uestion: I’m afraid of buying a foreclosure because I don’t want to make a mistake. I have my eye on two properties. One is selling for $365,000, and I want to offer $295,000 and stipulate that the bank pay for all closing costs and fees. The second property is listed for $310,000 as a short sale. I want to offer $275,000 and request that the bank pay all the closing costs. Both properties are in gated communities with houses around it in the price range from $400,000 to $500,000. Are my offers too low? Answer: I’m not sure what your question is. You can offer whatever you want, but the bank (in either case) may decide not to take it. With regard to the short sale, you might not find out for months if your offer is accepted. You may have the offer accepted by the seller only to find out that the lender won’t approve the short sale unless you pay more for the home or you pay not only your closing costs but the closing costs of the seller as well. I’m not suggesting that you’re not offering the right price or getting a great deal. You just need to decide what you want to pay and to avoid getting drawn into a lengthy negotiation with the bank on the fees that could add tens of thousands to the cost of your home. Some buyers in different areas find that foreclosed properties owned by a bank are easier to buy than short sales where owner needs the approval of a lender. In a short sale the owner does not have the full amount of money from the sale to pay off the debts on the home and is therefore short of funds. Some lenders have become hesitant to approve short sales, even though they receive a fee from the federal government for every short sale that closes. Moreover, a short sale can take months to be approved, whereas with foreclosed property a bank can make the deal rather quickly. One final thought: Be sure to hire your own real estate attorney to help with the paperwork for the deal. Be sure you’re protected from hidden liens and other problems or expenses that could crop up. ed� their house to us over five years ago to avoid having the home sold to pay for Medicaid expenses. Now they are 87 and need to move. They may buy a smaller house. My four siblings and I own the home, but the home is occupied and used by my parents. Since we inherited their very low “basis,� our capital gains amount is going to be very high and our tax rate will be about 20 percent, rather than our parents’ 10 percent rate. Is there any way to gift the house back to them so we will pay less in taxes? We can’t avoid it altogether, because they won’t have owned the home for more than two years before they sell it. Answer: If you gift the home back to your parents and they turn around and sell it, the sale will be taxed at ordinary income tax rates, unless they wait one year to sell the home. They would have to wait at least two years to take advantage of the $500,000 tax exclusion on the sale of a primary residence by married couples ($250,000 for individuals), and they may not have time to wait that long. Your situation is not unique. Many parents try to get rid of their assets to avoid paying Medicaid expenses. When your parents gifted the home to you, you effectively obtained the home at your parents cost. If you and your siblings now sell the home, the difference between your parents’ cost of the home, including major improvements to the home over the years, is what you would pay tax on the sale. Had your parents kept the home and now sold it, there probably would be no tax to pay due to the primary home sale exclusion. Now that you are in this situation, you might just have to sell the home and pay the taxes, whatever they might be. While you can transfer the home back to your parents, the net result might be worse if they now sell the home and have to pay taxes on the sale at ordinary income tax rates. To fully appreciate the amounts you are talking about, you should determine what the profit would be from the sale of the home. You also need to assess the risk of giving the home back to your parents at their ages and the risk that they might have to sell it now. Keep in mind that you usually want to transfer assets from parents to children and not the other way around if you are trying to avoid estate tax issues. This year is a particularly interesting year for estate planning. As of January 1, 2010, the estate tax disappeared but other tax laws changed as well. If your parents had owed the home and died this year, they would have to pay no estate taxes, but the transfer of the home from your parents to all of you would be at their cost. In previous years, when parents died and a home passed to children, the children received the home at the home’s value at the time the parents died. Those issues pose an interesting dilemma for you now. For more details, you should sit down with either an estate planner or a tax accountant to help work through your situation.

arimer County year-to-date foreclosures have dropped 20 percent from the same time period in 2009. There were 1,268 completed foreclosures in Larimer County from Jan.-July of 2009, while there have been 1,014 from Jan.-July 2010. According to the Colorado Division of Housing, Larimer County, along with Denver and Adams Counties, experienced the largest drops in foreclosure filings. The Trustee Office of Larimer County reported 2,037 foreclosure filings in 2009, a 566 percent increase from 2000 (there were 306 filings in 2000), largely due to sub-prime mortgages and unemployment. The numbers are not altogether posi-
tive, however, as forelosure filings increased to 156 in July this year from 124 in June. There were 232 foreclosure filings in July 2009, a 32.8 percent decrease. Statewide foreclosure filings were also down for the fourth month in a row when compared with the same month last year. Foreclosure sales at auction fell 15.4 percent during July as compared to July of last year. In a report by the Division of Housing, spokesperson Ryan McMaken said “We continue to see a generally downward trend in both new filings and foreclosure sales at auction. “The decline in sales at auction can be attributed at least in part to the success of programs like the Foreclosure Hotline. However, since foreclosure activity is so closely tied to wages and employment right now, the trend in filings could change at any time in response to the overall strength of the economy.” The Division of Housing’s monthly foreclosure report surveyed foreclosure activity in the twelve largest counties of Colorado. The report is a supplement to the Division’s quarterly foreclosure report that includes all counties in Colorado.

