ore than 60 years ago, a visionary group of Canadians, including physicians and researchers, established the National Heart Foundation of Canada with big hopes for the future. They had a dream: to put heart health on the public agenda, to empower researchers to turn the tide on heart disease, and to educate Canadians about their hearts. With the emergence of Ontario's Foundation in 1952 and British Columbia's three years later, a network soon began to develop across the country. In Ontario, volunteers in Hamilton, Kingston, Lakehead, London, Oakville, Oshawa, Peterborough and Port Hope launched a modest door-to-door campaign to raise a provincial goal of $250,000. By the end of the campaign, they had exceeded goal and raised $320,000. In 1962, the canvass – named the “Heart Sunday Canvass” – was expanded to include additional cities. Canvassers consisted primarily of Air Cadet Squadrons, Ladies’ Auxiliary and Canadian Legion branches and medical students from the University of Toronto. Today, the February Heart Month Person-to-Person canvass is our biggest and most well known campaign. Now, the Heart Month Campaign is a well established national community based fundraising campaign. The success of this program is rooted its 80,000 volunteers, who make friendly, personal requests to their neighbours and networks, by canvassing their neighborhoods for donations through the month of February, to support life-saving research and raise awareness of heart disease and stroke within their communities. Today, heart disease and stroke take one life every 7 minutes and 90% of Canadians have at least one risk factor. Heart Month is the Heart and Stroke Foundation's key opportunity to reach millions of Canadians in February and alert them to the risks of heart disease and stroke. The Emotional Roller Coaster of Bidding Wars

ou could not have dreamt up a more perfect house than this one. You will never be the same if you don’t get this house. It’s perfection with a capital P. It’s so wonderful, in fact, that two other couples want it, too. So what is an eager house hunter to do? That depends on your bank account and your personality. Do you have the extra funds often required in a competi-

tive bidding war that almost always send up the price tag? And can you stomach the suspense, the churning anxiety and the utter disappointment that invariably comes with defeat? Being involved in a bidding war is an emotional roller coaster ride not for the faint-hearted. A recent BMO Home Buying Report indicated that most Canadians would rather walk away from their dream home

than get lured into a bidding war. Only 28 per cent said they would fight for a house. Of first-time buyers, 39 per cent were more inclined to pay above list price. Bidding wars typically happen in hot real estate markets such as Toronto and Hamilton. Let’s explore the ins and outs: Know what you can afford before shopping – You don’t want to get caught up in the drama and risk spending more than you can afford. That’s just silly. So have a set price and stick to it. You should also know the market value of homes in the area so you don’t get stuck over-paying on a house, no matter how beautiful. Your realtor can help with that. Also, try to cough up a larger down payment than the typical one to five per cent. That shows the purchaser you’re very serious and invested in this transaction. Keep it simple – The fewer conditions, the better. Now is not the time to request that they accept your offer once you sell your house. Conditional offers that depend on financing approval don’t cut it

when other offers are on the table. In fact, if your offer is relatively clean this may be the tipping point for the seller to select you over other offers. First offer – Make it your best because you may not get another chance. While at it, try to come up with a sizable deposit to show you mean business. Be flexible – If a seller has already purchased and you meet their closing date that could net you the house over a higher competing offer. In an effort to stand out from competing offers try to only ask for those extras included in the listing. Also on this point, try not to nitpick on minor repairs and instead offer to purchase the property as is. Emotional flattery – Sometimes emotions do work in a real estate transaction. So write a letter to the seller about why you love their home and how you envision your family living there. Believe it or not, that may be the way to score the house. Don’t be insincere because they will smell it a mile away.

How to receive your Retirement Income Tax Free

M

ost of us view insurance as a “necessary evil,” but what if I could show you that not only is insurance a good thing to have in case of your death, that it could also provide you with a way to grow and use money TaxFree. RRSPs can shelter your money and let it grow within the RRSP, without any tax liabilities until you begin to take the money out. Usually at age 71 in the form of a RRIF. Hopefully, by that time you will be in a lower tax bracket and therefore get to pay the tax at a lower rate. However, Life Insurance Tax Shelters (LITS) offer another option that will not only permit your money to grow Tax-Free but if structured properly, will permit you to access the funds without tax ramifications. So instead of just a Tax Deferral you can have Tax-Free money. Why are these plans better than other non-sheltered investments?

