President’s Message

RHA Oregon BOARD MEMBERS

Things move pretty fast in our world today. Something happens across town or a globe away and we hear about it almost instantly. Events shaping our world are available via our phones, internet, or TV for instant viewing. We can check RHA Oregon up on changing opinions on Facebook, Twitter and a myriad President of other sites. Does all this information or misinformation help John Sage us to have better understanding of the issues of today? Does this information/misinformation lead to better decisions for our future? There is a certain secure feeling about having the time to think through an issue and trying to see all sides before coming to a conclusion. Is this something that we are allowed to do today, with the speed at which information comes to us and at us these days? Comedian Steven Wright asked the question “If your car is moving at the speed of light, do your head lights work?” This makes me wonder, if decisions are made at the speed of changing opinions. Does this work for long range planning? Well myself, I think that this is something that we will have to decide when we look back on this period in our history. There was a time in the past when I was a tenant, that I can remember seeing signs on the sides of apartment complexes throughout the Portland Metro area. These signs advertised reduced move in costs, first month’s rent free, and many other inducements to tenants to get them to move to a new location. Why would the property owners do that? Well, at the time there were more units available than there were tenants wanting units. Rents were lower due to competition for tenants. Life was good if you were a good tenant and wanted to move to a bigger unit with more amenities. That was only a few short years ago. Does anyone else remember those times? Hard times to be a property owner!! Where was the federal or local government then? Did they subsidize our businesses while we were struggling? Was there a “Landlord Crisis” declared? Did they change the rules on tenants and make them give us 90 days’ notice for moving out? Did we have to give them 90 days’ notice to give them a reduction in rent to induce them to stay in the unit? You all know the answer. We were on our own to get by the best that we could. Struggling to maintain properties with lower income and some empty units. I’m not bringing this up to whine or complain but to illustrate that things change; it is the circle that life seems to always move in. There will be times of feast and times of famine. It is during both times that we need to band together as property owners. The State Legislature will be having a short session starting in February 2016. There will be bills put forth that will again effect our industry. Our Lobbyist Cindy Robert is already working to keep RHA Oregon members and board informed of the proposed bills being put forth by committee and individual legislators. Since 1927, RHA Oregon has set the standard for community participation by landlords providing affordable and quality housing. You have all seen this statement on our website. Did we just create it in a vacuum? No; since I have been involved with RHA Oregon I have seen that our members live this statement. They are involved with working in the community to improve the lives of others: Helping out with feeding and clothing the homeless and reaching out to others in need. By Oregon Better Business Bureau Own or work at a small business? Be on the look out for a scam that attempts to fool businesses into paying fees to stay in compliance with government regulations that don’t even exist. How the Scam Works: You receive an official-looking letter in the mail. It’s labeled something like “Notice of Potential Compliance Violation,” “Certificate of Good Standing Request Form” or “Annual Letter Solicitation Form,” and it looks like a document from the state or provincial government. The mailing informs you that, in order to be in compliance with a regulation, you need to fill out the attached form and send it back with $125. Don’t do it! There is no “corporate records” filing form or “good standing certificate.” Scammers are hoping that business owners, eager to adhere to regulations, will automatically pay any “government” fee that comes along. There are many versions of this scam. Con artists are very creative in their fake regulations. In on iteration, the mailing informs you that your business needs to file “corporate meeting minutes” with the government. How much does this cost? You guessed it: $125. How to spot a compliance scam: Here’s how to spot fake government mailings. Search online. Some of the invented regulations are similar to real laws, so do your research before you pay. Your provincial or state government websites will have a section for businesses that list required licenses and fees. Don’t believe what you see. Scammers are great at mimicking official seals, fonts and other details. Just because it looks official, does not mean it is. Contact the government. Don’t call the number on the mailing. What Unfolds in February? By: Cindy Robert RHA Oregon Lobbyist

2016 is a short session year, meaning the Oregon Constitution (changed by voters in 2010 to allow for annual sessions) limits assembly to 35 days. Oddnumbered years are limited to 160 days.

actively vying for signatures to be placed on the November ballot that legislators have the ability to impact in February. They could change the laws themselves or they could refer versions of the ideas they like to the ballot.

Theoretically, the short sessions were to be about tweaking the budget (after all, budgeting two years in advance takes a crystal ball we just do not have), technical fixes to policies already passed, and dealing with emergencies.

