Forging Ahead With Resource Efficiency

I

am delighted to introduce the Irish Packaging Yearbook and Directory 2012. My Department is responsible for the implementation of the EC Directive on Packaging and Packaging Waste in Ireland through the Waste Management (Packaging) Regulations 2007. The purpose of the Regulations is to ensure that packaging is managed in an environmentally friendly manner by minimising the production of packaging waste and ensuring that as much as possible is recovered, recycled and reused. Ireland continues to exceed our EU targets thanks to the help of industry. In 2010, a recovery rate of 74% was achieved, 14% above the 60% EU target due by 2011.

initiatives include packaging training, sector specific guidance and case studies, all of which are available to companies from the website. Furthermore, the EPA’s Cleaner Greener Production Programme has focused on packaging. For example, by applying eco-design principles to its packaging designs, Dawn Meats reduced the amount of packaging it created by 10%. This reduction resulted in related savings due to reduced resource consumption.

The Review of the Producer Responsibility Initiative for Packaging In late June, as mentioned in last year’s foreword, I launched the review of the Producer Responsibility Initiative Model in Ireland. This review will examine all aspects of the regulatory structure for packaging compliance in Ireland, including the possibility of a packaging levy, competition, self compliance, enforcement, deposit and refund and reverse vending. The wide ranging nature of this review will provide me with an overall assessment of the existing regulatory structures and will assess how various proposals might impact or complement our current structure. I want to thank all of the industry stakeholders who have provided their valuable input into the review of the Producer Responsibility Initiative Model in Ireland and the earlier consultation on a possible packaging levy. I expect that my Department will have the conclusions of the review on the packaging sector for consideration before the end of the year. Any policy changes which might be forthcoming should be viewed as an opportunity. They provide the opportunity to build on the industry’s success in exceeding EU recovery targets. They also provide a platform from which the packaging industry can position Ireland as a leading exporter of expertise in packaging waste prevention. I know that the Irish Packaging Yearbook and Directory 2012 will be an extremely useful tool for the sector.

A New National Waste Policy Statement: ‘A Resource Opportunity’ In July 2012, I published the Government’s new waste management policy statement ‘A Resource Opportunity’. This policy will provide the regulatory certainty that industry needs to plan and make investment decisions. In terms of the prevention of waste, the EPA, as part of its renewal of the National Waste Prevention Programme (NWPP), will be asked to focus on resource efficiency, prevention and reuse. In addition, all local authorities (whether acting separately or in groups) will be expected to participate in the Local Authority Waste Prevention Demonstration Programme, which provides the skills to develop waste prevention in local communities. The measures outlined above will focus even more attention on the steps industry takes to minimise packaging waste. The minimisation of packaging waste will help reduce operating costs. It could be a competitive advantage for firms looking to increase sales. Consumers are fully aware of the financial benefits of reducing the number of bin collections they have annually. Therefore, consumers may be more inclined to buy better packaged products. The ongoing Packaging Waste Prevention Programme, jointly funded by the NWPP and Repak (www.preventandsave.ie) continues to deliver. Between July 2010 and June 2011, the programme worked with over 30 companies on packaging related projects and carried out 12 formal packaging optimisation surveys. Other

W

ith the current global population standing at seven billion and set to rise to over nine billion by 2050, the planet’s resources are already stretched and landfill space is running out. In recent years, governments have been forced to take steps to impose and meet targets for recycling and encourage innovative ways to help reduce packaging waste. Major retailers and brand owners are demanding sustainable business practices from their suppliers in their quest for “greener” solutions. The packaging industry is taking steps to address this through light-weighting of materials and use of alternative materials/technologies, all the while ensuring the performance level and quality of the packaging is maintained. Some examples of new materials/technologies that have come about in packaging include:

• It is capable of growing 24 inches a day; • It doesn’t require pesticides or fertilizers; • It absorbs five times more CO2 than trees and produces 35% more oxygen; • It is certified for both recyclability and compostability; • Bamboo is available that is REACH, RoHS and FDA 21CFR175-177 compliant; • When harvested, the plant is not killed and there is no damage to its large root structure; • Poles mature in 4-7 years, compared to 30-50 for hardwood trees. When traceable to FSC certified forests, waterways, wildlife habitat and species are protected. Furthermore,

the rights of indigenous peoples are respected and local people are involved in forest management. The majority of the water used in the pulping process is reclaimed and rice hull (waste from rice harvesting) is what is used to fuel the process. Other materials being looked at and trialed as packaging alternatives include rice hull, coconut waste, sugarbased polymer, corn, bio-films, etc.