Because: 1) They permit your money invested in the plan to grow Tax-Free. 2) The annual maintenance fee for the plan is considerably less than the tax that would have to be paid on earnings on the investments that were not sheltered. This illustration may help. Although the numbers will not be the same for you, it should give you a good idea of the benefits of such a plan. Suppose your investments are earning a rate of 10% annually and each year you deposit $10,000 into a non-sheltered investment of some kind with your tax rate at 40%. At the end of 20 years you would have $630,025 in the plan, but if you had to pay the tax of these investment earnings each year, you would have also paid a total of about $172,010 in tax. If you are able to shelter that money in an LITS, those earnings will be the same but because the funds are growing within the plan there are not tax liabilities. Over 20 years the administrative

fees for the plan will probably be somewhere slightly over $20,000, so by participating in the plan you saved an additional $150,000 in tax . The second option is what makes LITS the GREAT Tax Shelter available in Canada. Instead of withdrawing the money, visit your bank (your insurance company may also do this for you) and borrow money using the policy as the security. Generally, do not borrow the full amount all at one time, but annually as you have need of it. The arrangement you make for the loan is that no repayment will ever be made on it, but at the time of your dealth the funds from the LITS will be used to cover the total owing. This permits you to access the earnings from this money Tax-Free. The lending company will feel comfortable with this arrangement because they know that their loan is well secured (by the balance you have in the fund plus the insurance) and that funds are continu-

ing to grow. So everyone is happy. If you choose the second option- and borrow against the funds rather than withdraw them, here is what could happen. You could take your first loan of $50,000 and then each year you increase it by3% to account for inflation. Even doing that it will take you 24 years to borrow the total amount accumulated. Remember that this money is flowing into your hands Tax-Free and in addition, in the event that you do not survive as long as the money does, because it is an insurance policy the balance remaining plus the insurance benefit moves into the hands of your beneficiaries Tax-Free. Here are a few ways that seniors can stretch their retirement dollars by saving money at tax time: • Public transit saves money that you might have otherwise spent on rising gas prices, parking, and car maintenance. Not only do seniors typically pay less for public transit and the

cost of transit passes can be claimed on your tax return. • You may be able to split your eligible pension income with your spouse or common-law partner, allocating up to 50% of your pension to him or her, to lower your taxes. • If you or your spouse or commonlaw partner has a severe and prolonged impairment in physical or mental functions and meets certain conditions, you might be eligible for the disability tax credit. • If you care for a spouse or other family member who has a physical or

mental illness that makes them dependent on you for care, the new family caregiver amount could save you money • If you receive the Guaranteed Income Supplement or Allowance benefits under the Old Age Security program, you can usually renew your benefit simply by filing your return by April 30. If you choose not to file a return, you will have to complete a renewal form. This form is available from Service Canada. • Applying for the goods and services tax/harmonized sales tax (GST/HST) credit helps to offset all or part of the

Why Real Estate Contracts must be Properly Accepted

R

eal estate contracts must be properly signed and accepted. This applies when offers are transmitted via email communication as well. Careless errors or omissions can cause a contract to be cancelled. Here’s an example of why. On Sept. 22, 2011, Ian and Anita Pilon put in an offer to buy a home Page Place in Kitchener, from Adrian and Florica Rosu for $400,000. They asked for a closing date of November 16, 2011. This offer was not accepted. The Rosus changed the price from $400,000 to $420,000 on the front page of the offer. They also changed the closing date to December 16, 2011 because they had a tenant who would not leave before that date. Their real estate agent, Ninoslav Orasanin, then scanned the

offer and sent it by email to the buyer’s real estate agent, Clifton van Dincten, on September 23, 2011. However, the counteroffer was missing the actual signing page, so there was no signature of the seller included in the offer that was transmitted. Van Dicten met with the buyers and they changed the price on page one of the offer to $410,000 and initialed it. He then scanned it and sent it back to the seller agent by email on September 25, 2011. Again, the offer that was emailed continued to be missing the actual signing page. The offer was open for acceptance until 6 p.m. on September 25, 2011. The seller agent then told the buyer agent verbally that the sellers had accepted the price change of $410,000 and he resent the offer to the buyer agent by email. However, the sellers did not initial the price change on page 1 of the offer. The sellers later claimed that they never agreed to $410,000 and that they always thought that the sale price was $420,000. The deal couldn’t close because the tenant refused to vacate on December 16 and the parties could not figure out a way to settle the matter. It ended up in court. The buyers sued for $17,000, based on their losses as a result of the sellers’ failure to close the deal on December 16.

In a decision dated January 8, 2014, Deputy Judge Sebastien Winny in the Superior Court of Justice of Ontario Small Claims Court, decided that there was never any valid contract signed and accepted. He found as a fact that the missing page 4 was not correctly inserted into the offer until October 11, 2011, so by then, the buyer’s last offer had expired. In order to have a valid contract, it must be signed and accepted and the acceptance must be communicated to the person making the offer, before the contract deadline. Real estate agents can sometimes accept this communication on behalf of their clients. However, verbal communication is not good enough. It has to be in writing. In this case, because the offer was missing the signing page and because the last price change was never initialled by the sellers, the contract was cancelled. It is interesting that the judge ruled that if he had decided that the contract was valid, he would have given the buyers $13,000, being their damages as a result of the sellers not being able to close on time, including moving costs, legal fees, renting alternate accommodations and mental distress. There are several important lessons from this case:
