Safeguard your futures Cohabitees and wills – Why it’s not as straightforward as you might think! By Duncan Watson.

D

id you know that the number of couples cohabiting has grown by nearly 30 per cent in the last 10 years? As a solicitor dealing with wills amongst other matters that’s a statistic that really catches my eye. I’d urge everyone to make a will, or if you have one, to make sure it’s up-to-date, but it’s especially important for cohabitees. If you fall into this category and you die without making a proper will, there is no protection under the intestacy rules for the surviving partner. In the eyes of the law, cohabitants are not automatically entitled to each other’s estate. It doesn’t matter if they’ve been living together for years; if one of them dies without making a will, their partner doesn’t automatically benefit, even if they have children together. There may be no choice therefore but to start potentially expensive litigation under the Inheritance (Provision for Family and Dependents) Act 1975 which does allow cohabitees who have lived as husband and wife for the two years prior to death to claim what the deceased partner would have wanted you to have all along. Also, there is no guarantee that at the end of the process you will succeed in winning your case. All this could be avoided if you and your partner made sure your wills are up-to-date. There was a move by the Law Commission to address this contentious issue, with a bill that would give cohabiting couples automatic inheritance rights after a

set period of time – five years cohabitation for couples without children and two years cohabitation for couples with children. Unfortunately, whilst the Inheritance (Cohabitants) Bill was drafted, it has not been implemented under the current parliament, so intestacy remains a real issue for cohabitees. As well as making a will, I’d urge cohabiting couples to think about the tax implications of their estate. When one half of a married couple dies, whatever passes to the surviving spouse does not attract inheritance tax (IHT), and the surviving spouse can inherit the other’s unused IHT allowance

(currently £325,000). This doesn’t apply to cohabiting couples, so it is well worth seeking the advice of a lawyer who is well versed in the tax implications of inheritance to ensure a large tax bill doesn’t land on your welcome mat. Question: I have to get up three or four times a night to urinate and I find it difficult to start and stop passing urine. My GP thinks I might have an enlarged prostate and has suggested a PSA test. Can you tell me what this test is and what it might reveal? I’m 61 years old. Answer: Urinary symptoms such as yours are commonly caused by prostate problems. Most often this is just enlargement of the prostate but they can be caused by prostate cancer. PSA stands for prostate specific antigen. This substance is produced in the prostate and small amounts get into the blood and can be measured. In prostate cancer larger amounts of PSA usually get into the blood and hence the test can be used to try to detect cancer early. The generally accepted normal PSA for a man of 61 is less than 4ng/ml. If higher there is a significant chance of prostate cancer (>25%) and your GP will refer you to a urologist to discuss further investigations including a prostate biopsy (samples taken from the prostate with a needle). Other causes for a high PSA include infection and benign enlargement. Before having the test it is important to understand that prostate cancer is very common as men get older and may not cause any harm. Hence often even if cancer is diagnosed it does not need treatment unless it shows aggressive signs. Close to the temples is a swimming spot popular with locals, Ghar Lapsi, a great place for a dip in Malta’s clear blue waters. Another ‘must’ visit is Mdina, Malta’s first capital and still a small medieval-style citadel city, full of historic buildings. Evening is a lovely time to wander here. Zaap-ed by the zing! Food bursting with flavour and sophisticated surroundings make Chaophraya’s brand of Thai tastes ideal for city slickers.

F

irst impressions count for a lot in the restaurant world and Chaophraya goes all-out to make a big impact, from the moment you step around the tuk-tuk parked on the street and venture within. As it happens, when it comes to Thai food, I love the fresh herbs, zingy flavours and sudden explosions of heat so much, I am perfectly happy to eat in a simple café with wipe-down tables and minimal decoration. After all, it’s all about the food... right? Well, up to a point, but I’m also a sucker for a bit of showmanship, and Chaophraya really sets its stall out to show what a big, bustling city centre restaurant can do. For starters, this lavish Leeds diner comes with its own elegant cocktail bar – the Palm Sugar Lounge – and this is the perfect spot to sip something chilled while watching the world go by. In fact we felt so relaxed, the summons to our table upstairs came as quite a shock. This is one busy restaurant and the constant hubbub of conversation is a shock to the system for the first few minutes. Décor is modern and chic. Even the menu design is slimline, although it does open out to reveal a massive selection of curries, stir-fries and grilled meat and seafood, along with a big vegetarian selection. We simplified things by ordering the most popular starter on the menu – a sharing platter of chicken satay, pork, prawn, grilled squid on bamboo skewers and Thai fish cakes with a warm satay sauce. Presentation was terrific, service extremely attentive and our first mouthfuls reassured us that all would be well. The batter on the squid was exquisitely

