President’s Message The November elections are now around the corner and landlords all around the state of Oregon should be put on notice that their voices count. In 2017 HB 2004, a “rent control” bill, was introduced in the state legislature. It seems like ancient history now. There RHA Oregon President Ron Garcia was a lot of testimony and a lot of press and a lot of drama and angst on both sides of the debate. It was ugly, but the landlords won and the bill was defeated. Don’t remember the details? I found this summary from Oregon Rental Housing Association: • “HB 2004 PROHIBITS landlords from terminating a month-to-month tenancy without cause, except under certain circumstances, with 90 days’ written notice and payment of relocation expenses that could be upwards of $5000. • It also REQUIRES fixed term tenancies to become month-to-month tenancies on the ending date, unless the tenant elects to renew or terminate tenancy and REQUIRES the landlord to make tenant an offer to renew fixed term tenancy. • Repeals the statewide prohibition on Rent Control.” If you own rentals in the City of Portland, none of this would probably ring any new alarms for you, as it was pretty much passed, locally. Portland landlords have been reeling from “rent stabilization” ordinances all year. Meanwhile, the rest of the landlords throughout the state are still scratching their heads and wondering how such zany antics could ever become a reality! After all, “everyone knows rent control doesn’t work!” Right? I think it’s important to point out here that HB 2004 did not “lose” statewide in terms of its momentum. The bill was only narrowly defeated. How narrowly? By one, single vote. It was a victory, but it did not reveal the stronger team. If you don’t recall the rest of the story, let me remind you. Sen. Rod Monroe, a landlord and Democrat for District 24, held the line. The final vote failed by his stance alone. It became a bellweather moment in his career. Subsequently, after the session ended, Senator Monroe was attacked, and aggressively picketed by Portland Tenants United. During the hearings, they accosted his office in the State Capital. Later, they staged demonstrations at his church, handing out defaming literature. A few months later, they disrupted his 75th birthday party at his house with flash mobs, and tried to intimidate guests with intrusive photographing and they dropped off a box of wrapped dog crap at his front door. (They rang the bell and ran!) I was at that event and personally witnessed the disruptions. In February of this year, Senator Monroe (who was first elected as a State Representative in 1976 and has been district’s State Senator since 1980), was defeated in the primaries by a novice candidate that ran on an “antilandlord” platform. Senator Monroe is serving out his final year in office in these remaining months of 2018. (continued on page 8) 4

Understanding the Proposed Screening Criteria Reform in Portland, Oregon by Christian Bryant, Owner of www.RPMApplication.org

If you haven’t already heard, Commissioner Eudaly’s office has been working on a proposal to regulate tenant applications, along with screenings, approvals, denials, and move-in costs related to residential rental units in Portland, Oregon. Earlier this week, the commissioner released the latest draft of the proposal. I have included a copy at the end of this article, if you want to read the complete text. The Portland City Council is hoping to consider this ordinance during a council meeting in mid to late September. It is important to keep in mind that this is a working draft, so it may change before it officially goes before the city council. As you will see, this is a very comprehensive proposal, so it is worth reading the entire document. I have done my best to summarize the most significant parts for you. The first section deals with the process for submitting applications. Landlords will be required to screen applicants on a first come, first served basis. This has always been a practice that I recommend, but, per this proposal, picking through a group of applications will no longer be an option. For verification, landlords will have to time/date-stamp applications as they are received. They’ll also be required to send a confirmation to prospective tenants within one day. For management companies, which can afford a website and management software, this is a process that can easily be automated. For smaller landlords, this will ultimately be a shift in the way business is done, as many currently have their tenants fill out physical applications. There are, however, new web-based services available for landlords. www. RPMApplication.org, for instance, offers landlords a free online application which they can then customize as necessary. When a prospective tenant submits an application and pays for screening, both the landlord and prospective tenant receive a time/date-stamped confirmation email. Another big change being considered for the application process is preference being given to any applicants who identify as disabled, with mobility challenges. If a rental unit is at least 60 percent ADA compliant, then preference must be given for the first 24 hours of the open application period. There are a couple of proposed changes that will affect advertising rental units. The first is that all ads www.rhaoregon.org

