President’s Message
Every November, The Rental Housing Alliance Oregon nominates its new board members. This may seem to be just another administrative chore, but it is the single activity that creates the heart and soul and strength of our organization. I asked one of the new board members, Ken Schriver, a few questions and I think we could all be inspired by his RHA Oregon President responses. Ron Garcia What is your current landlording status/experience? I helped defray my living expenses while I was attending Reed College in the early 1980s by working as an on-site manager at a 28 unit apartment complex in Portland. Twenty-five years later, my wife and I became “accidental” landlords in 2005 when we combined our households in Nashville, TN and ended up with an extra house that we rented out to students. Over the next ten years, we expanded our holdings to several single-family homes and a duplex in Nashville. In 2016, we moved to live full-time in Portland, where my wife is a research neuroscientist at OHSU. Our rental properties here in the Portland Metro area are comprised of two houses, a duplex, and a triplex. By managing and maintaining these properties myself, it gives me something to do in my retirement. How long have you been an RHA member and how did you hear about us and what prompted you to join? As we shifted our property holdings from Nashville to Portland over the past few years, I learned that the being a landlord in Portland was somewhat more involved than it had been for us in Nashville. I attended the City of Portland’s Landlord Training in May 2016 and learned about the existence of RHA. The first RHA meeting I attended was the Under a Starry Night dinner in July 2016, where I met John Sage and Liz Carpenter, who encouraged me to get involved. I attended a member-mentor meeting run by Phil Owen a week later, and joined RHA the following week. How did you come to join the board? I have served on the boards of both for-profit and non-profit entities in the past. Shortly after joining RHA, I started attended board meetings from timeto-time as a guest. After about a year, I felt that I knew enough about the workings of the organization that I could provide value to RHA as a board member. Coincidentally, a couple of positions came open this summer so the timing of my appointment worked out well.

Why would you encourage other members to join? I believe that RHA provides the greatest benefit to our stakeholders when we have input from all of our stakeholders. We have a great team in the front office but they cannot possibly do it alone. Many RHA members have enjoyed attending a Dinner Meeting, our Under a Starry Night fundraiser, or the Annual Picnic. The success of these events depend on volunteers who are able to commit their time and experience. More broadly, the success of RHA in providing effective resources to landlords large and small also depends on volunteers who are able to commit their time and experience. Since we have a relatively large board, the time commitment of just a few hours a month is not a burden. Thank you Ken. I am honored to serve along with you and all of the other Board of Directors. Oregon Housing and Community Services Department reminds us of changes that have occurred to the Housing Choice Landlord Guarantee Program. • Landlords still need to file a small claims in their local court; however, the judgment will now occur following a hearing in which the landlord proves the amount of damages. This is in effect beginning August 1, 2017. • The requirement of recovering payment from the tenant for the amount provided to landlords by the agency was repealed and took effect on any claims filed before or after June 8, 2017. • Claims eligible for the program must have been incurred from occupancy that began after July 1, 2014 effective July 24, 2017. • Payment of eligible claims will not include eviction costs or related fees effective July 24, 2017. Using a checklist will help you make the right insurance purchase decision for your real estate investment by Clif Hockley, President of Bluestone & Hockley
In today’s competitive world, we ask insurance vendors for bids to insure our investment properties - get the bids back, choose the lowest one and go on with life. Unfortunately, buying insurance is more complicated than that. It takes some analysis to make a great choice, and not only do you need to compare vendors you also need to consider the needs of your bank. Financial institutions are taking a more proactive role in ensuring people choose the correct insurance. In a recent refinance with a large regional bank, they required: 1 1. A Lender’s Loss Payable Endorsement 2. Special form extended coverage 3. No co-insurance clauses 4. Loss of income coverage 5. Ordinance and law Coverage 6. Workers compensation coverage (if you have onsite employees) 7. Flood insurance (in a flood zone) 8. General liability with an aggregate liability of no less than $2,000,000 for bodily injury and or death, and property damages no less than $1,000,000 9. Earthquake deductibles not to exceed $10,000 or 1% of the loan amount 10. A term of no less than 12 months They also requested that all requirements be confirmed using insurance forms Acord 28 and 25 before a loan would be issued. 2 In the past banks just required insurance coverage now they want to guide the limits and coverage. What is usually included with real estate insurance? There are many details to consider when purchasing property insurance, including coverage for casualty losses and liability. We will define some of the key issues and explain some of them below: Casualty insurance includes damage to your buildings and personal property due to fire, storm damage, theft, vandalism and tenant damage. Ideally - your landlord insurance will cover the replacement costs for your entire rental property in the event of a total loss.
