DEARBORN COUNTY BOARD OF COMMISSIONERS MEETING July 17, 2012 9:00 a.m., Commissioners Room County Administration Building 215West High Street, Lawrenceburg, Indiana CALL TO ORDER Present: Jeff Hughes, Shane McHenry, Tom Orschell, Gayle Pennington, Auditor, Andrew Baudendistel, County Attorney, Teresa Randall, County Administrator. OLD BUSINESS: Payroll Schedule Change – Suellen Cauble presented a payroll revision. Beginning with the payroll on August 20th the payday will move one day later for 5 consecutive pay days in order to meet State Board of Accounts approved guidelines. Shane McHenry made a motion to approve the revised Payroll Schedule as presented by Suellen Cauble. Motion seconded by Tom Orschell. All in favor, motion carried. Maintenance for Dearborn County Vehicles – Terri Randall asked that this be tabled. A motion was made by Shane McHenry to table. Motion seconded by Tom Orschell. All in favor, motion carried. Whitewater Canal Scenic Byway – Terri Randall and Todd Listerman reported that they are waiting on clarification from INDOT. A motion to table was made by Tom Orschell. Motion Seconded by Shane McHenry. All in favor, motion carried. OKI Funding Contract / Agreement (tabled until Aug 21st) NEW BUSINESS: Planning & Zoning - Mark McCormack presented proposed changes to the DC Zoning Ordinance: Article 3, Section 320: Dimensional Variance Requirements - eliminate the dimensional and implement variance requirements. Motion to open public hearing moved by Shane McHenry and seconded by Tom Orschell. All in favor, motion carried. No comments Motion to close public hearing moved by Shane McHenry and seconded by Tom Orschell. All in favor, motion carried. Shane McHenry made a motion to sign the Ordinance to amend Article 3, Section 320 which is Ordinance #2012-013. This motion was seconded by Tom Orschell. All in favor, motion carried. Article 27: Definition of Variance - define the variance definition. Motion to open public hearing moved by Shane McHenry and seconded by Tom Orschell. All in favor, motion carried. No comments Motion to close public hearing moved by Shane McHenry and seconded by Tom Orschell. All in favor, motion carried. Shane McHenry made a motion to sign the Ordinance to amend Article 27 which is Ordinance #2012-014. This motion was seconded by Tom Orschell. All in favor, motion carried. Article 21, Section 2125: Handicap Parking Requirements – reworded to conform to ADA requirements.

Shane McHenry made a motion to sign the Ordinance to amend Article 21, Section 2125, which is Ordinance #2012-015. This motion was seconded by Tom Orschell. All in favor, motion carried. Article 25, Section 2546: Private or Resident Swimming Pools - Replace 5ft enclosure reference to 4ft enclosure. Motion to open public hearing moved by Tom Orschell and seconded by Shane McHenry. All in favor, motion carried. No comments Motion to close public hearing moved by Tom Orschell and seconded by Shane McHenry. All in favor, motion carried. Shane McHenry made a motion to sign the Ordinance to amend Article 25, Section 2546, which is Ordinance #2012-016. This motion was seconded by Tom Orschell. All in favor, motion carried. Jack’s Forever 3 Foundation’s 5K Run - Erin Fox asked for permission to close the road. This will be the same course that was run last year. Tom Orschell made a motion to allow the road closure and Shane McHenry amended the motion to include Sneakville Rd., Garden Meadows Dr., Garden Green Dr., Grubbs Rd., Tom Orschell seconded, all in favor, motion carried. HIGHWAY DEPARTMENT Highway Superintendent – Tim Greive - Updates – slip repairs Hogan Hill are near completion. The new Mack truck is in service today. Other new equipment should be in service before winter. Highway Engineer – Todd Listerman – Updates – Solar School flashers are installed funded by the Federal Safety Program. They will be in use at Bright Elementary, N. Dearborn Elementary, and Sunman Dearborn Intermediate School. Line striping – add to the list Weisburg Rd. - this will delay bids until September. The bid opening was held and low bid was McAllister in the amount of $295,172.22 for Bridge #224 at South Hogan Creek. Todd’s recommendation is to accept the bid. Tom Orschell moved to accept the bid of $295,172.22 by McAllister Excavating Co. Shane McHenry seconded the motion. All in favor, motion carried. ADMINISTRATOR – Teresa Randall Hoosier Square updates: A proposal by Marshall Enterprises/sub Thomas Construction to construct new stairs was reviewed. Tom Orschell abstained due to conflict of interest. Shane McHenry moved to give the County Administrator the authority to enter into a contract with Marshall Enterprises in the amount of $18,725.00 to complete the stairs in the Hoosier Square Building. Motion seconded by Jeff Hughes. Motion carried. Fiber optic – Indicom will install and connect to the annex satellite on the roof. The cost will be $2,500.00 with an amount of $5,000.00 to contract with CSX for air space. Tom Orschell made a motion to approve submission of the CSX Right of Way application. The motion was seconded by Shane McHenry, all in favor, motion carried. Votaw Building Demolition – City of Lawrenceburg is helping thru staff resources, permits, etc. There is also a small piece of property that is pie shaped behind the Votaw and Shumway buildings that Dearborn County has a right of entry from the city. The County will hire out drainage and grading with a plan to connect to the city storm water system. This will be paved for parking also. Jail Architect Committee recommendation - Rosser/American Structurepoint. RQAW, Brandstetter, DLZ, and Rossser were the contending companies.


