Pre-nuptial agreements – just how binding are they? SARAH BUXTON IS AN ASSOCIATE IN THE LEEDS FAMILY TEAM AT IRWIN MITCHELL PRIVATE WEALTH. SHE IS PASSIONATE ABOUT PRE AND POST-NUPS AND ADVISES THE REGIONS FAMILIES ON HOW TO APPROACH THESE SORTS OF AGREEMENTS. HERE SHE DISCUSSES THE COMMON QUESTION, ARE PRE OR POSTNUPS WORTH THE PAPER THEY ARE WRITTEN ON? t’s now eight years since the case of Radmacher was heard by the Supreme Court. This was the case that changed the landscape in relation to prenuptial agreements – and yet I’m still often asked “is a pre-nup worth the paper it’s written on?” And I answer, “Yes, a pre-nup can often carry a lot of weight. But it depends what it says and how it was entered into…” As with many aspects of family law there are misconceptions and myths. For example, the myth of the “common-law spouse”. Living together for a certain period does not automatically give people the same rights as a married couple. Also, the “quickie divorce” – there’s no such thing as that either, whatever the media may tell us. In a world of misinformation and “fake news” it’s understandable that people don’t know much about the realities of pre-nups. Not so very long ago they were considered unromantic, and reserved for Hollywood Alisters. This is no longer the case. If done “right” pre-nups can be incredibly useful and can avoid the acrimony and uncertainty that come from the end of a marriage.

I

If a couple divorces without a pre-nup (or a post-nup – which is an agreement reached after the date of the marriage), the court has a very broad discretion to make financial orders. It can, for example, transfer properties from one person to the other, order the sale of a business or home and/or split pensions between the couple. It can order lifelong maintenance payments to be made from one person to the other. In coming to what it considers to be the right outcome, the court takes into account all the resources available. This can include inheritances, whether these came in before the marriage, during it, or after separation. What the court believes to be the right outcome, might not be not what either party would have chosen. A pre or post-nup allows a couple to exercise autonomy and to set the boundaries. As long as each party comes out with enough to meet their needs, they can agree to protect things like family businesses or inheritances. A couple can also agree a clean break i.e. that the financial ties between them come to an end. For a pre-nup to carry weight both people have to enter into it freely; they each have to

take their own legal advice and the agreement has to fall within the parameters of overall fairness. It can’t therefore provide that one person gets everything and the other receives nothing. The court will not uphold a pre-nup which is so clearly unfair that it leaves one party in financial dire straits. A judge might instead alter the pre-nup to ensure there is a fair outcome, but this award might still be less generous than if there had been no pre-nup at all. The court is generally prepared to respect the fact that the parties have chosen to have their own agreement, and it tries not to trespass on this any more than is strictly necessary. short flight from the UK – East Midlands airport with bmi to be exact – an 11-minute train direct from Brussels airport followed by a further 20-minute train journey through Antwerp makes the beautiful Mechelen super easy to get to. Situated in the heart of Flanders, this pocket-sized city, is midway between Brussels and Antwerp, and is the perfect starting point to explore Burgundian heritage. A light stroll around the city allows you to take in one sight after another as all her attractions are in walking distance of each other Full of historic buildings on it’s narrow streets, every step will take you back in time to the 16th century when Rumbold the missionary left the British Isles to preach his message of forgiveness and salvation, with his final destination being the settlement of Mechelen. After his death, he was venerated as a saint and the monks founded St. Rumbold’s Abbey (whose bells ring loudly every seven-and-ahalf minutes) in honour of him. Connected to the Abbey is St. Rumbolds Tower, an unfinished Gothic tower which is listed as UNESCO world heritage and offers a 360-degree view of the city. After climbing

Working his way back JERSEY BOYS, THE STORY OF FRANKIE VALLI AND THE FOUR SEASONS, HITS THE STAGE IN LEEDS THIS MONTH. RHIANA HUGHES TALKS TO SIMON BAILEY, WHO WILL BE REPRISING HIS ROLE AS TOMMY DEVITO FOR THE SECOND TIME. he Tony and Olivier Award-winning musical Jersey Boys has been captivating theatre-goers in London and across the world for years. With numerous accomplished actors having told the story of Frankie Valli and The Four Seasons, it’s Simon Bailey’s second stint playing tough guy Tommy DeVito. With a long list of West End credits to his name, the stage veteran talks to us about his experiences in the industry and why you should come to the show when they visit Leeds this November.

Who or what inspired you to get into acting?

After I somehow got the highest marks in my school’s history in my A-Level, one of my drama teachers handed me a form for the National Youth Theatre and said they thought I should really pursue this as a career. From then, I auditioned, I got in, I moved to London and I had a job within a week. Really quick, very lucky, so I owe a lot to Emily Whitehead. What advice would you give to young people trying to get into the industry?

