Are $1 real estate listings legal?
Gimmick isn’t against the law, but it doesn’t help sell a house O
ne of the most widely read Moneyville (moneyville.ca) stories in the past month is the one about the Oakville home that was listed for $1. The house was originally listed for more than $1 million. However, when no offers were received, the price was reduced to $1 in the hopes of creating a bidding war. Instead, the ruse generated accusations of false advertising. While a few offers did come in, they were nowhere near what the sellers wanted, so the property was taken off the market. Readers were angry and confused. Although few really believed the house was for sale for $1, they wondered whether this gimmick was legal and, more importantly, did it actually work? It is legal, but the tactic generally doesn’t work because everyone sees through it.
The $1 listing started appearing about five years ago. In the beginning, it was about getting the property noticed or creating a buzz. In reality, it was more about creating a buzz about the real estate agent, who received lots of media exposure. But it didn’t help sell the house. In fact, many agents have told me they and their buyers have not treated these $1 listings seriously in most cases. When it comes to the law, real estate deals have to be in writing and signed by the seller and the buyer. Just offering to sell a home on the MLS system does not obligate the seller to accept any offer that is presented. That is why if a house is listed for $500,000 and you offer $500,000, the seller doesn’t have to accept it. The financial terms may not be acceptable, the seller may have realized later that they had
priced the property incorrectly. Or, perhaps the seller suffered a change in circumstances, such as losing their job, and could no longer afford to go through with the deal. But this does demonstrate the importance of properly pricing your property to attract the largest number of potential buyers. Do not try to “test the market” by advertising a price that is 10 to 20 per cent above fair market value. You will only succeed in helping sellers who are selling in your area for fair market value, as they will be able to compare their home to yours. Later, as you start to reduce your price, people will wonder whether the reduction is because something is wrong with your home that is not being disclosed. Also, do not price your home more than 7 to 10 per cent below fair market
value, hoping to trigger a bidding war. Buyers and buyer agents are more sophisticated now about pricing and can recognize this tactic, as well. In a way, it is not much different than the $1 listing strategy. If you want to price your home to sell, first do the proper home staging to make it appeal to the widest number of potential buyers. Then, after obtaining opinions as to what your home should sell for, price it at a range between fair market value to, at most, 5 per cent below fair market value. By being more open and honest about the price you will accept, you will attract the most serious buyers who are ready to purchase a home. HOLIDAY BOOK DRIVE The best gift you can give this holiday season is the gift of literacy. Across the world and even in our own community, thousands of young children, teens, and adults are left without books to challenge their minds, to cuddle up and read to their young ones, or to simply enjoy while sipping a nice cup of warm tea or coffee this winter. Together as a team, they will be hosting a Book Drive and are asking for your help in spreading the joy of reading. Books will be donated to the Community Access to Child Health (CATCH) Program. CATCH is a community development program which offers playgroups, a lunch program, after school programs and a women’s group. Children and youth who use CATCH visit the book bank to browse and choose a free book, which they can take home and keep – a luxury for many children. Children can visit as often as they like. Books will also be distributed to the local Stoney Creek Book Bank. The book bank provides books for children from newborn to Grade 8 to support and develop an interest in, and success in reading, self-esteem and pride of ownership. Veteran's Week – november 5 - 11 How will You Remember?

