President’s Message
The Rental Housing Alliance Oregon is a volunteer based, not for profit 501c3 Oregon corporation. The Board of Directors is made up of 15 members, 3 affiliates, the Office Manager and our paid lobbyist, Cindy Robert of ZRGroup. The governing controls, bi-laws, financial accounting and reporting, and the rules of procedure are highly regarded RHA Oregon President and diligently respected. RHA Oregon has a decades-long Ron Garcia history as an utterly professional organization that is, simply put, sterling in its structure. Being on the Board is a rewarding experience for anyone who wants to “be in the know” on current trends and issues in the rental housing industry. But the legislative insights that we become privy to are just the start of what we get as insiders. The professional and personal relations we develop, the opportunities to serve our community in a variety of ways that meet nearly everyone’s strengths, and just the good times we all share all make the dedication of our time commitments much more of a privilege than an obligation. The meetings are held on the 2nd Wednesday of the month. They begin at 5:00pm at the RHA Oregon Conference Annex in NE Portland with a 30 minute networking time, and a there is an always-different catered dinner to enjoy. Guests are welcome to observe the meetings. We follow our agenda as best as possible and usually end by 7:30. It’s not too unusual for enthusiastic discussions to take us on some detours, which keep the meetings exciting and informative. Committee heads are asked to give their reports and we set aside time to complete “old business” along with presenting “new business” for on-going discussion and action items. Committees may be chaired by non-directors, so often guests learn they can take an active role in projects that have personal meaning to themselves. Having a common interest in providing quality affordable and safe housing as a business is the basic foundation of our association. The desire to take an active role in our community and the willingness to provide a service is the brick and mortar that we build it with. The chance to improve our own personal businesses and make profitable connections is the true bread and butter that provides real satisfaction.

To Renovate or Not to Renovate? The Best Upgrades to Increase Rent by Christina Burch, of PropertyManager.com, a Service of AppFolio
The decision to renovate never comes easy, as there’s considerable risk involved. However, it’s a common solution property managers turn to when looking to increase the value of existing properties. In addition to the heavy price tag, most renovations require a fair amount of time to complete. In opportunity cost alone, pulling a unit or group of units out of the game might mean a big hit. Luckily, the investment in your property is more likely to bring in long-term profitability. You just have to know which will be worth your time and money. Consider these types of property renovations that renters and investors are likely to pay more for. Internal Improvements Figuring out which renovations will contribute to higher rents may be more art than it is science. Property management companies choosing to upgrade flooring, kitchens, bathrooms, and lighting in older units cannot be sure of which improvements will yield the highest ROI. However, a good way to gauge the sentiment of potential renters is to survey current residents and find out which improvements would increase satisfaction. External Improvements Property owners may also want to consider making upgrades to landscaping, signage, and exterior paint. Cosmetic projects like this generally don’t cost that much, and they can provide high returns by boosting curb appeal. Other worthwhile improvements include laundry facility or exercise room upgrades. Also high on a renter’s list, swimming pools, shuttles to a transportation hub, or community rooms can go a long way. These additional conveniences give residents the chance to save time and money – so they are likely to pay more for them. Technical Improvements Today’s modern renters are likely to expect good internet connectivity as much as they expect lights and running water. Communications companies can usually improve the connectivity of buildings that don’t already have it. Another way to cater to today’s tenants is by offering online or tech-savvy solutions www.rhaoregon.org
for bill paying, mobile communication, and even sophisticated internet-based security and temperaturecontrol systems. Wired buildings are more attractive to prospects, and many of these features can also help the building run more efficiently. Which Renovations Bring the Highest ROI? It’s impossible to say which improvements will benefit your specific property or location most. However, the right mindset to have is one in which you put your renters first. Property owners might look around their community to see which features are most loved by renters of other communities. Of course, it’s always a good idea to consider asking current residents for their own input. While the goal of these improvements might be to attract new tenants who are willing to pay more, most property managers would hope to retain as many of their old residents as possible. In any case, the right renovations to an older property can often bring the owners a better and faster return than building an entirely new property can. Better yet, property managers can roll these improvements out in stages, so they won’t need massive capital to start enjoying more profits. Portland Building Earthquake Retrofit Requirements by Jeremy Boardman
In 2014 the Portland City Council directed several city bureaus to work together with a citizen committee and develop recommendations to reduce Portland’s risk from unreinforced masonry (URM) buildings. The resulting entity issued their fifth draft report on Monday July 10, 2017 (text https://www. portlandoregon.gov/pbem/article/646226). What is Unreinforced Masonry and Why the Concern? Unreinforced masonry buildings are structures made of brick or blocks joined by mortar, with no steel reinforcing bars. In an earthquake, these buildings can suffer damage to chimneys and parapets or experience partial or even full collapse. These seismically vulnerable structures pose a great risk for human injury, property damage and loss of economic use after an earthquake. URM Buildings in Portland URM buildings were constructed in Portland between 1870 and 1960 and with thousands still in use, Portland represents the highest concentration on the West Coast. (A link to a database with all known unreinforced masonry buildings can be found http:// pdx.maps.arcgis.com/apps/Viewer/index.html?appid =a920f2a1fd2746f1a7efad1262aa1312) Requirements to strengthen Portland’s URM buildings were adopted in 1995 (updated 2004, current code https://www. portlandoregon.gov/citycode/?c=28673), however their limited application as part of a significant renovation, occupancy increase or change in use only resulted in nine percent (9%) of URM buildings partially upgraded and five percent (5%) fully retrofitted. 22,500,000 square feet of URM buildings remain and include over 1,000 office/retail buildings, 45 schools, 35 churches and 270 multifamily properties (comprising nearly 7,000 apartment units). Policy Development Process Portland commissioned a benefit cost analysis to objectively quantify seismic retrofits in a holistic way. Then the Retrofit Standards Committee, a group of engineers, architects and geologists, developed a building classification system, upgrade standards, and timelines for each class. Next, the Seismic Retrofit Support Committee, a group of building owners, developers and lenders, investigated the costs to retrofit and attempted to identify funding sources. Finally, in January 2016 the Unreinforced Masonry 8

