The Wills Lawyer Over the last year, I have been writing about the importance of Wills and Powers of Attorney. I have tried to provide some insight into this very complicated area of the law. It is a topic that most people would rather not think about but realize they must, in order to protect their family. Many people have called me with questions, and I would like to share some of these questions with you. 1. Q. If I have a Will, why do I need to make a Power of Attorney for Property? A. It is important to realize that your Will only takes effect after you pass away. It has no relevance during your lifetime. Only a Power of Attorney for finances will protect you, in the event you are unable to manage your financial affairs due to accident or illness. The executor you name in your Will cannot help you, if you are ill and unable to manage your financial affairs. The executor’s role only takes effect once you pass away. 2. Q. I have a Will naming my brother as executor. Michelle Kotzer Now that my son is in his twenties I want to appoint him as my executor. Can’t I just scratch off my brother’s name and write my son’s name in? A. I do not recommend scratching any part of your Will. It would be prudent to see a lawyer about drafting a Codicil to your Will. If it is a minor change such as the name of an executor, a Codicil would revoke the appointment of your brother and appoint your son as your executor. It would also preserve the other existing clauses in your Will. If you want to make major changes to your Will, it is recommended that you make a new Will rather than a Codicil. 3. Q. My spouse and I cannot agree on whom to appoint as guardian for our minor children. Can’t we just leave this out of our Wills and let our families work it out after we pass? A. Appointing a guardian in your Will is an extremely important decision. If you do not appoint a guardian, you could have your parents fighting against your spouse’s parents over who is best to raise your children. This is not a good formula for family harmony. 4. Q. I have a son who is collecting benefits from the Ontario Disability Support Program from the Ontario Government (ODSP). I want to leave him my estate. How does his collecting ODSP benefits impact my Will? A. If you leave your child your estate as an outright distribution, this will most likely mean that he will be cut off his ODSP benefits. Setting up a Henson Trust for your son in your Will will mean that you are protecting his ODSP benefits, after you pass away. 5.Q. How often should a Will be reviewed? A. A Will should be a living breathing document. It should be reviewed on an ongoing basis to make sure it reflects your current life situation. If you are married, be aware that any Will you made before your marriage is revoked, subject to some technical exceptions. If you have separated since you made your Will, remember that under Ontario law, you are still considered married and if your Will refers to your spouse as the beneficiary of your estate, that spouse is the person you are separated from. He or she will inherit your estate according to your Will. If your previous Will made reference to your two children, but since that time you have two additional children, the additional children will not inherit from your Will. The same applies for grandchildren. If your Will leaves your son your house on Yonge Street but you have moved to a house on John Street, your son will not get that house on John Street. In my wills practice, I offer the public a free Will review. This means that you can make an appointment with me for me to look at your Will to see if it is up to date or a recipe for a family fight. I have found many problems in Wills that I have reviewed. Firstly, many of the Wills I have reviewed left assets that no longer exist or assets were left to people who have passed away with no back up beneficiary. I have reviewed Wills that were invalid because they were either not signed, not witnessed or signed and witnessed on different dates. Many of the Wills I have reviewed had no back up executor or back up beneficiaries in case the primary beneficiaries are not alive. If you are not sure if your Will is up to date, please feel free to give my office a call and set up an appointment for a free Will review. 6. Q. If I want to make a Will with you, what is involved? A. If you want to make a Will with me, generally there will be two appointments necessary. The first appointment will be for me to sit down with you, discuss your life situation, discuss your assets and draw up a Will plan for you. After the initial meeting, we will set up a time for the signing of your Will. At the signing appointment, I will go through the Will clause by clause with you. I will make sure that the Will reflects your wishes and that you understand each clause of the Will. If you have also made Powers of Attorney for Personal Care and Property, I will do the same clause by clause. If you are satisfied that the Will reflects your wishes, you will then sign the Will and/or Powers of Attorney in front of myself and my assistant. You will take the original Will home with you and I will keep a copy in a file in our office. If you do not have a Will and are not sure where to start, I offer a free Will consultation. You can make an appointment with my office and we can talk about a Will tailored to your particular life situation. My office is at 7951 Yonge Street in a turn of the century home. I also know that making a Will is one of the most important things a person can do to protect his or her family. annah Alper has interviewed some of the most notable people in the world today. She has spoken with Malala Yousafzai, Hannah Alper has Michael "Pinball" interviewed some of Clemons the most notable people in the world and the Kielburg- today. er brothers, just to name a few. And, she’s only 14 years old. The Richmond Hill blogger, motivational speaker, ME to WE ambassador and social activist can now add another achievement to her already impressive list. She has written a book, Momentus: Small Acts, Big Change, which comes out Nov 1. "I’m so excited about it coming out," she said. "There are only two words I can use to describe it and that is incredible and surreal." There are two things that she said she has believed in since she started her journey. "Anyone can make a difference, I don’t care
how old you are, how much money you have, where you live, you can make a positive impact in the world," she said, adding she hopes the book proves that, and that people will be inspired. "And feeling very empowered to take action." The second thing she believes is that small actions can add up to make big changes. "Every single tangible act that we create, weather its spreading awareness about an issue, a compliment, raising money for school, any action that you take to make the world a better place ... it makes a difference." Her journey started when she was nine and she wanted to start a blog, but her parents would not let her write about celebrities or herself. "I had to write about something that I was passionate about," she said. At the time she loved animals, and she learned more about animal and environmental issues. "I knew that I wanted to help, so I stared a blog with the hope that we could simply be ecofriendly," she said. She started taking
action with shoreline cleanups and campaigns at school. "Ever since then, I’ve really started to grow my passions into the issues that I care about now," she said. "I’m passionate about education, poverty, homelessness, youth empowerment, antibullying and so many others that I really I hope we can tackle together." The book features 19 interviews with people Alper considers her role models. She said it has been an "incredible experience." "When I was on the phone with Lilly Singh, or Face Time with Lily Collins or sitting down with Malala when she was receiving her honorary Canadian citizenship in Ottawa in April, it was one of those moments where I was just thinking, I’m 14 and I’m doing this," she said. "I’m very lucky." She said everyone she interviewed shares her belief in the power of youth, and everyone has created big change. "Malala is just one example, but she is one of the most powerful education advocates that the world has ever seen," she said. "And she’s proved

