Though not technically a “credit” (the amount must be repaid over a 15-year period), this sort of cash on hand will go a long way toward helping young, working buyers purchase their first home. Falling prices can be bad for buyers

Buyers will want to take advantage of this interest-free cash since, as Yun points out, “today’s dollar is worth more than tomorrow’s and certainly far more than it will be worth 15 years from now.” Yun also notes that the tax credit will lessen the pressure of foreclosure by helping the market move forward again. In fact, some of the hardest hit markets such as Las Vegas, NV and Sacremento, CA, are already seeing that turnaround. In the case of Las Cruces, where the market has remained strong throughout the housing slump, the stimulus plan should add an extra shot of adrenaline to the local market. “Bargain hunters and first-time home buyers who had been priced-out during the boom years have returned to the market,” Yun notes, seeing signs of recovery even before the stimulus plan takes effect. Furthermore, the approved stimulus package raises the limits for Federal Housing Administration (FHA) and government sponsored enterprise (GSE) backed loans. “NAR, of course, has been working diligently for years for some of the provisions in the Housing Stimulus Package,” says Yun. “All that hard work has paid off and both home buyers and sellers will benefit.”

The home mortgage market is devilishly difficult to navigate in normal times. During a period in which home prices are declining, the difficulties are compounded. Problems I had never thought about before now pop up regularly in my mailbox. Here are a few of them: Constructing a Home Becomes More Hazardous: Constructing a home to one's own specifications is enormously appealing to many people. It is also a time-consuming process with many pitfalls that can cause delay, cost extra or both. John agreed with the lender on a combination loan, a construction loan that would convert into a permanent mortgage upon completion of construction, with a 5 percent down payment. The construction cost was $1 million, making the down payment $50,000. Construction took a year, at the end of which the lender had the house appraised and found it was worth only $800,000. This reduced the loan amount to $760,000 and forced the borrower to come up with $240,000 rather than the anticipated $50,000. John does not have the added $190,000 to put down, and the house could go to foreclosure without ever

being occupied. More likely, the deal will be modified with the lender sharing the loss. I have always advised against constructing a home from scratch unless the borrower owns the land outright and has uncommitted monies in reserve. In today's market, such caution is even more important. Balloon Loans Are Hazardous: Tom took a five-year balloon loan 4 1/2 years ago because the rate was a little lower than that on a 5/1 adjustable-rate mortgage (ARM). On both instruments, the rate is fixed for five years, but on the balloon the balance is payable after five years whereas on the ARM it is not. The ARM rate is adjusted after five years (and every year thereafter), but the lender cannot demand repayment. In a normal market, the borrower with the balloon could easily refinance, provided that his credit remained strong. He would pay the current market rate, which might be higher or lower than the rate he had been paying, but his ability to borrow would not be an issue. Tom's house, however, is in a neighborhood devastated by foreclosures, and its current value is 20 percent less than it was five years ago. As a result, he cannot refinance without putting up additional cash that he does not have. Foreclosure is on the horizon.

Lease-to-Own Deals Can Unravel: Two years ago Mary did a lease-toown deal under which she paid a home seller 2 percent of an agreed-upon price for an option to purchase the house at that price within three years. Mary also pays rent for the right to live in the house for up to three years. Recently, she was informed that the current owner was not making mortgage payments, possibly because of a sharp decline in the property value. While the option to buy the house no longer has any value because the option price is above current market value, Mary is concerned about her right to live there for the remainder of the term if the lender forecloses. The lawyers I have consulted on this case indicate that a foreclosure would wipe out Mary's tenancy right. There is nothing that Mary can do at this point to protect herself. Those contemplating a lease-to-own deal in the future would do well to avoid deals where the seller's mortgage is more than 90 percent of current market value. They should also bear in mind that an option to purchase a house at a price 10 percent below current market value is not worth much in a market in which values are declining. Loan Approvals Aren't Conclusive Until the Loan Closes: During a period of declining home prices and rising defaults, underwriting requirements --

the conditions that must be satisfied before a loan can be approved -become more restrictive. Down-payment requirements in particular are likely to be raised as an offset to declining values. If mortgage transactions were initiated and closed within the day, borrowers would immediately know whether or not they were approved. In actuality, however, the process takes time, especially when it involves a home purchase. This creates a danger that the rules may change when the borrower is in mid-stream. This happened to Lucy, who kept getting a message from the loan officer that her loan "would probably be approved," but in the end it was denied and she lost the house along with fees she had paid for an appraisal and other services. Most reputable lenders will warn that an underwriting change is coming and that the old rules will apply only to loans locked and submitted before some specified date. But information about rule changes are distributed to agents (brokers and loan officers) who, in their anxiety to get deals done, may leave borrowers exposed, as one did with Lucy. Borrowers whose acceptance is borderline are in the greatest danger from an impending rule change.

