I love the 4th of July. It is a day that really makes me proud to be an American. When I watch the fireworks it always makes me feel proud, yet humbled. It’s a great day to celebrate – but it’s also a lot more than just hot dogs, sparklers, and parades. It is about patriotism and sacrifice. President I’m RHA Oregon Ron Garcia
As I reflect on what it means to live in a free society, reminded of a suggestion that has been made by some, that our country should build a “Statue of Responsibility” in the San Francisco Bay to compliment the Statue of Liberty in the New York Harbor.

On Wednesday July 19th RHA Oregon will host our 4th annual Starry Night gala at our annex at 10530 NE Weidler Portland, OR 97220. It is our association’s way of saying “thank you” to all of its members and vendors who make our organization great. And it is our way to raise money for charitable activities throughout our community. RHA Oregon has set the standard for community involvement for 90 years! Please join us for this fun event to “let off a little steam.” It comes at a perfect time of the year – since the State Legislators have finally sounded the gavel and closed their session. Now we can assess the impact they have had on our industry, and the influence we may have had in protecting the rights of property owners statewide. Starry Night is the time when we can casually network with one another at the same time we can unite as a group to make a difference for those less fortunate. The Basics of Being A Landlord – The Skills You Need by Bill Biko, the Educated Landlord
So You Want To Be a Landlord? I seem to get a few emails/calls about being a landlord, so here are some quick thoughts from me on the basics of being a landlord.
nickel and dimed and tenants can’t wait to get out as they never feel comfortable and often feel ripped off.
Handyman Skills
In my experience it often works out far better when it’s a win/win negotiation. Where both parties get a fair deal whether it is the purchase/sale of the property, the renovation work or the rental amounts. So maybe you don’t need to be such a fierce negotiator to make your job as a landlord easier.
Well some landlords I know are incredibly handy people, they are great with renovations, they love working on their properties, and they are your typical Mr. Fixit’s.
Now, I’m not saying that having some of the above mentioned skills won’t help you, it just appears they may not be as important as people often believe. Many people find success anyway, even if they are lacking in one or more of the above areas.
This will likely be a multi part series, so this post will focus on what skills you need to be a landlord.
However, I know many landlords who’ve only ever used a pen and paper. Rather than investing their time in a property, they have simply hired someone to get the job done. So while being handy helps, I guess it’s not a needed skill. People Skills How about people skills? A good landlord should have people skills! Again I know many landlords that are great people people and having the ability to relate to the tenants and get along with them has helped them tremendously. But as I think about it, these same people have some challenges because they tend to get buddy buddy with their tenants, which rarely seems to work out well. I also know many landlords who I would definitely put people skills at the lower end of their abilities, yet they are tremendously successful. So maybe people skills aren’t quite as essential as it seems to be a successful landlord. Fierce Negotiator This one has to be important because first you need to be able to negotiate the best possible price on the property you’re purchasing as a rental property. Then you need to negotiate with contractors to get the best prices, and tenants to get the highest rates and everyone in general to get the best deals. Except this can be a horrible plan for long term success. The people you buy your property from resent you for being such an aggressive negotiator, the contractors won’t work for you again because they hate getting 6

So what skills are valuable to a landlord? Organization, Patience and Humility Now these three skills I do believe are important. Again, they may not be essential, but definitely important. If you’re organized you can find records, receipts, invoices and more that are required for everything from your taxes to warranties to simply getting your books done correctly. Having systems in place to guide you along the way is one of the best methods to help with this. If you’re patient and understand your Real Estate is a long term investment it makes being a landlord much easier. With the constantly changing market trying to time your purchases of rental property and your selling of them can be incredibly stressful. Rather than following the get rich quick path that so many people promote, with Real Estate a longer term approach with an extended time frame (and lots of patience) will guide you through the ups and downs of the inevitable transitions through both buyers and sellers markets. Finally humility. Have you ever run into a pompous landlord who knows everything about Real Estate? I’m willing to bet many of you have and apparently one exsubscriber felt that way about me. You need humility so you can go to others when you have questions or are unsure of the (continued on page 7) www.rhaoregon.org