Good riddance to employee discount tax idea

Hopefully, by now, employees in Canada’s retail sector - or what remains of it, at least - can breathe a little easier knowing the Canada Revenue Agency isn’t poised to take aim at the discounts they receive from their employers. Such incentives, which range from the meagre - a small percentage off the retail price of a given item, for example - to the generous - such as being able to buy merchandise at the employer’s cost - are commonplace in the customer service industry and serve as something of an enticement for would-be employees in a sector where a great many of the front-line staff members are paid minimum wage. Given that, it seemed the CRA was effectively talking about flipping retail workers upside down and shaking them by the ankles until their loose change fell out. The controversy began earlier this month when a 2016 update to CRA documents, stating that employees who receive a discount on the price of merchandise owing to their employment should have the value of said discount included in their income, was thrust in the spotlight via a Globe and Mail story. The policy went on to say the value of the benefit should be calculated as the difference between the retail price of the item less the amount the employee paid. No amount would be included in the event the same discount was offered to members of the public in some manner. Business groups, some of whom had decried the notion when it first came up but whose objections largely went unnoticed, argued it would be a nightmare to track their employees’ discounts, while other stakeholders voiced concern that employment incentives could be scrapped altogether by companies simply to avoid the aggravation. Despite a Liberal MP initially suggesting that any employee discount not offered to the public at some point would be fair game under the new rules, the federal government quickly distanced itself from the policy, expressing "disappointment" in CRA bureaucrats, and prompted Prime Minister Justin Trudeau to tweet assurances to retail workers that their discounts weren’t in the crosshairs. The government, in consultation with industry stakeholders, will now go back and review the policy and craft a new response to the 2011 court ruling that triggered the update in the first place. In any case, after the PR mess, it’s safe to say the idea of taxing retail employee discounts won’t soon be resurrected, and that’s a good thing. It was a wrong-headed idea that unfairly targeted workers in a sector primarily comprised of people at the lower end of the income spectrum.

