The Listing Agreement

When you decide to sell your home with a REALTOR®, one of the most important forms you will encounter is the Listing Agreement. The Listing Agreement is the contract between you and the real estate brokerage authorizing the brokerage, including its brokers and salespeople, to market your property.

The Listing Agreement is such an important part of your real estate transaction that you'll want to be sure it is as comprehensive and accurate as possible.

Your REALTOR® will work with you to fill in all the details and leave nothing to chance.

Detailed information about your home is spelled out in the listing agreement which helps other REALTORS® respond to questions from potential buyers about your property. Also, the Listing Agreement forms the basis for any offers drafted on your home as well as any resulting negotiations involving the offer.

There are two types of listings - an "Exclusive" listing and a "Multiple" listing.

An exclusive listing gives the brokerage the sole right to find a buyer for your home during a specific time period. You agree to pay a pre-established real estate commission to the broker once the sale is completed. The commission is payable to the broker regardless of whether someone else sells your home -- including yourself during the set period or even if your home sells at a future date to someone the broker introduced to the property.

A multiple listing is also an exclusive listing between you and the broker, but includes your authorization to allow the broker to market your home on the Multiple Listing Service (MLS) and have other REALTORS® help to find a buyer. In this case, you pay the agreed upon commission and it is shared between the listing broker and the REALTOR® who found the buyer.

Most often, a REALTOR® will recommend that you list your home through the MLS so that you receive maximum exposure in the shortest time possible.

Many REALTORS® in Ontario use a standard listing agreement form such as the

one published by the Ontario Real Estate Association.

Because the Listing Agreement is so vital to the whole real estate transaction, REALTORS® are well-trained to carefully include every last required detail. The agreement is divided into two sections authority and property details.

The authority section establishes the legal relationship between you and the real estate broker, sets a time limit for that relationship, and describes the obligations of each party. The detail section provides information about the property being offered for sale and the ideal terms the seller would like to see in an offer. Your property will be completely identified by its full legal description, including street and house number, as well as to lot and plan number if the property is in a registered plan or subdivision.

Your property size and location, floor area, room sizes, style and number of rooms, zoning, building age and type of construction will all be spelled out on the Listing Agreement.

The listing price is specified along with any other clauses regarding price or terms.

There is a specific reference to the commission that will be paid upon a successful sale, trade or exchange of the property.

Other details to be filled in on the Listing Agreement include mortgage information, how many days until closing after your home sells, and how your property will be shown. Your REALTOR® will also discuss with you what items you are willing to sell along with the home.

These items usually fall under one of two categories - fixtures or chattels. Fixtures are permanent improvements that normally stay with a property as part of the sale.

Things like central air conditioning, builtin appliances and wall-to-wall carpeting are fixtures.

Chattels are usually movable pieces of personal property such as microwave ovens, blinds or washers and dryers. You may wish to include some of these "chattels" to sweeten the deal. These items will be clearly spelled out in the Listing Agreement.

Your home is probably the largest asset you will ever sell and you want to be sure you do it right. Selling your home is a complicated transaction involving many legal forms and procedures. Having a REALTOR® like Rob Golfi on your side will ensure the sale of your home goes smoothly.

Housing Market Shows Signs of Recovery by: Sue Ippolito RBC Mortgage Specialist

T

he Canadian housing market has felt the strain of a receding domestic economy since the fourth quarter of 2008. However, signs of recovery are beginning to emerge this spring.

Affordability puts ownership within reach for more Canadians The most recent RBC housing affordability report indicates that lower mortgage rates and lower home prices are combining to make housing more affordable across the country.

RBC's affordability measure identifies the proportion of pre-tax household income needed to cover the expenses of home ownership. During the 4th quarter of 2008. the Canada-wide affordability measure improved for all housing types.

Better affordability puts home ownership within the reach of more Canadians, and makes trading up more attractive to existing homeowners. Both these factors contribute to a more active and balanced housing market.

New Home construction rebounds New home construction in Canada showed welcome signs of improvement

in May, rising to 128,400 annualized housing starts from 117,600 in April.

These gains were geographically broadbased, with all provinces moving up except British Columbia.

The rise in housing starts is consistent with forecasts for economic improvement during the second half of 2009. RBC expects Canadian annualized housing starts to average 141,000 this year. As economic growth picks up in 2010, starts should expand again to 173,000. Although the trend is toward improvement, this level of activity is well below benchmarks set earlier in the decade.

Moisture and Mold Prevention • Check the condition of all water piping, fittings, and fixtures periodically.

• Vent appliances that produce moisture, such as clothes, dryers to the outside.

hen water leaks or spills occur indoors — act quickly.

If wet or damp materials are removed or allowed to dry out within 24-48 hours after a leak or spill happens, in most cases mold will not grow.

To avoid conditions that lead to mold • Repair or reseal roof flashings when damaged or worn.

• Clean gutters regularly.

• Make sure the ground slopes away from your house foundation.

