No-fault divorce WHERE THERE’S NO BLAME, HOW CAN DIVORCES PROCEED? TERESA DAVIDSON, FAMILY LAW PARTNER AT IRWIN MITCHELL PRIVATE WEALTH, EXPLORES THE ISSUE. he issue of no-fault divorce has been widely discussed by the public and lawyers alike for some time now. The recent highly publicised case of Owens v Owens has highlighted the problems which arise in relation to the divorce legislation as it is currently. Mr and Mrs Owens received plenty of media coverage when Mrs Owens was not able to divorce her husband because the court said that her husband had not behaved unreasonably enough to cause the marriage to break down. Mr Owens did not want to divorce and refused to provide his agreement to the divorce. The law currently states that there is one ground for divorce – that the marriage has irretrievably broken down – and to prove this, you have to rely on one of five facts: adultery, unreasonable behaviour, desertion (which is rarely used in practice), two years’ separation with consent and five years’ separation without consent. Both adultery and unreasonable behaviour are deemed to be “fault” based facts whereas the others are “no-fault”. It is not possible for a couple to separate and to then be able to divorce using a nofault divorce fact immediately. To enable someone to divorce straight away they need to say the other person is at fault. Many couples approach their lawyers now

with a view that a divorce should be granted immediately without any blame on either side – for instance because they have grown apart. Unfortunately, the law does not fit with that approach. Whilst it is usual for one party to think of some examples of unreasonable behaviour to include in a petition, which would allow the proceedings to start straight away, it can unnecessarily increase the hostility between the parties. The matrimonial law dealing with divorce dates back to 1973 and in light of the change to social attitudes since then many believe it is in need of updating. Many groups have lobbied parliament to change the law including Resolution, an organisation who are committed to the constructive resolution of family disputes, but with no avail to date. The case of Owens, however, does highlight the need to ensure that a person thinks carefully about whether they can satisfy the unreasonable behaviour requirement and prove that it is for this reason that the marriage has broken down. If not, they leave themselves open to the risk that the court will decide that they are unable to divorce. Mrs Owens has been granted permission to appeal to the Supreme Court for them to decide on this issue and it is unclear as to the route the court will take; will they allow the divorce to proceed or will

they continue to say the ground for divorce has not been made out? Either way, it is hoped that this case will prompt parliament to reconsider the issue of no-fault divorce. Couples who divorce also need to remember that the divorce itself does not resolve any financial claims they may have against each other. Those claims are available often years after the divorce has been finalised. Even when one of the couple believes everything was agreed at the time they could find themselves back in court years later dealing with historic financial claims, perhaps because they have then come into money or property they did not have before. Legal advice should be obtained to ensure that cannot happen and the finances, as well as the divorce, are sorted out so everyone can rest easy that they will not find themselves in court many years later. This is never truer than at Christmas as each December, Rusby embarks on a popular Christmas tour across the UK. Her Christmas concerts bring the festive season to life, resulting in a spellbinding, magical evening for all involved. Here, she gives us into an insight into her career influences, inspirations and what to expect from this year’s tour.

What inspired your new album Angels and Men?

We have the most fantastic tradition in South Yorkshire of singing rare carols in pubs, starting the weekend after Armistice Day carrying on though until New Year’s Day. The songs were at one time widely known up and down the country but the Victorians threw them out of the churches for being too happy, so, the people who loved singing them took them to the pubs where they could combine singing with beer - there the songs have remained, passed on down the generations. Christmas is a time we can gather together as a family, leave work behind and we cook and sing, open presents and sing, drink wine and sing, walk to the pub and sing. You get the picture, I just adore Christmas, it was always made magical for us - we had no money at all growing up but my parents

always created a sparkle. Who has been the biggest influence on your music?

Apart from my parents who both sing and play, it has to be Nic Jones. He’s an incredible guitar player and when he sang, it was as if he was just telling you about something that happened to a mate. He had a bad car accident over 30 years ago and was in a coma for a long time. He could never play like he once did but when he did come back he sang on my album 20, joining me on a song called Lark. When he started singing I couldn’t help but shed a few tears, it was a ‘dream come true’ moment and so amazing to hear him sing again. What are some of your career highlights especially over the Christmas period?

Apart from being made a Patron of Yorkshire, and a Freeman of the Borough of Barnsley last year, I think the highlight is that we are celebrating 25 years of touring. When I started out all those years ago we had no idea what would happen, we set up our own record company – Pure Records, for which all my family still work. The music that my parents gave me has then employed us all andwhat we have achieved over the years as a family and as a team fills me with pride. The last gig of this year will be very special too, it will be the last gig of the Christmas tour, and the end of the 25th year so we are streaming it. I’m very lucky and humbled by the support from fans over the years.