If you're framing a new deck one weekend and then installing some intricate stain-grade crown molding the next, you might be wishing for one saw that could handle both those tasks -- and everything in-between. If so, then you don't need to look any further than one of the big and versatile 12-inch compound or sliding compound miter saws that are now on the market. A compound miter saw is one that is capable of cutting a miter and a bevel on a piece of wood at the same time -- known as a compound cut -making it perfect for anything from roof rafters to crown moldings. With a sliding compound miter saw, the head of the saw is mounted on single or dual rails to allow it to slide over the table, which increases its cutting capacity and adds the ability to cut overhead dados and rabbets. Several of the top tool manufacturers are now producing these saws, so you have a variety of different configurations, features and price ranges to select from. When you're in the market for one, look for a home center or tool store that has several different brands side by side, to allow you to make accurate comparisons.

One of the top saws in the 12-inch compound slide saw field is the Bosch 12-inch Dual-Bevel Slide Miter Saw (Model 5412L, $629.95). This workhorse of a saw is beautifully designed and constructed, with a number of great features that add to its versatility. Perhaps the handiest of those features is the upfront bevel controls -- the only 12-inch sliding miter saw that has them -which allows you to quickly and accurately set and lock the bevel angle of the head from the front of the saw, rather than having to reach around behind it. The saw head tilts to a maximum bevel of 47 degrees both left and right, and there are built-in stops at 0 and 45 degrees, as well as at 33.9 degrees for crown molding. The saw can bevel to 52 degrees to the left and all the way to 60 degrees to the right, with built in stops at 0, 15, 22.5, 31.6 (for crown molding) and 45 degrees. The Bosch saw is also well designed from a user's standpoint. The comfortable main control handle -- where you activate the motor and pull and lower the cutting head -- can be rotated and locked vertically, horizontally, or at 45 degrees in either direction, so it can be set where it feels most comfortable and also works well for both left- and right-handed operators. There are slideout extensions on both the left and the right to extend the length of the table for better stock support, as well as a hold-down clamp and a stop for cutting repetitive lengths. The saw also has an arbor-mounted laser, and large, easy-to-read angle markings.

One of the great things about the big 12-inch sliding miter saws is their capacity. You can cut lumber up to 4 1/4 inches high and 12 1/2 inches wide with this saw, and the 15-amp motor will power through wet beams. An adjustable stop holds the blade at variable heights above the table, so you can also cut dados at accurate and repeatable depths. The saw is not light -- 59 pounds -- but there are two carrying handles that are well located for lifting and carrying the saw in a well-balanced position, as well as a cord wrap to keep the cord out of the way.

For a great saw that's a little lighter in both weight and cost, you might want to take a look at the Ridgid 12-inch Dual Compound Miter Saw (Model R4121, $333). Another big, tough, 15amp saw, this nonsliding miter saw bevels to 48 degrees in both directions and miters to 50 degrees in both directions, and also has built-in stops for cutting the compound bevels required for crown molding.

Even without the slide, the Ridgid saw will easily handle cross-cutting a full 2-by-10, and can miter a 2-by-6 at 45 degrees. The front miter locks are easy to use, and the quick, positivelocking feature lets you accurately set and hold any desired angle. The saw also features an adjustable laser and a big, quick-release holddown clamp. At 46 pounds it's a rugged saw made for shop or job-site use, but it's still well balanced and easy to carry.

And for nice smooth cuts, you might want to have a look at the Final Cut carbide saw blade ($74.95). This nicely engineered blade has a sanding disk on each side that is slightly wider overall than the width of the saw teeth, so the blade will cut the wood and then sand the cut smooth all in one operation. The result is a very clean cut with no kerf marks, and you get the added advantage of a reduction in kickbacks.