must include complete screening criteria, or at least a weblink to a page with a landlord’s full screening criteria. Many landlords don’t have a typed version of their screening criteria and will have to create one, but it’s a very good practice anyway, in my opinion. Another proposed requirement for landlords that require physical applications is advertising a unit at least one week before accepting applications. If a landlord uses an online application system, then there is no one-week waiting period. This is even more reason for landlords to start using online application sites such as the one I previously mentioned. One of the city council’s goals is to limit the ability of landlords to determine if a tenant can afford a unit. If this passes as proposed, a landlord won’t be able to require a gross income greater than two times the rent and average utilities. The proposal also establishes specific rules around a tenant’s rights to have a cosigner if his or her income doesn’t meet the gross income requirements. The next and largest section of the proposal sets restrictions on what a landlord can require for criminal record, credit reporting, and eviction history. I strongly encourage you to read the full text below, as it can get very specific. This proposal lists 11 serious crimes that landlords won’t be able to deny a prospective tenant for if he or she has been out of jail for at least one year or the sentencing was more than three years prior. Prospective tenants will be allowed to have up to three of six negative credit reporting marks, considered to be “minor,” such as low scores, adverse accounts under one thousand dollars, and bankruptcies more than five years old. There are many parts of this proposal that concern me because they significantly limit a landlord’s ability to determine screening standards to protect their property, maintain the safety of the neighbors, and establish a tenant’s ability to pay rent on time. When I see proposed laws like this, one of my biggest concerns is always the complexity. Given how comprehensive the proposal is, I worry that we may have landlords violating this law simply because they didn’t understand it clearly. With damages being the higher of three times the stated rent or actual damages, this can easily be an honest mistake that sends a small (continued on page 10) RENTAL ALLIANCE UPDATE OCTOBER 2018

So now, back at the State Capital, the legislative math on housing rights is pretty simple: There is no longer any sure vote in the entire State of Oregon to stop a bill like HB 2004 from resurfacing and passing. There remains a lot of dissatisfaction from the Tenants’ Rights advocates. With a presumed super majority being (re)elected in November, these groups and politicians are preparing to celebrate. I encourage all rental property owners in our great state to look into where their candidates stand on housing issues. If they are running for re-election, find out how they voted in 2017 on HB 2004 and vote accordingly. If they are challenging the incumbent, let them know how you feel to earn your vote. The November elections will make up Oregon’s legislative session beginning in February 2019. What’s at stake? How far will the State go on dismantling property owners’ rights? No one knows for sure, but I’m sure that if you could see the writing on the wall, it would spell R-E-N-T -C-O-N-T-R-O-L. Sincerely, Ron Garcia, RHA Oregon President

Dear Maintenance Men by Jerry L’Ecuyer & Frank Alvarez

Dear Maintenance Men: I have a green mold problem on the vinyl siding of the building. It was installed in 2013 by a reputable home services company. A year later the mold started to appear at the bottom of the siding, and today it is spreading to the top of the two-story house. Luckily it is only on the north side of the house. It is rather unsightly and unhealthy to have the green mold on the siding. What do I do to clean it off and keep it off? Would a good coat of paint help to keep the mold off? Thank you. James Dear James: The magic words in your question is “North Side of the House”! If you ever go into the forest, you might notice moss growing on the north side of the most trees. That is because the forest is moist and the north side does not get a great deal of sun light to dry out the bark of the tree. The same can be happening at your property. First check the landscape sprinklers on that side of the building. They might be running too long, hitting the side of the wall or the vegetation is too close to the property and not allowing proper air circulation. Mold, moss, and algae grow well in moist and wet environments. The way to clean the siding is to use a mixture of the water, bleach, and detergent. Use a pump up sprayer or hose sprayer bottle. Mix 1/3 laundry detergent, 2/3 household cleaner (409 cleaner) one quart of laundry bleach and a gallon of water. (Do not mix bleach & ammonia.) Using a pump up sprayer or hose sprayer; start from the top of the wall and soak the siding with the solution. (Be sure to cover any plants, vegetation, trees etc. with plastic sheeting to protect them from the bleach solution.) Let the solution soak on the siding for ten minutes. Using a garden hose, rinse the siding starting from top to bottom. This process may need to be repeated until the wall is clean. An alternative to bleach: use white vinegar and baking soda mixed with water. 1/3 white vinegar to 2/3 water and generous amount of baking soda to add grit to the solution. This method requires a more hands on approach using a scrub brush and physically scrubbing the vinyl siding until clean. To keep the mold/moss/mildew from returning; remove what is causing moisture to build up on that side of the property. After cleaning one could paint with a mold killing primer such as Zinsser primer and paint the siding. However, the whole point of vinyl siding is to eliminate 14