What’s the appeal of the festive season for you?

I adore sharing these songs with the rest of the country. Apart from South Yorkshire the only other place that has this tradition is Cornwall. I love going back to a town where we sang the songs previously, because the audience all join in the choruses - It’s one of my guilty pleasures to hear people singing these amazing songs back to us as we travel around. We always have a brass quintet with us at Christmas so that’s always just gorgeous too, being a Yorkshire lass from a mining background, I find the sound of brass instruments so moving. What can we expect from this year’s festive tour?

Well we have the new album out so there will be loads of new songs to play, can’t wait, and of course stories and laughs a plenty. Sparkles and twinkles galore!

That’s why LeedsBID (Leeds Business Improvement District) is collaborating with local artists for an unprecedented advent with the arrival of immersive art and light installations around the city, bringing added sparkle, originality and innovation to the festive season and encouraging people to create and experience their own special festive moments. Leeds Winter Moments – Christmas In Leeds is a new project which will create moments of wonder, magic, joy, surprise, escape and beauty for all ages by guiding people around the city centre, while also showcasing the incredible talent of local creatives. From the simple beauty of Frost Blossoms in Park Square to the Nordic-inspired indulgence of Arctic Bazaar, complete with marketplace, hot chocolate bar and sweet bites, to the magical draping of white lights

on the iconic Queens Hotel and the playful performance of ‘Illuminate Us’ on the Platform Building above Leeds Station, this is an exciting and hugely ambitious project for the city. There is also the welcome return of some firm favourites from Christmas in Leeds 2016 with the ethereal SPIRIT flying high in a new location in Victoria Quarter, the delicate tree lights adorning Park Square and the fun festive light projections dancing on the historic lifting tower in Wellington Place.

Alison Smith is the artist behind Frost Blossoms and Candy Chaos. The Frost Blossoms will be hung in the central area of Park Square, while Candy Chaos is made up of three explosive and colourful lanterns that will be hung in Park Plaza Hotel’s window as part of their candy cane theme. “Candy Chaos is a playful nod to the messiness of Christmas,” says Alison. “I've sourced most of the materials through Scrap Creative Reuse, a local social enterprise who intercept waste from trade and sell it on to artists and teachers. The cellophane used in the lanterns is actually discarded material from the Quality Street factory in Halifax. “Frost Blossoms is a light installation crafted from recycled single-use plastic packaging. Spiky, fuzzy clusters will cling to the trees, casting the centre of Park Square in an icy glow. It's a development of Textures of Winter, the installation I created for last year's trail, and mimics the textures of ice and frost.” “Through most of my work, I explore the idea of materials having a ‘life-cycle’, and how absurd it is that we produce so much

plastic which is destined to be used once then thrown away. I find unwanted materials and transform them in some way, returning them to a more ‘natural’ state and highlight the potential that lies in what we discard.” And after following this festive trail outside, why not warm up by entering a mysterious world of warming spices, salted liquorice and black ice. Arctic Bazaar based at the Art Hostel on Kirkgate, is made up of a Scandinavian cafe, art installations, local arts marketplace, and a mobile sauna, where you can sit, relax and enjoy some festive Fika (hot drinks and homemade bakes). The artists behind Arctic Bazaar aim to create an inclusive, religion-free space that focuses on the beauty of winter and the Scandinavian themes of Lagom and Hygge, which conjure up images of snuggling up indoors. “Arctic Bazaar invites you to take a moment’s respite from the festive chaos and explore a Nordic world,” say creators Helen Russell Brown and Raf Bogan. “Guests are encouraged to linger and reconnect with the true sentiments of the season. The space is created in collaboration with artists, makers and designers and offers an alternative marketplace that focuses on supporting the local arts scene.” Arctic Bazaar was partly inspired by Helen’s six-month trip to Lapland, Finland, where she fell in love with Scandinavian winter concepts of togetherness, warmth, and a connection to nature. Hoping to carry these true sentiments of the season to Leeds, while showcasing a wealth of local artistic talent and providing a platform for independent makers, Arctic Bazaar was born – a destination to pick up unique festive gifts and reconnect to loved ones over a spiced hot chocolate. LeedsBID has been working with a number of other key partners including, East Street