Residents deserve choice on hydro bill frequency Is it not time to make a push to restore a formal option by those many Ontarians (i.e. those residents of the once-great province now known as "Ontaxio") a choice to make their electricity payment each two months as before? Most Ontaxians are well-organized with their monies; they pay water each three months, their taxes two to four times a year, and want to pay their heating gas bills every two months. Re: Class struggle, Oct. 5. I just saw your great article in the paper. I am a special-needs parent and someone who is helping out in the school. From reading your article and what I have seen, it is a combination where the teachers don’t understand the special needs and lack of support in the school system. The school day can be very overwhelming for our kids. At times, these behaviours are a way for the kids to communicate that they are overwhelmed. I believe the system misses that point at times.
With there being inadequate supports in the schools, our kids are not taught good coping skills to deal with how they feel. I am troubled when I see teachers ask for protective gear. I agree with Clegg that isn’t necessary. That would only create a bad feeling among our kids. Basically, in order to fix, there needs to be more understanding of special needs and why behaviour comes about, as well as much better supports. Robert Boileau, Richmond Hill

Celebrations of Canada’s 150th continue As you know, 2017 marks the 150th anniversary of Confederation for Canada. What a special year this has been and it’s not over yet. Popular events, including Canada Day, Ribfest and Tastes of the Hill, all featured a special Canadiana Pavilion and entertainment such as a Lumberjack show on Canada Day, a Canada 150-themed drone show at Tastes of the Hill, and much more. A smudging ceremony was also added to the Canada Day celebrations to commemorate the importance of Canada’s Indigenous people. We also had the privilege of being selected as the only stop in York Region on the SESQUI Cinematic Dome Tour through Ontario. We had a record attendance of

"It’s an opportunity to showcase Richmond Hill through storytelling, history and of course, food", said Karolyi, Shadowpath’s artistic director, a Thornhill resident and a Richmond Hill native. The tour has indoor and outdoor locations and will be led by Shadowpath actors, transformed into "wandering spirit tour guides". Last October, Shadowpath presented a similar project when it staged a
haunted library event at the Newmarket Public Library. The Oct. 28 tour begins at the 200-year-old Richmond Hill Presbyterian Church. The group will roam Yonge Street visiting a handful of places. Some locations have tasty treats included in the ticket price. The tour, which runs at 6 p.m., and 9 p.m., lasts about two hours and includes many rest stops. There are only a few minutes of walking between locations. Tickets are $30. For more information, visit shadowpaththeatre.ca.

