Las Cruces, NM – Las Cruces Home Builders Association (LCHBA) to provide a Thanksgiving meal for 200 families in Las Cruces. Annually, the LCHBA Community Service Committee packs boxes with all the grocery items needed for a Thanksgiving dinner, including turkeys, pumpkin pie, even margarine and delivers the boxes to disadvantaged families at the Families & Youth Center and MacArthur Elementary School. In 2007, the Community Service Committee provided a combined total of 120 boxes to the organizations. The committee raises funds for this endeavor through its raffle at the LCHBA monthly membership luncheons. They also rely on donations of money from the general membership and community businesses. The committee is still in the process of raising funds and soliciting empty copy paper boxes for delivery of the items. $50 is all it takes to sponsor one family. This years’ delivery will take place on Tuesday, November 25, 2008. Las Cruces Home Builders Association: The Las Cruces Home Builders Association (LCHBA) is a non-profit trade association and it represents the residential home building industry in our region. Its designated membership area includes all of Dona Ana County as well as the Truth or Consequences and Deming areas. The LCHBA is a local association chapter and is affiliated with the state chapter, the New Mexico Home Builders Association (NMHBA). Both the LCHBA and the NMHBA are part of a national federation, the National Association of Home Builders (NAHB). The LCHBA has over 500 members, the state association has over 3,000 and the national federation has over 250,000 members nationwide. Members of our local association are elected annually to serve as directors and/or officers of both the state and national groups. Of the 550 plus members of the LCHBA, approximately one-third are licensed builders and the remaining members are subcontractors, suppliers of materials, and providers of services. All of the members have a vested interest in the success of home building in our community. We all work together to provide the community's housing. A fourteen-member board of directors, a five-member executive committee, and executive officer manage the LCHBA. There are over 15 committees, task forces, forums, and councils. The LCHBA's activities are planned
and managed by volunteer members and a staff of five. The LCHBA’s purpose is to protect the American dream of home ownership. We have the following mission statement: Chartered in 1959, the Las Cruces Home Builders Association is comprised of members of the building industry and its affiliates. As the voice of the building industry, we serve our members and the community by: • promoting balanced economic development; • providing education; and • promoting professionalism. As a regulated industry, the LCHBA takes pride in working with local, state, and national governments in shaping fair and equitable policies that will help maintain sensible growth and help overcome the barriers to affordable housing. The LCHBA strives to provide education and other professional benefits for its members. Dozens of courses in business management and construction are available to members through NAHB. Members are able to purchase affordable workers' compensation insurance coverage through the NMHBA. The LCHBA offers a variety of informational seminars to its members to keep them informed about the latest regulations and products. Several major events are held by the LCHBA each year and provide multiple benefits to the association, its members and to the public. Through the annual Home Improvement and Lifestyle Show, Spring Showcase of Homes, and Fall Parade of Homes, members have an opportunity to spotlight their products and services. The community benefits by seeing what the latest offerings are in home building and home remodeling. Because the LCHBA is a non-profit association, it must raise over 60 percent of its operating revenue and it does this in part through these association sponsored community events. The LCHBA over the years has also been very active in supporting community needs. The construction of the 48Hour House in 1990 benefited the homeless community. The joint venture with the city in constructing Veteran's Park on the East Mesa was a huge success. The Fallfest Auction has enabled the LCHBA to contribute over $75,000 to the United Way, September 11th Fund, and Mesilla Valley Habitat for Humanity. In addition, there have been many other projects that members have contributed to individually, such as the construction of Unidad Park, and renovations of various community service buildings.

An Oakland, Calif., couple had wanted to change their lifestyle for years. Like many people who want to make a move from the home they own to another they hope to own, this couple put the cart before the horse. They started by researching what it would cost to buy the next home before investigating how much cash they would net from the sale of their current home.
Instead, they are planning to sell their current home first. If need be, they are prepared to rent until they can find a home to buy. Contingent sale offers still aren't popular in some niche markets. In these desirable markets, sellers are able to sell if they price their home reasonably for the market and properly prepare it for sale. Unless you can afford to own two homes and verify that a lender will qualify you to do so, you need to sell first or stay put.
When they consulted with a local real estate about the probable sale price of their current home, they discovered that it wouldn't sell for enough to enable them to afford the lifestyle they envisioned. So, they delayed their relocation plans. They hoped that the housing market would improve and their house would sell for more during the next year.
There are a couple of ways to buy time to find the next home. Sellers are more receptive to offers from buyers whose home is sold, but not yet closed. This is especially so if all contingencies have been removed.
Unfortunately, the resale market in their area took a downturn, putting them further away from their dream. Fortunately, however, they did not buy the dream home last year before selling their current home. This would have been a risky move financially.

Also, you may be able to rent back your current home for a time after closing in order to minimize the possibility of making an interim move. However, there are benefits to renting an interim home. One benefit is that you don't feel rushed to buy.
The couple mentioned above has decided to wait no longer for the market to give them a "go" sign. They are ready to get on with their lives. They have decided to sell their house now. It's impossible to time the real estate market, but it is possible to minimize your risk when buying or selling a home.