The advantage of the individual cushion cells is additional protection of the packaged product, in case one cell is punctured or damaged: i.e. the integrity of the cushion is not compromised. It uses less energy to manufacture, less raw materials, is volumetrically smaller, uses 100% recyclable materials, and has undergone a life cycle review, offering increased sustainability and a better cradle-to-cradle design as a “green� product. Fibre/Core Wood and Plywood Replacement: 100% recyclable and traceable to FSC-certified forests, Fibre/Core provides a lighter, sustainable alternative to wood and plywood for building crates, skids and pallets, and is even used for temporary furniture. This extraordinary paper-based product provides tremendous vertical strength, combined with outstanding lateral stability. It weighs up to 50% less than wood and has the available option of a wax coating being applied to the bottom in order to prevent water penetration. Fibre/Core in its many forms can substitute wood where performance is vital but the use of wood is restricted. It is safer/easier to handle as it is free of chips, splinters and nail heads and can be processed with traditional wood equipment. Users can benefit from package weight reduction and freight savings, as well as direct material cost reductions.

No Better Time to Box Clever Packaging designs must evolve continuously for companies to meet the changing market and sustainability needs, as well as being socially and environmentally responsible. There are numerous tools out there to help move companies in the right direction.

Airpaq Case Studies One customer switched from thermoformed plastic cushions to AirPaq, with the following benefits: i) The 3.5� AirPaq cushions weigh less than thermoformed cushions by 42%. ii) The overall size of the corrugated container has been reduced by 53%. iii) The AirPaq cushions are supplied preinflated, thereby providing 97% increase in pallet density. Another customer switched from 2 PE endcaps to 2 AirPaq endcaps, which led to a reduction of 72 sets / pallet to 5,000 sets (69 pallets to 1), resulting in reduced costs in storage, freight, materials and waste. Meanwhile another customer changed from packing 250 LCD monitors in Instafoam and into 16 different boxes to all monitors being packed in AirPaq and in just three different boxes. This resulted in a cleaner, chemical-free process, with reduced waste and a reduction in the cost of materials used. The verdict: AirPaq has the ability to deliver significant savings to customers.

Implementing Environmental Standards ISO14001 is an internationally recognised certification scheme for environmental management that provides for savings through energy reduction, waste minimisation and pollution prevention. However, to achieve and maintain this standard requires resources that smaller companies may not have. That’s where €coCert comes in…. Small companies that are doing what they can to save on energy, raw materials and waste can still get recognised for their efforts. EcoCert helps companies to get on-track by identifying their cost-saving improvement areas while helping them meet the certification requirements. The requirements are very straightforward and provide a framework for further improvements, year-on-year (see www.ecocert.ie for further information). for different processes. Packaging Assessments: How Low Can You Go?

Down-sizing will continue to happen in order to reduce weight and materials used. Recyclability and recoverability of materials will continue to be a key deciding factor. While innovation might be held back in the current market due to cost-cutting and a shifting of priorities, certain changes are accelerated for the same reasons, making it a perfect time for opportunists to think outside the box.

Providing information to the decision makers to select the products or processes that result in the least environmental and human health impact. Avoiding shifting environmental problems from one place to another. Reducing supply chain costs and impacts. Demonstrating product stewardship and reduce downstream impacts. Influencing regulatory initiatives. Comparing products or processes on the basis of impacts, efficiency, or emissions. Facilitating purchasing of environmentally preferable products (e.g. Bamboo, AirPaq). Comparing available technologies to solve problems.

Life Cycle Analysis Life-Cycle Analysis (LCA) is a method by which elements such as the energy and raw material consumption, emission types and other important factors related to a specific product are being measured over the product’s entire life cycle from an environmental point of view. Life-Cycle Analysis attempts to measure the ‘cradle to grave’ impact a product and its manufacturing processes have on the ecosystem. nnovation, variety and flair were on display at the annual Pro Carton/ECMA Awards, when the latest winners were celebrated in Dusseldorf at the Pro Carton Congress this year. The awards were presented in 12 categories to cartons which have already proved themselves on the market in Europe, and with 114 entries from 15 countries, the competition achieved the second highest number of participants in its 15-year history. The coveted Carton of the Year was awarded to a pack which impressively improves on its previous form in metal packaging. The product is a gift from ABT, a car tuning company, to its most valuable customers in the automotive industry. The styling and attention to detail of the carton, which echoes the shape of a sports car exhaust pipe, amply conveys the premium quality of the gift.

