Oregon President I have been fortunate to have lived in several communities over RHAKen Schriver

the course of my life where, through volunteering, I have had the opportunity to “cast my vote” about the kind of community I wanted for me and my family. I became involved with Rental Housing Alliance Oregon when I moved back to Portland three years ago in part because of the commitment of our members to community service. Most of our members are small business owners and operators, whether landlords, or vendors, or both. As such, we are all very busy people. Yet I am consistently impressed at the number of RHA members that find the time to volunteer to make our community a better place. This devotion to volunteering and community service is embodied in our slogan, which affirms that we “…set the standard for community participation by landlords.” If you review the list of volunteer board members alongside this message, you will notice the recent changes in board composition. After many years of dedicated service, Ami Stevens, Liz Carpenter, and Mihyun Pratt are taking a break from their board service, although they will continue to be involved in committee and subcommittee work. At our December holiday dinner, we recognized these volunteers along with our immediate past president Ron Garcia, who also received the Al Moulton and Sharon Fleming-Barrett Volunteerism Award. I encourage you to thank them for their work with RHA the next time you see them at one of our functions. At that same December meeting we installed three new board members: Tamara Evans, Jake Ramirez, and Violet Anderson. Please seek them out as well and thank them for their willingness to help our organization. We will share more about each of them, as well as other board members, through a new Spotlight feature in each month’s UPDATE. President-Elect John Sage was featured last month, and Ron Garcia is featured on page 13 of this issue.

What You Should Know About Online Rent Collections By Zachary Lawrence JD

I spend way too much time handling and processing monthly rent checks. During the beginning of each month, I’m driving to my office, collecting rents, opening envelopes, endorsing checks, entering the data into a software program, and making multiple trips to the bank. I know all of my bank tellers by name and bring them donuts. In an effort to reduce the time I spend processing paper checks, I looked into the many companies that now offer landlords the ability to collect their rents electronically. Just imagine – no more collecting piles of rent checks, processing paper rent checks or multiple trips to the bank. Many of the ads for these online companies show a picture of a landlord on a beach, sipping a cocktail, as he looks at his Smartphone, presumably to review his online rent payments. Someone please hand me a shot of Tequila and some sunscreen. It’s the beginning of the month and time to collect my online rents! Going Paperless The concept of going “paperless” is indeed appealing. However, going “paperless” should not result in a landlord becoming clueless. And as I learned the hard way, some of these online companies sell the “sizzle”, but the steak is lousy. And … a Colorado-based online rent provider is being sued by multiple landlords in multiple states because their rents got lost somewhere in cyberspace. The lawsuit claims that the company creates the impression that it manages its payment processing system, when it actually contracted with another electronic third party, which in turn, contracted with yet another electronic processing firm to process the rents. Maybe it’s just me, but this sounds like way too many cooks in the cyberspace broth! Based on a study conducted in 2014, 22% of tenants pay rent in cash, 42% by check, 16% by money order and 15% electronically. If you are considering using an online rent service for collection of your monthly rents, please put down your sunscreen and start asking questions; lots of questions. First, let’s look at the process. Online rent collection services deliver your rents electronically by using an “ACH”, which stands for Automated Clearing

House. This is an electronic “hub” used by banks to move money from one point to another. These online rent companies are acting as a middleman between you and the ACH. Most online rent collection firms charge a fee for each transaction. This fee is usually paid for by the tenant. However, the landlord may elect to absorb the costs. One eviction attorney told me that because the transaction fee is for the benefit of the online rent company and not the landlord, the transaction fees are not treated as a rent increase. The same eviction attorney reports that a landlord may only request, but not compel, a tenant to use an online service for payment of rent. What You Should Know These are just some of the questions and issue that I would suggest a landlord raise before engaging any online service for collecting rents: • How long has the company been in business? Check online reviews and contact the Better Business Bureau. Some of these companies have been reported for failure to distribute or release funds in a timely manner. • Bank statement information: Make sure that the company you select will identify, on your bank statement, the name of the tenant and the corresponding amount of rent paid. For example, I have multiple tenants that pay rent of $1,000.00 month. If I receive a bank statement that reflects a rent payment for $1,000.00 and nothing else, I won’t know which tenant made the payment. Most online companies will indeed send you an email indicating which tenant has initiated the payment, the amount of the payment and the date that it posted to your bank account. However, if you are audited, or of there is a dispute with the tenant, it’s essential that your bank statements identify the paying tenant, the date that the funds were posted, and the corresponding amount posted to your account. • Can you wait for your money? As per the terms of his lease, your tenant, Joe Smith, is required to pay rent on the first day of each month. (continued on page 8)

