President’s Message RHA Oregon President Ken Schriver

In Homer’s Odyssey, the hero must navigate his ship through the Strait of Messina, which separates the island of Sicily from mainland Italy. This was a hazardous undertaking: the shoals on the north side are described as a six-headed sea monster called Scylla. To the south, a naturally occurring whirlpool became associated with an equally threatening monster, Charybdis. From that Greek mythology, we still refer to the process of navigating a particularly difficult situation as being “caught between Scylla and Charybdis.” Even if you’re not familiar with that phrase, you’ve probably heard one of the more modern variations such as “caught between a rock and a hard place.”

As landlords in Oregon, it may feel like we are now in such a situation. The Oregon legislature has fast-tracked Senate Bill 608, which would establish the only state-wide rent control policy in the country. It would also restrict a landlord’s use of no-cause terminations. As I write this, indications are that both houses of legislature will pass this bill and Governor Brown will sign it into law. Because the legislation has been written with an emergency clause, the law will go into effect upon her signing; landlords and property managers will need to adjust their policies immediately.

Are you ready?

I believe that RHA Oregon’s members will adapt to the new law, just as we adapted to House Bill 2639, passed in 2013, which mandated inclusion of Section 8 vouchers and other assistance as a source of income for applicants. Now, as then, RHA is providing the information our members need to understand the new rules. Two weeks ago, we e-mailed all our members a preprint of an article explaining SB 608 that appears in this issue of the UPDATE. If you attended our February dinner meeting, you heard an overview of what the new law will do and how you might be affected.

Want to learn more? Our Spring curriculum has been modified to include a class on 26 March taught by attorney Jeff Bennett, who will review the ramifications of SB 608 and other ordinances such as the new registration requirement for Portland landlords.

The instructors for our other spring courses, including “The Everchanging Market,” “Creating the Tenancy,” and “Managing the Tenancy,” will be incorporating up-to-date information to reflect the latest developments in state and local law. We’ve also expanded our monthly informal forums: “New Member Mentor Meetings” are now on the calendar as “Mentor Roundtables.” These sessions are great opportunities not only for new RHA members, but for longtime members and non-members to learn about best practices from some of our most experienced members as well as one another. Whether you’ve been a member for a month or a decade, I encourage you to attend these roundtables and bring a colleague. If you’re not yet a member, this is a great way to “test the waters,” and find out for yourself how valuable membership in RHA can be.

If Oregon’s new laws make you feel “caught between a rock and a hard place,” remember that Odysseus did ultimately succeed in his quest to return home to Ithaca from Troy. Is it More Effective to Buy New or Used Appliances to Replace Broken Ones?

by Cliff Hockley, Bluestone & Hockley Clients always ask me, “Is it more cost effective to buy new appliances or used ones when existing appliances in rental units fail?” Unfortunately, there is no easy answer to that question.

Appliance Categories In order to find an answer to that question, we have to break down different appliance categories so we can draw some thoughtful conclusions.

There are some appliances that it makes sense to replace with new equipment if you cannot repair them. Garbage disposals, dishwashers and dryers fall into this category because the price point for new and used equipment is very close, so you might as well replace them with new units.

Stoves, refrigerators, and clothes washers tend to start at a higher price point and typically motivate you to start looking around for used or refurbished deals. Clearly, the choice also depends on the quality of property you own and the amount of cash you have available.

Other Variables You also need to consider how old the appliance is that you own and the history of repairs on that appliance. It’s hard to find an appliance repair person that will come out to look or repair appliances for less than $125 per visit plus parts.

If you are lucky, they will have the parts on the truck, or an appliance parts store will be nearby.

If you are not lucky that turns into two trips and parts which could cost you $250. Most appliances have a 15 to 20-year lifespan. If your appliance is older than 15 years and you need to invest $250 in repairing it, I would suggest replacing the appliance rather than repair it. Appliances in apartment units may not last as long, because apartments tend to have more turn over than rental houses and as a result see more wear and tear.

