IN THE DEARBORN CIRCUIT COURT GENERAL TERM, 2012 CAUSE NO. 15C01-1208-MI-043 STATE OF INDIANA ) SS: COUNTY OF DEARBORN ) IN RE: THE NAME CHANGE OF ) HERBERT MELVIN ADKINS, ) Deceased, ) ELDA JEAN ATKINS, Petitioner ) VERIFIED PETITION FOR CHANGE OF NAME Comes now the Petitioner, Elda Jean Atkins, by and through counsel, Andrew D. Baudendistel, on behalf of Herbert Melvin Adkins, deceased, and respectfully petitions this Court to change the name of Herbert Melvin Adkins. In support of this Petition, the Petitioner states as follows: 1. The name of the deceased on his birth certificate is Herbert Melvin Adkins; 2. The date of birth of the deceased was January 23,1925; 3. The date of death of the deceased was December 30,1980; 4. The Petitioner is the widow of the deceased. The Petitioner and the deceased had four (4) children whose names are: Cheryl (Atkins) Coys, Danny Atkins, Linda (Atkins) Sechrest, and Barb (Atkins) Kaffenberger. 6. The deceased has no current Indiana driver's license; however, as of the date of death, the de ceased's Indiana driver's license number was S303-22-7235; 7. The deceased. has no current residence; however, the current mailing address of the Petitioner is: 436 Bielby Road, Lawrenceburg, Indiana 47025. 8. The deceased does not hold a valid United States Passport. Proof that the deceased is a United States citizen is his bilth certificate which indicates that the deceased was born in Lawrenceburg, Indiana on January 23, 1925. Said birth certificate is attached and 9. No judgments of criminal conviction of a felony under the laws of any state or the United States were ever entered against the deceased; 10. The only document that spells the de ceased's name incorrectly is his birth certificate, other documents attached which indicate his name should be spelled "Atkins include: Honorable Discharge from the United States Army (attached and marked as Exhibit "B"), health insurance card, Seagram's employee identification card, Seagram's retirement card, and Indiana driver's license (attached and collectively marked as Exhibit "e"), and the Certificate of Death Registration (attached and marked as Exhibit "D"). Due to the birth certificate spelling being incorrect, the Petitioner is unable to receive military benefits to which she is entitled until such time as the deceased's name is changed to match the name that appears on the deceased's Honorable Discharge from the United States Army; and 14. Petitioner is requesting this Court to change the deceased's name to Herbert Melvin Atkins. WHEREFORE, the Petitioner respectfully requests that this Court grant this Petition for Name Change, and for all other just and proper relief.
