With over 140 different organizations helped over the last decade, the Russ Lyon Foundation has turned into one of the more prominent philanthropy organizations in the state of Arizona.

For more than 77 years, the agents, owners and employees of Arizona’s leading luxury real estate brokerage Russ Lyon Sotheby’s International Realty have been involved in community service work and with charitable organizations throughout Arizona, either through individual e orts or through an o ce within the company.

The Scottsdale-based luxury brokerage later saw an opportunity to make those e orts even more impactful and formed the Russ Lyon Charitable Foundation in 2014, or as its now called, The Russ Lyon Foundation. The Russ Lyon Foundation is now proud to announce its 10th anniversary; a full decade of giving back to the communities it operates in.

Since 2014, the Russ Lyon Foundation has helped over 140 di erent organizations and an incalculable number of individuals across the state. Organizations that the Russ Lyon Foundation has assisted have ranged in scope from educational groups to food banks to animal rescues to land preservation groups.

While its success is best measured by the organizations and lives it has helped, its e orts have also been regularly recognized by local publications.

In 2023, the Russ Lyon Foundation earned a spot on the Corporate Philanthropy List by the Phoenix Business Journal, securing 22nd place in terms of charitable contributions and 14th place in terms of volunteer hours.

It has been inspiring and rewarding to see our Russ Lyon Foundation grow over these ten years into a recognized, productive, and successful foundation, involving hundreds of our real estate advisors and employees doing good work and investing in important charitable organizations all across Arizona. That said, its good work is not just within the state of Arizona. As part of a volunteer partnership that has lasted for the past decade, recently around 20 volunteers returned for Agua Prieta, Sonora, Mexico to continue building houses with the Rancho Feliz Charitable Foundation and assisting individuals at the local migrant center who were deported from the United States and awaiting asylum. In addition to home building e orts, this most recent visit led to 750 needy families receiving bags of food and warm blankets as well as assistance for a dog rescue housing over 160 dogs.

The Russ Lyon Foundation strives to organize and work as a collective force, more powerful than the sum of the individuals, to improve the lives and communities of those in need, while spreading compassion and kindness within our state and across our borders.

Russ Lyon Sotheby’s International Realty strongly believes that when the communities it operates in have contributed to a company’s success, it is simply the right thing to do to give back. It hopes that the 10th anniversary of the Russ Lyon Foundation is the first of many anniversaries it will be celebrating in what will hopefully be a very long legacy of philanthropy and community building.

What It Means, What Happens Now and How Russ Lyon Sotheby’s International Realty Continues Guiding Buyers and Sellers Through Complex Transactions Involving Arizona’s Finest Properties.

The NAR Settlement has reshaped the real estate landscape, but Russ Lyon Sotheby’s International Realty continues its 77-year tradition of guiding buyers and sellers through Arizona’s finest properties. As the state’s leading luxury brokerage, it remains dedicated to delivering exceptional, white-glove service from start to closing at all price points.

As brokerages across the country and in Arizona have experienced, there has been a shift in the way buyerbroker compensations could be advertised on the Multiple Listing Services (MLS) following a national class-action lawsuit against the National Association of Realtors (NAR) that occurred in 2019.

That’s when a group of Missouri home sellers filed a suit claiming anti-trust violations and alleging that the association’s practices inflated compensations.

Last October, a jury sided with the plainti s, awarding a nearly $1.8 billion verdict against the powerful trade group representing about 1.5 million real estate professionals.

To settle that lawsuit, along with several similar suits, NAR denied any wrongdoing but agreed to pay millions in fines, and the group also agreed to two rule changes:

1. When agents list homes on the Multiple Listing Service databases, they can no longer advertise the buyer agent’s compensation in MLS.

2. Instead, buyers must negotiate their own agents’ compensation and formalize it in a signed contract.

Now as we continue in this post-NAR settlement era, Arizona’s leading luxury brokerage is committed to complete compliance with the industry’s new regulations and has developed a strategic plan implementing the best practices for continued success and leadership.