Where to shop You tenant’s refrigerator has failed, and you need a new one what do you do? The obvious choice is to buy from the appliance repair company you are using, but they may not have the appliance in stock, or they charge you more than another company or maybe they do not carry a brand you like. If you buy a used appliance, you need to ask some important questions. How old is the appliance? It does not make sense to buy a used appliance that is fifteen years old. A five to seven-year-old unit could work if it has been reconditioned. If you buy a refurbished appliance, you will want to know who refurbished it, what they did and if they have a warranty. Is it manufactured by a reputable appliance company? You will want to research online and ask your used appliance store what they recommend. Quality Of course, you want to buy appliances that are well made and not all appliances are. Buying the least expensive unit in the market place may not be the answer. (continued on page 11)

Summary

Consider if it fails within a year; the cost of the service call justifies spending little more to get a unit that has a good warranty policy and a record of few failures.

Unfortunately, research shows that even the best units fail, just not as often. How could a washer help but fail when a tenant decides to put her jeans in the wash with twenty pounds of rocks to stone wash the jeans? Never the less look for good reviews and talk to appliance repair people.

The crystal ball has spoken and the answer to our question is… it’s really up to you and your vision for the appliance you are replacing. If you can afford it, by all means, replace a broken un-repairable appliance with a new one. Your tenants will love you for it and might even extend their stay. If you don’t have the money, replace the broken appliance with the best used appliance you can afford. Remember all appliances will wear out and will need to be replaced at some point or another.

Best Time to Buy If you can time your purchase, there are times when you can get a better deal.

For the best price do your research for rebates as they can be up to 35% of the product value. The best rebates seem to occur around holidays like: • President’s Day • Memorial Day • Independence Day • Labor Day • Columbus Day • Veteran’s Day • Black Friday (or Cyber Monday) If you are planning a renovation see if you can plan ahead or maybe your favorite appliance installer can get you contractor pricing if you are renovating a group of apartments.

Installation Don’t forget that most appliances have three additional costs affiliated to their replacement: installation, delivery and removal of the old appliance. These should all be included in your calculations regarding appliance replacement.

New technology The market is constantly changing giving you an opportunity to upgrade the living environment for your tenants and your ability to be more competitive and maybe charge more rent.

Recent innovations you might want to consider including: • The quieting for dishwashers down to 39 decibels. (Look into American made Bosch and Kitchen aid dishwashers.)

SENATE BILL 608, Explained With the passage of Senate Bill 608, Oregon will become the first state in the country to have statewide rent control. Many property owners are incredulous. Their reactions are loud and clear and indignant: “How could this happen?!” “We need to stop this!” “If this is in, I’m out!”

The purpose of this article is to explain A) What the bill is, B) How it came about, and C) Why Rental Housing Alliance Oregon did not support it or oppose it.

What the bill is: Briefly, SB 608: • Caps rent increases at 7% per year + CPI (which currently totals to just over 10%) • Restricts no-cause terminations to the first year of occupancy • Requires all fixed term leases be converted to month to month tenancies upon end dates • Adopts an annual “3 strikes you’re out” system to terminate leases at end dates for “just cause”, with 90-day notice • Defines “Landlord Exceptions” to terminate tenancies due to sale / renovation / demolition / family move-ins of unit • Establishes a relocation fee equal to 1 month’s rent for Tenants displaced by a Landlord Exception • Relieves small Landlords (with 1-4 units) from paying relocation fees • Exempts Owner-occupied tenancies (roommates) and Owner-occupied duplexes • Provides Tenant defense against action for possession with 3 months’ rent plus actual damages for violations when Tenant brings action within 1 year • Is defined as Emergency Legislation thus immediately enacted upon receiving the Governor’s signature

How SB 608 came about: The process to enact legislation generally entails a bill suggested through a legislator, drafted by legislative counsel and published with legislative sponsors. This allows for committee hearings, work sessions, amendments and public debate.

If a committee approves the bill, it usually goes next to the House or Senate floor for a vote and then the whole process starts over again in the next chamber. However, many bills never make it to the floor, some are changed beyond recognition, while others simply glide through the formalities of the process unscathed and adopted as law.

