President’s Message

Amid all of the Holiday inspired messaging, shopping and planning there is another common activity many people partake in during December: It is last minute tax planning. Whether you have done so or not in the past, perhaps this year would be a good time to do it. I am talking particularly about every tax payers’ right to a $50 credit for donating to RHA Oregon President a Political Action Committee – commonly called a “PAC”. Ron Garcia What is a PAC? Encyclopedia Britannica offers the following definition:

Political action committee (PAC), in U.S. politics, an organization whose purpose is to raise and distribute campaign funds to candidates seeking political office. PACs are generally formed by corporations, labor unions, trade associations, or other organizations or individuals and channel the voluntary contributions they raise to candidates for elective offices, primarily in the U.S. House of Representatives and the U.S. Senate. PACs may also spend their funds on what are termed independent expenditures— defined in law as a message “expressly advocating the election or defeat of a clearly identified candidate that is not made in cooperation, consultation, or concert with, or at the request or suggestion of, a candidate, a candidate’s authorized committee, or their agents, or a political party or its agents.”

I might add that the tax perk is just the beginning incentive to inspire citizens to participate. When a cause is near and dear to your heart (or financial concerns) many people choose to invest much more. The financial limits are as follows according to OpenSecrets.org “PACs can give $5,000 to a candidate committee per election (primary, general or special). They can also give up to $15,000 annually to any national party committee, and $5,000 annually to any other PAC. PACs may receive up to $5,000 from any one individual, PAC or party committee per calendar year.” There are 2 PACs that I know of (and have some affiliation with) that I would highly recommend to all of the members of the Rental Housing Alliance Oregon. “The Good Landlord PAC” which can be found at: www.goodlandlordpac.com, and the“More Housing Now” PAC at: www.morehousingnow.org.

Why? There is no question that the conversations about the housing crisis throughout Oregon in general and Portland in particular has gotten louder and more divisive. Unfortunately, many politicians are simply not hearing the concerns of property owners and are basing their decisions on the loudest voices in the room, which are often the radical tenant rights activists. Long standing policy practices (like the Tenant Landlord Coalition) have been jettisoned in favor of pushing radical new and financially difficult restrictions onto Oregon landlords in both the Portland City Council chambers and the Oregon State Legislature. Because of this I urge you to donate the largest amount of money you can to either or both of these PAC’s to represent your rights. How to Deal With Angry Occupants by Dakota Thornton

As a property manager, you receive more than your daily dose of drama. Much of it happens as a result of spontaneous combustion from angry occupants. Here are some ways to diffuse the situation, often ahead of time, and to keep things running smoothly. We’ve all heard the old adage, “you can’t please all the people all the time.” That’s especially true for property managers when it comes to angry occupants. No matter how hard you work and try to provide a pleasant, safe, livable environment, issues will and do arise. The ultimate difference between the reality of the job and the nightmare of a bad experience: the occupant’s attitude, especially if they are angry—as well as your reaction to that attitude. Being sensitive to occupants’ anger before the issue escalates may turn the heat down instead of up. Here are four of the most common occupant complaints (but, as you surely know, there are many others): Note: These tips can be applied by both commercial and multifamily property managers. Because of this, we wanted to use an all-encompassing term for tenants/ residents, so we refer to them as occupants within this article. Maintenance Issues Make sure you have an efficient, airtight, maintenance resolution system, that doesn’t allow for leaks or blockage—that means a system that is easy to communicate and follow. Be sure that the process for registering complaints is stated clearly in the lease. Maintenance requests should always be in writing. If you can’t fix the issue immediately, at least acknowledge the issue right away, and follow-up within a reasonable time. This shows the occupant that you haven’t forgotten about them. Unavailability A property manager who is hard to find ultimately translates to good occupants who are hard to find. In the digital age, a property manager who is difficult to track down is inexcusable. Always acknowledge an occupant’s issue, even if it’s by email (for example: “So sorry I was out of the office when you came by. I know of your problem and I am working on it. I’ll keep you posted.”). It’s tempting to try to avoid an angry occupant, but your absence will only intensify 8