If Joe Smith is paying rent using an online service, the landlord will usually receive an email from the online rent company, stating that tenant Joe Smith has “initiated” his rent payment on the first of the month. However, because the rent was paid online, it will often take approximately three to five business days for the “initiated” funds to post to your account. Are you, the landlord, okay with this? Or do you require access to your funds immediately upon the due date? • Late fees: Again, tenant Joe Smith “initiated” his payment on the first of the month. However, because of the ACH time lag, Joe Smith’s rent did not post to your bank account until the fifth of the month. Is Joe Smith’s rent now considered “late”? According to eviction attorneys, the answer is no. If Joe Smith “initiates” his online rent payment on the due date, and notwithstanding the date the funds are posted to his bank account, the landlord may not demand a late fee. • Customer service: Some online rent collection companies only provide support via email. Others offer both phone support and live “chat rooms”. Ask yourself if you require phone support or if email-only support will suffice. By using an online service for rent collection, the landlord is entrusting the security of his rental income to an electronic

third party. This process may be a dream come true for some or a nightmare for others. So … before you head to the beach and sip that cocktail, look before you leap, ask lots of questions, and consult with your CPA. For example, the Membership/Marketing committee will be focused on growing our membership through new marketing efforts, including social media. That committee will also be exploring ways in which our landlords and our affiliate members can more effectively connect. The Program Committee is always seeking out knowledgeable dinner speakers and venues, as well as individuals to help with Starry Night and our Annual Picnic this summer. The Education Committee is already selling out classes this year; demand for timely, quality instruction is only going to increase as statewide legislation and local ordinances change how we operate our businesses. Our committee chairs and board members are amazing folks, but they cannot do this work alone. We need your help. Should I Rent or Sell my Home? by Cliff Hockley, Bluestone & Hockley

You have been given the opportunity to transfer with your job, but you love your home and don’t really want to sell it. But your financial position is such that you cannot support two homes. What do you do, rent or sell? Rent your house: If you want to rent your house, you need to have a handle on the costs of renting your home. Typically, you will face the following costs as a Landlord: • Taxes (Property and Income Taxes) • Insurance (You will need to change Insurance coverage from a Home owner policy to a Landlord Policy. This does increase the cost a little) • Maintenance • Replacements of items like water heaters, roofs, decks, just as if you lived in the house • Repairs of broken items • Preventative maintenance, like gutter cleaning, servicing your furnace • Advertising for new tenancies • Landscape maintenance between tenants • Cleaning and painting (also called turning costs) between tenants • Utilities – between tenants • Association fees (If you live in a neighborhood that has a home owners association) • Property management (Usually property management costs from 9 -11% plus a lease up fee. This varies from town to town, city to city, state to state, property manager to property manager) • Cost of vacancy (Mortgage, Taxes, Insurance) • Cost of potentially canceling a lease (In Portland that could cost you $4,500 if you need to ask a tenant to move) • City or county, Landlord registration fees • The mortgage payment Tenants are typically responsible for: • Utilities (except for garbage service in some cities) • Keeping the inside of the house clean and light yard work. You might look at this list and decide that this is too much to consider.

But if you inherited your home or own it free and clear, your typical costs of operating a rental should not exceed between 40 and 50 percent of your income, so you can make 50 or 60 percent return on the house. Consider this, you get the cash flow and: • Appreciation (in a strong housing market with increasing population) • Depreciation • Debt reduction, since the tenant is paying down the mortgage (if there is one) All this can add up to a significant return, depending on your individual circumstances. (Disclaimer: Of course, you need to check your personal tax and income position out with your CPA ahead of time. Please choose a CPA that has real estate investments or a significant number of clients that own and invest in real estate, otherwise you will not be getting good advice. Candidly, the first thing you should do as you are pondering this decision is to find a knowledgeable CPA and property manager. The CPA will give you the tax and cash information and the property manager will provide an estimate of the rental rate for your home in the market place. It pays to talk to at least three of each.) Tolerance for being a Landlord It takes patience (and cash reserves) to be a successful owner of rental real estate. Some tenants will be late on their rent, not pay the rent, damage your property, complain about the property and want rent reductions. They will call you in the middle of the night to fix plumbing leaks and stopped up toilets (that is if you don’t have a property manager). You might have roof leaks, or a landslide, or the tenant allows their new dog to scratch up your hardwood floors. Some tenants will lose their jobs or gamble away the rent money and not be able to pay the rent and you will need to evict them. You just need to be prepared for these expenses and experiences. Tenant screening is critical. Tenants should have a verifiable income and you can secure their behavior with damage deposits. (continued on page 11)