Occasionally a bill seems to be doing fine until it is finally and abruptly stopped in its tracks by a single vote. In February 2017 HB 2004 was the housing bill that endured the legislative process, was hotly debated, looked like it would pass yet was ultimately defeated due to the efforts of a single senator, Rod Monroe. This was a stunning defeat for Tenant advocates and for the legislators heavily invested in it (including Speaker of the House Tina Kotek).

While Landlords celebrated, Tenant advocates regrouped.

Meanwhile in Portland, newly elected Commissioner Chloe Eudaly was able to pass a temporary emergency Rent Stabilization Measure. The city was sued, arguing the ordinance was a violation of the statewide preemption to non-constitutional rent control.

The court nevertheless sided with Portland and the lawsuit then progressed (stalled?) to the appellate level. Mayor Wheeler double-downed in 2017, eliminating small Owner exemptions to the measure and signed it into permanent statute. Additionally, the City Council has since decided to pursue Landlord registration, revise screening criteria and challenge accepted practices for security deposits.

In 2018, Landlord groups rallied with a new (Continued on page 11)

organization called More Housing Now, attempting to unite their voices in a single effort to affect housing policies. The plan failed to take root as conflicts over what form of “single messaging” surfaced, pitting the issues of No Cause Terminations, Rent Control and Relocation Assistance against each other: RHA Oregon (with a heavy Portland membership) became active in challenging Relocation Assistance; ORHA, headquartered in Eugene, has predominantly defended the use of No Cause Terminations; Multi-Family NW has remained laser-focused on stopping rent control.

Trying to stop everything at once has put all Landlords in a defensive posture and the media attention has not been sympathetic.

It’s worth noting here that preparation and positioning for law making and rule changes does not begin when the bell rings and the Legislative Session commences. Early in 2018 officials were converging to discuss what the “next housing bill” would look like. RHA Oregon and others participated in a variety of meetings on housing issues throughout the year. In September (prior to the elections) a sample proposal surfaced that revealed just how much the Tenant groups were pushing for. Here is what surfaced: • Rent control at CPI only (no additional index) • Relocation fees matching Portland’s formula • Lift all local preemptions (meaning local ordinances could go further) • “Vacancy control” meaning o No ability to re-set rents on vacancy and o No option to terminate any rental except for For Cause (which was suggested as too Landlord friendly and subject to being modified)

Of course, many 2018 election campaigns rallied around housing as a platform issue; not only as races with Democrats v Republicans, but also lining up more liberal Democrat candidates against their more centrist incumbents. Because of his stand in 2016, Sen. Monroe was defeated in the primary by Democrat Shemia Fagan (who is now the current chair of the Senate Housing Committee). Three term Republican Rep. Julie Parrish (formally on the Human Services and Housing Committee) lost her seat to newcomer Democrat Rachel Prusak, who used homelessness and no-cause evictions as her rallying campaign message. There are other examples as well, including the governor’s race with the re-election of Democrat Kate Brown over her Republican challenger Knute Buehler.

And not to be overlooked, Democrat Val Hoyle was elected to Labor Commissioner, a job that oversees B.O.L.I. (the state bureau that presides over all Fair Housing discrimination disputes).

The result? Oregon has become one of six states (California, Illinois, Rhode Island, Delaware and Hawaii) to have a Democratic Super-Majority that can pass the laws of their choice (barring a veto from their own party’s leader). And Oregon is decidedly not Landlord friendly.

Why Rental Housing Alliance Oregon testified as Neutral on SB 608: SB 608 did not get introduced in the House of Representatives as HB 2004 had in the last session, and it was not written by any of the individuals on the Human Services and Housing Committee. Interestingly, while it was written by the Speaker of the House, Tina Kotek, it was co-sponsored by Senate Majority Leader, Ginny Burdick and introduced as a Senate bill.

And even though Shemia Fagan chairs the Senate Housing Committee, she can claim no responsibility for its content.

Five Landlord-friendly amendments were submitted to the committee. All of them were

And while Landlords are fuming mad over SB 608, note that Tenant’s rights groups and advocates (including the Community Alliance of Tenants, Portland Tenants United, Oregon Legal Aid Society and others) have all lined up to voice their objections that the bill “does not go far enough”.