Building permit fee waiver program expires end of Sept. JENNIFER LEHMAN SPECIAL SECTIONS REPORTER
T
he second round of the city’s building permit fee waiver program applying to owner-occupied structures including homes, townhouses and condos, ends September 30. Permits can be applied for through the 30th and can be picked up within 90 days of being issued. “Potentially someone could pick up their permit by the first of the year,” said Tom Hawkinson, Building Official at the city’s Building Division. If permits are not picked up at the designated time, they become null and void, Hawkinson said. It takes about five working days from the time someone brings their information into the building division to the time the permit is printed and issued, said Margie Potochniak, Administrative Technician with the city’s Building Division. The city and county use taxes are not
waived in accordance with state law and taxes are collected on the permit when it is picked up from the Building Division. Contractors can apply for the permit on behalf of owners, Hawkinson said. The city offered a similar program in 2009 for three months, the 2010 program will run for a total of five months, starting May 1. The idea was to get contractors working, get the use tax flowing and help homeowners getting done what they need to get done, Hawkinson said. The building division has mostly seen permit applications come in for single family homes as opposed to town homes or condos. Last year’s program was a success, but quite a few permits were withdrawn, Potochniak, said. Hawkinson and Potochniak attribute this to the holidays (the program ran from mid-October to the end of December) and because people may have not had the money to spend on building
projects at the end of the year. “This year they really seem to be enthusiastic about it,” she said. People are picking up their permits right away and jumping into their projects she said. “So far its been really positive this year I think,” she said. The past couple of weeks have plateaued with the number of permit applications, Potochniak said. “We’ll see a big gear-up in mid-September again.” Whether or not a similar program will begin again next spring is up to the City Council, Hawkinson said. The estimated valuation of the work done on projects participating in the building permit fee waiver program is $3,187,709, according to the Building Division. The amount in building permit fees without the waiver would be $180,270.95 for the estimated valuation. Of that amount, $107,812.62 has been waived through the program. The difference in
these numbers mostly being the the city and county use taxes that are not waived. The council has yet to do discuss the issue for next year said Mayor Cecil Gutierrez, but it will come up for discussion once the council has reviewed the building division’s report on the program. ow is the perfect time of year for butterfly activity; these active and graceful pollinators seek the sweetness of late summer nectar-producing plants. Look around at purple butterfly bushes, yellow black-eyed Susan, coneflowers, asters and daisies and delight in the movement and lightness of these beautiful insects. If your garden lacks these charming visitors, plan now to attract them for next season. Plan it, plant it and they — the butterflies — will come. Butterflies undergo a complex life cycle. Adult females lay eggs on host plants which provide forage for the developing larval (caterpillar) forms. Caterpillars grow and molt successively, then form a resting stage (chrysalis) and, by metamorphosis, become an adult butterfly. Butterflies are cold-blooded day fliers who require sunshine and warmth for growth and reproduction. A butterfly garden provides a biodiverse habitat which has plants for the entire life cycle of the insect, including host plants for larvae and nectar plants from spring to fall. A successful butterfly garden will include: PLANT DIVERSITY Annuals, perennials, shrubs, wildflowers, vines and native species all provide nutritive nectar energy for butterflies. Plants like butterfly bush, goldenrod, aster, coneflower, bee balm, daisy, lantana, gayfeather, yarrow, sedum, phlox, butterfly weed, honeysuckle vine, and sunflowers are just a few. Yellow, orange, red and purple flowers are desired, especially those flowers which form clusters of tubular clumps such as Buddleia. Group similar colored plants together. Butterflies do not hover like hummingbirds, and seek umbrella shaped flowers (i.e. coneflowers) for a “landing zone” to feed and pause. Some butterfly species have specific host plants for larval growth. The Western black swallowtail feeds on fennel, parsley, cow parsnip and dill. The monarch butterfly only feeds on milkweed (Asclepias). Plant cultivated milkweed (A.tuberosa or butterfly weed) for larval habitat in the spring, and then nectar producing yellow, orange and red-orange flowers in the summer. The fritillary butterfly is attracted to sedum for similar reasons. A natural Colorado meadow is an area where butterflies abound. Using native species and wildflowers in a messy wild patch of the garden encourages overwintering and gives butterflies and other insects a home and protection. SHELTER, SUNSHINE AND MOISTURE Butterflies need the warmth of sunshine. On cold or cloudy days, the early morning hours is spent basking, often on a warm rock, resting with wings stretched and refolded as the temperature warms. Butterflies are most active between 75-90 degrees F. A butterfly garden should have mostly sun and some shade. Butterflies also need shelter from wind for egg laying and rest. A windbreak or a flowering hedge can provide this. Butterflies cluster at the edges of shallow sandy areas for drinking and mating purposes. A shallow bowl of water with a few stones or pebbles to provide a resting spot is an alternative in the home garden. Butterfly houses can provide additional protection. CHEMICAL FREE ENVIRONMENT Insecticides and added chemicals interrupt the life cycle of the butterfly, so as much as possible, butterfly gardeners should try to use natural methods for pest control. The more natural a habitat, the more successful butterfly populations will be. Do not be too hasty to eliminate an unknown caterpillar in the spring. Use an insect identification book and save a potential butterfly for your garden oasis.