answers. It’s why you need a Real Estate agent who understands investment property when you’re buying. It’s why you need an accountant familiar with Real Estate if you are a landlord so you are aware of the correct deductions you can apply for and the correct processes for setting up your accounts. It’s why you need to call plumbers, drywallers, painters and other contractors when something is beyond your scope or when it makes sense to bring a pro in to get the job done right. Doing all of this takes a bit of humility at times as we often believe we can do it all. And perhaps we can, but if we do, then we lose focus on what the property is. Summer Season Property Maintenance To-Do List by Alexis Hammond of PropertyManager.com, a Service of AppFolio
Summer is almost here; and it’s a popular time for renters to move in and out of apartments. If you’re busy welcoming new renters, performing move-out inspections in vacant units, and trying to get apartments rented property maintenance can fall by the wayside until things calm down. Yet your renters deserve clean and wellgroomed common areas. Make sure your apartments look their best all summer long by adding these summer season maintenance tasks to your to-do list. Property Exterior Summer Maintenance Tasks Focus your energy on keeping your property exterior looking great in summer, when outdoor areas will see increased usage. Put outdoor lighting in place: Long summer nights entice renters to stay outdoors in common areas. To help them get back inside safely, make sure that you have outdoor lighting illuminating pathways and doorways. Solar lighting is an energy-efficient, modern option that requires little maintenance once installed. Trim grass: For comfort and protection from pests, keep grass trimmed regularly. Set a reminder in your calendar so you remember to mow the lawn every two weeks (or on the schedule of your choice), or contract out to a landscaping company if you prefer not to do this yourself. Perform a garden/common areas landscaping cleanup: Late spring and early summer is a perfect time to trim back plants, trees, and shrubs. Don’t forget to weed paths and walkways, where little plants can spring up in cracks and make your property look shoddy. Mulch garden beds: Flowers, trees, and shrubs get thirsty during summer heat. Adding 2-3 inches of mulch to garden beds helps the soil retain water for longer. Plants will look better during long, hot summer days; you will also conserve water usage and reduce utility costs through this eco-friendly landscaping tip. Wash and repair deck and patio spaces: Outdoor common spaces like decks and patios will see heavy use in summer. Check all of these common spaces now, and make any repairs that are necessary (such as repainting or replacing a loose deck board). Then clean all common areas to remove dust, dirt, and grime. To help keep these areas tidy and reduce the amount you’ll need to clean up after renters, install trash cans on decks and patios. Clean window wells and gutters: To ensure that rain can flow freely, clean out window wells and gutters seasonally, including as part of summer landscaping. Remove leaves, dirt, waste, and debris. Property Interior Summer Maintenance Tasks Tackle these tasks to keep interior common areas pleasant in summer: Have air conditioners serviced: Whether you have window air conditioners in common areas or enjoy central air conditioning, summertime will place a big demand on your AC. Be prepared by having your air conditioning serviced by a reputable HVAC company. This way, you can make repairs or replacements so your units will work properly when it matters most. Address gaps in windows, doors, and walls: Summer is prime pest season. These critters get inside through holes in windows, screens, doors, and walls. Get ahead of the pests by sealing cracks in windows and doors using caulk or expandable foam. If you notice that screens have rips, repair them to minimize your work mitigating pest problems later on. Test smoke and CO2 alarms: Test unit smoke and CO2 alarms several times a year. By adding this to your seasonal property maintenance list, you can help keep residents safe.

Evictions are annoying, but they are part of doing business as a landlord. Don’t panic when you need to do an eviction—just move forward with confidence and take care of the problem. Once again, we do recommend you contact an attorney to help you with your eviction, at least until you are confident that you can complete it correctly yourself. 4 Frequently Asked Questions on Evicting a Tenant 1. How long does an eviction take? In most states, as long as everything goes as planned, an eviction takes about a month. However, in some “tenant-friendly” states, evictions can take up to six months. 2. How much does an eviction cost? The state-required legal fees involved with an eviction are fairly light, usually no more than a few hundred dollars. However, the attorney fees and lost rent are the big cash flow killers. You’ll likely spend between $1,500 and $3,000 on attorney’s costs, plus several months of lost rent and damages done to the property. Cash for keys doesn’t sound so crazy now, does it? 3. Is it possible to evict a tenant without a rental
contract? If you don’t have a rental contract with your tenant, it is still possible to evict. In most states, a tenant without a rental contract is treated the same as a tenant on a month-to-month lease. This can actually be a good thing for you, in that an eviction could be avoided by simply “not renewing the month-to-month lease” and asking the tenant to leave with a Notice to Vacate (according to your specific state’s laws). Of course, if you have to evict without a rental contract, just bring every bit of paperwork and information you can about the tenant. 4. Where do I get an eviction letter? Before filing the lawsuit, you will need to serve the tenant with a notice, also known as an “eviction letter.” This is either the Pay or Vacate Notice (72 hour notice) or the Notice to Comply (Termination notice). These can be obtained from an attorney. *Editor’s note: or RHA Oregon/Rental Housing Association There is no one-size-fits-all solution for getting rid of a tenant. Hopefully you are well aware of the many different options you have for removing a tenant from your property, so getting rid of a bad tenant should not be an issue going forward.