This is more than confirmed by the winning entry in this category, the Illy brand, with its 'Astuccio monodose', which changed from metal to cartonboard and where the company had little doubt about being able to maintain their brand value and premium positioning at the same time.” Entries for the category for the most innovative cartonboard solution always produce a lot of surprises and the winning entry from the STI Group was no exception this year. A waterproof cartonboard tray designed to prevent glasses, plates and cutlery from slipping from the tray, even at extreme angles, and capable of branding and individual design, is a truly innovative concept and provides an excellent solution for caterers.

To honour a really exceptional achievement in cartonboard design, the President's Special Award was presented for the first time this year to the Carton Smart, a fully functioning “for two” Smart car, which has all the plastic parts of the bodywork and interior replaced with small cartons. Not only was the external bodywork composed of thousands of cartons, but also the rear-view and external mirrors, rims, dashboard and floor mats. In total, over 7,000 cartons in four different shades of green were used. There was a special focus on sustainability this year. Satkar Gidda of the design agency SiebertHead, and Chairman of the judging panel, commented: “Brand owners are focusing more on sustainability and will be

the Internet via codes; on the other hand, consumers want to see the packaging during online purchases. President of Pro Carton, Roland Rex concludes: “The numbers are clear cut: packaging belongs to marketing planning and the marketing budget, the same as other media. It is not simply a medium among many, but one of the most effective. Cartons as a Marketing Tool

Although not all cartons can be competition winners, Pro Carton believes that cartons show variety, skill and innovation every day on the supermarket shelves and help brand owners to sell their products. The challenge, however, is to substantiate this and to answer the question: does packaging only support the classic 4 P’s – product, promotion, placement, price – or does it have a value of its own, its own role in the marketing mix? To examine this further, Pro Carton asked Pointlogic International Media Consultants to undertake a study, ‘Packaging: a Medium with Considerable Power’, which compares the efficacy and reach of 23 different communication channels, including packaging. The study was conducted in Germany, and examines the contribution of packaging from two angles: first, the media-relevant data of the individual consumers were quantified for the first time with packaging and compared with other promotional media; secondly, the potential of packaging to reach marketing and advertising objectives was calculated on this basis and examined in detail. Over 2,000 consumers were asked to connect 23 different media with relevant communication tasks and estimate how well each channel is suited for meeting this task. The responses revealed the power of packaging both at the Point of Sale and in a domestic environment. Direct comparisons were made with other media and channels used in marketing communications, such as TV, radio, internet, newspapers and the results clearly show the efficacy of packaging: • Packaging is one of the most influential communication media and contributes greatly to brand communication; • Packaging is a medium with broad scope – it is effective both in stores as well as in consumers' homes; • Packaging influences the various aspects of the buying process; • Packaging appeals to all consumers. Younger consumers tend to notice packaging even more than older consumers – a sure sign that packaging will not lose importance in the long-term; • Packaging is of major relevance in a digital media world. On one hand, it can connect consumers with

Maximising our Resources As well as the marketing and communication aspects of packaging, it is clear that brand owners are also focusing more on sustainability. Cartonboard packaging has a good story to tell on sustainability, since over the past two decades, the industry has reduced its atmospheric emissions, effluent load, carbon footprint, water intake and energy use. And while sustainability remains a key topic, another environmental challenge is taking centre stage: resource efficiency. Building on its sustainability record, cartonboard packaging can point to many positive aspects which show that it is resource efficient. Almost all of the wood fibre used for production of cartonboard in Europe comes from managed European forests. This resource is sustainably managed and renewable; forest owners supplying the industry can demonstrate this by applying to independent, third party, auditing bodies for an assessment of their performance. The two main certification bodies are PEFC and FSC. 99.9% of company owned and company leased forests in Europe are certified by independent certification schemes. Cartonboard manufacturers use wood fibres from forest thinnings, small diameter tops of large trees and 8

