President’s Message

Last month at the January dinner meeting, RHA Oregon had former newscaster Kelley Day speak. Kelley has spent her career in front of the TV cameras and is a consummate professional. It was great to have her share her insights and experiences on how to present a story in its best light. These days that seems to be getting more difficult.

There is a new rancor now being substituted for communication over the cures to Portland’s housing crisis. As rental property owners, it’s no longer enough to provide quality housing. We all need to learn to be better story tellers.

Let’s start off with a couple of observations: Portland is one of the world’s 10 most livable cities according to a recent list in Metropolis Magazine. Portland ranks alongside with Helsinki, Copenhagen, Sydney and Singapore. Additionally, Oregon is one of the fastest growing states in America, and it recently ranked # 2 for in-bound moving vans nationwide.

There is no question that we need to come together to solve our housing needs. Yet Landlords are stunned that the government would interfere with contractual clauses that allow for the simple termination of an agreement. They are outraged that their income could be arbitrarily capped with no regard to the free market, (no matter how low they’ve been voluntarily kept for years past). They are flabbergasted to learn they must pay thousands of dollars for Tenant relocations.

Tenants are also in conflict. Those that live in comfortable and affordable homes may not want to rock the boat. Many live with the anxiety that their safe haven could all come to an end with a single notice. Others personally feel the hardships of the rising economy around them, and have been forced to find substitute housing; to become roommates; move to less desirable locations. For them, that rental property is the center of their life… it’s not “just a business that should earn a profit”.

Meanwhile, however, tenant / landlord court cases are rife with accusations from both sides for unwonted damage and neglect left by the ravages and lack of care of that other party.

So I ask myself: What’s a professional property owner to do?

Without owners willing and able to invest in properties we have no inventory. And without tenants willing and able to pay market rents we have no incentive to build more housing. Has our industry devolved into nothing more than crisis management trying to ward off government restrictions, collections and lawsuits?

I often rely on basic rules to solve problems. One rule is what I call the “zipper theory of life”: When a zipper disconnects, the solution is to move the clasp back to the point of separation and start over. (continued on page 7)

Let’s consider the term “Landlord”, a title that itself is stuck in the past. Who wants to be “lorded” over by a profiteer? We should re-brand ourselves as “Rental Property Providers.” We should ensure that our properties are safe and comfortably livable. We should make an effort to consider the needs of our clientele – because without good renters our properties soon become derelict.

Perhaps we can be encouraged with the fact that for thousands of years there has always been hope that people can overcome conflicts with decency and dignity in place of disrespect and drama.

Tenants ought to consider their obligations as well.

Normal wear and tear shouldn’t be an excuse to allow mold to grow, grease to build up, yards to grow out of control or smoke detector batteries that save lives to expire. Good Tenants respect and thrive in their homes and value Good Property Owners.

As I move the zipper back further in time, I found a connection from the oldest book in print, the Bible: “Put away from you all bitterness and wrath and anger

Those are the stories that should be really worth telling.

Tenant Screening Notice As we all know, the screening process is one that is critical to the success of a landlord-tenant relationship.

To better keep up with the times, and the changes, the Rental Housing Alliance Oregon, in partnership with National Tenant Network will be making some changes in 2018.

First, to better serve you, there will be 24 hour access online to submit screening requests starting March 1st.

Simply go to www.rhaoregon.org/tools to access the screening login screen or visit www.ntnonline.com directly.

For those of you already under a service agreement with NTN allowing online access, you’ll just login as you may have in the past. For those logging in for the first time please contact National Tenant Network at 503-635-1118 or RHA at 503-254-4723 to receive your access information.

Secondly, for the first time since 2012, there will be a slight change to the pricing for services, effective March 1, 2018. Dear Maintenance Men

Dear Maintenance Men: I want to create a seating and relaxing area in the middle of my building’s courtyard. My thoughts are to use decomposed granite and eliminate the current grass area. How do you go about installing the surface without making a mess or a future headache for myself?

Bryan

1: Locate the main water shut-off valve and any minor shut-off valves. Make sure the valves are in working order. If they are gate valves, it might be time to upgrade them to ball valves. Old gate valves are notorious for breaking valve stems at the moment you need them to work.