• Pipe downspout water discharge points away from the foundation.

• Keep air conditioning drip pans clean and the drain lines unobstructed.

• Keep indoor humidity low. Use air conditioners and/or de-humidifiers when needed.

• Use exhaust fans or open windows whenever showering or cooking for extended periods.

• Increase ventilation or air movement by opening doors and/or windows, when practical.

• Cover cold surfaces, such as cold water pipes, with insulation.

• Add a moisture barrier over dirt floors in crawlspaces.

• Make sure attics and crawlspaces are vented properly.

• If you see condensation or moisture collecting on surfaces, act quickly to dry the wet surface and reduce the moisture/water source.

These tips are only general guidelines.

What Are Your Retirement Living Options?

etirement isn’t what it used to be. These days, rather than sitting back and watching the roses grow, more of us want to use the extra time, energy, and any cash released from the sale of a property to travel the world or fulfill some other lifelong ambition. Today’s retirees want somewhere they can perhaps travel from and entertain. Health issues are still there but people now stay fit for longer, have the spending power, and have the force of numbers to drive change. A whole new home market is growing up to meet their varied demands.

Ideally, the perfect "retirement" home is one that provides for the inevitabilities of aging and accommodates changing needs.

Whether you decide to downsize to a smaller home or move to a retirement community, the advantages are obvious—smaller homes translate into lower costs and less maintenance.

Retirement communities also ensure likeminded neighbours.

Moving can be an overwhelming experience both physically and emotionally, however, preparing yourself for your move can make all the difference in the world. There are many options available to you.

Before you make a decision about where to live in retirement you need to consider many factors: the daily lifestyle you want; proximity of children, or other relatives and friends; the type of climate you enjoy; and your health or medical

needs. Then you need to face reality.

What can you afford?

Should I continue to live in my current home after retirement? Staying in your current home will probably be much more economical if the mortgage is already paid off. If you don’t own the house free and clear, you’ll need to figure out if your retirement income will be high enough for you to continue the payments.

If your current home requires repairs or remodelling, do you want to undertake these projects, and can you afford the cost? For example, if you or your spouse have a medical problem, you may need to consider constructing entrance or exit ramps, modifying stairways, installing railings, support bars, or other modifications to bathrooms, and grading the ground to provide access to the house.

Condos and apartments: A condominium lifestyle has been a favourite of empty nesters and retirees since its inception. Condominium apartments and townhomes are available in virtually every price range and neighbourhood. Some of the more upmarket developments have their own swimming pools, gymnasiums, tennis courts, and bowling greens. Others are set in the countryside, by lakes, or are even child-free for those who want peace and quiet. In addition to being short on maintenance and long on amenities, condos offer more opportunities to socialize. Condo living is a good choice for low-key, sociable types who enjoy getting to know other residents. On average, condos are much more

affordable than houses, making them an excellent fit for individuals who want to lower or limit their housing costs.

Bungalow living: The "bungalow living" concept has surged in popularity in recent years, especially in smaller communities outside major centres.

Many empty nesters and retirees are considering the sale of their larger, more expensive homes in the city to purchase less expensive bungalows in more rural areas.

Retirement communities: Retirement communities offer retirees the amenities often associated with condominium living, smaller homes and the opportunity to live with like-minded individuals.

Current day retirement communities are resort-like in nature. The focal point of these communities is the clubhouse, where a variety of amenities including fitness facilities, tennis courts, game rooms, swimming pools, and in some areas, golf courses are available. These communities are designed to help you with the assistance you need. For example, when you first move in, you may not need a large degree of care and supervision, but as time passes, your needs might increase. This is how retirement homes and communities operate today. They attempt to steer completely clear of the stereotypical convalescent or old folks home. Yet as you progress, should you get sick or need surgery, be assured that all necessary care will be there to assist you.

Giving up the home where you have lived for many years may seem

frightening. Mentally, emotionally, and physically it is better to start to think and plan for such an eventuality before you are forced into somewhere you really don't want to be.

1. Combine the berries in a bowl and toss together.

2. Add a layer of the berries to each parfait glass, then a layer of yogurt, followed by a layer of granola. Add a second layer of berries, followed by additional layers of granola and yogurt. Top the parfait with berries.

1. Preheat the oven to 300 F. 2. Combine the oil, oats, sugar, and cinammon. Spread the oat mixture in an even layer on a baking sheet and bake, stirring occasionally, until it is fragrant and lightly toasted, about 20 minutes.

3. Add the sunflower seeds, coconut, wheat germ, sesame seeds, almonds, and walnuts to the mixture in the pan. Stir together and spread into an even layer on the pan and bake until golden brown, about 15 minutes. Add the raisins and cool completely.

4. Store in an airtight container in a cool, dry place.

hen remodeling a house one of the most important factors for getting a good price in the end is the bathroom. This article discusses how to remodel a bathroom. One of the most popular areas of a house to renovate is the bathroom.

There are many different ways to renovate a bathroom, from small surface changes to completely gutting the room.