the anger. Noisy Neighbors In most cases, this issue is out of the jurisdiction of property managers, and not much can be done. It’s usually up to the occupant to resolve the issue (hopefully amicably), or call the cops. One good precaution: make sure your lease contains clear language about quiet hours or noise violations. Pests Non-negotiable: Call an exterminator immediately. Cockroaches, spiders, ants, termites, mice, and rats are nomads. They don’t set up shop in just one unit. Even better: treat the problem before it starts with regular exterminator inspections and treatments. Here are some things to keep in mind (and body) when dealing with an angry tenant: Listen for a long time. This means until the tenant runs out of steam. What he probably needs, right from the start, is an ear, and you’re providing yours. Don’t get defensive, this is the most natural response in the world, but suppress it with every fiber of your being. Instead, practice empathy and concern. This by no means is an admission of guilt or failure. You are not required to bash yourself in the process. Instead, you are joining the occupant rather than beating him. Stay positive. All the negative words you know (including no) won’t help you in this situation. Avoid adding these words into the conversation (and it takes mindfulness and practice to do so: can’t, won’t, don’t, not. Instead of telling the occupant what you can’t do for him or her, tell them what you can do. Give positive suggestions of what can be done. This shows that you are clearly on their side, and working to get the issue resolved. Say things like, “We’re going to find a solution,” and “I’m going to get you an answer.” Use body language to your advantage. Body language is key in getting an occupant to calm down, and look at the issue rationally. Make eye contact while they are speaking, and show that you are paying attention. Nod your head. Lean in. Show concern and empathy. Don’t excuse yourself to answer the phone or a text. (continued on page 9) www.rhaoregon.org

Repeat it back. Make sure you clearly repeat the issue to show you completely understand what is making the occupant so angry and frustrated. Avoid turning it into a pity party. Don’t try to make the occupant understand what you are up against, and what you have to deal with, and how the powers-thatbe make your life a living hell. At first, it feels like a great way to make a connection and bond with the occupant, but ultimately, nothing will get resolved, and the occupant will ultimately realize that you are not all that interested in his issue and that getting the matter resolved is hopeless. Tell them what to expect. Report an estimated delivery time for a needed part, or the window of time when maintenance workers will arrive. Creating a mental picture of resolution will help the tenant feel less hopeless. Of course, continue to monitor the situation and follow up, and keep the occupant posted. Say what you mean and mean what you say. Let occupants get used to you being a property manager

of your word. If the sink is meant to be fixed on Wednesday, make sure the plumber is there. Turn “no solution” into an opportunity to improve. If the occupant’s complaint is truly unsolvable (and we know how often this happens), consider it a chance to think about how your property may improve with an alternative solution. Using these tips can turn an angry, frustrated occupant into a loyal fan who may even talk you up to other occupants and recommend the property when spaces become vacant. Calm always wins. Dear Maintenance Men: Our studio units have under counter refrigerators. One of the fridges does not cool and I believe it has a Freon leak. Can this fridge be repaired? Is it worth repairing? Will it leak again? Lou Dear Lou: Yes the fridge can be repaired, however you may want to consider the 50/50 rule. If the repairs reach fifty percent of the replacement cost, it is best to replace the item. If the appliance is a name brand, most likely the replacement parts are available. Common issues related to non-cooling are compressor failure, refrigeration line breakage or crack due to vibration and thermostat or capacitor. The compressor is the most expensive to repair or replace and will most likely go over the 50/50 rule. A leak in the refrigeration line is the hardest to repair properly and has the most likelihood of repeat failure. The thermostat and capacitors are typically easy fixes. Dear Maintenance Men: My resident called and stated the toilet is not flushing properly. I have replaced the flush valve and the flapper valve. The toilet is still slow to flush. What have I over looked? Phillip Dear Phillip: You might have any number of issues at play. First, make sure the flapper valve is letting through enough water. If it flops down too soon, be sure the toilet flush handle is not loose or that the chain or line connecting to the rubber flapper is tight enough. The chain connecting to the flapper should have about an inch of play. You want the flapper to open wide enough to float a few moments before it falls back down and closes off the flush valve. If the flapper is working properly, check that the holes under the rim are not clogged. If you live in an area with very hard water; calcium may buildup in the drain holes under the bowl rim. A partially clogged rim might not allow enough water through the rim to start the vortex motion and slow the evacuation process. Use a stiff toilet bush and a vinegar solution to help remove the calcium buildup under the rim. Lastly is an item lodged in the toilet trap? The items we find most often are small toys, rags, etc. Use a toilet auger to push your way through the 10