the round sections of the trunks which are removed in the saw mills (saw mill waste). No tropical rain forests are destroyed in order to produce paper and board in Europe. The paper and board industry does not use wood from tropical rain forests, as, apart from other considerations, this wood is not technically suitable. The cartonboard industry also uses waste as a resource, through recovering and recycling used paper and board. Manufacturers constantly work to optimise material use and thus reduce waste. Paper and board, including cartonboard, achieved a recycling rate of 78% in 2010. As water issues are local to the manufacturing site and carry different weights depending on location in Europe, the European paper and board industry has focused to date on water abstraction by mills. Companies are encouraged to improve efficiency of the water resources used at the mills in the production process and the water resources drawn from the ground or surface. The trend during the past two decades has been to reduce the withdrawal of fresh water by 20% in total volume. In 2008, 94% of the water used by the European paper industry was returned to surface water supplies.

European paper and board companies, including cartonboard manufacturers, are leaders in renewable energy. Mills produce much of their electricity and most of their heat on site and increasingly, surplus electricity is supplied to the local or national grid. Installation of boilers fuelled by biomass has meant that more than half of the European pulp and paper industry’s total primary energy consumption is bio-energy and this corresponds to one fifth of the bio-energy produced in Europe. The use of renewable resources for energy generation, which are used responsibly and which benefit climate change as a substitute for fossil fuels, such as coal and oil, is undoubtedly an asset for the industry and an excellent example of resource efficiency. The use of bio-energy also has an enormous impact on the emissions profile of the industry. Carbon dioxide emissions from biomass are considered at least carbon neutral and according to the recent Pro Carton study, using cartons has a positive effect on the climate change issue. The trend is also continuing for using less energy. From 1991-2010, the European pulp and paper industry’s consumption of electricity and all primary energy

Preventing Food Waste In the EU Commission’s “Road Map to a Resource Efficient Europe,” food has been identified as a key impact area, and therefore indirectly, packaging is involved in this debate. In Europe, 62% of folding cartons produced are used to package food and together with other packaging, are part of the solution to the problem of food waste. By protecting food and reducing food waste, cartons contribute to resource efficiency and more sustainable consumption. 9

RELAND has an excellent record of meeting its packaging recovery targets. From an initial rate of under 15% when Repak was founded in 1997, we are now recovering just under 74% of the packaging managed in Ireland (See Graph 1).This positions Ireland as the seventh best packaging recycling country in Europe (See Graph 2).

packaging consumption and the economic climate. This is a difficult concept to illustrate, as we are talking about measuring the prevention of packaging waste or measuring something that is no longer there. Looking at the Sales Volume Index figures provided by the Central Statistics Office, we get a picture of what should be expected on the market each year compared to a base year figure of 2005. The packaging placed onto the market by Repak members since 2005 has shown a decrease of about 2-3% each year compared to what would be expected from the Sales Volume Index. The cumulative effect of this is a 14% reduction in packaging placed on the market compared to the expectation of the Sales Volume Index (See Graph 4). These figures support a similar trend shown in the latest EPA National Waste Report for the amount of packaging managed per person (See Graph 5). At 0.24 packaging tonnes managed per person in 2006, this has dropped to 0.189 tonnes per person in 2010, equivalent to a drop of 21% (i.e. a drop of 51kg per person). While the economic downturn has definitely had an effect on the figures, it also has to be acknowledged that businesses are now trying to optimise their packaging and prevent packaging waste. This makes economic sense as well as environmental sense and in the current climate, excess packaging waste is one of many costs that a company cannot afford. While optimising packaging is not a new

While this is admirable, there has also been increased concern about the amount of packaging placed on the market in the first place. This had gradually been increasing up until 2007 but has seen a reduction in the years since then (See Graph 3).

Packaging Optimisation and Packaging Waste Prevention The concern is that this decrease in packaging placed on the market is purely due to the economic downturn and will pick up again once the economic climate improves. Companies are much more prepared to show their customers what they are doing to reduce the amount of material they use and to promote the re-use and return of packaging. In the past, such packaging improvement projects were carried out in the hope that no-one would notice the change. Difficulties arise when customers see or perceive a negative change that impacts on the product they are buying. If a product is packed in a lighter or thinner material without adversely affecting the product it contains, then there should not be an issue, but such changes are now more likely to be communicated to remove any suspicion or doubt in the customer’s mind. There can also be issues surrounding products that are bought for oneself compared to products that are bought as a gift for someone else. We are much more likely to accept a new lighter/thinner/smaller pack if we will use the product ourselves, but are not so keen to accept the change if the product is a gift for our friends or family. This type of issue is what is driving the current debate around what is ‘adequate’ or ‘acceptable’ packaging.

