from acquiring used products – and remanufactured cartridges may be taken as a used product. However, they do leave a smaller carbon footprint and significantly expand the usage capacity of the cartridges. In terms of the economic recession and its effects in Brazil, there are different opinions. Some companies were much more affected than others by the negative effects generated by the world economic situation. Some companies did suffer much more than others, as explains Daniel Constantino from DRG/RECOM group: “Early on the world’s economic www.recyclingtimes.com.cn | April 2010

reflect that afterwards, in general, it showed to have been positive for the remanufacturing industry as many companies sourced remanufactured cartridges as an alternative way of achieving cost reduction”. There is a great potential, as a very large part of the market still consumes only original products. This is about to change as many companies have been doing a serious, organized, technically superior and specialized service in cartridge remanufacturing. When asked about the key to achieving good results these days, Varela, said: “At the moment companies and businessmen are searching for a cheaper alternative to reduce printing costs. The remanufacturers that knew how to take advantage of this opportunity have reacted to this demand in a positive, reliable and professional way. Those who have proved that a remanufactured cartridge can be as good or even better than OEM, today have loyal and satisfied clients”. downturn was concretely felt in Brazil - in the second semester of 2008. Before the crisis took place in Brazil, Our expectations for 2009 were to grow nearly 40%. However, after the economic recession wave passed the numbers have changed quite a lot. In the last months of 2009 the market started to regain strength, which gives an indication that in 2010 things will look up again for us”. Other companies, for instance Master Ink and Diamond Brasil have presented satisfactory outcomes in 2009. “Our market has grown much more than we had previously expected in 2008. We had a 50% growth in 2009. We believe that economic issues may bring some benefits to the cartridge remanufacturing industry as many companies start to buy remanufactured goods as an alternative to expensive OEM products”, said Jackson Marega, Commercial Director of Master Ink. Continuing in a positive vein, Eduardo Varela, Commercial Director of Diamond Brasil affirmed: “The market data show us that 2009 presented a growth beyond what was previously expected. If we take into account the fear of what consequences the economical downturn would bring and

What to expect in 2010

An economic crisis; a change in strategies; difficulties to survive on one side, unexpected higher results on another. A wave of uncertainty has flowed over companies of all kinds in the last couple of dozen months. In Brazil, the economy was stable in the last semester of 2009 and started to regain its growth in the end of 2009. The Brazilian cartridge remanufacturing industry is vast and occupies a market that is still growing. There are numerous opportunities available to new players intending to be part of this important market. The Brazilian industry is expected to regain the growth rate experienced before the crisis which hovered around 25-30%. The general mood in the Brazilian industry is that 2010 has a great potential of being better than 2009 was. Hopefully, this year will be a year of recovery and responsible development for the whole world.

Company profiles of Hanguang ——Interviewing Handan Hanguang OA Toner Co., Ltd Handan Hanguang OA Toner Co., Ltd., a famous, long-established professional Chinese toner manufacturer, is now a large-scale R&D and manufacturing corporation that boasts a large production capacity and advanced equipment. In the last 30 years, the difficult path taken by Hanguang has reflected that taken by the toner industry in China. It has had to grapple with the introduction of production lines and techniques, absorption, localization and independent R&D. By the end of 2008 the annual total production capacity of Hanguang has reached 2,000 tons. How has Hanguang always kept itself ahead of its competitors in the changing international and domestic toner market? As a former state-owned corporation, how has it coped with fierce market competition? How could Hanguang go further with its dream of invigorating the native toner industry? We interviewed the general manager of Handan Hanguang OA Toner Co., Ltd, Mr. Shouming Xu to find out. Brilliant history