The Final Cut blade will perform both rip and cross-cuts in hard or soft woods. It will work on your miter saw, table saw or radial arm saw, and the self-adhesive sanding disks are easily replaceable. You can check it out at www.finalcutblade.com.

I don't know what was more exasperating: the number of commercials during recent sporting events telecasts or the fact that most of the paid interruptions were approved by political candidates. Can the pace possibly slow before November? What we know for sure is that there will be a different person in the Oval Office, and many people believe that will most likely benefit housing. According to a study commissioned by Move Inc. and conducted by Harris Interactive, 44 percent of the population believes the housing market will improve when the new U.S. president takes over. Because housing is cyclical, that's a fairly safe bet. (We are at least two years into a decline after a long upswing and the new president conceivably could have eight years to get it done). Some markets will take longer to recover, however, especially those in south Florida, southern Nevada, California's San Joaquin Valley and Phoenix-Scottsdale, Ariz. "Consumer confidence tends to rise whenever there is regime change in Washington, and this should be especially true in 2009," according to John Tuccillo, former chief economist of the National Association of Realtors and one of the housing industry's leading analysts. "For housing, however, the current downturn needs to run its course. Some markets will improve before the election, some after and some not until the end of 2009." The Harris survey indicates a strong underlying demand for homeownership. Nearly half (41 percent) of current homeowners plan to purchase a home again, while 80 percent of renters intend to buy a home at some point in the future, with 47 percent planning a purchase within the next five years. More people will do so for space-related (26 percent) and life-stage-change reasons (17 percent), such as having children or downsizing to a smaller residence. Most home buyers are willing to make substantial sacrifices to save and earn extra income for down payments, and will compromise on features and amenities to acquire an affordable home, the survey revealed. Many of their choices may reflect changing values, including a growing concern over the environment, the importance of community features and the rising cost of fuel. About four out of five home buyers say they face barriers to buying a home in the current market. The greatest single barrier is high home prices, a concern that was much higher in the West than in the South or Midwest. Affordability is not just about prices -- it is significantly influenced by interest rates. What is

curious is the misguided notion that mortgage interest rates never rise during an election year. In reality, for the past 40 years, the chances of interest rates declining during a presidential election year have been poor. While there are fluctuations depending on the type of loan and the terms and the month the loan was written, the truth is that mortgage rates tend to go up more often than they go down during presidential election years. In the last 10 presidential election years, the interest rates tied to the 10-year Treasury-bond rate went up seven times and dropped three times (by less than a half-percentage point). Thomas French, former president of the Mortgage Bankers Association of America and a man who steered clear of ambiguous, middle-ofthe-road statements, told me before the 1988 election: "I don't think anything as puny as a political party or candidate can move mortgage rates in this world. They may hope, but it won't happen." Most home loans are now sold as long-term securities on the international market to a variety of investors. They, not local bankers, now control long-term interest rates. In a capsule, things are so much more complex and different today. Local bankers no longer dominate the financial landscapes they serve. For example, years ago when the corner banker had plenty of cash in deposits, he typically lent money at a cheaper rate. Now, there's a definite international influence. If the Saudis decide to hold down the price of oil, it will affect what you pay at the pump -- and probably what you pay for a home mortgage. This move typically has nothing to do with a specific political party in the United States. Even the Federal Reserve Board doesn't have the long-term power to keep rates down like it once did. It does react to harness and stimulate the economy as it sees fit, but other countries now have to cooperate. Tuccillo pointed out that the United States pulled out of recessions in 1993 and 2001 when the White House welcomed new occupants. He believes the "election economic bump" indicators will begin to surface soon because the autumn consumer confidence figures are expected in the next several weeks. "Both candidates are offering economic programs that will expand the role of the federal government and thereby stimulate the economy," Tuccillo said. "The Obama platform appears to be a shade better in that it would help redress the maldistribution of income that has handicapped the middle class. Most of the McCain program is a continuation of the Bush economic policy." Perception can move economic mountains. If Americans feel good about the economy and the future, a housing resurgence could easily follow - regardless of who becomes president.