The main thing I would say to anyone who wants to get into acting is just to never give up. It’s a really tough industry to crack into, there’s a lot of luck involved, there’s a lot of talent involved. It’s mainly persistence, you’ll hear a lot of yesses but you’ll hear a lot of nos and you have to develop a thick skin and just pick yourself up and keep going.

anniversary cast, being the first person to sing ‘All I Ask of You’ on the steps of the Paris Opera House and of course being in Jersey Boys is a huge highlight. Tommy DeVito is a part I’ve wanted to play since the show came out in 2008. What made you want to come back and play the role of Tommy DeVito?

Roles like this genuinely don’t come around too often, the music in this show is so awesome anyway, but when you have characters that are this well written, and it’s this fast-paced and it’s so lively, energetic, slick, interesting and shocking, there’s just so much to it. When I first saw this show I saw it on its first night in 2008, and within two minutes of when Tommy started talking I just knew that I had to play that part. When you’re asked to come back and play a part that you love, there’s not many reasons to say no. It was an instant no-brainer. What’s it like taking a role in a show that’s got such a large fan base?

It is slightly intimidating because you don’t want to mess it up for people, these people keep coming back to watch the show for the story, and for the people telling the story. You don’t want to mess it up for people but you hope they’re going to like your take on it, you have to trust yourself. Would you consider returning to any of your past roles?

Probably not because I’m not getting any

younger! Those roles are a little bit younger now, but there are certainly shows I’d like to return to. I’m too old to go back to the roles I played in Les Mis and Phantom now, but I would like to go back to those shows. I’d love to play Javert and Phantom at some point, and if they did I Can’t Sing again, I would go back and play Liam O’Deary in a heartbeat. Why do you think people should come and see Jersey Boys?

Why not? What I like to hear from everyone who comes to the show is that they come knowing the music but they leave knowing the story. You’re totally consumed for two and a half hours. It’s a show that you genuinely can keep coming to watch again and again, I’m proof of that, I saw it eight times before I was in it. There’s no reason not to come to this show. Are there any shows you want to see yourself?

I really want to see Hamilton, and Dear Evan Hansen is a soundtrack that I play an awful lot because I think it’s brilliantly written, so I’d be excited for that to come over. It’s an exciting time for musical theatre actually, there’s a lot of new style work coming in and new shows being written and put on. It’s quite difficult to see things when you’re on tour but I certainly want to try and get to see as much as I can. What would you say have been the highs and the lows of your career so far?

Lows are obviously being out of work, or getting really close to a role that you want. Highs, genuinely so many. I met the Queen when I was performing at the Royal Variety Performance with my group Teatro. We got a gold album after three weeks of release which was amazing. The three most common causes of chronic neck and arm pain that we see in practice are: 1. Discogenic pain – bulging disc between the vertebrae in the neck 2. Facet syndrome – wear and tear in the joints between the vertebra from injury or repetitive strain to the neck 3. Spondylosis – wear and tear process causing bony growth at edges of the vertebra (bony spurs) When you see the neurosurgeon, they will take a detailed history from you focussing on the onset, intensity of pain, its radiation to the precise place in your arm and whether there

are problems with grip, walking or balance. If appropriate they will refer you for an MRI scan of your neck which will help to see if any nerves are trapped. They will then correlate any abnormal scan findings with clinical findings to make a defnitive management plan. The first line of management is generally conservative with physiotherapy and modification to lifestyle. If this fails and you have a large bulging disc or significant compression of the nerves, the option of surgery will be discussed. Season’s greetings IF YOU’RE THE TYPE OF PERSON WHO WISHES IT COULD BE CHRISTMAS EVERY DAY, THIS TRADITIONAL YORK EMPORIUM IS JUST FOR YOU. BY RHIANA HUGHES. he first and only Käthe Wohlfahrt store in the UK, York’s Käthe Wohlfahrt, has been attracting visitors from all over Britain and all over the world, in fact, since it opened in August 2016. Keeping us in the Christmas spirit all year round, Käthe Wohlfahrt can be found in York’s city centre, making one of the city’s oldest and most beautiful buildings its home. Mulberry Hall dates back to 1434, and for almost 60 years it was home to one of York’s flagship retail stores. Helen Dawson and Pam Boulton both worked for Mulberry Hall before it transformed into the winter wonderland that is Käthe Wohlfahrt, and together they manage the festive store today. They told us how it was inevitable that when the day came for the property to change hands, the Wohlfahrts would be the ones to step in and take over. “Harold Wohlfahrt first saw and fell in love with the building some 40 years ago, so when it eventually became available he snapped it up,” said Helen. Not only did Harold Wohlfahrt recognise Mulberry Hall as having a great position in the centre of York, it being a mere 200 yards from tourist hotspot York Minster, but he also saw it as the perfect spot in the UK, with transport links to York available across the country. Each Käthe Wohlfahrt shop is unique, as they search for older buildings full of character and charm in which to house their

