Q
uestion: We purchased a home in 2006 for $582,000. We put down $130,000 and financed $452,000 with a 5-year interestonly loan as we only planned to be here for four years. Our home is now worth only about $400,000 and we’ve made small payments to the principal so our mortgage is about $449,000. Our mortgage interest rate is set to adjust in June 2011. In addition to our first mortgage, we also have a $9,500 home equity loan that we will pay off in May 2011. My husband is in military, and it looks like he’s going to get orders to move in this summer. Rather than sell the house and lose money we will rent it. But homes in our neighborhood rent for about $500 less per month than our current mortgage payment. than we can pay, once you factor in housing costs in our new location (likely overseas), rental property management fees, and the $500 per month loss. We’d like to refinance before we move, so the mortgage will be on our primary residence, not a rental property, as the rates are lower. But of course, we are way upside down on the loan. Will any bank even touch us? We haven’t missed a payment, have been paying extra principal, don’t have any other debt except a car payment, and have excellent credit scores (both of us are over 760). What are our options, if any? Answer: You’re in a tough spot, although you’re better off than many simply because of the enormous amount of cash you put down on your home. In evaluating what to do, you might consider a Home Affordable Refinance Plan under the Obama Making Home Affordable program. If you qualify, you can have your lender refinance your loan. If you are current on your
loan, live in the home and it’s a one-to-four family building, and your loan is serviced by Fannie Mae or Freddie Mac, you might have a chance at refinancing the loan through the program. You can get more information about the Home Affordable Refinance program by going to MakingHomeAffordable.gov. If you are unable to refinance your loan through the program, you’ll have a tough time refinancing. Why? You owe $449,000 plus the $9,500 home equity loan, for a total of $458,500. That is above $417,000, which is the amount of financing covered by Fannie Mae, Freddie Mac and FHA. Loan limits may be higher in certain high-cost areas. If you’re in jumbo loan territory at that amount, you’d need to find a lender willing to give you two loans: One for $417,000 and a second loan for the remainder that you owe. But here’s the rub: To get that much money, with most lenders you’d need to have 25 to 30 percent in equity in your home. Right now, you’re about 25 percent underwater with your mortgage. Your home is worth substantially less than what you

I don’t think any lender will touch you at the moment, although you should call some local, reputable lenders and have a conversation about your situation. There are very few 100 percent loans available, although the VA offers one, as does USDA. But I believe the VA tops out at $417,000, and your home is worth even less than that, let alone how much you owe above that. To get a VA loan, you’d have to come to the table with almost $60,000 in cash to make up the difference between what you owe and what your property is worth. Your $130,000 cash down payment, a substantial number, has vanished. For a USDA loan, your home has to be located in a qualifying area. Big cities and most suburban areas are out as these are rural development loans. If you can’t refinance, then you have to look at renting your property. It’s clear that you’re
going to lose money. But if you can swing a $500 per month loss for the ext few years, you might find that properties values will rise a bit. What you’re looking at is a $6,000 per year gamble. Normally, I’d tell people to take the loss and move on with their lives. But your house is so expensive, and you have so much at stake, and relatively speaking, you’re not losing that much money, so it’s a gamble probably worth serious consideration. What you have to hope is that when your interest rate adjusts next year, it goes lower, and that thereafter increases are capped by 1 to 2 percent per year, which will help keep things slightly more affordable. Take a look at your mortgage documents to see where you might end up if interest rates stay where they are today or go up a point or two. Like so many others, you’re in between a rock and a hard place. Another option is to find a way

The new programs are supposed to encourage lenders to write down the principal of a loan to the current loan value. FHA is supposed to step in and write new mortgages, even if there is no equity in the property. And borrowers who lose their jobs are supposed to qualify for forbearance of up to six months, allowing them to skip mortgage payments while looking for a new job. It’s possible that these borrowers would qualify under the new rules, but it will take months for the new programs to get up and running. In the meantime, if you’re underwater and don’t want to walk away from your mortgage, you might call the HOPE for Homeowners hotline at 888-995-HOPE and speak to a HUD-certified housing counselor.

overnor Bill Ritter signed House Bill10-1288 — Commercial Real Estate Brokers Commission Security Act today after eight months of research, meetings, negotiations with stakeholders and legislators by representatives of the Colorado Association of Realtors (CAR). It is anticipated to go into effect August 11. “We are pleased the Governor signed this bill and feel not only will this law correct the imbalance between commercial brokers and commercial property owners, but our hope is that it will also encourage a more positive working relationship between both parties,” said George Harvey, president of CAR. HB10-1288 provides a broker with the ability to record a lien for an unpaid commission against a commercial property which has been enhanced by a lease with a tenant produced by the broker. Real Estate Brokers create an increase in value for property owners; a property without a lease has little value. Brokers, who often work for months and even years on a deal to earn a commission, deserve a mechanism that protects them. Brokers who have not been paid their commissions or have not had their written agreements honored properly need recourse for receiving their earned commissions. Tips for first-time homebuyers RHEMA MUNCY SPECIAL SECTIONS