crispy and the squid itself – which can be ruined by an extra ten seconds of cooking – was tender perfection. For me, Thai food is all about sharing, so my companion and I set about selecting main courses we would both be happy eating. Thai red prawn curry is always a safe bet but there was nothing tame about this heavenly combination of king prawns, red curry paste, coconut milk, wild pepper, aubergine and sweet basil.

We also shared a huge appreciation of the duck in roasted chilli, which was rich, tender and not intimidatingly hot, accompanied by mushroom, carrots, peppers, onions and sweet basil. The days when I used to regard a visit to any Thai or Indian restaurant as test of my ability to bear the hottest dishes on the menu are long gone, but, if you do like the occasional invigorating blast of pure heat, I can’t recommend the papaya salad highly enough. This innocuous-sounding mix of raw shredded papaya, carrots, cherry tomatoes, beans, peanuts and other good things also contains a crisp sticky rice parcel and an awful lot of chilli. The menu says Zaap Zaap! I’m not sure about the direct literal translation, but I get the drift. Do try it – but treat with respect. With noodles rather than rice to complete our sharing of main course delights, this was a meal and an occasion to savour. Looking around the packed restaurant, a good time was being had by all, especially those parties that included a birthday boy or girl. At regular intervals, a solemn-looking bunch of restaurant staff, immaculately kitted out in national costume, would troop past the diners in single file, banging odd-shaped drums and mini cymbals, before stopping before their ‘victim’ for a rousing chorus of Happy Birthday, making up with genuine goodwill what it may have lacked in conventional tunefulness. The usual milky sweet puddings are available and totally authentic, for sure. But we were searching for a lighter taste to finish and fresh fruit fondue with warm chocolate dipping sauce rounded things off very nicely.

Grid Thirteen marks a year of success Leeds interiors business sees turnover boosted by more than double the initial projections in its first 12 months of trading.

ew kitchen and interiors retailer Grid Thirteen has announced a £1.3 million turnover in its first trading year. This is more than double the amount that the Leeds business had projected and places it well on track to surpass a target of £1.5million in three years. Grid Thirteen offers the very latest selection of kitchens, appliances and furnishings with exclusivity on up-market brands including SieMatic, for which it is one of just six UK ‘Premium Partners’. It has also become successfully established as a hub for design excellence, providing access for consultation, knowledge sharing and product training with architects and designers. The business had already secured preorders valued at £500,000 before opening its showroom last February and, whilst maintaining a strong flow of orders from private clients, attributes the boost to a

number of high-end commercial projects secured. These include eight new apartments at Wigton Court and 15 luxury apartments in Abersoch. Grid Thirteen is owned by Natalie Fry, a former designer and multiple award winner for Poggenpohl with 20 years’ industry experience working with some of the UK’s most prolific interior designers and architects. Natalie said: “We were off to a flying start with pre-orders but the new studio and shop front on Street Lane has driven fantastic interest. We try to differentiate by offering exclusivity with unusual and luxurious materials and this is something we have been able to carry through for commercial projects with budget constraints. “Last year we showcased the UK’s first kitchen display featuring real gold surfaces…a brave move which has paid off. Teacher selected to play rugby for England Counties Brontë House School in Apperley Bridge is delighted to announce that current head of boys’ games – and former pupil of the senior school – Joe Bedford, has been selected to represent England Counties in their forthcoming spring internationals. Joe was a professional rugby union player for 11 years, playing for Leeds Carnegie,

Rotherham Titans, Newport Gwent Dragons and Doncaster Knights. He amassed more than 200 senior games before retiring from his professional career in 2013. He also assists with the 1st XV at Bronte House’s senior school, Woodhouse Grove, and plays for Sandal RUFC in National 3 North, where he is also joint head coach.