trap and clear or pull back any obstructions. A toilet auger is a special tool that has an offset hand crank, a long sleeve handle and a special auger bit at the end to break through a clog or retrieve an obstruction. The auger bit is connected via a flexible shaft to a crank handle that you control. Its reach is about 3 feet. The auger can be found at any hardware store. Dear Apartment Owners, Manager and Maintenance: Remember, the holiday season has started and the demand on your properties only gets worse. Check each stove and oven for proper operation, many residents only turn on their ovens at this time of year, and the problem may be as simple as a blown out pilot light. This time of year sees a higher than normal use of the plumbing, it may be a good idea to snake out or hydro jet your main plumbing lines. In addition, sending a note to each tenant on the proper use of the garbage disposal will be useful. Note what they should and should not put down the disposal unit. A few items to include on this list are: banana peels, potato skins, coffee grounds and any stringy food. Also make sure they turn on the water before using the disposer and put down small amounts of food at a time. Instruct your residents to not use the disposer as a trash can and then turn it on when full, it will clog. Christmas and other holidays also mean more people than usual walking on your property. Is your property safe? What are some of the liabilities to worry about? Check trip and fall hazards. Do you have sprinkler heads sticking up above the grass or landscape near sidewalks? Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can be solved with a concrete grinder or replacement of the section and removal of the tree root. Cut any low hanging tree branches and look for branches that may break in heavy winter snow, wind or rain. Check your decking for cracks or damage and inspect the exterior stairways for wear and tear. Inspect all your garage door springs, winter wind and rain may make them heavy causing the door to close or fall unexpectedly. Check all property lighting and timers. Remember: Preventive Maintenance is cheaper than Emergency Maintenance! (continued on page 15) www.rhaoregon.org

Check your smoke and carbon monoxide alarms to ensure they are in working order!  Never operate a barbecue or portable stove indoors! Unvented, these outdoor devices produce DEADLY carbon monoxide!

Electrical Safety:  In the event of a power outage, choose safe alternatives for lighting such as a flashlight or battery-powered lanterns... rather than candles or kerosene lanterns. Fireplace Safety:

Make sure the area around your fireplace is clear of things that can burn, including clothing, decorations, furniture and magazines/papers.  Install a metal fireplace screen or heat-tempered glass door to prevent embers from escaping… as those embers may start a fire.  Fireplace ashes can stay warm for up to a week! So dispose of all ashes safely by using a metal can with lid and keep the metal can at least 10 feet away from your home and/or deck. Never dispose of ashes in a paper bag, box, or other container... such as a plastic garbage can or waste basket. 

Silly Season by Marcia Gohman of National Tenant Network

Trying to rent your place any time between Thanksgiving and the New Year? Be very careful! This is the time of year that we call, “The Silly Season.” If you think about it, who would want to move this close to Christmas? Nobody in their right mind! That’s who! Many of us already have Christmas Decorations up; we have purchased a tree or lights and other assorted decor for our homes, front porches and lawns. So why would someone be moving this time of year? Because they HAVE to. Typically the applications we see from December to January 1st have the most inventive information and the most interesting criminal reports we see all year. > On one application under “Why are you moving” “Just got out of the Canadian Navy”.. Canada has a Navy, but he was just released from prison in Washington. That’s close, right? >On another application the applicant listed her name, then we noticed a different last name in her email address and that she signed it with a slightly different name... >The applicant warned the landlord that there was “This one little thing” on her criminal report. Two pages of little things. They apparently all blend together. So what do we do? We take things very slowly. Pay more attention to how the application is filled out, check picture ID more carefully, and ask for a recent pay stub. If the applicant is in a BIG hurry, you tell them it will take you five days to complete your verification process. And no matter how tempting, remember that almost everyone who offers to pay you six months’ rent in advance is a recreational pharmaceutical salesperson (Drug Dealer). Verify all telephone numbers, just today I have found that one phone number was a family member, and one was to a friend who runs a storage facility. The applicant listed that she lived in #6. How did I find that? Google Earth. It’s a great tool for landlords! Plug in the address and see what comes up! Does it appear to be an apartment community? A house? Or is it a strip mall or office complex? If you are given what appears to be a single family residence address, you can call the county tax assessor and get the owner’s name and address. Many counties have a Tax Assessor web site where you can enter the address and find the owner. You still have to find the phone number; use Whitepage.com or anywho.com for that. I subscribe to Whitepages.com Premium which has a wonderful reverse telephone search. If the applicant gives you a number for his/her employer, you can reverse search it and see if the number belongs to the company or is a friend’s cell phone number. One of my favorite tricks, when I know I’m going to talk to a friend or family member, is to call and ask about the rental I heard they have. The family member automatically says, “What?!? We don’t have rentals!”, and bingo. You have verified a fib on the application. I know, I know. This sounds like a LOT of extra work. But it will pay off in the end. You don’t want to start out your New Year in evictions court trying to get that tenant out because you didn’t verify that “One little Thing”.. Once we get to January the company transfers go out and the better applicants re-appear. Until then, just remember: ‘Tis the Season!!