Case Study: Lakeland Dairies LAKELAND Dairies in Killeshandra are well used to working with Repak to improve their environmental performance. Already keen recyclers (Lakeland won the Repak Member of the Year Award in 2007), Lakeland were one of the first companies to use the Packaging Optimisation service. As a result of recommendations generated by this survey, as well as the commitment of the Lakeland staff, a number of measures have been implemented to reduce the amount of packaging material placed onto the market.

Segregation of material for recycling: Different packaging types are segregated to achieve the best value for the recycled material. These include tetrapak containers, EPS ice cream tubs, PS milk tubs and the webbing used to seal milk containers. Ice cream is now being re-worked through return piping, which eliminates the need for large plastic tubs that were once used to store re-worked product.

Repak’s ‘Prevent and Save’ Programme Repak are helping their members to optimise their packaging systems and reduce packaging waste through the ‘Prevent and Save’ programme (www.preventandsave.ie). Trained packaging technologists visit company sites and carry out a packaging optimisation survey to determine where the opportunities are to reduce packaging waste and optimise packaging systems. The surveys normally take between two and three hours and the technologist will discuss any of the findings with the company before leaving the site. They will then compile a report on the survey, discussing the ‘Best Practice’ already in operation and the opportunities for improvement with regard to packaging. A summary of these opportunities is also provided that can act as an action list for the participating company (See Lakeland Dairies Case Study). Reduced input packaging: Input packaging has been reduced in several areas, including tubs for ice cream. Cardboard cases are no longer being used to pack the tubs and a basic pallet frame is being used instead. Re-use of woven plastic sacks: Woven plastic sacks for raw material deliveries to Lakeland are re-used to store and return recyclable materials. Reduced output packaging: A lot of work has been done in the finished goods area to minimise packaging. Standard size pallets are used, very little secondary cardboard is in evidence, and pallet covers, base sheets and layer pads are kept to a minimum.

Longer Term Outlook

Returnable input packaging: Pallets, pallet tops and other input packaging are being returned to input packaging suppliers. Plastic film cores are returned for re-use and cardboard cores are returned for recycling.

While it is imperative that we manage our packaging systems now, there is also a longer term view. What happens when the economy picks up again? How can we prepare for this and what will be the consequences? It is estimated that the global demand for food, feed and fibre could increase by 70% by 2050, not very far away. The “Food Harvest 2020” report published by the Department of Agriculture, Fisheries and Food in 2010 (see www.agriculture.gov.ie/agri-foodindustry/foodharvest2020)

The most common form is the combination of a plastic thermoformed sheet used to make the cavity and, for ‘pushthrough’ blisters, a sheet of 20µm rigid aluminium foil laminate providing the lidding layer. The next generation of blisters saw alufoil prove its exceptional value, with the development of the coldform or alu/alu blister. No other flexible packaging material can match the all alufoil blister to protect against humidity and gases. Accessibility and convenience for many types of pharmaceutical products have been achieved because of the blister. In 50 years, the format has evolved into an indispensable packaging product and found new applications, even for its original use with foods, such as confectionery and chewing gum.

Birthday for Blister Packs Alufoil blister packs are this year celebrating 50 years of solid service. The first blister pack was introduced to the market in 1962. Today, it is hard to imagine a world where unit doses of solid form pharmaceuticals are not available in this user-friendly format. So many advantages for the end-user have emerged and its most obvious benefit is that it is always clear how many tablets have been used. However, the first style of pack to incorporate a cavity and lid was designed for food containers, not pharmaceuticals. It took a clear vision of its potential to create the blister packs we know today and to raise the bar on both form and functionality. New materials and modern engineering have enabled this dynamic form of packaging to become an indispensable part of life: easy to carry; available in a wide range of shapes, sizes and formats; simple to print on and brand; and of course, a very secure and protective pack! The birth of the blister was far from simple. Indeed, it came about because of the need for birth control. When Schering (today Bayer) developed the first birth control pill, it needed a pack to aid patient compliance and make it simple to control administered doses over a set time period. Blister packs had become possible thanks to the development of PVC and later copolymer, which had

