Challenges with the Trust Registers IRWIN MITCHELL’S JAMES LAYCOCK EXPLAINS THE ISSUES.

he Trust Register has brought about a new set of challenges for trustees in dealing with family issues” comments James Laycock, Partner in the Will, Trust and Estate Disputes team at Irwin Mitchell Private Wealth. “The online register is now the only way trustees can comply with their obligations to HMRC and report details of any tax liabilities. But while serving a clear purpose at one level, at another it could introduce some tricky complications. The registration process requires trustees to include the personal details of potential beneficiaries, and classes of beneficiaries where individual beneficiaries cannot yet be identified. This could upset family dynamics. Given that a National Insurance number must be provided, and the trustee has to take reasonable steps to obtain it and show the steps taken if failing to do so, it risks opening a can of worms by alerting family members to future inheritances which may or may not come about. Such notifications, perhaps about a remote possibility, have the potential to fuel family tensions. So what should the trustee do? They could consider whether they can obtain the personal information required from other sources, or whether the trust instrument would permit the exclusion or change of any named potential beneficiary or class of beneficiaries. But they must always act within the scope of their powers identified in the trust instrument, and within their duty to act impartially as between the beneficiaries. This means they must treat different beneficiaries fairly, and those within the same class equally. If a potential beneficiary, who was previously unaware of their ‘potential’ to

inherit, is alerted to their status because of a request from trustees for their personal information, they may start probing for more information about the trust and its assets. Now what should the trustee do? They should consider the interest of the beneficiary. If it is remote, that should limit the type of information that should be made available. The trustee should consider disclosing the core trust documents if requested, but with sensitive information (which might affect other beneficiaries) being redacted. Documents relating to the personal wishes of the settlor which might be expressed in a letter of wishes, or which relate to decisions made by the trustees, should only really be disclosed in exceptional circumstances, and even then perhaps with safeguards. There could be redactions, or undertakings obtained from the inquisitive beneficiaries which limits use and disclosure. Fundamentally, trustees should not rush to placate a beneficiary who proves to be persistently inquisitive. Beneficiaries do not have an entitlement as of right to obtain documents, though trustees do owe the beneficiaries a fundamental obligation to act honestly and in good faith. As such, they must comply with that obligation when considering the demand for disclosure, whilst also weighing up the possible impact and consequences of disclosure on other beneficiaries. If they are uncertain as to whether to comply with a particular beneficiary’s demand for disclosure, it would be prudent to take specialist advice on the issue. The Court, through a couple of seminal case authorities, has given some helpful guidance. If the concern and uncertainty
persists, the trustees could apply for directions from the Court on the issue. However the Court will want to know whether there has previously been a careful and considered deliberation about whether to disclose before coming to Court, because if not, it may be slow to allow the trustees to recover from the trust’s assets the costs of seeking direction. The Trust Register will not (without statutory change) be open to the public, though it will be accessible by the law enforcement agencies. However it is conceivable that this requirement to provide personal details of potential beneficiaries could lead to trustees facing more demands for information and greater scrutiny of their conduct, stoking up an increase in trustrelated claims. On the one hand beneficiaries, potential or otherwise, should be able to expect the trustees to act honestly and fairly. But on the other hand trustees can only do so when considering the interests of all the beneficiaries. Therein lies the friction which this new registration requirement is, at best, unlikely to lessen.” Now is an important time to review your trusts, to ensure they are fully compliant, are being administered correctly, and are meeting the real purpose of the trust and the needs of the right beneficiaries. How did you start a career in accountancy?
I originally had been doing a PhD in electronic engineering but in my late 20s decided I wanted a career change that helped the public and utilised my problem-solving skills. So, after completing my PhD, I secured a job as a trainee accountant. That was at the age of 29 and now at 41, I am a partner at a well-established north Leeds accountancy practice. That’s not all I do though, as at the weekend I’m a professional entertainer and magician.

It’s like another side to my personality. Many of my clients ask me if I can use my magic skills to make their tax bills disappear…there is always a bit of banter between us. Seriously though, people tend to be surprised about my “magic side”, but then I explain that I come from a family of performers so really wanted to keep that tradition alive. Official celebrations at Aagrah Restaurant Garforth were marked by the cutting of a huge cake. Northside publishing director Amanda Roy officiated the ceremony. Attending the special occasion were Mr Mohammed Sabir MBE, Dbs, founder and chairman, and Mr Mohammed Aslam MBE, managing birector, Deputy Lieutenant of the Aagrah Restaurant Group. The restaurant prides itself in offering contemporary dining, a versatile Kashmiri menu and great wine and beers to accompany meals. The branch was the fourth in the group, opening in 1993 in an old school building. The company has grown to 12 restaurants across Yorkshire and with it created 280 jobs. Aagrah Garforth is one of the company’s flagship restaurants. Such is its success they

The stream runs through the garden and on either side an array of plants form a wave of sumptuous colour. A lot of work over the winter to open up the tree canopy near the stream has produced stunning results: swathes of candelabra primulas, hostas and our famous Himalayan blue poppies create clouds of colour along both banks. The other area looking sensational at this time of year is the Main Borders, two long beds of lush herbaceous perennials and summer flowering bulbs. In the Plant Centre we have replicated these beds in two collections for you to buy and recreate in your own garden: The ‘Harlow Carr Streamside Collection’ features the blue poppy Meconopsis ‘Lingholm’, hosta ‘Halcyon’ and primula ‘Millers Crimson’, guaranteed to provide glorious colour and delight to any garden as they flower in June and July. Alternatively, try the ‘Harlow Carr Long Border Collection’ with plants such as Monarda ‘Garden View Scarlet’, Echinacea daisies in subtle shades of pink and cream, and the tall and stately Veronicastrum which will add a touch of drama and height to a summer border. The gift shop is now retailing our exclusive RHS giftware ranges of Hydrangea and Rose collections that were launched in the spring and are proving very popular with our visitors on the lookout for a beautiful gift or souvenir. Nel prepares for exhibition Nel Whatmore has been Artist in Residence at RHS Harlow Carr since June 2017 and she is finishing her last paintings for May, which focus on changes in the weather. The culmination of her study of the garden will be an exhibition called ‘A Year in the Garden’ and a poetry trail around the garden recording her thoughts where she painted at different locations. LEEDS THE ARCADES Leeds is proud to house the 19th century Grand Arcade - one of the oldest shopping arcades in the city - as well as Thorntons Arcade and Queens Arcade, where you’ll find a selection of shops and boutiques. SWINEGATE Throughout the Middle Ages, Swinegate was a medieval pig market, and as such, you’ll find many references to its roots, particularly in Swinegate Court. CLIFTON MOOR All your fashion, home, pet and food needs are covered at Clifton Moor, situated just three miles from the centre of York.