Shane and Jeff commend the committee for all of the time they have put in. Council did have a good idea asking that it be bid out. Tom agrees that even though it is a hard decision for him, at the end of the day, fair and professional research allowed them to make the best possible decision. Tom Orschell made a motion to award the architect contract for design of the Dearborn County jail expansion to the Rosser firm with the stipulation that Mrs. Randall, the Maxwell group, and the County Attorney negotiate to the County’s satisfaction. This motion was seconded by Shane McHenry. Jeff Hughes abstained because he does not agree with the project. Two cars from the Sheriff surplus were discussed. Shane McHenry made a motion to allow Moores Hill Fire Dept. to purchase a 2005 Crowne Victoria, VIN# 2FAFP71W45X142092 and a 2006 Crowne Victoria, VIN# 2FAHP71W16X142416 for use in their department for $1.00. This motion was seconded by Tom Orschell. All in favor, motion carried. AUDITOR – Gayle Pennington presented AP Claims for signatures. Shane McHenry made a motion to approve the AP Claims as presented. Motion seconded by Jeff Hughes. Motion carried. Payroll Claims were presented for signatures. Shane McHenry made a motion to approve the Payroll Claims as presented. Motion seconded by Tom Orschell. All in favor, motion carried. Minutes from July 3rd were presented for signatures. Tom Orschell made a motion to approve the minutes as presented. Motion seconded by Shane McHenry. All in favor, motion carried. Minutes from June 16th were presented for signatures. Shane McHenry made a motion to approve the minutes as corrected stating “the letter drafted by Roger Howard” on page 2. Tom Orschell seconded, all in favor, motion carried. Commissioner’s Dockets were presented for signatures. Shane McHenry made a motion to approve the Commissioner’s Dockets as presented. Motion seconded by Tom Orschell. All in favor, motion carried. ATTORNEY – Andy Baudendistel presented Joint Resolutions and Interlocal Agreements between Dearborn County and Lawrenceburg City and City of Greendale for signatures. Shane McHenry made a motion to sign the Joint Resolution for the Hardintown Water Project and disbursement of Grant funds between Dearborn County and Lawrenceburg City. Motion seconded by Tom Orschell. All in favor, motion carried. Shane McHenry made a motion to sign the Interlocal Agreement for the Hardintown Water Project and disbursement of Grant funds between Dearborn County and Lawrenceburg City. Motion seconded by Tom Orschell. All in favor, motion carried. Shane McHenry made a motion to sign the Joint Resolution for the Hardintown Water Project and disbursement of Grant funds between Dearborn County and the City of Greendale. Motion seconded by Tom Orschell. All in favor, motion carried. Shane McHenry made a motion to sign the Interlocal Agreement for the Hardintown Water Project and disbursement of Grant funds between Dearborn County and the City of Greendale. Motion seconded by Tom Orschell. All in favor, motion carried. Shane McHenry made a motion to declare the Hardintown water project an emergency under IC 36-12-9. Motion seconded by Tom Orschell. All in favor, motion carried. Herzo Engineering, Inc. made some recommendations for bid requests from CH&M Contractors (Milan, In.) and Brackney Contractors (Brookville, In.). Bids to be approved at next commissioners meeting. Shane McHenry made a motion to request bids from Contractors and Brackney Contractors. Seconded by Tom Orschell, all in favor, motion carried.


Ordinance # 2012-017 – Amendment to the Personnel Policy Shane McHenry made a motion to amend by striking language from the Dearborn County Personnel Policy, specifically the Firearms Policy, section 6.12, Security of Premises. Seconded by Tom Orschell. All in favor, motion carried. 1. COMMISSIONER COMMENTS Jeff Hughes - NONE Shane McHenry – The Dearborn County Sheriff Department would like to donate some older radios to the Aurora and Moores Hill Fire Departments. With no further business before the Board, Shane McHenry made a motion to adjourn at 10:45 a.m. Tom Orschell seconded, the motion passed unanimously.