Dear Bryan: Decomposed granite or DG for short is a great way to add a durable, natural and water wise surface. A few things you need to know before you get started. The key word in DG is “Decomposed.” In other words, this granite is decomposing. There are three options: raw DG for flower beds, stabilized DG for walkways and resin-coated DG for driveways. For your purpose you need to use a stabilized DG for walkways. It has a binder mixed into the DG. Non-stabilized DG is much cheaper, but will of course decompose, create dust when dry and slush when wet. To properly install DG, dig down three inches overall and use a wood, rock or brick border to keep the edges of the DG from crumbling. As an option, lay down a weed barrier cloth under the DG. Apply DG in one and a half inch layers, water down (don’t flood) and tamp or use a heavy roller to compress the DG. Wait eight hours between layers to let the DG settle. Repeat the above for each subsequent layer. When installed properly, the DG surface will be rock hard, stable, dust free and will allow water to drain.

3: Locate and mark the main sewer clean-out. Run a mainline snake or hydro jet at least once a year. (A Friday evening main back-up is a disaster.)

Dear Maintenance men: I am aware of having a disaster preparedness kit for my family, however, what do I do for my apartment building?

Jason Dear Jason: A quick list of what should be in your family disaster preparedness kit: Flashlight with batteries, canned goods, a Gallon of water per person, a knife, Meds and blankets at minimum. Now this works ok for a family, but may not be appropriate for an apartment building. The residents may very well shelter in place during a disaster and be fine. What may be in danger is your property! Start with a bit of preventive disaster maintenance.

2: Locate and clearly mark the main electrical panel.

4: Locate and mark the main gas or fuel oil shut-off valve.

5: Write down and post this information in a public area of your apartment building, including emergency phone numbers and how to get hold of management.

Alternatively; Post this information on the inside of a kitchen cabinet door in each rental unit.

Dear Maintenance Men: I am starting my planning for a major kitchen cabinet remodeling project in my rental units. However, I am having a difficult time making material and design decisions. What recommendations can you give?

Allen.

Dear Allen, When doing a kitchen or bath material selection, cohesive and functional design is important. Kitchen and bath rehabs are some of the most expensive work you can do in an apartment unit and proper planning is a must. In order to appeal to a larger segment of the population, try to keep the interior color scheme to neutral earth tones. Cabinetry quality varies greatly.

Don’t let the cabinet fronts fool you. Manufactures designed their cabinets to look good at first glance.

Keep in mind, being in a rental environment, the cabinets also need to hold up to abuse. Look at the actual construction of the cabinet box or frame. Keep in mind; you do not need to use custom cabinets to fit your existing layout. The use of prefabricated modular cabinetry can greatly reduce the time and cost to have a finished kitchen or bathroom. Using real wood cabinet fronts with 3/8” plywood sides is essential for durability. The drawer fronts and sides should be connected with a dovetail or other positive lock (continued on page 11)

construction. Drawers that are held together by nails or cabinets built with particle board will not hold up to tenant abuse.

On a side note; if you are gutting the kitchen or bathroom, use this time to relocate and add more electrical outlets and under cabinet lighting.

Upcoming Changes to Tenant Screening Process

***Announcement*** We are excited to announce that there will be changes to your screening processes in March. In the past, you may have submitted your report requests to the Rental Housing Alliance Oregon, who then submitted them to us at National Tenant Network. We are streamlining the entire process by asking you to send your reports directly to NTN. This will cut down on the turnaround time, and make the entire process more convenient for you.

Starting in March, you will be able to fax report requests to NTN at 503-635-9392, or you can log on to our web site either through the RHA or NTN directly to submit your requests.

You can also call reports in to our office at 503-635-1118 or email them in to us. Call us for more information on emailing, there are some precautions we would like you to take.

So, Upside – you get your reports back faster!

Downside – you won’t be able to walk into the RHA with your report requests.

By logging in to your NTN account, you have access to a number of other benefits.

You can report when your tenant moves in and moves out, sharing that information with the NTN network for free. This provides you with the opportunity to give that tenant a Gold Star, or Tenant Worthy recommendation, and will prompt other landlords to call you for more information before renting to that resident if you had a negative experience.

