In the early afternoon of Jan. 4, 1987, an Amtrak train crashed into a locomotive, 18 miles northeast of Baltimore, causing 16 deaths and dozens of injuries. In post-accident drug and alcohol testing, the engineer driving the train tested positive for marijuana, although no one noticed anything unusual about his behavior before the crash that day. The threat of workplace drug use was well-known even before the tragedy. Six years prior to the Amtrak incident, the crash of an aircraft aboard the USS Nimitz spurred an investigation by the U.S. military that found widespread use of drugs among U.S. Navy personnel. These events helped prompt Congress to pass the Drug-Free Workplace Act in 1988 to address the issue of workforce drug use. The act requires certain federal contractors and all federal grantees to agree that they will provide drug-free workplaces as a condition of receiving a contract or grant from a federal agency. In 1991, the government also authorized mandatory random drug testing for employees in “safety-sensitive” jobs in industries regulated by the U.S. Department of Transportation, resulting in the creation of 49 CFR Part 40 in 1995. Similarly, the explosive growth of crack cocaine in the United States in the mid-1980s focused attention on the workplace impact of drug use in the private sector. This led to the implementation of workplace drug education, monitoring and employee assistance programs for both public and private employees. Thanks to the coordinated efforts of the medical and business communities, the rate of positive drug tests in the workforce has declined significantly among employers who have instituted a drug-free workplace policy since the implementation of the Drug-Free Workplace Act. Naval Air Warfare Center Weapons Division Total Force Strategy & Management Department Point Mugu, CA 93042-5049 24 August 2015 To Whom It May Concern: My name is Chris Perkins and I am presently the Division Head of the Personnel Policy and Programs Division of the Naval Air Warfare Center Weapons Division (NAWCWD). I am writing this letter on behalf of Mr. Joe Torres who was employed as the Civilian Employee Assistance Program (CEAP) representative for (NAWCWD) Point Mugu from approximately May 2004 through May 2014. During this period of time I had the pleasure to work with Joe, often on a daily basis, as he assisted employees, supervisors and my staff on a variety of workplace issues. I would frequently engage Joe for advice and guidance on difficult and complex issues: critical incident debriefing; suicide prevention and intervention; workplace violence, etc. as well as routine human resource matters. I always found Joe to be responsive to our needs and his advice and guidance often led us to arrive at effective solutions for even the most complex of issues. Joe had a unique ability to quickly gain trust; cut through to the core of the issue; and engage managers and employees at their level to resolve employer-employee disputes. From 2007 through 2010, the NAWCWD Point Mugu workforce was under considerable strain due to down-sizing from Base Realignment and Closure (BRAC) decisions. We had approximately a quarter of our workforce (300+) potentially facing layoff and transfer. Joe was readily available to employees during this stressful time and helped many navigate their way through a very difficult and emotional decision-making process. In May 2014, the Department of Navy implemented a centrally managed Employee Assistance Program – DONCEAP, administered by the Federal Occupational Health administration. Unfortunately, our employment relationship with Joe ended at this time. I am forever thankful for his time and expertise in assisting many of our employee and supervisors at NAWCWD Point Mugu.