Arts, Leeds Arts University, NEWSUBSTANCE, Lumen, David Shearing, David Lynch, Cefn Hoile and Suzie Cross, The Glass Cyphers, Leeds City Council and key retailers, to create the installations and bring something a little different to the city for Christmas. “LeedsBID has been working with businesses from different areas of the city to bring new animation to the Christmas experience in Leeds,” added LeedsBID chief executive Andrew Cooper. “It is vital we create special moments for those people who come to Leeds over the festive season – to stay, shop, explore and enjoy the city.” Members of the public will be able to pick up maps detailing all the installations across the city centre, including hotels and the Visitor Information Centre (Visit Leeds & Art Gallery Shop), as well as being able to download a digital version from www.christmas.welcometoleeds.co.uk. Scarborough football and raft race If you fancy a bracing walk along the seafront followed by good, old-fashioned, eccentric sporting action, Scarborough’s annual Boxing Day celebration is one of the biggest events on their calendar. Watch the Fishermen versus Firemen Boxing Day football match, which kicks off at 10.30am on Scarborough’s South Bay Beach. The match is Scarborough’s oldest surviving custom, having first been played on Christmas Day in 1893. The teams will be serenaded by the Comic Band as they parade down Newborough before the match, with a collection for the Fishermen and Firemen Charity Fund along the way. After the football, it’s the unusual Boxing Day Crazy Raft Race, organised by the Sub Aqua Club. Each year, crowds flock to the harbourside to watch teams battle to win the race on their homemade rafts – often pelting their competitors with eggs and flour along the way. WINTER WALKS AROUND NIDDERDALE After being sat around for a few days, stuffing our faces with turkey and chocolates, a walk is the perfect way to blow off the cobwebs. There is no limit to the number of different walks you can enjoy in the Nidderdale Area of Outstanding Natural Beauty (AONB).

With hundreds of miles of footpaths and vast access land, combined with the beautiful winter weather, it makes the idyllic walk. The Nidderdale Way is a challenging circular walk at 53 miles, but it’s certainly worth taking in Pateley Bridge, where this walk begins/ends. Fewston Reservoir in the middle of Washburn Valley is another fantastic area offering a number of relaxing paths along the side of the water and through the woods. Firecracker ball raises over £270,000 for Barnardo’s One of the biggest and brightest charitable events in the region’s calendar took place at Rudding Park Hotel, Harrogate and once again Yorkshire dug deep – with early indications showing over £270,000 raised in aid of Barnardo’s. This year over 800 guests were transported to wonderland, through the rabbit hole and into the marquee attached to the hotel. Barnardo’s vice president and chair of the Firecracker Ball committee, Phil Taylor said: “Every year we begin the planning and think how on earth can we even come close to what we did last year? And every year I wake up the day after and count myself lucky to

have such an amazing committee working so very hard to pull it all together and, of course, the astonishing generosity of the people of Yorkshire who come every year and dig so very, very deep for such a wonderful charity.” Christopher Biggins joined the night via video link and thanked the people of Yorkshire for their continuing support and urged them to dig deep when the auction began. His words certainly had an impact, with the eleven lots publicly auctioned raising virtually over £100,000 in less than half an hour. The Firecracker Ball has raised more than £2.5m for Barnados since 2002

How long have you been a radiographer?

I’ve worked as a radiographer for the past 18 years. After I studied Diagnostic Radiography at Bradford University and worked at St. James University Hospital, Leeds, I was lucky enough to travel Australia and New Zealand working as a radiographer. I regularly scan neuro cases, but my main passion is sport, so my career highlight todate was definitely being the Lead MRI Radiographer at the London 2012 Olympic and Paralympic Games. I was based in the Olympic Village, scanning athletes, workers and dignitaries. It was definitely the hardest six weeks of my working life, but equally the most rewarding as I gained so many skills and helped to provide an unrivalled service to every single athlete unfortunate enough to pick up an injury during the Games. What do you enjoy most about being a radiographer?

I really enjoy how varied my days are. I cope badly with repetitiveness and cannot sit at a desk for prolonged periods, but this profession comes with a built-in randomness to it so I rarely do the same thing twice in a day. I can be doing anything from scanning patients, fulfilling management duties or taking part in marketing strategies. Interacting with patients is also really important to me as I get to meet such a diverse range of people. What’s the most challenging part of your role?

Being in the middle of most processes is challenging to me personally. As radiographers we regularly find ourselves being the go-between in the middle of the clinician and the radiologist. However, when you get the balance right, it is one of the most rewarding aspects of the job.