Have interior carpets and furniture cleaned: After wet, muddy spring weather passes, treat interior carpets to a deep cleaning. Hallways will look brighter when carpets are cleaned. Many residents will breathe easier when mold, dust, pollen, and other allergens are removed from common area carpets. At the same time, clean interior furniture. Regular cleaning of furniture can forestall furniture replacement and keep your apartment looking its best. When you are able to keep up with summer maintenance, fall clean up won’t be as time-consuming and you’ll feel less stressed as a result. Summer Maintenance Checklist by Land lady Katie
In summer, complete the following projects to keep the rental property landscape lush and the home cool for your tenants.
Outdoor Tasks:
-Walk around the property’s exterior and open or uncover foundation vents. -Uncover central air conditioner and install window air conditioners. -Pressure wash siding and fences. -Pressure wash sidewalks and patios. Repair and seal cracks in walkways, driveways, patios, etc. -Touch up peeling or damaged paint. -Check exterior caulking and apply caulk as needed. -Wash exterior windows. -Remove lint from dryer exhaust vent with a long, flexible brush. -Clean the swimming pool or spa. Fix cracked tiles and any safety or structural concerns. Ensure any fence around the pool is secure and the gate has a working latch or lock. -Turn on the sprinkler system and check for leaks. -Open or remove storm windows.

Oregon’s New Housing Legislation Update HB 2004 by Cliff Hockley and Jeremy Boardman - Bluestone and Hockley Real Estate Services
HB 2004 is moving to the Oregon Senate floor. We wanted to update you regarding this House bill and its impact on the Landlord Tenant Act. Since its initial drafting, there have been many substantive changes and amendments, which the housing industry has viewed as favorable. The bill is out of the Senate Human Services Committee, which amended HB 2004 and then passed the bill onto the Senate Floor for a vote. We expect this bill to go to a floor vote as soon as this coming Tuesday, June 6th. Although the rent control provision has been removed, the Tenant relocation fees and the right to issue a termination notice without cause is still in the bill. A summary of the bill, as currently proposed, is below. This version allows 30-day no-cause eviction within the first nine months of month-to-month tenancy. • Tenants can give Landlords a 30 day notice to move out at the end of their lease term. • After the first nine months, eviction must be ‘forcause’ (with 90 days’ notice) and the following new “cause” categories added: -> The Landlord intends to convert unit to nonresidential use -> The Landlord intends to demolish the unit -> The Landlord must make repairs or renovations and the unit will not be habitable during that work, so long as the Tenant has the opportunity to lease the unit when the repairs/renovations are complete -> If a Landlord has notified the Tenant within 14 days of listing the unit for sale, the Landlord may issue a 30day notice to vacate after the sale of the unit -> The Landlord wants to live in the unit or allow family member to move into the unit • If the eviction is for a Landlord-based cause (listed above) and the Landlord operates five (5) or more units, the Tenant must be paid one month’s rent for relocation expenses. (Please note, this applies to LANDLORDS only, not to property management companies. Landlords with four (4) or fewer units, who use a property management company, are NOT subject to the relocation fee).
the tenancy, the fixed term tenancy automatically becomes a month-to-month tenancy, without requiring further notice. • If the Landlord terminates a tenancy in violation of the bill’s subsections, then the Landlord may pay a penalty equal to three months’ rent. • A Tenant has one year after the termination of the tenancy to assert a claim. • If the tenancy is within the same structure or property that the Landlord lives, a no-cause eviction can be issued at any time, with 60 days’ notice. • Prohibits a Landlord from issuing a no-cause eviction within 60 days of receiving a written request for repairs necessary to correct a violation of the building, health or housing code or to correct an un-inhabitable condition, as described in ORS 90.320. • A fixed term tenancy must be for at least six months, unless a shorter term is requested by Tenant • The Landlord must inform the Tenant 90 days before the end of a fixed term lease whether the Landlord intends to renew the lease. The Tenant must inform the Landlord 45 days before the end of the fixed term about whether they intend to accept the new lease • If the Landlord fails to inform the Tenant of their intention to renew or not renew, the Tenant can choose to vacate the unit on the end date of the lease term or ask that the lease roll into a month-to-month lease. • A Landlord can increase the rent for a Tenant only once in any 12-month period. While cumulatively beneficial for Tenants, after a series of compromises and changes, the current bill is palatable for most Landlords.
• If the Landlord fails to give the Tenant 90 days notice for a lease renewal and the Tenant does not terminate 16