aking the step to become a first-time homeowner presents a thrilling proposition. There are many elements to consider about the home buying a process. Neighbor to Neighbor homeownership counselor Deena Pettit teaches a home buying class twice a month in the Northern Colorado area. She and other professionals offered advice for first home buyers. EDUCATION ON THE PROCESS From going to the library to attending a class, Pettit said education about the process is vital, especially when 90 percent of foreclosed homebuyers never received pre-purchase counseling. “I would steer people away from attending a class at an agency that is going to make money off of you in any way,” Pettit said. “Stick towards a neutral party and receive some education on the process so you know what you are getting into.” DETERMINE SPENDING LIMITS Come up with a spending plan and figure out where your finances are. Are they equal to your expenses? Are you able to save? Are you able to pay up on debt? Where are you going to be post purchase?
DETERMINE SPACE NEEDED Talk with the person the house is being purchased with. What area do you want to be in? What schools do you want to be close to? Do you want to be close to shopping centers and grocery stores or far away? What kind of home do you need in order to
maintain your living or make it a little more comfortable for your family? What are the things you absolutely cannot live without? What are the things you can be flexible on? Theses are all questions Pettit said should be considered. SHOP FOR A HOME “This is the point in the process where you will go and find representation,” Pettit said. “When you are shopping, interview three different Realtors and make sure you are finding a good fit. This is someone you will glean a lot of information and wisdom from and you want to make sure you are comfortable with them. Utilize the power of competition. When people start fighting for your business, the service increases and the prices fall.” First-time home buyers should choose a Realtor that is willing to listen, be honest, available to answer any and all questions, communicate promptly, and assist them in the entire home buying process from beginning to end and thereafter, according to Matheson. “A home is the one of the biggest financial investments of their lifetime,” Matheson said. “A realtor who has resources available to help them find the best qualified lender for their financial situation will assist in price, financing, terms, date of possession, inclusion and exclusion, inspection and resolution, and market conditions in their community.” First-time homebuyers should look for an agent who will walk them through the entire process and educate buyers along the way. “Since this will be the biggest purchase they have ever made, their agent should have their best

interest as a priority,” Luthi said. “Don't be afraid to tell your agent your likes, dislikes and your must haves in a home. Look for a fulltime Realtor who knows the market, familiar with reputable lenders and inspectors. Your real estate purchase can be smooth if you work with an experienced agent who knows the local market.” As for the shopping part, from the home to the realtor, loan and home insurance, don’t just drop money where ever. Spend the money where it is really wanted and deserved, Pettit said. For Realtors, find someone who is going to meet your needs and work the kind of schedule you need and will be in contact with you and on the ball. “For first time home buyers, inventory is scarce,” Pettit said. “When something does come on the market, it tends to go really fast, especially if it is priced well. You need someone who is out there looking for you and in constant communication for you.” MAKE AN OFFER “It is one of the scariest but most fun times in your life. Then get a home inspection. Even if the home is newly built home, it is important to have somebody walk you through the blue print for that property and show you
exactly how it drains and what are the mechanical ins and outs of the property,” Pettit said. SUBMIT YOUR LOAN APPLICATION AND ORDER AN APPRAISAL “Appraisals tend to be a big deal because once an appraiser sets a value on a home, you are crossing your fingers that it will come at or above the asking price or the contracted sales price,” Pettit said. The value if the new home loan depends on this appraised value. A value below the appraisal price can create some sticky situations. First time home buyers also need to plan ahead to have enough saving for their down payment and closings costs for the home they are purchasing, Matheson said. PURCHASE YOUR INSURANCE Pettit recommended shopping several companies and to look for the one with the best coverage and reputation, not necessarily the cheapest price. GET YOURSELF PRE-QUALIFIED “The lender will take your financial information, pull your credit and get you pre-qualified so you can go out and start looking with your Realtor for a home,” said The Group Inc. broker associate and partner Diana Luthi. Get your credit scored pulled
and figure out what kind of improvements you need to make in that area. Right now the lending process is a tricky area to navigate, especially with all of the new regulations and Good Faith Estimate requirements, according to Pettit. “There are a lot of steps that can slow a buyer down if they don’t take early precautions to get the loan under order. Have your head above water and know where you stand financially and with your credit,” Pettit said. Part of that process is knowing what a comfortable payment will be for the family according to Lucinda Matheson, president, office manager and managing broker for Premier Lifestyles Realty. “They will need to interview with a local reputable lenders and find a lender that is best qualified for their financial situation who can qualify them based upon their monthly income, monthly expenses and credit history,” Matheson said. “It is very important to find what new home buyer programs assistance programs are available in the community where they will be purchasing their new home and take advantage of the first time home buyer assistance programs and classes that are available.” Matheson also advised buyers to stay within their comfort level even when they are qualified to purchase above that comfort maximum.

orsican Violet is a closely related cousin to the pansy and shares many traits in common. It is prized for its hardiness and ability to flower in chilly weather and the blooms are a very welcome sight when winter is either on the wane or waiting in the wings. The bounty of pretty-faced, pansy-like flowers throughout the entire year gives Corsican Violet plenty of reason to be considered a penny-wise perennial. Good value is the overall theme of this year’s selections of Perennial of the Week. These violets are cherished for their cheerful flowers of bright purple faces with whisker-like markings. The flowers appear in early spring, continue into the summer and without missing a beat, flower on through the fall.