Joe played against Scotland Clubs at Fylde RFC in Lytham St Annes on 27 February and will next play against France Federale at Perigeaux, near Bordeaux, on 20 March. Last year, Joe’s under-11 rugby team missed out on watching him play for England Counties as the matches were held in Georgia – which was a little too far for a school trip.

Amy Garcia speaks to Stephanie Burns about life on the Look North sofa – and how balancing a demanding television career with a young family is no easy task.

atched by 2.5million people each week, BBC Look North is held dearly in the hearts of Yorkshire folk. So finding a new presenter to reignite the on-air chemistry that Harry Gration shared with his former sofa buddy, Christa Ackroyd, was undoubtedly a tall order. But 33-year-old Amy Garcia – who took up the role in November 2013 – has a winning combination of warmth and genuine charm that has been gladly welcomed each evening by the show’s loyal viewers. Having grown up in Wakefield and studied media and performing arts at the local college, Amy embarked on a six-month stint as a cruise ship singer before, at the age of 19, venturing into children’s television. Staying in the genre for three years, she worked for S Club TV, CBBC and the Disney Channel and then side-stepped into light entertainment shows on Sky. At 27, she decided to travel in a different direction and enrolled at Goldsmiths College in London for an MA in journalism – a qualification that opened up a new world of opportunity. Three years after making her first appearance on the Look North sofa – presenting different bulletins as well as working behind the scenes on production – she secured a presenter/reporter role on BBC South Today and presented BBC3’s 60 Seconds news bulletins. In early 2013, she left to take up maternity leave and it wasn’t until the call came from Look North that she was propelled back into the spotlight – and back up to her beloved home county. Amy met her husband Tim, a Yorkshireborn songwriter and producer, 12 years ago in Brown’s bar, Leeds. But it wasn’t until the

following year, when they bumped into each other in a music studio in London, that they really hit it off. The rest, as they say, is history. Their 22-month-old daughter now kisses the screen when she sees her mum on television and even shouts out the names of Harry and weatherman Paul Hudson. So how does the glamorous presenter – who is fast becoming a Yorkshire sweetheart – juggle the pressure of such a demanding role with the reality of early motherhood? And just how did she survive the gruelling Tour de France Yorkshire Grand Depart route on the back of that tandem? I caught up with Amy during a lateevening shift to find out.

Was there anything that surprised you about the job? There are lots of added extras. I get invited to open fairs and do talks at schools, which is really nice. Sometimes it’s really hard to say no to things so you find yourself running around ragged doing everything. But it’s really lovely to be part of the community and see what amazing work some people do.

You’ve been on the sofa for just over a year now, how are you finding it so far? I am absolutely loving it and feel like I’m in a bit of a rhythm now. The first six months were just terrifying and then I had the tandem bike ride thrown into the mix. But it’s a really lovely team and there is such a variation every day.

Have there ever been any on-air disasters or blips that have got your heart pumping? Oh all the time – gosh there are so many mishaps that I probably couldn’t name them all but they play out on screen I think.You’ve got to be open and honest about it and I think the audience thanks you for that rather than trying to pretend nothing’s happened.

It is a really big role to take on, were you nervous in the lead up? Yes, it was a huge pressure. There were big shoes to fill and Look North has a massive audience, but I tried to push that to the back of my mind otherwise I’d have been a nervous wreck every night. How are you balancing a career and motherhood? I’m always juggling lots of balls but I’m lucky that I have very supportive parents and inlaws. Without them, I don’t think I’d be able to do the job. I also have a very supportive husband and, between the three of them, they look after Mabel while I’m at work and they do a great job. Mabel had just turned eight months when I came back to work so I felt like it was a little bit early to be leaving her. It was a bit of a shock to the system as we had six weeks to find a house and get everything sorted. As any new mum will know, your mind just goes to mush when you have children – for at least the first year – so it was terrifying not just going back into work and easing myself into it gently like most do, but being on live TV four nights a week.

What is your favourite part of the job? Meeting different people is the best part and the variation is great as it’s just different all the time.