Originality and Technical Innovation Take Centre Stage THE great diversity of applications and multiple functionality of alufoil were clearly demonstrated by the entries for the Alufoil Trophy 2012. Particularly impressive was the original thinking which had gone in to some traditional items, taking them to a new level of performance and technical innovation. difficult shape to wrap. The solution offers excellent readability and a complete adherence to the complex contours of the product. Important to the design is the tab opening, which runs along the front of the bar rather than around it. This allows easy access and enables consumers to see the entire clever shape of the bar when unwrapped, adding to its appeal. When it comes to Product Preservation, Guala Closures Group has developed a standard sized roll-on aluminium screw cap, which incorporates a tamper evident feature. Roll-On TE has been produced to offer the wines and spirits sector additional protection for premium brands from forgery or tampering, without affecting existing production lines or filling speeds. It comprises a coloured plastic ring, incorporated into a standard rollon cap (30x60mm). What are the challenges for the food industry in this area? Dialogue is required between the food producer/ packer and the packaging supplier in relation to any FCM. The packer needs to ensure that the supplier is clear about the intended conditions of use of the packaging material, so that they can supply the necessary declaration of conformance (DoC) or technical data necessary to show that the packaging material is suitable for the intended use. Several issues can impact on the performance of packaging and the rate of migration of materials into food. For example: the temperature at which a product is processed and stored at; the shelf-life of the food or beverage and the length of contact time between the foodstuff and the packaging material; the composition of the food, in particular the fat content and pH, as these will also influence the rate of migration.

Primary FCM Legislation The Framework Regulation (EC) No 1935/2004 is the primary legislation for FCM in conjunction with the GMP Regulation (EC) No 2023/2006. There are also a series of material specific European Directives and Regulations that apply. In Ireland, there are no additional national requirements but it should be noted that some other member states do have additional legislation for producers and importers of FCM. Packaging suppliers will need to ensure that materials are tested and DoCs are available for FCM produced and/or imported into the EU. There are currently DoC requirements for plastics, recycled plastics, ceramics, and active and intelligent materials, with some of the new provisions relating to plastic materials coming into force in January 2013. Suppliers will need to use reliable/accredited labs to ensure the credibility of results and satisfy regulatory requirements. In Ireland, the monitoring of compliance with FCM legislation has been subcontracted to the NSAI, by the FSAI, who will be inspecting importers, manufacturers, distributors and suppliers of FCM.

On one hand, food business operators (FBOs) want to promote their products in a competitive market, so anything that can give them the edge is important. On the other hand, consumers don’t want to be misled into buying a food product that claims or implies it will do something it can’t. In Europe, the decision was made to introduce a formal process for approval of health claims. There are some precedents for this in Japan and the USA (van Loveren et al, 2012). So far there has been some controversy, with some commonly held beliefs regarding health benefits for foodstuffs being rejected by the European Food Safety Authority (EFSA), the body responsible for issuing scientific opinions on health claim applications, at the first attempt. The European Commission (EC) and EFSA have been criticised in recent times, providing fodder for the tabloids, with a UK MEP challenging the European Commissioner with responsibility for food to a prune eating contest to

Labelling, Nutrition and Health Claims Probably the most topical issue when it comes to food law aspects of packaging and labelling relates to nutrition and health claims and the recent food information regulation. Food businesses will need to review labelling to ensure compliance with the nutrition and health claims legislation (Regulation (EC) 1924/2006) and plan for compliance with the new labelling require-

Milk helps support the normal and healthy development of teeth. Milk contributes to dental health.” Equally, it has been difficult for those seeking to make claims in relation to probiotics to gain authorisation: applications relating to certain Lactobacilli and Bifidobacteria and their role in supporting healthy gut flora have not been authorised, as the scientific data provided were not considered to be sufficient in certain respects. These would be familiar to us from television advertising as some of the “good bacteria” that might help us “stay healthy”! So for businesses in this area, there is more work to do to get over the approval hurdle or perhaps they may have to review their marketing and advertising campaigns in the future! It certainly has implications for the functional foods market.