In 1972, the first selenium-xerographic duplicator came into being in Hanguang, and the eyes of the whole country were on Handan. Since this point, Handan has been fated to become a special being in the Chinese consumables industry. Although Handan is located in the Northern corner of the country, far from the Pearl River Delta and Yangtze River Delta where the consumable industry has tended to cluster, it has kept going over 30 years and always maintained a leading position in the industry. Today, when people mention duplicators, they will think of Handan, and when they mention Handan, they will think of Hanguang. The history of toner manufacturing of Handan Hanguang OA Toner Co., Ltd. can be traced back to 1982. In 1980, Hangang began to cooperate with Sanyo Japan, manufacturing and selling Sanyo series duplicators. In 1982, Hanguang began to produce toner for Sanyo Japan. In 1984, it cooperated with

28

1-19.indd 28

Konishiroku Japan, manufacturing and selling the Hanguang Graceful series duplicators. In 1987, Hanguang introduced four production lines including a general assembly line for duplicators, a toner cartridge line, a toner line and a carrier line. Using manufacturing techniques from Konica it became the OEM factory for Hanguang Graceful series duplicator consumables. From the introduction of foreign production lines and techniques to independent innovation, Hanguang was always groping its way, which was a long and difficult process. In 1996, it began to produce and sell the electropositive toners for Konica OPC duplicators. Since then, Hanguang has enhanced its investment in the R&D and manufacturing of toner, having developed toners for duplicators by Toshiba, Sharp, Ricoh and Minolta in succession. In 1999, the annual production capacity of Hanguang toner was 100 tons. In order to enlarge the production capacity, Hanguang organized its technicians to reform the production lines on their own. In 2002, the production capacity of toner was doubled, reaching an annual capacity of 200 tons. In 2004, Hanguang Machinery Plant and China Shipbuilding Industry Corporation(CSIC) jointly invested 10 million Yuan to introduce the latest fully automatic toner line from Alpine Germany, whose annual production capacity was 500 tons. With the growth of market demand, Hanguang introduced a third production line from Germany in 2007, and its annual production capacity was 1,000 tons. Thus, the current annual production capacity of Hanguang toner has reached 2,000 tons and Hanguang has become a large-scale R&D and manufacturing corporation second to none in terms of both production scale and the advancement of its equipment.

Mr. Xu entered Hanguang in 1995. He has always been engaging in the research of toner technique and is an established expert in the industry. He is there during the 23 years when Hanguang developed fastest and it could be said that he has grown alongside Hanguang. Expertise demonstrates quality of Hanguang

When I asked how Hanguang sustained such rapid growth for many years, Mr. Xu told me a short story. “At one time, a foreign client came to visit Hanguang. When I served him, he sincerely said that, ‘if Hanguang succeeds in the toner industry, China will succeed in the toner industry’. Such a simple analogy made me think that in the opinion of the client Hanguang toner was the representative of Chinese toner. I kept these words in mind for many years. Therefore, we always take responsibility and make it our mission to work not only on our administration and R&D but also on improvement of production and sales of products. We hope that the whole world will think that they can buy good consumable products in China, not necessarily cheap products.” “Good” products mean good quality, good price and good cost performance and it is this sense of mission to invigorate the national toner industry that has encouraged Hanguang to keep pursuing new techniques and higher quality. Hanguang succeeded due to its expertise. The company has had 30 years’ production experience with duplicators and consumable products. At present, the professional R&D members in the Hanguang R&D center total more than 10% of the whole staff. The toners produced with the self-owned core technologies have already been able to replace imported products completely. Recently, the universal toner applicable for HP P1008/1505/1007/1522/1006 series launched by Hanguang used the physical spheroidizing technique and skillfully integrated the advantages of two toner production methods, that is, the low cost of the physical production method and the good image quality of the chemical method. The original binding toners for the above HP series were produced in the chemical method. When Hanguang developed the HP-TC toner applicable for the series, the physical spheroidizing technique was used, thus improving the particle shape. The produced toners provided with high blackness, firm fixation and less background, which made the image quality closer to that formed in the chemical method. Besides attention to technical R&D, Mr. Xu also focused on controlling product quality. He said that, “In the production of toner, all the materials and production steps require operators to process. It is hard to imagine that stable, high-

quality products such as toner could be produced only by several senior engineers.” What impressed him most in the past years was steadfast attention to quality control. The main raw materials in the Hanguang recipes came mainly from large, well-known international companies and large domestic companies in the industry. For all the incoming raw materials, all the indexes were confirmed through measuring characteristics such as melt index and softening point. Raw materials could not be transferred to the storage for use until they were qualified through analysis and quality monitoring. Hanguang gained ISO 9001: 2000 international quality certification and ISO 14001: 2004 international environment management certification in succession, and strictly conformed to the corresponding standards in its production. Services characterize Hanguang brand

