In this column last month, I mentioned Oregon House Bill 2639, passed in 2013. This law requires Oregon landlords to consider federal rent assistance (e.g., Section 8 vouchers) as a source of income when screening applicants.

The law took effect 1 July 2014, over four and a half years ago. Yet on any given day, I can always find an ad or two on Craigslist advertising a vacancy with stipulations such as “No Section 8,” or “Not set up for Section 8.” I hope that those using this language in their ads are not members of RHA; in case you missed the memo, such advertising is illegal under Oregon Fair Housing law.

April is Fair Housing Month and an excellent time for landlords to review current Fair Housing law in Oregon and in the specific cities or counties in which you own rental property. Are you familiar with the different protected classes? Do you know which exceptions apply to owner-occupied units?

Do you know what to do if an applicant tells you they have a disability and requests “reasonable accommodation?” Do you have a plan of action in the event a tenant or applicant files a fair housing complaint against you?

(Hint: the correct answer to the last one is “call my lawyer.”).

Compliance with Fair Housing law is not difficult, and there are many resources available to landlords. The Fair Housing Council of Oregon (FHCO) has several guidebooks available for download from their website (http://fhco.org/), including the New Landlords Guide to Fair Housing Law and a table of Protected Classes. If you are not familiar with the fraught history of housing discrimination in Oregon, I recommend that you take 15 minutes to watch the video on the FHCO website.

The issue of housing discrimination by landlords in the Portland metro area was brought to the forefront in a 2011 report entitled Analysis of Impediments to Fair Housing Choice. Improvements have been made in the past eight years, but work remains to be done. I believe the best way to achieve fair housing goals is through improved education of housing providers and tenants and enforcement of current law. However, there are some very loud voices in the Portland community advocating for changes in screening and security deposit rules that go far beyond current Fair Housing law. Under these proposed ordinances, security deposits would be limited to one month’s rent or just one-half month’s rent depending on whether the landlord charges first alone or first & last month’s rent to move in. Landlords would not be able to set a higher income threshold than two times rent. The use of criminal history as screening criteria would be strictly limited. The list goes on. The Portland City Council has tentatively (continued on page 6) 4

scheduled hearings on these proposed ordinances at their meetings 3 – 4 April. Tenant advocates will certainly show up in force at these meetings; I hope Portland landlords will as well.

RHA continues to be a strong advocate for Fair Housing. One of our board members sits on the Oregon Housing Choice Advisory Committee, and another is a member of the Portland Fair Housing Advocacy Commission, which was established in response to the 2011 report. The next RHA class on Fair Housing will be held on 11 April, the 51st anniversary of the 1968 passage of federal Fair Housing Act. The course is being taught by Louise Dix of FHCO. I hope to see you there!

3 Criteria that Must be Met in Regard to Assistance Animals

People with disabilities are involved in the majority of housing discrimination complaints, so the Grace Hill training tip for the week goes back to some basics on assistance animals. As a landlord or property manager, it is important to handle assistance animal accommodation requests properly.

According to The Case for Fair Housing: 2017 Fair Housing Trends Report by the National Fair Housing Alliance, nearly 55% of all reported housing discrimination complaints in 2016 involved discrimination against people with disabilities. This statistic is a reminder of how important it is to handle accommodation requests properly. Let’s review some of the basics.

Under the FHA and Section 504, individuals with a disability may be entitled to an assistance animal as a reasonable accommodation in housing that places restrictions on or prohibits animals. Remember, assistance animals include service animals, companion animals, and emotional support animals. They can be dogs, cats, birds, rabbits, or other types of animals. Examples of reasonable accommodation requests related to assistance animals: • Requesting to have an assistance animal in a community or building that doesn’t allow pets • Requesting to have a 70-pound dog in a community that doesn’t allow dogs over 50 pounds • Requesting to have a pit bull in a community where pit bulls are a restricted breed Always review and verify the three criteria that must be met for a person to be protected by the FHA and Section 504 in regard to assistance animals: 1. The person must have a disability 2. The animal must serve a function that directly relates to the person’s disability 3. The request to have the animal must be reasonable Keep in mind that the FHA and Section 504 do not protect individuals who do not have disabilities, and they do not protect situations in which individuals train animals for use by other people. www.rhaoregon.org

This means, for example, that you would not be required to grant an exception to a no pet policy for a resident who does not have a disability but has a dog that keeps people company at a nearby nursing home on weekends.Understanding these basic principles of reasonable accommodations for assistance animals under the FHA and Section 504 will help you comply with the law, and will also ensure that everyone feels welcome in your community.

Tips for Conducting Applicant Screening That Complies with Fair Housing Law

3. Ask for a “Government-Issued” Photo ID Rather Than a Driver’s License Specifically Consult your company’s policies to determine which forms of photo identification are acceptable to verify identity during the application process. However, be mindful that it is better to ask for a “government-issued” photo identification rather than to ask specifically for a driver’s license. Not everyone has a driver’s license and asking for one could be viewed as discriminatory.

Here are some tips for conducting applicant screening in a way that complies with Fair Housing law and makes all people feel welcome in your community. They will help you avoid screening pitfalls.

1. Think Before You Speak It is natural to make friendly conversation with prospects during the application process. This is fine but think carefully about questions you ask or comments you make.

For example – asking “Where is your accent from?” Or saying “You have such an interesting look” may seem harmless, but could be viewed as discrimination particularly if you end up rejecting the applicant for some reason.

2. Know and Comply with your State Laws and Company Policies Applicant screening is an area in which it is particularly important to know and follow your state and local laws. Take the time to educate yourself. “I didn’t know” will not be an acceptable defense should you face a discrimination claim.