Survey: New-home buyers more satisfied in 2007 By Ilyce Glink Inman News Service
How satisfied are homeowners with the new homes they purchased in 2007? If the J.D. Power and Associates' 2008 survey of customer satisfaction with new-home builders is to be believed, homeowners are a lot more satisfied than those polled in last year's survey. "The survey results don't surprise me," said Paula Sonkin, vice president of real estate and construction industries for J.D. Power. Sonkin says a lot of consumer satisfaction stems from the fact that the average new-home buyer is getting more for his or her money. The average amount of incentives a builder is giving away is about $16,500. New-home buyers "like the price, but now they're getting things that were options that they had to buy -- like granite and marble baths -- as standard," she explained. In rare circumstances, new-home buyers are getting swimming pools for free. "If it was part of the model home, and they buy the model home, they'll get it," she added. Sonkin said that the homeowners believe that builders are putting up better products. "Quality is up and problems are down. We've seen builders go out of business, but builders that are surviving are finding ways to adapt to the market." J.D. Power and Associates surveyed more than 50,800 home buyers of newly built, singlefamily homes, all of which closed in 2007, Sonkin said. "By the time they get our survey, they've been in their new home anywhere from four months to 18 months." The survey covers nine key parts of the homebuying experience: sales staff (15 percent of the ultimate score); warranty/customer service staff (15 percent); workmanship/materials (14 percent); price/value (14 percent); on-time completion/home readiness (13 percent); construction manager (13 percent); recreational facilities provided by the builder (7 percent); builder's design center (6 percent); and location (4 percent). Price and location, while extremely important to home buyers making the choice of a builder, factor less into the decision when measuring how well homeowners are satisfied after making that selection, Sonkin explained. Any builder that closed on at least 125 homes in 2007 was eligible to be included in the survey, she said. J.D. Power gathered the names of buy-

ers from independent sources of public record. Buyers were contacted, and at least 50 buyers for each builder survey had to respond for the builder to be included. A total of 500 builders were ranked in each of 33 markets nationwide. National brands had to compete individually in each of the 33 markets. But rather than choose a builder based solely on its ranking, Sonkin suggests that the survey results be a starting point for more research. "New-home buyers should ask the builder questions. Everyone has well-meaning friends and relatives, but no one can tell you more about the house than the builder. You can't ask enough questions," she said. Sonkin said that new-home buyers should knock on doors and talk to other homeowners as well. She also recommends discussing the project with the construction manager. "No one knows more about your individual home than the person in charge of building it," she noted. "You should also visit your home site. Go see how a home is being built. If you're going to buy a new home, go watch your new home being built. Ask the warranty people lots of questions as well." Sonkin said that the most satisfying part of the survey was noting that the overall rankings went up this year. New-home buyers are more satisfied than last year, she said.

In a recent column, a seller wrote in that his agent had a buyer for his house at the full asking price. The only quirk in the deal? The seller -not the buyer -- wrote up the full-price offer. The seller wanted to know if I had heard of this practice and why it was used. I thought it was strange, but a number of agents all over the country have responded that this has either happened to them or they have employed this tactic in an aggressive move to get the deal done. Others say this wouldn't work in their state. There is an undercurrent of concern that this is all about getting the seller to pay the listing agent's commission -- for example, the seller may have entered into a listing contract that requires the seller to pay the listing agent a commission if the seller refuses to accept a full-price offer -- even though the buyer hasn't brought a full-price offer to the door. I'd argue that you'd need a signed purchase contract from the buyer for that. I received more than a dozen comments. Here are a few, some of which have been edited for clarity or length. I'll post the rest at ThinkGlink.com/blog. Comment: I think the misunderstanding about the buyer and the full-price offer has to do with the agent's commission. At least in Rhode Island, a seller does not have to take a full-price offer, but the agent has earned the commission if they procure one -- even if the seller refuses it. Ilyce's take: I don't think there is an offer on the table. The agent said the buyer was willing to pay full price. But as good real estate brokers know, you've got to have an offer in writing for it to be valid. Comment: Here in California, when a listing is placed into the MLS there is an asking price and buyer's agent's commission (among many other fields) that must be filled in by the listing agent/broker. Ilyce's take: A buyer's agent can offer any price his or her client chooses (a full-price offer is all the better). And of course the sellers can choose to accept, reject or, in most cases, counter the offer. In the situation you've described, there is no offer. Whether the agent is representing both the seller and buyer, or the buyer and seller have dif-
ferent real estate agents (i.e. different brokerages) is not relevant. The home if listed for sale simply needs an offer IN WRITING. If an agent is a dual agent and is "double-ending" the property, the same rules apply -- write up an offer and present it to the seller(s). Comment: I am responding to your recent question/answer column regarding an agent who told her seller she had a full-price offer on their home. My understanding is when we offer a home for sale through our multiple list system at a specific price and terms and have a valid listing contract with a seller, the seller is obligated by the terms of this contract. If the listing Realtor presents an offer (written) at the exact terms offered, the seller may reject the offer but still owes the agent the full commission. If the seller decides to reject the offer, they must take their home off the market for six months through the multiple list system. I don't know if they can then put the house up for sale by owner. However, I am confused about a couple of points: Why didn't the agent put the offer in writing, and in this market, what seller wouldn't jump for joy to get a full-price offer? Ilyce's take: I don't think the author of the letter sent has told the whole story, and fair housing law plays a large role in a seller having to sell their home if an offer comes in that meets their price and terms. I am from Michigan and if I brought a seller a written offer meeting all their terms and price, whether they accept or not, I would want my commission. Comment: I am a Realtor (since 1985) and about 15 years ago, in another downturn market, I had a listing that finally got an offer, albeit a low one. Months later, after several more price reductions, I contacted that agent who said the buyer hadn't bought yet. So the seller and I put together an offer -exactly what the buyer had offered months before and presented it back to the agent who took it to his buyer -- and voila! We got the house sold. It was a great story that my manager had me talk about at several other offices in my company. It's also possible that this buyer just won't get off the fence to make the move. Who knows?