Being the only state-held professional copying and printing toner manufacturer in the country provided Hanguang with advantages in capital, technical R&D and credit. Hanguang bolstered this with credible management. Mr. Xu said, “We would rather suffer loss ourselves than let faulty products enter the market.” This philosophy was not only a promise for users but also drove every member of staff to work well in each step of quality control. The sales system of Hangang was quite unique. Hanguang established a great sales network both at home and abroad, with products sold to the countries and districts in Europe, America and Southeast Asia. However, they achieved this not with salesman but with professional customer service centers. Regarding this point, Mr. Xu has his own opinion, “Many big companies in Japan do not have salesman but make www.recyclingtimes.com.cn | April 2010

provision for after service support. The marketing system of our company has learned from this model. We focus on products and services. Quality is the greatest support for sales. We own a professional team with about 30 years of R&D history in duplicating, which provides powerful technical support and after service care. Customers sometimes may have problems unrelated to Hanguang producets, such as the state of duplicator, but our service staff would still be able to help.” Such considerable service gains Hanguang products a good name. “Our old customers will continue to cooperate with us for a very long time. Moreover, new customers will turn to us because of the products and reputation of Hanguang.”

30

1-19.indd 30

As Hanguang’s market share in the Pearl River Delta increased steadily, Hanguang established a storage facility in Guangzhou at the beginning of 2008. Thus, customers in Guangdong could receive products within the day or on the next day, which largely improved the efficiency of customer service. At present, Hanguang plans to establish a fourth production line with a 1,000 tons annual production capacity. It was predicted that the annual production capacity of Hanguang would have reached 3,000 tons by 2009. As to the future, Mr. Xu said, “Although Hanguang ranks first in our country, we still fall behind the best international toner corporations. We hope that through continuously improving our techniques and production capacity we will catch up with them as soon as possible.” At the end of the interview, Mr. Xu said firmly, “We will devote ourselves to the invigoration of national toner industry.” It was a dream of the toner corporation, a dream of the consumable industry and a dream of the national industry. In the fierce competition of the consumables market, the corporations that follow big dreams provide us with much confidence. There must be a larger platform for such corporations.

Case analysis on patent application strategy (part 1) By Helen Duan, INNOPAT Intellectual Property Patent priorities can be thoroughly enjoyed if a good application type has been chosen. The PCT (Patent Cooperation Treaty) application method can be used to apply for a foreign patent. If the patent has wide prospects in the US market, the USA patent system could be exploited to gain protection for multiple invention subjects. In this review, lawyers Shuhua Duan and Jinxia Gong of Zhuhai INNOPAT Intellectual Property Co., Ltd. explain which strategies can be used in the application of patents. In modern society, research on patent application strategies has become an important component of patent work in corporations. Corporations benefit by performing patent strategies better, developing marketing activities and enhancing competitive power in domestic markets and even more so in foreign markets. Here we show you some patent application strategies garnered from our intellectual property work in recent years and analyze these strategies with case examples. 1. Choose the appropriate application type to take advantage of priority • Case: Application for Chinese patent

(1) A client invented a product with wide market prospects and consigned the application for Chinese patent A for invention to us, then the applicant improved patent A. We took advantage of the provisions in Article 29 in Chinese Patent Law, which stipulated that “Where, within twelve months from the date on which any applicant first filed in a foreign country an application for a patent for invention or utility model, or within six months from the date on which any applicant first filed in a foreign country an application for a patent for design, he or it files in China an application for a patent for the same subject matter, he or it may, in accordance with any agreement concluded