This has been the most focused and coordinated e ort by our Russ Lyon Sotheby’s International Realty leadership, legal, management, training, and marketing that I’ve seen from any company in this industry in my 30 years of practice. We are immensely proud of our Global Real Estate Advisors’ willingness to learn, practice, and implement these significant changes and go forward, helping our clients accomplish their goals and realize their dreams in the real estate arena.

To meet the challenges ahead, Russ Lyon Sotheby’s International Realty quickly created a series of resources to ensure its Global Real Estate Advisors were fully prepared for the changes and equipped to communicate e ectively with their clients. These resources included updated Buyer and Seller Guides.

Owners, managers, brokers, and Global Real Estate Advisors attended multiple pre-change classes to address questions and provide updates as they became available. Then following the changes, Arizona’s longstanding brokerage again organized additional classes to ensure all agents felt comfortable with the new forms and could address any questions that arose.

The company’s management team continues to meet weekly to discuss the changes and brainstorm the best strategies to ensure its Advisors continue to succeed.

The luxury brokerage, which is based in Scottsdale, Arizona with 13 o ces throughout the state also introduced a company-wide bulletin, periodically sent from the brokerage’s Designated Broker Bret Lamberson to highlight important information as soon as it’s available, keeping the Global Real Estate Advisors informed. Lamberson initiated a countdown email, providing advisors with timely information at the top of their inboxes leading up to the change.

We are incredibly proud of our family of Global Real Estate Advisors. Over the past eight months, our brokerage has taken advantage of every available resource to prepare for our current regulatory landscape. Ownership and management have prioritized collaboration with our Sotheby’s International Realty a liates from around the country, and world, to establish and reinforce the absolute best practices for our profession.

The Designated Broker then took all of this to his team with months of training and rehearsal.

Early on, we realized that we needed to prepare our Global Real Estate Advisors on the changes to our industry well in advance of the deadline, We put together a plan utilizing our excellent team of Managers in cooperation with our Training, Marketing, and IT departments to develop the best training opportunities, proprietary online platforms, and presentations to help our Advisors with the transition. It started with understanding the process and the forms that went along with the new regulations.

What impresses me the most about our Advisors is the amazing level of engagement and true passion for enhancing their real estate practices. All of this has led to our position now, and we are the most prepared in the business. With an even higher level of expertise and our foundation of unwavering integrity, we are excited for the next 77 years of leading Arizona real estate.

Post-change, the brokerage has hosted multiple sales meetings and Zoom events, discussing possible scenarios and answering questions about all of the changes. The brokerage has also continued to feature critical information and reminders at the top of their weekly newsletter, o ering another valuable resource for their Advisors.

Anything we could do to empower our Advisors and give them the knowledge and tools to assist their clients, we put at the top of the list of things to accomplish. That work has paid o . It is clear that our Global Real Estate Advisors have the knowledge and skills to confidently serve our clients in this new real estate landscape.

Among the new rules -- agents who are representing buyers will now be required to get a Buyer Broker Compensation agreement signed, which states what the agreed upon compensation will be on an executed contract. A Buyer-Broker Agreement must state a clearly defined amount of compensation in exchange for specific services. This must be done in advance of touring properties with the desired Buyer’s Agent.

On the flip side -- Unrepresented Buyers attending open houses are not required to sign any forms and listing agents of a particular property will still be permitted to show Unrepresented Buyers that property. The Unrepresented Buyers are not required to sign any Buyer-Broker Agreement or an Unrepresented Buyer Disclosure, as the Listing Agents are performing the service as the exclusive representative of the Seller.

When it comes to writing and submitting an o er for a Buyer, the Buyer’s Agents will send a Seller Compensation Addendum stating the total Buyer-Broker compensation requested. This has been established as the quickest and cleanest way to move forward in the absence of a Compensation Agreement Between Brokers.

What we’ve learned from the NAR Settlement and continue to stress is that real estate compensation have and will always be negotiable, and it must be written into the contact. Also now more than ever it is important for all of our Advisors to di erentiate themselves and really show clients the incredible value, care, expertise and white-glove service that we as Arizona’s leading luxury brokerage will continue delivering to all of our buyers and sellers in every transaction that we are a part of.