painting! Dear Apartment Owners and Managers: We are getting close to the holidays, which mean more people at your apartment buildings. Chances are, some of those residents will be inviting guests for dinner over the coming holidays. For some of these residents, this will be the first time this year they will turn on the oven! What are the odds you are just starting your own dinner or you are sitting down with your own guests when an emergency call comes to you on Thanksgiving Day from one of your residents. That call might be about a clogged sink or non-working oven with an apartment full of guests waiting for dinner. This scenario can ruin both you and your residents’ holiday. The answer is: Preventive Maintenance. Remember, the holiday season starts with Halloween and the demand on your properties only gets worse from there. Check each stove and oven for proper operation, many residents only turn on their ovens at this time of year, and the problem may be as simple as a pilot light being out. Also, check the oven’s temperature calibration with an oven thermometer. This time of year sees a higher than normal use of the plumbing, it may be a good idea to snake out or hydro jet your main plumbing lines. Also, sending a note to each tenant on the proper use of the garbage disposal will be useful. Note what they should and should not put down the disposal unit. A few items to include on this “No No” list are: banana peels, potato skins, coffee grounds and any stringy food. Also make sure they turn on the water before using the disposer and put down small amounts of food at a time. Instruct your residents to not use the disposer as a trash can and then turn it on when full, it will clog. Christmas and other holidays also mean more people than usual walking on your property. Is your property safe? What are some of the liabilities to worry about? Check trip and fall hazards. Do you have sprinkler heads sticking up above the grass or landscape near sidewalks? Use pop-up heads to solve this problem. Look for sidewalks that have been pushed up by tree roots. This can be solved with a concrete grinder or replacement of the section and removal of the tree root. Cut any low hanging tree branches and look for branches that may break in heavy winter wind or rain. Check your decking for cracks or damage and inspect the exterior stairways for wear and tear. the door to close or fall unexpectedly. As a precaution, always replace both garage springs at the same time and throw away any used springs. Never install used garage springs. Check all property lighting and timers. Remember: Preventive Maintenance is cheaper than Emergency Maintenance! Dear Maintenance Men: I would like your advice. My husband and I are installing new interior doors in our vacant unit. My understanding is using pre-hung doors is better and easier and my husband insists that buying a door slab is cheaper and faster. We’ve never installed doors before and want to do it right the first time. Maurine Dear Maurine: We have found that there are no two doors hung alike. They are all unique to their doorways. Let’s start with your husbands plan. When buying a slab door, it does not have a hole for the door knob or latch; it also does not have the hinges attached. It might take a master carpenter to fit the door perfectly; the door frame might not be square, which means you will need to trim the door to fit the opening. You will find, getting the hinges to line up with the existing hinges on the jamb is not an easy feat. You also need a special tool to drill the door knob hole and latch. It might take you a few doors to get it right, negating the savings of buying a slab door. Now, Maurine, your plan is to buy a pre-hung door. As you might guess, we recommend buying a pre-hung door. For those who don’t know what a pre-hung door is; let us explain. The pre-hung door comes as a complete door, including jambs, trim, hinges, doorknob & latch holes etc. The pre-hung door comes as a package with the jambs already square to the door. At first glance, a pre-hung door might looking like a lot more work. But it is not. A prehung door can be installed by a novice easily the first time and is much faster than trying to wrestle with a slab door. After removing the old door jamb and trim and exposing the rough opening, insert the pre-hung door into the rough opening. Using a level, plumb and level the hinge side of the jamb using shims and gently nail the hinge side of the jamb in place. Level the top of the jamb using shims and nail into place. Using shims on the doorknob side of the jamb; be sure the door opens freely and closes without binding and nail the jamb in place. Most pre-hung doors come with the trim in place. The trim can now be nailed and use caulking around the trim to hide any gaps that might be present. Paint, install the knob and you are done. www.rhaoregon.org

Installation tip: Do not disassemble the pre-hung door package. Install it as it came from the hardware store. The ridged packaging will help in keeping everything square while you install the door. In fall, prepare your rental property and yard for cooler temperatures, falling leaves and more hours spent indoors.

Outdoor Tasks:

Clean gutters and downspouts Have a fireplace professional clean & inspect the fireplace, roof and chimney for cracks or damage Close or install covers on foundation vents Rake leaves and shred to use as mulch or dispose of them based on local guidelines Close or install storm windows Remove hoses from spigots Install spigot covers Prune trees and shrubs Have heat pump professionally inspected and serviced

Indoor Tasks:

Test all smoke and carbon monoxide detectors Check windows and doors for weather-tightness and install weather stripping where it’s needed Have furnace professionally inspected and serviced Maintain clean drains by adding one-half-cup baking soda followed by one-half-cup white vinegar. After 10 minutes, flush with boiling water. If needed, set traps for rodents and/or insects Use a professional service if necessary

As the largest provider of food assistance in the state of Oregon, we help nearly 10,000 people in need each month. SnowCap accomplishes this with the hard work of 1,000 volunteers led by a staff of 9 and without government funding. Since 1967, SnowCap has made healthy, fresh foods available to those who would otherwise go without. The majority of our clients are children, the elderly, disabled and folks who struggle to make ends meet.