32

between the said foreign country and China, or in accordance with any international treaty to which both countries are party, or on the basis of the principle of mutual recognition of the right of priority, enjoy a right of priority. Where, within twelve months from the date on which any applicant first filed in China an application for a patent for invention or utility model, he or it files with the Patent Administration Department Under the State Council an application for a patent for the same subject matter, he or it may enjoy a right of priority, applied for patent B for invention to State Intellectual Property Office again with patent A as priority within one year. This allowed the applicant to fully enjoy the earliest applicant date whilst protecting both the original and improved schemes economically. Moreover, since patent B claimed the patent application A as the priority with one year, after the patent B is granted, the invention is equal to be protected about 21

years.” (2) When we applied for the patent for invention, we also applied for utility model patent in China as it takes more time to get the former than the latter. The utility model patent was approved more than two years earlier than the patent for invention, and it even won the gold award for patent in Guangdong. • Strategy analysis:

(1) Article 29 of Chinese Patent Law provides that where , within twelve months from the date on which any applicant first filed in a foreign country an application for a Patent for invention or utility model, or within six months from the date on which any applicant first filed in a foreign country an application for a patent for design, he or it files in China an application for a patent for the same subject matter, he or it may, in accordance with any agreement concluded between the said foreign country and China, or in accordance with any international treaty to which both countries are party, or on the basis of the principle of mutual recognition of the right of priority, enjoy a right of priority. Where, within twelve months from the date on which any applicant first filed in China an application for a patent for invention or utility model, he or it files with the State Intellectual Property Office of the People’s Republic of China an application for a patent for the same subject matter, he or it may enjoy a right of priority. According to the above provision, if a corporation wanted to enjoy the priority for a patent for invention or a utility model patent, the corporation would have 12 months to prepare for it. Even if the corporation thought that the first patent was not ideal, the corporation could apply and claimed the first patent as the priority within 12 months. (2) Both the formal examination and the substantive examination should be performed in order to win a patent for invention. This method takes more time to finish the examinations, has high requirements for the creativity and the protection period is longer. However, only the formal examination was necessary for a utility model patent. It took less time to finish the examination for the utility model

patent. It had lower requirements for the creativity and the protection period was shorter. As a strategy for patent application, more and more people began to apply for both patent for invention and utility model patents. The advantage of this strategy was that the patent could be protected earlier with the utility model patent, and even if the applicant could not win the patent for invention due to low creativity, it could still be protected by the utility model patent. 2. Applying for foreign patents through PCT • Case: PCT application

A client submitted an application for the PCT international patent with a Chinese utility model patent as the priority. The international searching organization issued a searching report for the PCT application. Moreover, we submitted the requisition for international primary examination to www.recyclingtimes.com.cn | April 2010

the international primary examination organization. The international primary examination organization issued the international primary examination report. The similarities and differences between the international searching report and the international primary examination report on the PCT application were as Figure A shows: It can be seen from Figure A that the results of the two reports on the three characteristics of the patent were the same. As the results of the reports were positive, the client finally succeeded in applying for patents in Europe, America and Japan through PCT with the report as reference. • Strategy analysis 1. The international phase was the first phase of the international application and approval procedure. It included the necessary processes including acceptance of international application, formal examination, international searching and international publishing and the optional process of international primary examination. 2. The international searching was that China Patent Bureau searched for the subject of international application according to the provisions of the treaty, found the contrastive references related to the subject and pointed out the degree of correlation. Generally, China Patent Bureau finished the international searching report within 4 months after the date of international application. The international primary examination was that China Patent Bureau examined the international application according to the request of the applicant, and gave primary and unbinding opinions Name of report

on whether the invention to be protected was of novelty, creativity and industrial practicality. The aid for the applicant in the aspect of application in the national phase was from the “opinions” in the international searching report. The international primary examinational report only reviewed the three characteristics of the patent according to the document cited by the international searching report. IF the related documents in the international searching report was type A, it could be concluded that the patent were of the three characteristics. As the results of the international searching report and the international primary examination report were the same, it was not necessary to submit the request for international primary examination, thus saving the cost of international primary examination. 3. Take full advantage of the USA patent system to win protection on several invention subjects • Case: Application for USA patent