Building Policy Committee was convened and charged with creating a policy proposal for the City Council. Comprised of representatives from several bureaus, the two previous committees and various community stakeholders, multiple public hearings were held finally resulting in a draft policy recommendation. Policy Recommendations Based on the seismic risks Portland faces, the need to ensure public safety, the lack of progress under current codes and the effectiveness of mandatory retrofit policies in other locations, the Committee recommended that all URM buildings within the city of Portland be required to comply with a seismic strengthening program. After exempting one- and two-family homes and buildings upgraded under previous laws, existing URM buildings were classified by risk and required to be upgraded according to the table on page 9. The table on page 9 is just a summary of a very intricate combination of standards, but 90% of URM buildings (Class 3 and Class 4) are required to submit proof of an engineering evaluation within three years; brace chimneys and parapets within ten years; secure walls and floors within 15 years; and complete all required retrofits within 20 years (or within 10 years of suitable funding being made available). While each building is unique, the benefit cost analysis estimates an average construction expense of $51-$69/ square foot for Class 3 buildings and $20/square foot for Class 4. Using these estimates, an owner of a small 10,000 square foot office or retail building might have to spend upwards of $700,000 (excluding soft costs, relocation, business interruption/loss, etc.) without any increase in market value. Penalties If an owner forgets or doesn’t have hundreds of thousands or even millions of dollars laying around, fines of up to $6,000 may be levied for engineering evaluations; $12,000 for chimneys and parapets; $24,000 for wall-to-floor attachments; and 1%/year of Real Market Value in addition to a recordation against the title as not in compliance with seismic safety standards. Government Assistance Now for the good news: the government is going to pay for all of this! No. Just joking. But Portland will generously waive permitting and fees up to $2500 (or 50% off amounts above $2500) and establish an ombudsman to help historically underserved neighborhoods and organizations navigate permitting.
olis.leg.state.or.us/liz/2017R1/Measures/Overview/ SB311) may be a silver lining, which permits localities to suspend property taxes for up to 15 years to offset some of the retrofit costs. Passage of a retrofit policy is still several months away, but so too is any possible property tax relief under SB311. In the meantime, check back here for updates and review any applicable insurance coverage in place. Owners of unreinforced masonry buildings need to review the city requirements and start reserving funds to pay for the retrofitting of their buildings. Policies that have been developed will most likely be voted on by the city commissioners and become law in the Spring of 2018. 3 Benefits of Holding Your Properties in an LLC by Brandon Turner of BiggerPockets.com
Let’s talk about what an LLC is and what it isn’t. An LLC is not equal to a get-out-of-jail-free card. You can be sued with an LLC, and you can still lose everything. An LLC is not designed to prevent you from ever being sued. An LLC is intended to help you manage and contain the fallout from such a lawsuit. According to the United States Small Business Administration (SBA), a limited liability company is “a hybrid type of legal structure that provides the limited liability features of a corporation and the tax efficiencies and operational flexibility of a partnership.” Given this definition, an LLC’s benefits are threefold. 3 Benefits of Holding Your Properties in an LLC 1. Limited Liability If you were to get sued, your liability (the damage to your wallet) could be contained to the assets within the LLC, not everything else you own. In other words, if the LLC is set up correctly, and you get sued and lose, the creditors probably would not be able to take your personal house or car, or garnish your W-2 job wages. Of course, there are ways a judge might “pierce” the protection of an LLC and go after these things if every I is not dotted and every T not crossed. 2. Tax Efficiency The LLC is fairly easy to handle during tax time, especially if it is a “single-member LLC,” which means an LLC owned by just you or by you and your spouse. LLCs are known as “pass-through entities,” which means the income and expenses flow magically through the LLC and are reported (and paid) by each individual member on their personal income statement.
to a real estate investor. Let’s say a tenant slipped on the stairs and broke their hip. The tenant decides to sue the landlord for “neglect,” and the court sides with the tenant. For whatever reason—let’s say your insurance doesn’t cover all the legal penalties—you, as the owner, are required to pay $500,000 out-of-pocket to the tenant. Ouch. If you own the property without an LLC, the tenant could have your wages garnished, force you to sell all your properties, and drive you to bankruptcy. You could end up eating cold beans out of a can under a bridge while pigeons sit on your shoulder—not a fun place to be. On the other hand, if the owner of that property was “Main Street Investments LLC” rather than you personally, then the LLC would be the entity getting sued. The courts could make you sell that property, or other properties owned by that LLC, but they likely wouldn’t be able to make you sell other properties owned by other LLCs, if you have them. They won’t take your primary residence. You won’t be eating cold beans. Sorry, pigeons. Of course, this example is a bit overdramatized and unlikely to happen. And I don’t actually mind eating cold beans. But it illustrates the fear that drives most investors to pursue an LLC. Even though it may sound like I’m encouraging you to establish an LLC, remember that there are still cons to doing so; it all depends on your personal situation.
There is no “corporate tax” like a corporation might pay. This can definitely make taxes easier and less expensive than for, let’s say, a corporation. That said, although a single-member LLC does not require its own business tax return, a multimember LLC does. Don’t make this mistake. 3. Operational Flexibility Finally, an LLC is fairly flexible in terms of running it. You don’t need thousands of documents or to issue stock. An LLC can be set up fairly easily and inexpensively and requires just a few documents. It’s easy to see why an LLC might be advantageous www.rhaoregon.org