authentically German Christmas emporiums. Though each store may be slightly different aesthetically, the heart of each Käthe Wohlfahrt shop remains the same, each store sharing the aim to create a bridge between the past, present and future of the Christmas tradition. Unlike many other shops you’ll find on the high street today, Käthe Wohlfahrt has a real story behind it. A music box that founding couple Wilhelm and Käthe Wohlfahrt brought from Saxony to Stuttgart is what laid the foundation for the company. The couple made friends with an American officer and his family, and after noticing that they were fascinated by the music box, Wilhelm set out to find another one to gift them. Looking for another music box just after Christmas, Wilhelm was disappointed to find that all of the shops had already stopped selling seasonal items, and it wasn’t until February that he managed to find a wholesaler who was still selling music boxes. “They wouldn’t sell him just one, so he had to buy at least ten of them”, Helen tells us. Really wanting to be able to give this gift to his American friends, Wilhelm bought ten, and his friends were thrilled with their present. They suggested that he go door to door in the American barracks to sell the remaining music boxes, and he was successful until the military police took him into custody. Even they liked the music boxes though, and they suggested he sell them to the American officers’ wives at the bazaars. From then on, Wilhelm and Käthe spent their weekends at the bazaars, and their range of traditional decorations gradually expanded until they finally decided to go independent in 1964. After his father’s passing in 2001, Harold Wohlfahrt took over, and it’s the sense of family and tradition that keeps Käthe Wohlfahrt running so well to this day. Though not biologically a part of the Wohlfahrt family, Helen and Pam are both very much a part of the family in spirit, and this shows in the dedication they have to maintaining the York store’s infectious Christmas charm. As soon as you walk into Käthe Wohlfahrt it’s like you’ve been transported straight to 25 December in the most Christmassy house in the world. Greeted by staff wearing Bavarian national costume, you start to question whether you’re even still in York. As you explore the store’s two floors, built on a one-way system to tackle their busier seasons, you can’t help but become enchanted by the spirit of Christmas, and it would seem an impossible task to leave Käthe Wohlfahrt only purchasing one item. About 70 per cent of the items you’ll find

in Käthe Wohlfahrt are exclusive to them, and they even have their very own brand of decorations, Poetry in Glass. Everything they sell is of an extremely high quality, and you can really see the hours of skill and dedication that have been put into creating each and every decoration. This year they’re selling commemorative products to celebrate the 200th anniversary of Silent Night. Performed for the first time on Christmas Eve 1818 in a church just outside of Salzburg, Silent Night has remained an integral part of our Christmas traditions ever since, and Käthe Wohlfahrt’s stunning Silent Night music boxes are the perfect way to continue to pass the song down through generations. o, I made a conscious decision to take a more sophisticated approach to Halloween this year, and that plan seemed to be working just perfectly when I agreed to attend a dear friend’s dinner party. It was all going so well, but several bottles of Chardonnay later and there I was dripping fake blood into my risotto and hitting up Uber to whisk me to the nearest bar. Oops. Well, they do say old habits die hard. C’est la vie. Workwise, autumn has been crazy-busy and there’s been days when I’ve been running on caffeine and adrenaline alone (no rest for the wicked hey?), but somehow, it’s all worked out. One of the best events we’ve hosted recently was the Blackhouse tenth birthday bash; over 200 guests attended and the fizz and short rib bon bons were flowing all night. Speaking of food, Deborah (or Miss Trunchbull as I’ve been referring to her recently!) has put me on a strict cake ban in the office and gives me daggers if I even look at anything sweet. To prove her wrong and to take my mind of cake, I’ve signed up to the new Fitness Space studio in Granary Wharf in a bid to look ‘extra-extra’ in time for Christmas. The guys there are amazing and design a bespoke fitness programme based around a non-invasive DNA test, which lets you know which exercises work best for you. It seems to be working so far, and with a bit of persistence I won’t be returning to work come new year looking like a baby elephant crossed with Santa! But let’s not jump the gun, as November has barely begun there’s plenty of fun to be had before the obligatory detox. If, like me, you’re keen to get the party season started asap, then you must attend our fourth Cocktail Experience event on Friday 9 November. We’re hosting the party at Aspire once again, where 16 of the city’s finest bars will be working their magic, creating some of the most picture-perfect cocktails you’ve ever seen. Look out for Vice’s Pink Espresso Martini and Manahatta’s Tequila Me Softly, they’re almost too perfect to drink.