Your company should have clear policies and procedures for determining which applicants are accepted to live in your community. Follow these policies and procedures at all times and apply them uniformly to all applicants. Make sure all applicants understand selection criteria and related policies and procedures. This will help them see that you don’t choose residents arbitrarily; rather you have a standard process that you follow for all applicants.

4. Be Consistent in All Interactions to Avoid Screening Pitfalls Most importantly, be consistent in all of your interactions with applicants and follow your company’s policies and procedures in the same way for all applicants. If you make an exception to any policy or procedure, make sure you provided the same information and options to all applicants who are in the same situation. Making a habit of treating applicants fairly and equally reduces our risk of discrimination claims and creates a welcoming atmosphere for all that meet your qualifications and wish to live in your community.

Summary Avoid discrimination within the screening process by carefully considering how you approach your application process. Claims of discrimination often arise in relation to the applicant screening process. This can be a tricky area to navigate and one where even well-intentioned people can find themselves on the wrong end of a discrimination claim.

Would you know what to do if your smoke alarm went off at 2 am in the morning?

Creating and practicing a escape plan can increase your chances of exiting quickly in the event of a fire or emergency.

It is important to include your entire family in the planning process and to then practice your plan.

Tips to Remember for Your Escape Plan:  Ensure your smoke alarm(s) are working.  Plan at least two ways out of each room.  If you are on second story, consider purchasing an escape ladder.

If you do not have one, stay at the window and yell for help.  Designate a meeting place for you and your family.  Call 9-1-1 from a neighbor’s home.  Teach children to never hide during a fire– they need to get out and stay out.  Plan, practice and double check your escape plan.

Dear Maintenance Men

Dear Maintenance Men, WATER HEATER LONGEVITY: Having replaced about five water heaters in the last five years, it is my subjective impression that water heaters manufactured in recent years do not last as long as those purchased prior to that time.

For example, I have replaced several failed water heaters that were about 15 years old. This contrasts with some water heaters (same size) manufactured in the 80’s which are still in service. Consequently, I have been seeking ways to prolong the life of water heaters. I have been told that replacing the sacrificial anode rod will help accomplish this. Is it worth the time and cost to replace an anode rod? Is there a way to determine the condition of an anode rod short of removing it? What tools would be needed to accomplish this?

Gerard Hi Gerard: You are not alone! Unfortunately, many of our clients, including us, have had the same experience as you. It has been very frustrating to replace a water heater with a six year warranty the day after it expires! Most information available is purely anecdotal as the manufacturers do not wish to share the actual reasons why. It appears that manufacturers have moved to the model of disposable water heaters much the same as all other large appliances for residential use. However, the following is what we know by dissecting a few duds: 1.

The tanks appear to be thinner and made of lesser quality metals, possibly a weaker blend. (This is true for Residential, Big Box store purchased water heaters of any brand.)

2.

The anode rods (sacrificial rod) is also thinner.

(Replace often using a 14” to 20” Crescent wrench or Pipe wrench.) I prefer a socket wrench and extension but it can be a pricey tool for a job you will do once every two yrs. (dependent upon how bad your water is in your city). Replacement of the rods is absolutely worth the time and effort, they are relatively inexpensive and not hard to replace. If your water heater is more than 3yrs old it’s probably time to replace them. Unless you remove them you cannot tell what condition they are in. If you remove them be prepared to install new ones.

Water quality. Consider a water softening system or filter between your water heater and the city supply. A water softening system will also prolong the life of your dishwashers, faucets and shower heads.

4.

Sediment. Clean out or drain your water heater once 14

a year. Severe build up can cause premature failure due to tank expansion, prolonged burner operation, encapsulation of the anode rod, and damage to your fixtures.

5.

Residential Vs Commercial quality water heaters. Do not purchase any brand of water heater at a big box store. They are all manufactured for residential use no matter what the packaging says. For the past 10yrs or so we have been purchasing our 40 to 100 gallon water heaters from a commercial source.

Research where in your areas the commercial plumbers buy their water heaters. A commercial plumbing house deal with warranty issues directly with the manufacturer and vet their suppliers rigorously. (They do not want to deal with a rash of returns.)

Temperature settings. If at all possible, keep the temperature as low as you can without causing issues with your tenants. Install a protective cover to eliminate the chances of your residents raising or decreasing the temperature at will.

7.

Check your vent sizing as many people have replaced their old water heater and have not resized the vent stack accordingly.

Dear Maintenance Men: Our apartments are early 1960s era. During remodels, we replace the doors and due to the small bathrooms, we have been changing the “swing-in” door to “swing-out” to allow more room and for installing an elongated toilet. Any unforeseen problem with doing this?

Marc Dear Marc, Interesting. Currently, there is no IRC Rule (not codified) regarding in-swing or out-swing doors on interior residential dwellings. However, it may be a good idea to consider the following: Most individuals are accustomed to opening doors inward and the years of that action has made it second nature which can cause some frustration, accidents, disrupt flow and unintentional damage.

Depending on where the door is located in respect to the general layout, an out-swinging door can be opened in the direct path of another occupant. Blocking the door from the outside and trapping someone inside the bathroom during an emergency, or earthquake. Since we usually walk up to a door and knock, there is now a risk the door will be opened inadvertently causing you to knock with your nose. (continued on page 15) www.rhaoregon.org

A slightly more costly alternative would be to install a pocket door, or frame for a 24” to 28” in-swing door. Lastly, installing a bi-fold door may be an alternative, although not a very secure door.

As the largest provider of food assistance in the state of Oregon, we help nearly 10,000 people in need each month. SnowCap accomplishes this with the hard work of 1,000 volunteers led by a staff of 9 and without government funding.

Since 1967, SnowCap has made healthy, fresh foods available to those who would otherwise go without. The majority of our clients are children, the elderly, disabled and folks who struggle to make ends meet.