A client applied for a USA patent for an invention with good market prospects in the USA. As the technical data was still incomplete, we first submitted a provisional application (PPA) to the United States Patent and Trademark Office, then submitted the formal application (PA) one year later. In response to the PA, the US Patent and Trademark Office issued examination comments. We immediately answered the comments and communicated with the examiner. Finally it was rejected. However, we submitted the application, that is, the continuation-in-part application (CIP), for the

subsequent part of the PA according to the first examination comments just after the answering the first examination comments. The CIP used the PPA and PA as the priority and entered the USA national phase through PCT. Meanwhile, after we received the notice on the final rejection of the PA from the US Patent and Trademark Office, we immediately submitted the continuation application (hereinafter referred to as CP) for the PA. The CP used the above PPA and PA as the priority and requested three priorities in China. The US Patent and Trademark Office thought that claim A and B of the CIP were not about the same subject as the first examination comments on the CIP, and required us to divide the application. The client finally asked to keep claim B and give up on claim A. However, the US Patent and Trademark Office thought that claim B contained 8 invention contents and asked us to choose one to be examined. The other invention contents had to be processed individually. The client chose claim B1 and B2 with the same invention content. However, the US Patent and Trademark Office thought that only one claim of B1 was of patentability and rejected claim B2. We amended according to the requirements of the examiner and insisted that claim B2 be of patentability. Finally, the United States Patent and Trademark Office agreed with us and accepted both claim B1 and B2. The CIP was finally approved. The US Patent and Trademark Office also issued the first

examination comments on the CP, and thought that claim C and claim D were about two different protection subjects and lacked singularity. They therefore asked us to choose one. The client finally asked to keep claim C. However, the examiner accepted claim C1 and rejected claim C2. We immediately amended the application according to the requirements of the examiner, kept claim C1 and gave up claim C2. Finally, the United States Patent and Trademark Office accepted our application and accepted claim C1. This CP was also finally approved. Finally, the contents protected by the above CIP and CP and the contents to be protected by the original rejected PA was almost the same. Through the application of patent application strategy, we protected the rights of the patent applicants to the best advantage. • Strategy analysis:

During the USA patent application the PPA route can be selected. This has fewer requirements and costs less than PA. PA could then be submitted within one year of the submission of PPA. The USA patent application submitted for the first time should contain as many contents as possible, and then the CIP or CP can be submitted. Thus, the protection on several invention subjects can be realized.

Remanufacturing the Konica Minolta Magicolor 1600W black and color toner cartridges First released in November 2008, the Magicolor 1600 series of machines are based on a 20ppm Black 5ppm color print engine. The 1600 series has a base resolution of 600 x 600 Dpi, Enhanced resolution of 1200 x 600Dpi. The MF machines are multifunction with scanners, copiers and fax built in. All models have a recommended monthly duty style of 35,000 pages/month. These machines are all based on the old carousel type system where the toner cartridges rotate and feed a single drum cartridge. This system is slower than the newer systems, but the costs for the cartridges are less. (One drum unit for all) The machines based on the 1600 series engine are: Magicolor 1600W, Magicolor 1650EN, Magicolor 1680 MF, Magicolor 1690 MF, Magicolor 1600W, Magicolor 1650EN, Magicolor 1680 MF, Magicolor 1690 MF. There are High yield cartridges as well as low yield cartridges available. In addition to the toner cartridges, there is also a separate drum unit as well as a waste box. The cartridges used by these machines by region are as follows: This is the first machine I have seen where China has its own region set aside for cartridges. Cartridge Type