With some forethought and elbow grease, there are renovating techniques the do-ityourselfer can accomplish, while saving money at the same time.

The first rule in any renovation is to start with a budget, and stick to it. After a budget is set, one must decide on how serious of a project the renovation will be. Surface alterations can be done fairly quickly and cheaply, while rearranging the layout of the bathroom, such as moving the toilet to a new location, will be more labor intensive, and require a contractor to move plumbing lines. A complete tear out is the most difficult, as well as money and time consuming, but is sometimes necessary if several years of moisture has begun to rot the bathroom’s wooden framework.

Hopefully moisture hasn’t penetrated the bathroom’s joists and studs, but it’s quite possible that drywall will have to be replaced. Today there is moisture resistant drywall called greenboard. If a

August 2009 easily achieved by mixing a self-leveling compound that is then spread across the floor, evening out any inconsistencies.

A new sink or vanity can spruce up a bathroom as well. There are many popular styles, such as wall mounted sinks, pedestal sinks, and vessel sinks that are fairly easy to install. It’s often possible to use the current sink piping to reconnect to an updated sink which can drastically change a bathroom’s appearance.

Some of the most effective updating can also be the easiest to do. Changing all the hardware, such as drawer pulls, faucet handles, and shower heads, can make a great impact, especially when they are all pulled together with the same materials, such as stainless steel, bronze, or brushed nickel. The cheapest home improvement choice of them all- paint- can also give a bathroom a new feel. Ditching a bland, frameless mirror for a new, large one with a funky frame is also an easy fix.

Sometimes the cost of new bathroom features is the priciest part of a renovation, but looking beyond big box stores can save cash. The local craigslist may have a treasure being thrown out by another remodeler with a different taste. eBay can work the same way. Buying discontinued tiles is another good money saving technique, but remember to pick up extras to replace damaged tiles in the future.

Most remodeling techniques can be learned, but a contractor may be necessary to deal with new electrical or plumbing lines- it will be worth the money for it to be done correctly, and they will follow building codes properly.

What is Probate?

P

robate is a legal process to distribute a deceased person's estate. It includes: • applying for Letters Probate to prove in court that the deceased's will is valid (usually a routine matter) • identifying and drawing up an inventory of the deceased's property • having the property appraised • paying debts and taxes, and • distributing the remaining property as the will directs.

After your death, the executor you named in your will (or, if you die without a will, the person appointed by the probate court) files papers in the local probate court to prove the validity of your will and presents the court with lists of your property, your debts, and who is to inherit what is left and relatives and creditors are officially notified of your death.

Your executor must find, secure and manage your assets during the probate process, which commonly takes about a year. Depending on the contents of your will, and on the amount of your debts, the executor may have to decide whether or not to sell your real estate, securities or other property to satisfy cash bequests or to pay outstanding debts.

Does all property have to go through probate when a person dies?

No. Most provinces and states allow a certain amount of property to pass free of probate, or through a simplified probate procedure. In addition, property that passes outside of your will through joint tenancy or a living trust is not subject to probate.

Probate is time consuming, expensive and usually unnecessary, so many people plan in advance to avoid it.

Who is responsible for handling probate?

The executor named in your will. If there is no will or the will fails to name an executor, the probate court appoints someone to handle the process. It is usually the closest capable relative or the person who inherits the bulk of the deceased person's assets.

Should I plan to avoid probate?

Probate rarely benefits your beneficiaries, and it always costs them money and time. Probate makes sense only if your estate will be complicated, e.g. many debts that cannot be easily paid from

the property you leave.

If you're older, in ill health or own a significant amount of property, you should plan and implement a plan to sidestep probate.

What are the different ways I can avoid probate?

There are a number of ways to pass property to your inheritors without probate. Some of these methods are simple while others take more time and effort. No one probate-avoidance method is right for all people. Your choice of method should depend on your personal and financial situation. Here are some common techniques to consider: Pay-on-death designations Designating a pay-on-death beneficiary is a simple way to avoid probate. You simply name someone to inherit the property at your death. You retain complete control of your property when you are alive, and you can change the beneficiary if you choose. When you die, the property is transferred to the person you named, free of probate.

Joint tenancy Joint tenancy with right of survivorship is a form of shared ownership where the surviving owner(s) automatically inherits the share of the owner who dies. Joint tenancy is often a good choice for couples who purchase property together and want the survivor to inherit. Be careful when adding another owner to your property in order to implement this plan, because the new coowner can sell or borrow against his or her share!

A living trust or inter vivos trust A revocable living trust is a popular probate-avoidance device. The trust is created by preparing and signing a trust deed or document and transferring property into the name of the trust, without giving up any control over the trust property. When you die, the trust property can be distributed directly to the beneficiaries you named in the trust document, without the approval of probate court.

Insurance, RRSP's and RRIF's or CD's and IRA's If you buy life insurance, you can designate a specific beneficiary in your policy. The proceeds of the policy won't go