EC Database

Product recalls, amongst other developments, have led to an increased focus on Food Contact Materials and changes to legislation.

The EC has set up a database of authorised and rejected health claims that can be accessed at the following link: http://ec.europa.eu/nuhclaims/ The register currently contains over 2,000 claims, of which almost 250 have been authorised, (the rest were rejected). FBOs can use this information to determine if a health claim is permitted or not, but in order to make a claim, the FBO will need to be able to show that the amount that the consumer would normally eat can provide the benefit claimed. Minimum amounts of the nutrients/substance/food may be specified in the authorisation, for example the number of grams per portion, or it may be linked to the nutrition labelling requirements in Regulation 1924/2006, e.g. source of nutrient/substance/food. Any food business operator can use authorised health claims if the conditions of use and any applicable restrictions are respected. This is seen as a benefit for SMEs, as they may use health claims approved through applications submitted by larger businesses. Not surprisingly, there are terms and conditions of use! Health claims can only be made for the nutrient, substance, food or food category for which they have been authorised, and not for the food product that contains them. Non-authorised health claims cannot be used. There may be some flexibility around the wording used but the fundamental principle of the food information regulation applies (i.e. the consumer must not be misled).

Claims that can not, should not be made”. A nutrition claim, in essence, relates to the energy or calorific value provided (or not!) by a food, or to the presence, absence or amount of nutrients contained in the food. Health claims are based on the relationship between a food or its constituents and health. Stated or implied claims are both covered by the regulations.

Categories of Health Claims Health claims fall into two broad categories, claims related to ‘function’ or ‘risk reduction’ claims. ‘Function’ health claims relate to growth, development and functions of the body, or psychological and behavioural functions or slimming or weight control. ‘Risk reduction’ claims relate to risk factors in the development of a disease e.g. the effect plant stanol esters have in reducing cholesterol and its role in the development of coronary heart disease. In addition, health claims relating to children’s development are addressed separately. Risk reduction claims and those relating to children’s development go through a different authorisation process than that for function health claims. Examples of authorised health claims: “Calcium is needed for the maintenance of normal bones and teeth”

1169/2011) is to improve information to consumers and allow them make more informed choices. This is a positive step to empower the consumer in the battle against obesity and in transparency, but is it a step too far? Once again, the battle lines were drawn between the trade lobby groups and the consumer, and animal welfare lobby groups, amongst others. The latest “labelling” legislation refers to food information for consumers and clearly extends beyond the traditional labelling context; it also applies to advertising and presentation of foodstuffs, including marketing via modern technological tools such as the internet. The existing requirement that food information must not mislead, continues and is an important principle to consider when interpreting food labelling requirements. New labelling legislation aims to enable consumers to make balanced and healthier dietary choices; it introduces a mandatory nutrition declaration (previously voluntary) and requires information to be accurate, clear and easy to understand. Mandatory requirements are extended and any additional voluntary or additional information must not detract from, obscure or be displayed to the detriment of the mandatory information. There are legibility requirements, including aspects such as font size (1.2mm), spacing, appearance and contrast; there is a reduced font size (0.9mm) requirement for packs less than 80 cm2. Allergens and their derivatives must be clearly indicated in the list of ingredients, using means such as a different type-face for emphasis. There are additional requirements for certain categories of foods e.g. beverages or foods with high caffeine content, frozen meat/ fish products, refined oils and fats. There are also some exemptions for certain alcoholic beverages, non-prepacked foods and foods sold in small pack dimensions. Compulsory country of origin labelling has been extended to other fresh meats in addition to beef, with the possibility of further extensions to follow. Another area for future development relates to the energy value on alcoholic beverages and a definition of ‘alcopops’. These new rules come into force on December 13, 2014, with some exceptions, notably the mandatory nutrition declaration that applies from December 13, 2016.

There are opportunities in relation to labelling with permitted nutrition claims, protections for certain geographical indications and traditional specialities and organics under EU law. But for protected designations, the investment in time and effort to achieve protected status must be weighed against the potential return that might be achieved. Anecdotally, time scales of around five years have been quoted in terms of the time taken to obtain protected designation status. Labelling requirements are extensive, with many specific requirements and a number of exemptions, making it advisable for food businesses to pay close attention to the legislation or to seek expert advice if necessary.