Do you have any unfulfilled career ambitions? I’d quite like to travel a bit more with work. Harry went to Afghanistan recently and that was such an amazing trip; I was quite envious. Is there anyone who has particularly inspired you? Harry definitely has because he’s a bit of an institution. He’s got a real knack for doing both serious and soft news. I think Sophie Raworth’s great too. She used to work for Look North and she’s someone that I saw as a bit of a role model. What do you like most about being back in Yorkshire after a ten-year spell down south? You know where you are with Yorkshire folk; they don’t dilly dally around the subject. What you see is what you get and I love that because that’s what I’m all about as well.

You must be recognised fairly often. How are you greeted by the Yorkshire folk? Well to begin with it was ‘ooh didn’t you do well on that tandem’ or ‘I hope you’re looking after Harry’. When I’m out and about, I’m with my little girl so I look very different as I’m in my mum get-up. A few people have said ‘do you know you look just like Amy Garcia off Look North, has anyone ever told you that before?’. I’m like ‘erm a few people, yes!’. How did you prepare for the Tour de France challenge? We did about six weeks’ training together and on our own. But I don’t think anything can really train you for that amount of cycling so it was just a case of trying to get a few miles under our belts. How did you keep yourself going when it was really tough? The audience was just brilliant; so many people came out to cheer us on. We had moments when we wanted to get off the blummin’ bike but there were crowds of people who’d been waiting in the rain for an hour to see us so we just had to keep going. The fact that we were raising money for BBC Sport Relief as well gave us a great incentive. Was there a specific high and a specific low? Oh yeah. The low was probably Holme Moss – that was just a killer. Apart from the fantastic crowds, Buttertubbs was a high because that was the first big hill. It was on the second day and we were both really worried about it but we made it up there without too much of a problem. The tandem is a big achievement in your Look North career – what would you say is the biggest achievement in your life so far? My daughter, definitely. That sounds really soppy doesn’t it? To be honest, I feel like I’ve got everything – I’ve got a dream job, the most gorgeous, supportive husband and a healthy, beautiful baby girl. I feel like I’ve won the lottery. Look North Yorkshire is on BBC1 every week night at 6.30pm.

Irwin Mitchell Wills, Trust & Estate Disputes Families fall out at the best of times and the consequences can be devastating. This can be exacerbated following a death. The controversial provisions of a will can quickly lead to a total and utter breakdown in the relationship amongst family members. People’s emotions can overwhelm them. It can become an exceptionally emotive dispute and as such people can often be ruled by their heart rather than their head. It can create a situation where the family is quickly ripped apart. Claims are on the rise. Recent reports indicate that claims have increased by 30%. This is, in my view, the tip of the iceberg. One in five people have been involved in a Will dispute in the UK and this is likely to increase. Irwin Mitchell gets 70 new enquiries a month on average and this figure is growing. It is a significantly higher figure than it was even three years ago. It is difficult to avoid these disputes where there are disappointed beneficiaries and their very nature means that they are not easy to resolve. It is vitally important to take advice from experts. This is a very specialised area of litigation and has its own unique rules and procedures. If it is approached like a commercial dispute, this can create additional problems. Those of us who are experienced in this area of law, generally adopt a pragmatic and reasonable stance, always looking to explore the possibility of settlement, given the very high costs involved in litigating the matter. The first letter can set the tone for the way in which the dispute develops and ultimately the manner in which it is resolved.

In my view the best advice is simply to talk. People are naturally reluctant to discuss their Wills and what will happen in the event of their death. There are situations where there is no perfect solution. By way of example, a person may have two children, one of whom has worked in the family company for 20 years helping to make it the success that it is. The company may constitute 90% of the estate. Does the Testator leave his/her shareholding to the child that has been in the business or look to split the estate equally? There is no right or wrong answer. However, if everything is discussed openly and the reasons for the decision conveyed, it cannot often prevent a dispute arising after death. It is frequently the “shock” of the contents of the Will, at a time when family members may be suffering from significant feelings of loss and upset at the death of a loved one, that fuels the dispute. I am increasingly involved in assessing the risks of a dispute and devising strategies to minimise those risks. I discuss these issues with the person making the Will, in conjunction with the tax advisors, so that an informed decision can be made as to how to structure their estate. Indeed, I have found myself mediating with the family members to reach a solution that everyone can live with. This has so far avoided any disputes arising after death, and indeed, helped the airing of long-held grievances which has generally improved the relationships amongst the family.