Survey: New-home buyers more satisfied in 2007 By Ilyce Glink Inman News Service

How satisfied are homeowners with the new homes they purchased in 2007? If the J.D. Power and Associates' 2008 survey of customer satisfaction with new-home builders is to be believed, homeowners are a lot more satisfied than those polled in last year's survey. "The survey results don't surprise me," said Paula Sonkin, vice president of real estate and construction industries for J.D. Power. Sonkin says a lot of consumer satisfaction stems from the fact that the average newhome buyer is getting more for his or her money. The average amount of incentives a builder is giving away is about $16,500.

New-home buyers "like the price, but now they're getting things that were options that they had to buy -- like granite and marble baths -- as standard," she explained. In rare circumstances, new-home buyers are getting swimming pools for free. "If it was part of the model home, and they buy the model home, they'll get it," she added. Sonkin said that the homeowners believe that builders are putting up better products. "Quality is up and problems are down. We've seen builders go out of business, but builders that are surviving are finding ways to adapt to the market." J.D. Power and Associates surveyed more than 50,800 home buyers of newly built, single-family homes, all of which closed in 2007, Sonkin said. "By the time they get our survey, they've been in their new home anywhere from four months to 18 months." The survey covers nine key parts of the home-buying experience: sales staff (15 percent of the ultimate score); warranty/customer service staff (15 percent); workmanship/materials (14 percent); price/value (14 percent); on-time completion/home readiness (13 percent); construction manager (13 per-

cent); recreational facilities provided by the builder (7 percent); builder's design center (6 percent); and location (4 percent).

Price and location, while extremely important to home buyers making the choice of a builder, factor less into the decision when measuring how well homeowners are satisfied after making that selection, Sonkin explained.

Any builder that closed on at least 125 homes in 2007 was eligible to be included in the survey, she said. J.D. Power gathered the names of buyers from independent sources of public record. Buyers were contacted, and at least 50 buyers for each builder survey had to respond for the builder to be included.

A total of 500 builders were ranked in each of 33 markets nationwide. National brands had to compete individually in each of the 33 markets.

But rather than choose a builder based solely on its ranking, Sonkin suggests that the survey results be a starting point for more research.

"New-home buyers should ask the builder questions. Everyone has well-meaning friends and relatives, but no one can tell you more about the house than the builder. You can't ask enough questions," she said.

Sonkin said that new-home buyers should knock on doors and talk to other homeowners as well. She also recommends discussing the project with the construction manager.

"No one knows more about your individual home than the person in charge of building it," she noted. "You should also visit your home site. Go see how a home is being built. If you're going to buy a new home, go watch your new home being built. Ask the warranty people lots of questions as well."

Sonkin said that the most satisfying part of the survey was noting that the overall rankings went up this year. New-home buyers are more satisfied than last year, she said.

Q: My son signed a contract to buy a home and put down $600. The real estate company found a bank who approved him for the loan (over the phone), but he did not sign any paperwork with the bank. Later that night, after he had had time to think about it, he decided the costs would be too much and he wasn't sure he could make the payments. He tried to withdraw from the offer, but the sellers say they will sue him to make him buy the home. I realized he shouldn't have signed anything, but in this case, would the sellers win such a case? Does he have other options? A: Your son may have many options and would be wise to review the contract immediately with a real estate attorney. The contract may give him the right to have the document reviewed by an attorney and during that review he might be entitled to terminate the contract. The contract may, and should, give him the right to inspect the property to determine whether the property has any major defects. Upon such inspection, if your son finds major defects, the contract might give him the right to terminate the contract. In some states, if the seller has not given the buyer the proper disclosure documents for the home, the buyer has the right to terminate the contract at any time up until those disclosures have been delivered and the buyer has had time to review the documentation. Finally, if the buyer doesn't go through with the purchase, the contract may limit the

seller's damages to the amount he deposited under the contract. In other words, it's possible that your son's maximum exposure to the sellers could be the $600 he put down. With so many options, you can see why it would be helpful to have your son sit down as soon as possible with a real estate attorney who can guide him through the process. If you live in a state where buyers and sellers do not customarily use real estate attorneys for the purchase and sale of homes, he should still seek one out that can help him. While it would be highly unusual that a seller would be able to force a buyer to close on the purchase of the home, if the contract does not limit the seller's damages in case the buyer fails to close, the seller could sue the buyer for the losses and expenses the seller incurs as a result of the failed deal. The big lesson, of course, is to think first and sign later.