Minimum Wage The minimum wage is actively being pursued for the November ballot, but we may see the legislature head that off. The minimum wage proponents seem to have split into two camps. One is still collecting signatures for a ballot measure asking for increase to $15. The other is asking the legislature to pass a law raising to $13.50 and lifting the preemption on local governments setting their own minimum wage. Because of the unconstitutionality of posing two questions in one measure, the $15 folks can't ask for an increase and removal of local preemption, something that has become increasingly important to some ($10 in Portland is different than $10 in Pendleton). But the legislature can do both in one bill - raise base amount and let locals decide to go higher. In addition, if Democrats agree to pass a bill in the legislature, that frees up union groups to use ballot measure money for other efforts including campaigns. Not all Democrats are on board though, and some Republicans will need to commit in order to see a bill introduced.

Yet, in the past short sessions many of the policy bills introduced were not budget oriented and were not the result of an emergency. Several were ridiculous, some too complicated for the short timeline, and many were clearly for campaign collateral purposes (the primary begins just weeks after close of session). Time will tell how legislative leaders hone and redirect these short sessions to make them more successful. Another effect of having a short session in the campaign year is the leverage it creates within the initiative process. In Oregon, issues get to the ballot in three forms, referral, initiative, veto referendum: 1) the legislature refers issue, 2) citizens collect enough signatures to place an issue they draft up for vote, or 3) citizens collect enough signatures to place a repeal of passed legislation on the ballot. Ballot measures seek to change the Constitution or Oregon Statute - but more signatures must be collected for measures seeking to change the constitution: 8% of voters for Constitutional changes vs 6% for statutory changes, and the 4% for referendums. In 2016, changing the Constitution required 117,578 signatures, statute 88,185 and referendum 58,789. Most initiatives petitions have paid signature gatherers and signatures are due 4 months prior to the election. In all three cases, the measure to be voted on can only have one question. As example, we could not ask on a ballot "Should Oregonians repeal the state income tax and institute a sales tax of x%?" That would be asking two separate questions. Many suggest one of the reasons we have not been able to change the tax structure in Oregon is this inability to ask the question in such a way. We would need to ask in one measure "Should Oregonians repeal the income tax?" and in another as "Should Oregonians institute a sales tax of x%?" This would give the voters the ability to vote YES on the first and NO on the second! So, what does this mean for February? I see two big issues

Corporate Tax Increase It was not so long ago that the legislature actually raised corporate income taxes with approval by voters in 2010 (really called "corporate excise tax"). In 2009, when the state was desperate for an influx of money to jumpstart the economy out of a recession, the state made two major changes: 1) the corporate minimum tax, paid by businesses who have no taxable income (are not profitable after subtracting business expenses and tax deductions), was moved from a flat $10 amount to a graduated amount from $150 to $100,000 based on Oregon sales, and 2) the corporate tax rate which had been 6.6% was raised to 7.9% for 2008-2010 if a corporation's taxable income was more than $250,000, but then stepped down to 7.6% for 2011 then back to 6.6 in 2013. The exceptions to the step down are companies with more than $1 million in taxable income - they do not receive the second decrease per legislation passed in 2013. So, in 2014, companies with taxable income less that $1 million pay 6.6%, those with more pay 7.6%. The ballot initiative being circulated for signatures by a (continued on page 18)

Dear Maintenance men: I have given my residents information on how to prepare a personal emergency preparedness kit for their families. My question is for you is: does my Apartment or commercial building need an emergency preparedness kit? And if so, what should be in it? Diana

Dear Allen, When doing a kitchen or bath material selection, cohesive and functional design is important. Kitchen and bath rehabs are some of the most expensive work you can do in an apartment unit and proper planning is a must. In order to appeal to a larger segment of the population, try to keep the interior color scheme to neutral earth tones. Cabinetry quality varies greatly. Don’t let the cabinet fronts fool you. Dear Maintenance Men: I am starting my planning for a major kitchen cabinet remodeling project in my rental units. However, I am having a difficult time making material and design decisions. What recommendations can you give? Allen.

Dear Maintenance Men: I am a property supervisor for a local property management company and I am looking for solutions to my maintenance issues. How do I keep the cost of maintenance down while still maintaining good living conditions for my residents? Sally Dear Sally: Prioritize and bundle is the short answer. To elaborate, you will want to prioritize all of your non-emergency maintenance work by unit, building and area and then bundle enough work for each unit, building or area to use your maintenance tech or vendor efficiently. The less your tech or vendor needs to travel between jobs the lower the cost of each job will be. Essentially, you would accumulate all non-emergency routine maintenance work placed on a P.O. or work order and forward (continued on page 16)

it to your vendor or tech as authorized. This dramatically reduces the costs related to gas, trip charges, mobilization, purchase hours, etc. (It works even better if your parts are already onsite) to billing vs. a per unit price method would also give you more bang for your buck. work for our industry. Let’s make our voices heard in the halls of the City Councils throughout Oregon. We have already gotten the ball rolling. First, Vice President Phil Owen and Lobbyist Cindy Robert testified recently in Salem before the Housing Committee about housing. Then Phil and I were interviewed separately by KGW channel 8 about the recent changes made by the City of Portland. So I urge each and every one to get involved. Watch your emails for updates as to proposed changes and or bills from the legislature. Attend meetings on the issues, emails will be sent out concerning the time and dates. As always it is a privilege to serve as President of RHA Oregon. I am proud to be involved with an organization that represents the best of our industry. Is it really rent control? New tenant protection ordinance passed by the Portland City Council in October of 2015 By Clifford A. Hockley, President, Bluestone & Hockley Real Estate Services