Liability insurance protects you against liability claims and lawsuits in the event that a tenant, visitor or even a trespasser is injured on your rental property. Liability insurance covers costs associated with bodily injury claims on your property. These costs can include medical payments, funeral costs, legal fees and judgment or settlement costs. You will also be covered if you, as the landlord, are found responsible for another person’s property damage. For example - if you neglect to fix a leaking water pipe and mold damage destroys a tenant’s expensive collection of vintage albums, a liability claim can be filed against you by the tenant. Additionally, legal claims can result from a range of causes, including slips and falls, property damage from leaky pipes and break-ins. Landlord liability insurance also covers the cost associated with your legal defense, whether you are found to be at fault or not. Coinsurance clause Banks are encouraging good insurance choices. With a recent refinance with a regional bank, we were told that the co-insurance clause (part of many current insurance policies) was not allowed if this bank granted the loan. (As you probably already know many insurance companies first offer you insurance with a co-insurance clause included. They will remove the clause if you inform them that the bank will not issue a loan with the co-insurance clause.) So, what is a co-insurance provision? “A property insurance provision that penalizes the insured’s loss recovery if the limit of insurance purchased by the insured is not equal to or greater than a specified percentage (commonly 80 percent) of the value of the insured property.”
“Coinsurance in property insurance is a means for insurers to obtain rate and premium equality. Property insurers must have a standard in which to apply expected losses based on past loss experience over an entire underwriting book. This is accomplished by getting the exposure base (total insured value for (continued on page 9)

building, contents, and business income) on a common basis for all property insurance insureds: replacement cost, actual cash value, and actual loss sustained. Rates are applied against a specified percentage (100, 90, or 80 percent, for example) of the value to the insured: building, contents, or business income.” 3 The bottom line is that you don’t want to buy property insurance with a co-insurance clause. Valuation Most important is that you insure your property for the correct value. You may have gotten a good deal on your purchase and believe the estimated worth of your property to be at $680,000, but an insurance company might tell you that your property insurance should be valued at $1,282,000 (see our example attached) due to the increases in current construction costs. Additionally, you to need to make sure you have guaranteed replacement cost and ordinance language included to be able to rebuild your property after a loss to meet current code requirements. Other important issues You can reduce the cost of your insurance premium by increasing your deductible. Deductibles act as selfinsurance. In most cases - depending on the size and income of your investment - you can tolerate some level of self-insurance, unless you are in a weak cash position. Investors also need to need to consider the amount of insurance your bank and your property manager require. The larger the investment, the greater the risks - and the higher the amount of insurance you will need. Typically, you want no less than $1,000,000 per occurrence and $2,000, 000 in the aggregate. Loss of rental income Loss of rents coverage is critical to all real estate investors, and it is also called out in your loan documents. Some insurance policies are capped, others will extend to the actual loss sustained. Why is this important? It depends on the type and length of loss you incur. If you have a partial loss at a property, you probably can get a contractor to rebuild within 12 months. But if you have a total loss, your reconstruction could take significantly longer, and you will need the loss of rents to extend until your investment is completely rebuilt and has received a new certificate of occupancy. and take care of property bills while the property is being reconstructed. More miscellaneous insurance issues Other issues that come up as you ask for insurance bids for your real estate investment property include: • Medical expense limit per person • Terrorism coverage • Pipe breaks and sewer backups – included or excluded • Mold, fungus - included or excluded and what the limits are to this coverage • Law and ordinance coverage – for properties located in non-conforming zoning • Flood insurance • Earthquake coverage Cost and AM Best rating Finally, as we all know you want the most coverage at the least cost. At the same time, you need to consider the financial strength of the company you are insuring with. You can usually find information regarding coverage history for each company on the internet. You can also log into the AM Best rating agency to access the financial strength of every insurance company. 4 Summary Unfortunately, buying insurance for your investment property is not simple and takes a significant amount of due diligence on your part to make sure that you get the coverage you and your financial institution are satisfied with. To aid in your decision-making process, we have included a sample check list with an example of different insurance coverages for a real property. This might help you as you compare coverage by multiple companies – we recommend receiving bids from at least three. Portland City Council Extends Housing Emergency Reprinted with permission from Rental Housing Journal