What are patient’s biggest fears when they come to see you?

Intrigued by the wealth of health benefits which can be achieved by cryotherapy, Northside’s publishing manager Amanda Roy decided to follow in the stars’ footsteps and give it a go herself. The Cryo Arctic Whole-Body Chamber exposes the user to extreme cold

temperatures of between -120° and -150°C, which reduces the skin’s surface temperature to around 5°. The treatment is non-invasive and helps to boost well-being and motivation, and can invoke feelings of euphoria immediately after, while a multitude of other benefits begin to kick in. Collagen production is instantly encouraged, which helps restructure connective tissue, leaving the skin refreshed, appearing clearer and more plumped. The chamber also aids sports recovery, allowing the user to feel revitalised and ready to compete again. Any muscle or tissue inflammation within the body is reduced,

allowing injuries to heal faster and more efficiently. The Cryo Arctic also assists weight-loss by speeding up metabolism, with a three-minute session burning anywhere between 600 and 800 calories, which is the equivalent of running five miles. But, there’s more to cryotherapy than beautification and sports rehabilitation, as the treatment can reduce chronic pain and fatigue, in turn assisting numerous medical conditions, including arthritis, multiple sclerosis and fibromyalgia. On entering the Leeds branch, Amanda met Sara Turner, one of the brains behind Future Therapies. After a consultation, Amanda was provided with a vest and shorts, as well as specialised head gear and socks to wear in the chamber. Whilst extremely cold, her experience was made more comfortable with the option to play her own music through the in-built blu-tooth system. There are three types of therapy options; beginner, intermediate and pro. Beginners usually have a two minute session to ‘climatise’, but as the best results take place between two and three minutes, Amanda opted for the latter. Though a minimum of six sessions is needed before clients start seeing visible results, the effect it had over Amanda’s stateof-mind was instant.

As of early November, the restaurant formerly known as Dough Bistro will have undergone a complete transformation, to rise from the ashes like a phoenix to become Aperitivo. Taking the very best of Italian cuisine and drinking culture and throwing in a good dose of Yorkshire flair, Aperitivo presents the foodies of Leeds with a casual and unpretentious space to drink, eat and unwind. As the name suggests, visitors can expect a sensational cocktail menu packed with refreshing, palate-cleansing Italian staples. The Negroni and Aperol Spritz will both be present and correct and available with an Aperitivio twist, or in classic form for the traditionalists. Diners will be able to choose from a tempting selection of meats, which are all

cured in-house, as well as the best Italian cheese selection you’ll find in the suburbs, or indeed the city. A wide range of small plates will be on offer, including some excellent options for lovers of Frutti di Mare. Those looking for comfort food can seek out the stone-baked pizza menu, which combines classic toppings with more adventurous ingredients that Luke’s followers have come to expect. The menu has been something of a labour of love, and was put together by Luke and his new chef, who brings with him 20 years of experience, as well as three rosettes. Of course, no Italian restaurant or bar would be complete without a selection of the finest Tuscan wine flights, all of which have been handpicked from Italy’s most prolific vineyards by Luke himself. Aperitivo will also be providing world-class brunch and exceptional coffee blends to fuel guests throughout the day. West Park locals will also be able to indulge in Aperitivo from the comfort of their own home, as a wide selection of pizzas, small plates and drinks will be available on Deliveroo. The project marks yet another chapter in Downing’s impressive career that has so far seen the highly decorated chef open three successful restaurants in Leeds over a ten-year

Shadwell based Nineteen provides visitors of Leeds Golf Centre with an informal space to watch the latest live sport, while Vice & Virtue has made huge waves in central Leeds in just 12 months. Destination food heaven RACHEL MARTIN’S VERDICT ON RESTAURANT 92? SIMPLY SUPERB. eaded up by Michael Carr, a chefpatron who is only 24 years old yet has a resume including winning the title of Chef of the Year at Harrogate’s 2017 Hospitality and Tourism awards and three years under the stewardship of Gordon Ramsay at world-renowned Claridges of London - Restaurant 92 is what food guides call a ‘destination’ restaurant. In fact, it has recently become one of only a handful of restaurants in this corner of Yorkshire to be awarded a Michelin Plate. A word about the service before I focus on the food. Our sommelier Chris brought us our drinks and dissected the menu. He described the dishes with clarity and passion and kept them coming like clockwork. And he had that knack of knowing when my Rioja Blanco Viura/Verdejo Cone de Valdemar (£6.50) needed refilling – very important. The bellwether of a good bistro is the bread and our meal began with a moreish selection of spelt seed and sourdough, exhibited in a hessian bag alongside signature homemade tapioca crackers. Each almost celestial when crowned with light-as-air taramasalata, dried onions and salted butter, they masterfully struck the balance between a slightly chewy crust and a spongy, airy interior. My first course consisted of miso-glazed mackerel, laid meticulously on a bed of sweetcorn kimchi and yuzu. Each mouthful by turn succulent and crisp, the mackerel gave a shock of coast-to-plate freshness and the