A landlord shared an eye-opening experience for him on our landlord forum that happened a couple of weeks ago: “I had an application from a prospective resident. Everything looked OK but I was a little uneasy about his application. It just seemed a little off. My wife started digging to rule out any problems. He had good wages but his credit was poor at best. The more we looked at everything, the more we sensed that something was definitely off. But we couldn’t quite put our finger on it. We spent an hour going over everything.

Then my wife found it. His employer’s phone was linked in an online post to a lawn mowing business he had several years earlier. Then the Google map showed his employer’s place of business as a single wide trailer although they were writing over 100 payroll checks every pay cycle. The Secretary of State’s webpage showed no business of that name. Then I ask myself: Could this be a fake paycheck stub? Yes, it was!!! You can go online and for $10 or $20 you can print off fake payroll stubs for the wages

3 Strategies for Maximizing Resident Satisfaction by Cindy Wick
To do more than keep up with the competition, you need an effective plan for attracting and retaining the best tenants. Multifamily remains one of the darlings of the real estate market, continuing to sustain strong resident demand. That doesn’t mean property owners can rest easy, however. To stay competitive, owner–operators must have a strategy for constantly incorporating new amenities, providing top-of-the-line service, and maintaining a strong sense of community for their residents. As a manager of over 23,600 units in 162 apartment communities, Western National Property Management (WNPM) has found three strategies in particular that have proven effective in increasing resident satisfaction and retention: 1. Stay on the Pulse of Emerging Amenities New amenities are entering the market rapidly. For peak resident satisfaction, it’s critical for property managers and owners to stay up-to-date in providing the latest services and community features that suit the needs of their residents. By staying ahead of the curve and investing in the latest amenities, you’ll stand out from the competition and increase your renewal rates. 2. Offer Unique Resident Events and Activities Today’s residents place a tremendous value on community. That’s why hosting events that foster this feeling is essential to boosting resident satisfaction and retention. Events such as barbecues and ice cream socials are a great way to both convey your appreciation for your residents and provide them with opportunities to mix and mingle with one another. We’ve found the most successful resident-appreciation strategies are those with a personal touch. As a token of our gratitude, as well as a way to encourage community, we provide handwritten “letters from Santa” during the holidays to all children whose parents request them, which the participating families very much appreciate. All residents also receive handwritten birthday cards. These small gestures go a long way. Resident-appreciation events, activities, and programs that are personalized and create an authentic sense of community will have the biggest impact on your tenants and serve as a strong incentive for them to remain at your property. 3. Use Social Media to Drive Engagement Another way to meet the needs of residents in a timely and efficient manner is using social media to drive tenant engagement. Making a strong first impression is important, but keeping customers involved is critical to building brand loyalty and retention long term. By regularly updating your social media channels and corporate website with engaging content, you can increase your points of contact with residents, which in turn encourages them to connect with your property. At Western, we maintain and frequently update a greenliving blog that encourages sustainable living. The blog serves as a way to increase our residents’ online engagement as well as promote green practices, both of which boost a property’s bottom line. Responding promptly to both positive and negative reviews on Yelp and other Internet listing service (ILS) apartment sites is another strategy multifamily owners should be implementing to increase resident engagement. According to a 2014 survey conducted by Kingsley Associates and Apartment Guide, 70% of apartment hunters consult online reviews and ratings prior to leasing. In fact, reviews play an even greater role than referrals in leasing decisions. Multifamily owners should also regularly update their ILS sites—Apartments.com, Zillow, and others—to source new prospects and ensure that all rental information is up-todate.