The City of Portland, Oregon may make screening more difficult in 2019, so you will want to work closely with your property manager to reduce your risk as much as possible. If you don’t have the tolerance, don’t do it. Sell your Home You have decided you don’t have the tolerance, and the costs of keeping the house will outstrip the income and the potential appreciation of value. You are far away and cannot keep an eye on the house and you just don’t trust property managers. The decision is simple, find a great real estate broker and sell the house and trade the equity into your new home in your new town. Where the decision gets tough is when the economy is in a down cycle and your house is worth less than the mortgage you have taken out. That is when you have to make a difficult decision. Typically, property values do come back, and you can pay off your mortgage, but you may have to deal with negative cash flow for a few years while the real estate market gets its legs back. Summary The best reasons to become a Landlord are that you want to return to your home to retire in or take advantage of appreciation and sell it later or better, yet you are building your net worth and want to trade into other real estate investments as it increases value. In any case you need to decide if you and your family can handle that someone else will be living in your home while you are gone. If you have the right attitude and some financial reserves and a good property manager, it’s definitely worth considering becoming a Landlord.

Dear Maintenance Men by Jerry L’Ecuyer & Frank Alvarez

Dear Maintenance Men: I was cleaning the kitchen stove in one of my vacant units and noticed the free standing stove tipped forward when I put a bit of weight on the open oven door. It looked a bit dangerous and was wondering how I can fix this issue. Rick Dear Rick: You are very lucky it was you and not one of your resident’s children that found out about the dangers of a tipping oven. First let us explain what a tipping oven is: Most stoves with an oven are free standing appliances. The stove is placed in the kitchen, gas or electrical lines are installed and it is ready for use, very simple. The issue arises when a resident is using the stove and they or a child opens the oven door and puts weight on the open door. This causes a cantilever effect which may pitch the whole stove forward causing the stove top pots or pans to fly off the stove and onto the person or child in front of the stove. Best case scenario is this causes a mess in the kitchen and worse case is a resident or child is badly burned or disfigured. It is not uncommon to hear about a small child wanting to see what Mommy is cooking by using the oven door as a stepping stool or even more common, removing a turkey, roast or other large item from the oven and placing it on the open door. The extra weight is enough to tip the stove forward. The solution is an “anti-tip bracket” installed behind the stove. An anti-tip bracket is “L” shaped and usually installed on the floor and against the wall (towards the back of the stove) for one of the rear legs to slide into. Replacement parts are available at any hardware or home center stores, however, if not installed, there is a good chance, it is still in the plastic bag tied to the back of the stove. Shut off the circuit breaker or gas line feeding the stove, carefully slide the stove away from the,

wall, ensure a bracket isn’t installed (the last time the stove was slid against the wall it may have simply missed the bracket) and if not installed, search around for the original plastic bag. Hopefully, the instructions and template is still in the bag. Keep in mind installing an anti-tipping bracket is both a resident safety issues as well as an owner liability issue. This is a $10.00 part and a ten minute install that will keep both you and your resident out of hot water. Dear Maintenance Men: I am replacing a number of rotted pressure-treated 4x4 fence posts on my property. Why do some posts rot and other do not. I cannot see any rhyme or reason for one post to be good the other bad. How can I avoid this trouble in the future? Kent Dear Kent: The issue of the rotting posts lies in the Tree Growth Rings and their location. The rotting posts may have centered growth rings. If you look at the 4x4 post end, the growth rings will be either centered or not centered. A centered growth ring is common in post made from a peeler core. The tight centered growth rings of the peeler core will not accept pressure treatment as well as a post with offcentered growth rings. Chances are the fence you are repairing may have a mixture of peeler core posts and off-center growth ring posts. A Peeler core is the by-product of plywood manufacturing. A log is turned on a lathe to produce plywood veneer and the center that remains is called a peeler-core. When buying pressure treated post, look for off-center growth rings. Dear Maintenance Men: How can I add more storage to my utilitarian type bathrooms? (continued on page 15)

The residents complain that they need to store their toilet paper in the hallway! Please list a few suggestions on what to do? Robert Dear Robert: It does seem bathrooms are sometimes designed as an afterthought. Sink, toilet, bath and that is it. A modern bathroom will take into consideration the need for storage, electrical devises, personal hygiene etc. The first item that comes to mind is installing a bath sink cabinet. An old style cabinet might only have a set of doors under the sink. We find this is not adequate and a cabinet should have drawers along with access to under the sink. The drawers can store hair dryers, and all manner of personal bath items. A unique system we like utilizes the space between the studs in the wall. Cabinet doors or mirrors can be used to cover storage in the walls. The wall storage is perfect for toilet paper, rolled up towels, tooth brushes, and most other small items. As the largest provider of food assistance in the state of Oregon, we help nearly 10,000 people in need each month. SnowCap accomplishes this with the hard work of 1,000 volunteers led by a staff of 9 and without government funding. Since 1967, SnowCap has made healthy, fresh foods available to those who would otherwise go without. The majority of our clients are children, the elderly, disabled and folks who struggle to make ends meet.