Rental Housing Alliance Oregon has recognized the fact that there was a spirit of “pre-negotiation” to the bill. The fact is, there are not enough votes in either chamber to champion a Landlord friendly challenge and there are many votes in the House that are willing to go much further to benefit Tenants.

We are confident that with the current power of politics behind the measure, it will pass as written.

As written, it provides Landlords with some “relief” by maintaining no cause terminations for the first year. It allows for a rent-cap equal to over 10% (adjusted by the current CPI index). It gives landlords the ability to re-set rents upon vacancies and it creates a new “tool” to terminate leases after 3 violations in a year.

It defines Landlord-based exceptions to terminate with a “reasonable” one-month’s rent as relocation fee and exempts small Landlords from paying it entirely. It also maintains the state’s preemption over local jurisdictions for more severe attempts and rent control ordinances.

Although Rental Housing Alliance Oregon does not support the overall premise of the bill, for the reasons stated here, we cannot object to it either.

If there is a lot of opposition, there will be more amending – none of which will benefit Landlords. So, we have formally adopted a neutral position on SB 608 “as written”. Should it be modified in any way, RHAO will review this position.

Dear Maintenance Men

Dear Matintenance Men, I have heard the terms “Preventive Maintenance” for as long as I have owned apartments. But, I’m not sure how it applies to me. I own a small four-plex, I’m handy and just fix things as they come up.

Preventive maintenance just sounds like more work and expense to me and no doubt invented by a hardware store owner!

Tom Dear Tom: On the surface “preventive maintenance” may sound like a hardware store owner’s dream and it may in fact be, we don’t know! But, whoever came up with the idea was pretty smart. Both on a large or small scale, preventive maintenance or “PM” for short is a huge money saver not only in parts, but also in time. An unplanned breakdown is never convenient. Surprisingly, chances are high of a breakdown happening on a Friday evening after hours or over the weekend. Planning for a breakdown is the first step in avoiding an unplanned breakdown. Look at your apartment building with a critical eye and list everything that might go wrong at some point in time. This list would include: water heaters, hot and cold water supply lines, faucets, drains, garage door springs, heating and air conditioning, etc. At minimum you should have on hand repair parts for all the items on your list along with the tools to do the work.

If you want to get ahead of a potential breakdown, figure out the estimated lifetime of each item and schedule either a service date for the item or replacement of the item before a potential breakdown. As an example: A one hundred gallon water heater without maintenance may last between six and eight years. The same water heater with yearly maintenance of cleaning out the calcium buildup in the tank, inspection of the Zinc rod and burner assembly might last as long as ten to fourteen years. Another less extreme example might be cleaning out the main drain lines once a year before the big holiday season.

It is much cheaper to have a plumber service your building on a Tuesday morning than on Thursday Thanksgiving night Dear Maintenance Men, My apartment building was built in the 1950 and has no insulation in the walls or ceiling. What do you recommend as the most cost effective method of insulating the building?

Sam Dear Sam: It is very common for older buildings to have no insulation whatsoever. As for where the best bang for your buck is concerned; ceiling insulation is the winner. For single story or top story units, ceiling insulation is very easy and inexpensive to install. Wall insulation is much harder and involves a more invasive approach. To illustrate the differences; ceiling insulation can be either batt insulation or loose fill insulation. The batt method is a bit more labor intensive and is less effective than loose fill. If you decide to use loose fill, be careful not to block ventilation holes or cover any through the ceiling light fixtures. Insulating existing walls typically involves drilling holes just below any fire blocks and blowing loose fill insulation into the wall cavity. Repairs to walls will be needed after the work is completed. The best of all worlds would be to do both wall and attic insulation. But if you must choose one over the other, we recommend doing the attic first as we have found this to be the most effective at cutting heating and cooling costs. You may want to check with your city or utility supplier; they often have low cost energy saving programs, or rebates.

Shelly, Dear Shelly: We highly recommend that you try to save money elsewhere and install the more expensive sliding shower doors. In the long run this will save you more money in the form of avoiding water damage to the flooring, walls, and in the ceilings of the unit below. Not to mention possible rot of structural members and floor joists below the tub. Shower curtains invite water damage, because it is so easy for water to escape onto the floors and beyond. A little water can do a lot of damage.