On October 14, 2015 the city commissioners of the City of Portland unanimously voted to modify the laws that govern landlord / tenant relations in the City of Portland. Their stated objective was to help tenants manage the low city vacancy rates. These low vacancy rates are especially difficult for low income and disabled tenants to manage, because in order to move they need to save for moving costs, deposits and rent. Most low income tenants live from paycheck to paycheck (or public assistance check) and find it difficult to save enough money to move. To help those tenants, the city commissioners passed the following additional renter protections. 1. They extended no cause lease terminations from 30 and/or 60 days as established in the Oregon Landlord Tenant Law to 90 days. 2. They limited rent and/or utility increases to five (5%) percent within a 12 month period if the tenant is given less than a 90 day notice of the increase. 3. They put teeth into the enforcement section of this ordinance, penalizing a non-compliant land lord with an amount of up to three months’ rent as well as actual damages, reasonable attorney fees and costs. The bottom line is that the city commissioners bought tenants more time to be able to get together the funds they need to move. They also preserved the rights of landlords to pass through rent increases, albeit with a longer lead time. The major downside for landlords with this new language is that if you have a problem tenant you need out right away, you will have to use a for cause notice. I have attached the language as passed by the City of Portland and codified as section 30.01.085. 30.01.085 Portland Renter Additional Protections. A. In addition to the protections set forth in the

Residential Landlord and Tenant Act, the following additional protections apply to Tenants that have a Rental Agreement for Premises covered by the Act. For purposes of this chapter, capitalized terms have the meaning set forth in the Residential Landlord and Tenant Act. B. A Landlord may terminate a Rental Agreement without a cause specified in the Act only by delivering a written notice of termination to the Tenant of (a) not less than 90 days before the termination date designated in that notice as calculated under the Act; or (b) the time period designated in the Rental Agreement, whichever is longer. This requirement does not apply to Rental Agreements for week-to-week tenancies or to Tenants that occupy the same Dwelling Unit as the Landlord. C. A Landlord may not increase a Tenant's Rent or associated Housing Costs by 5 percent or more over a 12 month period unless the landlord gives notice in writing to each affected Tenant: (a) at least 90 days prior to the effective date of the rent increase; or (b) the time period designated in the Rental Agreement, whichever is longer. Such notice must specify the amount of the increase, the amount of the new Rent or Associated Housing Costs and the date, as calculated under the Act, when the increase becomes effective. D. A Landlord that fails to comply with any of the requirements set forth in this section 30.01.085 shall be liable to the Tenant for an amount up to three months’ Rent as well as actual damages, reasonable attorney fees and costs (collectively, "Damages"). Any Tenant claiming to be aggrieved by a Landlord's noncompliance with the foregoing has a cause of action in any court of competent jurisdiction for Damages and such other remedies as may be appropriate. www.rhaoregon.org

Winter Maintenance Checklist

In winter, your tenants can enjoy energy-efficient warmth and the fruits of your maintenance labors while you take a few precautionary measures on the outside. Outdoor Tasks: • • • • • • •

Walk around the property’s exterior and make sure the foundation vents are closed or covered. Protect the central air conditioning unit with a cover. Remove and store window air conditioners. Winterize sprinkler systems. Rake last of leaves and remove storm debris as needed. Check gutters and downspouts and clean them out if needed. Send freezing weather reminders to tenants. Insulate or wrap all exposed plumbing pipes.

It is said this "gross receipts tax" would raise over $5 billion every biennium. This would raise the percent of general fund attributable to corporate tax receipts from 6.3% to 26%. Word is that some are pushing the legislature to step in with a referral that is more reasonable - somewhere between 0.25 and 0.5% for sales above $25 million. They say a lower rate will raise some money without disabling corporations, halting investment in the state and raising consumer costs. In addition, the initiative says the money is to be used for public education early childhood to grade 12, health care and services for seniors. But it does not say how it is divided between those groups or to what programs funds should be allocated. Stepping in now to draft a referral would also allow the legislature to more specifically frame the spending for voter approval.