A Summary of The New Tax Reform (And What it Means for Real Estate)

The new federal tax codes signed into law this past December bode well for the real estate industry, overall. These improvements include lower tax rates for property owners that will spur new investments and increase demand for real estate investors. The Tax Cuts and Jobs Act bill will cut tax billings more than $1.2 trillion over ten years. Depending on your income, income taxes will drop from 37% to 29.6% – and this 6% difference can add up to serious savings for most real estate investors that invest using a pass-through business or limited liability company (LLC.) The bill itself creates a huge incentive for investors to organize their investments as an LLC or other pass-through business (sole proprietorship, partnership, or S-corporation.)

MORTGAGE INTEREST DEDUCTIONS The final bill reduced the limit on deductible residential mortgage debt from $1 million to $750,000 (or $375,000 for married taxpayers filing separately) for all new loans, and eliminates deductions when using home equity loans, unless the money was used for renovations or home improvements. Interest continues to be deductible on second homes, but is still subject to the $750,000 limit. Currently, taxpayers can deduct what they pay in state and local property, income, and sales taxes from their federal returns, but the new law caps these deductions at $10,000 per year for any combination of property, income, and sales tax.

Existing homeowners are grandfathered into the previous deduction cap of $1 million, but if a homeowner moves and takes out a new loan – then they would lose that $250,000 in savings. If a person sells their primary residence – they will not need to pay taxes on the proceeds – that’s up to $250,000 for a single or $500,000 for married homeowners – provided that they have lived in that home long enough (5 out of the past 8 years.) Homeowners in costly residential markets may choose to stay put rather than risk the loss of deductions with the purchase of a new home.

As far as commercial real estate is concerned, this tax plan could be beneficial to retail Landlords – with lower taxes for tenants, which in turn leaves consumers with more extraneous cash to spend. These tax benefits could also lead to office tenants choosing to stay in the US, rather than moving their headquarters overseas, and deductions are tied to the amount of wages a business pays, so ownership structures with more employees like Real Estate Investment Trusts (REITs) will benefit from larger savings.

ITEMIZING MORTGAGE INTEREST DEDUCTIONS Most people don’t take mortgage deductions into account when they are purchasing a home – more likely they are tired of renting, need more space or a yard, or are starting a family. Only homeowners who itemize their taxes receive mortgage interest deductions (in 2014, that was only about 30% of Americans.) With this new tax plan – the standard deduction amount has actually doubled. The standard deduction was raised from $6,350 to $12,000 for single homeowners, and from $12,700 to $24,000 for those filing as a married couple. To benefit from these interest deductions, a homeowner’s itemized deductions must total more than the max standard – which will likely only be true for the top tier high-income taxpayers.

ESTATE PLANNING & 1031 EXCHANGE Another thing to consider with the new tax laws is estate planning. Starting January 1, 2018, the estate, gift, and generationskipping transfer (GST) tax exemptions double to $11.2 million per person (or $22.4 million for a married couple), and will continue to adjust for inflation for the next 7 years.

This adjustment however, expires in 2025 – when the exemptions revert back to the $5,000,000 level per individual, so some people may want to take advantage of this generous increase to gift their properties to beneficiaries now rather than later. (continued on page 16) www.rhaoregon.org

The final bill retained 1031 like-kind exchanges of real property – as in real estate in the form of a building, land, etc. – but repealed the use for personal property such as art, automobiles, or heavy machinery.

RENT INSTEAD? These tax law changes have the potential to scare off homebuyers, and subsequently lower home prices, but demographically millennials will continue to create demand for housing as they marry and have children. (Note: With the current administration reducing the inflow of immigrants, a reduction in rental demand might be felt in the residential rental market in twenty-four (24) months.)

Since those tax deductions aren’t quite as appealing as they used to be – potential homebuyers could choose to rent instead, which in turn might lead to an increase of renters. But, past generations have embraced the American dream of owning a home and for many homeowners, owning and paying off the family home is a step towards planning for retirement. In other words, we expect millennials to be buying homes (if they can afford them) – after they have paid off their student loans. Remember that many of these millennials are children of the baby boomers, who have cash and can now gift their children money to fund a down payment for a new home.