The Portland City Council has extended its housing emergency declaration for another six months, including rules that require landlords to pay moving expenses of renters they evict without cause. The policy also says landlords must pay moving costs of tenant if they raise rent more than 10 percent causing tenants to move. Payments range from $2,900 to $4,500 for landlords. Landlords have argued the policy is disguised rent control. Attempt to include mom and pop landlords in housing emergency ordinance The ordinance currently exempts owners of one rental property. The Community Alliance of Tenants argued to close the exemption for moving and relocation costs for mom and pop landlords who only rent one unit. “There are several things wrong with the premise – the idea that property-owners of 1 unit be exempt of responsibility to the people of our city – but the most pressing concern is that many large property-owners and management companies have found a loophole. Landlords have been registering their individual properties under limited liability companies, or LLCs, to avoid accountability and traceability,” the alliance says on their website. According to Oregonlive, Commissioner Chloe Eudaly proposed an amendment removing the exemption for small landlords. But the other four commissioners voted against it, noting the complexity of the exemption. They all said they thought the stakeholder group advising the housing bureau on this policy should iron out details of whom the council should and should not exempt. “I’m not prepared to vote for amendments on the fly,” Mayor Ted Wheeler said, according to Oregonlive.com. “I’d like to respect the process we currently have in place.” Landlords argue city fee increases can force rent hikes Jane Leo, a lobbyist for the Portland Metropolitan Association of Realtors, suggested that landlords are forced to hike rents higher than they’d like because of city policies. “When the city sets its limit on what the rent increase can be, the city needs to take a look at itself,” Leo said, according to the Portland Mercury. “How much did the water and sewer rates go up? How much did the property taxes because of the bonds go up?” The council is expected to vote again in December on making the housing emergency ordinance permanent. Portland landlords have filed appeal in effort to overturn the ordinance The appeal with the Appellate Court Administrator in Salem is seeking to overturn the judgment entered in the case back in July, signed by Judge Henry Breithaupt, in the Multnomah County Circuit Court. Breithaupt stated the ordinance was legal, ruling against landlords Phillip E. Owen and Michael L. Feves’ suit, concluding “the ordinance was a legislative response to a socio-economic problem in the city… such change is not prohibited.” “Though we appreciate the time and effort the court expended on this case, we still strongly believe the ordinance will only aggravate Portland’s housing crisis,” Owen and Feves’ attorney John DiLorenzo said in a release. “The court failed to see it for what it is – disguised rent control, which violates state statutes and the Oregon Constitution,” DiLorenzo said. Holiday Lights Use only UL approved lights. Always use indoor lights/inside & outdoor/outside. Never use light sets with broken or missing sockets, and/or frayed or cracked wires. Any one of these hazards may cause an electrical shock or fire. Candles Place candles on candle holders that are sturdy, uncluttered, and are unable to be knocked over by people or pets. Keep candles away from things that can burn such as curtains, decorations, trees or paper. Always extinguish candles before leaving the room or going to bed. Never leave candles unattended. Keep matches and lighters out of the reach of children. Better yet, use battery operated candles. Holiday Trees Select a fresh tree. It should be green and the needles hard to pull from the branches. If the needles do fall off easily - - - the tree is too dry. When you get home, make a fresh cut on the base of the tree and place in the tree stand. Water immediately and daily as needed. Place your tree away from heat sources and dispose of your tree by recycling it. Never burn your tree in the fireplace.
Decorations Keep decorations away from open flames such as candles and fireplaces. Never burn wrapping paper and/or plastics in the fireplace due to high flammability and/or off-gassing.

Winter’s Worries: Roofs and Mold by Lynne Whitney
It’s that lovely time of year; Rain, heavy winds, sleet and snow are heading our way! Are your properties winter ready? Moss, debris and overflowing gutters can cause leaks, flooding and frustration for both the landlord and the tenant. We encourage you to be proactive this year and have the inspections done now, prior to an emergency. Even just a visual inspection can help, look to see if anything looks out of place; missing shingles, roof debris, overhanging tree limbs can all pose potential problems in the winter. Ongoing preventative maintenance will save you time and money and increase your roof life.

While roof leaks can indeed lead to mold growth in the attic, a lot of mold is also caused by improper venting and high humidity. Since mold can grow in 24 to 48 hours it is important to inspect your properties at this time of year for proper ventilation. Bathroom fans are one of the leading causes of mold as quite often they are not hooked up properly and are blowing hot, moist air into the attic and not venting directly outside. Interested in serving on the Board? This year, we have two open seats on the board and we would like to invite interested members to participate in the organization. The board meetings are on the 2nd Wednesday of each month at the RHA Conference Annex located at 10530 NE Weidler, Portland Oregon 97204. Dinner is provided at 5pm with the meeting starting at 5:30pm and generally ending by 7:30pm-8pm. Joining the board is a great way to interact with other members and strengthen those relationships. It is a valuable way to serve your industry and have a voice on important issues that affect everyone of us as rental housing providers. As a board we are restricted to only 4 Affiliate members on the board at one time, so we really encourage our landlords and property managers to step up and volunteer!