kimchi was so melt-in-the-mouth that it somehow managed to be devoured even quicker. If ever there were a dish to make you welcome the bone-crunching cold, my partner’s pumpkin and coconut soup was it. Running with a nuttiness and spice, the heat of the chilli was perfectly complemented by the freshness of the coconut yoghurt, and for him, this was the dish of the day. Then came my favourite dish: a combination of black treacle cured salmon, crispy kale, anchovy and lemon curd. Seafresh, the salmon was faultless – the smell, the flavour, the sweetness – and it ranked as one of the most comforting dishes I have eaten in quite some time. Sticking to the tried and tested, my partner ordered the aged roast sirloin – a generous portion of blush pink beef, Yorkshire pudding and summer greens. Each component was cooked to perfection and it was the aerated bone marrow that made this dish exceptional – the savour that every Sunday cook recognises as the best bit. Clocking up minimal dairy miles, I arrived at simple and well sourced selection of three British cheeses, complemented by a glass of Quinta de Leda Port 1999 Vintage (£8.50). A true savant de fromage, Chris’s recommendation paired particularly well with the soft and creamy Harrogate Blue, cutting through the mellow flavour and taking the edge off the peppery finish. A masterful play on textures, my partner’s passion fruit, cardamom and baked white

chocolate tart perfectly balanced sharp with sweet. A final burst of fireworks in a meal which came humming and fizzing with invention, it was an amazing way to almost end the meal. I say ‘almost end’ because we rounded off dessert with coffee, accompanied by beautiful homemade banana and peanut butter macaroons, lychee jellies and dark chocolate and salted caramel truffles – the icing on the cake to a superb dining experience. Boasting beaming service, a modern British menu and seriously good cooking, Restaurant 92 is definitely a destination restaurant well worth the journey to the West Riding of Yorkshire. It is speeding that normally brings law-abiding citizens in conflict with the courts. “Speeding allegations normally start with a notice in the post, known as a Section 172, asking who the driver of the vehicle was at the time of the incident. This form should be checked first of all to see if it is received within 14 days of the incident and one also should check that the notice itself describes with certainty where the speeding offence actually took place. “If you do not return the notice, duly completed, within the time period allowed you will likely be summoned for failing to provide the name of the driver. If guilty, which is not always straightforward, this offence carries a six-point penalty. The common defence put forward is that the notice wasn’t received. This is not as simple as it may seem. Our firm have successfully won cases on this basis, but the key to a successful defence is the way in which it is presented to the Court. It is something you should seek advice on from an expert before embarking on such a course of action. “There may also be circumstances whereby the form not being returned could be advantageous to you. For example, there are circumstances whereby your speed is so

excessive that it could merit an actual period of disqualification itself. Therefore, the penalty of six-penalty points for not returning the form may well be better than receiving an instant ban as a result of the speed. “The offence of speeding carries a minimum of three penalty points and a maximum of six depending on the level of your speed. If one reaches 12 penalty points or more within a three-year period, the Court is obliged to disqualify you for a minimum period of six months unless you can show exceptional hardship, either to yourself or others, including family or employees. Evidencing exceptional hardship normally requires a skilled and knowledgeable advocate. “This month I appeared for a gentleman accused of two separate speeding offences in different parts of the country. The difficulty was that he already had nine penalty points on his license. I was able to have the cases heard together in one Court. There weren’t any defences that could be put forward to prevent him receiving further points. He therefore pleaded guilty and received six points, meaning he had a total of 15 penalty points. Fortunately for this gentleman, I was able to persuade the Court that he shouldn’t be disqualified and he was very pleased to keep his license. This kind of result is not always possible, but an experienced and knowledgeable lawyer makes this more likely. “The moral in this story is that, when in doubt, you should seek legal advice from an expert. Self-representation can result in being ‘penny wise pound foolish’ as appeals are costly and can be difficult to succeed in.”