Event paid tribute to late Tragically Hip frontman l Continued from page 1
special film screening this past weekend. It’s why the musician made his famous "call to action" at a concert in Kingston, Mike said, and why he worked to spread the word with the Secret Path project. The Secret Path film pays tribute to Chanie Wenjack, who died after fleeing a residential school in the 1960s, and to the many other residential school kids who never got a chance to share their story. It was an emotional event for many at Sunday’s sold-out event. Jeremy Hoyle, who performed acoustic version of Downie’s "The Stranger" immediately following the film screening, described it as "the most emotionally challenging performance I’ve ever done. Right before I walked out (on stage) I saw the image of Chanie
at the end of the Secret Path film. Instead of making me sad, it filled me with purpose." Joel Clements, a Richmond Hill resident and organizer of the event, was brought to tears listening to feedback from attendees and to keynote speaker Dr. Shirley Williams, professor emeritus at Trent University, as she described her own experience at an Indian Residential School. The film, which was screened on the 51st anniversary of Chanie’s death, continues to raise awareness, Mike Downie said, "but the next piece is action. "The big work lies ahead. There’s a crisis going on within families in communities across this country...We want Canadians to roll up their sleeves and do something. "We are not a young country, we are not 150 years old. We are 10,000, 12,000 years old," he said, eliciting a round of cheers and applause from the audience. "But we can’t be that country without a ribbon of Indigeneity running right down the middle." You’re going to want to avoid the area of Yonge and Oxford streets in Richmond Hill for the next little while. Beginning Oct. 23, the location will be closed for about three weeks as crews relocate and install underground utilities, York Region said. As crews trench across Oxford at the Yonge intersection, there will be no through traffic for the duration of this work. Here’s what you need to know: • Access will be maintained to businesses and properties near the work area. • Access to 14 Oxford will be maintained from Oxford. • Access to 10620, 10660, 10670 Yonge will be maintained from Oxford and Yonge. • Detour signs will be in place to guide motorists and pedestrians around the closure. • Due to the nature of this work, at times there will be noise and dust from equipment. • Some weekend and overnight work may be required. • Visit vivanext.com/roadclosures for up-to-date information about scheduled road closures or to view detour maps. • Bus stops, sidewalks and lane impacts: Sidewalks and crosswalks around the work area will be temporarily closed for the duration of this work. Athlete search unearths potential Olympic gem in Cook JOHN CUDMORE jcudmore@yrmg.com Sometimes elite athletes are found, not made. Uncovering champions that may be right under our noses is an ongoing challenge for the Canadian Olympic Committee. Hence, a proactive initiative by the COC and Royal Bank to unearth athletes from a nation-wide potential talent pool. Dennis Cook, for instance, is a serious competitor in life-saving sport for Canada at an international level. He also is active in parkour, a practice in which competitors logically and creatively move through predetermined points in an urban setting through climbing, vaulting, climbing and other means. He is also evidence that future Olympic medals could be hiding anywhere, raw and waiting to be polished. Cook was declared the

RBC Training Ground competition champion based on his performance Oct. 14 at the Pan Am Sports Centre in Scarborough. The 25-year-old was among 100 top men and women gathered from qualifiers held in Toronto, Kingston, Milton and St. Catharines. "I was completely shocked when I won," said Cook, who grew up in Richmond Hill and attended Langstaff Secondary School. "I didn’t even win my regional in Milton so I didn’t come expecting to win. I’m not that good at endurance and strength tests. "It was really something to do after my season. I love any competition." Cook’s time in the 40metre sprint was the best among all athletes at the event. He was also second in the vertical jump and triple jump competitions. In all, 11 national sports organizations attended the COC/RBC initiative to bring new and undiscov-

For Cook, the victory means funding of up to $10,000 for up to three years. More important, it may have opened a door for Cook to a future as a Canadian Olympian. and track and field means he could be in line for offers from those national organizations. The funds are to be administered by the national sports group with which he chooses to work. He also won a trip to the 2018 Olympic Games in Pyeongchang, South Korea, to experience the event first-hand. "Not a lot of people want
to do skeleton," he said of the downhill sport in which competitors zoom down a track head first on a small sled. "I think I could do well at it." It fits nicely with his desire to grow up to become a bobsledder after seeing the sport on television. "When I was a kid I told my mom I want to be a bobsledder," said Cook, who at
five-foot-six, isn’t exactly built for a sport dominated by big-bodied athletes. "Now, if it going to happen, skeleton is pretty close." In high school, Cook played soccer before tackling parkour and eventually break dancing. "Obviously I want to be in something I can be good at," said Cook, whose Olympics target is the 2022 Games in China. "I want to have those Olympic rings tattooed on my chest and be the first in my family to say I was in the Olympics. If I could win an Olympic medal, that would be awesome." Cook was the first Canadian to win at the 2015 Sanyo Bussan International Lifesaving Cup in Japan where he was a member of the Canadian team. He placed third last year at the world championships in The Netherlands and was intending to pursue a world championship in Adelaide, Australia, in 2018.

een night, he usually has a whole carload of food donations but this year, he has only received four items. "It is really strange," he said Tuesday morning. "This year, for some reason, it is almost zero. It is strange and disappointing." Samells and his sons Nick and Matthew create a scary display each year, with a large sign asking families who enjoy the fun to make a donation to the Richmond Hill Food Bank.