ach year, from November 5 to 11, Canadians join together to celebrate Veterans’ Week - this year is no different. During this week, hundreds of commemorative ceremonies and events will take place across the country to recognize the achievements of our Veterans and honour those who made the ultimate sacrifice. Today, many Canadian Forces members are returning home from missions around the world. Canadians recognize the commitment made by our service men and women and their families. They, along with past generations of Veterans, have made many sacrifices in the name of peace and freedom. This Veterans’ Week, take the remembrance challenge. Your challenge is to make remembrance more than something you feel, make it something you do. There are many ways to show that you remember and honour our Veterans: • Pin a poppy above your heart. • Attend the local Remembrance Day ceremony. • Talk to a friend or relative who has just returned home from Afghanistan or who served in other areas of conflict. • Listen to Veterans talk about their experiences. • Create a mashup and share it on the YouTube Channel (Opens a new window) and on our Veterans' Week Remembrance Feed. • Visit the Veterans Affairs Canada Facebook fan page (Opens a new window), write on our wall and share how you remember. • Change your Facebook profile picture to a poppy. • Blog, tweet or update your Facebook status about the importance of remembrance. • Download the "We Remember" mobile app. Above all, we must vow never to forget. uring November each year, Movember is responsible for the sprouting of moustaches on thousands of men’s faces, in Canada and around the world. With their “Mo’s”, these men raise vital funds and awareness for men's health, specifically prostate cancer. On Movember 1st, guys register at Movember.com with a clean-shaven face. For the rest of the month, these selfless and generous men, known as Mo Bros, groom, trim and wax their way into the annals of fine moustachery. Supported by the women in their lives, Mo Sistas, Movember Mo Bros raise funds by seeking out sponsorship for their Mo-growing efforts. Mo Bros effectively become walking, talking billboards for the 30 days of November. Through their actions and words, they raise awareness by prompting private and public conversation around the often ignored issue of men’s health. At the end of the month, Mo Bros and Mo Sistas celebrate their gallantry and valor by either throwing their own Movember party or attending one of the infamous Gala Partés held around the world by Movember, for Movember. The movember Effect: Awareness & Education, Survivorship, Research The funds raised in Canada support the number one male cancer, prostate cancer. The funds raised are directed to programs run directly by Movember and our men’s health partner, Prostate Cancer Canada. BUYInG A HOmE - an important lifestyle and investment decision
You want to buy at the best price possible. You want your monthly payment to be as affordable as possible. You want your home to increase in value as much as possible. To make sure all that happens, it is important to look beyond your individual purchase before you buy. A REALTOR® can help you examine the market conditions, assist you in evaluating mortgage options and financing at the most attractive prevailing rate. Affordability Guide How much can you afford? This depends on a number of factors. The most important are your gross household income, your down payment and the mortgage interest rate. The first affordability rule is that your monthly housing costs shouldn't be more than 32 percent of your gross monthly income. Housing costs include monthly principal, interest, taxes and
heating expenses (p.i.t.h.). If applicable, it also includes half of monthly condominium fees. Lenders add up these housing costs to determine what percentage they are of your gross monthly income. This figure is your GROSS DEBT SERVICE RATIO (GDSR). The second affordability rule is that your entire monthly debt load should not be more than 40 percent of your gross household monthly income. This includes housing costs and other debts such as car loans and credit card payments. Lenders add up these debts to determine what percentage they are of your gross household monthly income. This is your TOTAL DEBT SERVICE RATIO. (TDSR) About the Down Payment A mortgage is security for a loan on the property you own. It is the difference between your purchase price and your down payment. The greater the down
payment, the less you have to borrow, and of course, the smaller your monthly mortgage payment. A few options of down payment include your savings or a nonrepayable gift. There are other options available to you and this can be discussed with your REALTOR®. Other costs to be Aware of when you Buy This is a list of possible extra costs involved in buying a home. Some of them are one time costs and others, such as condominium maintenance fees and property insurance, will be ongoing monthly expenses. THE GOOD NEWS IS THAT NOT ALL OF THESE COSTS MAY APPLY IN YOUR CIRCUMSTANCES. • Appraisal fee - if your loan is not insured your lender may require a property appraisal for mortgage pur-
poses. A basic appraisal is somewhere between $150. & $250. • Land Survey Fee - Your lender will require a survey unless you are purchasing a condominium. • Land Transfer Tax - This applies in most provinces, including Ontario. It varies as a percentage of the property's purchase price. It is usually between 1% - 4%. • Home Inspection Fee - Inspectors in Ontario are unregulated so fees can vary. They range from $150 + GST to $350 + GST. Larger homes may cost more to inspect. A two-hour inspection carried out by an engineer who provides a written report will cost closer to the upper limit. • Mortgage Broker Fee - A broker may charge a fee to find you a lender. • Property Insurance - This insurance covers the replacement value of the structure of your home and its contents. • Lawyer fees - A lawyer is required to search the title, draw up mortgage documents and tend to closing details. Lawyers fees range depending on the complexity of the deal. • Moving Costs - The cost of a professional moving company or a rental truck if you move yourself. • Prepaid Taxes or utility bills. -You will have to reimburse the seller on a prorated basis if some bills have been prepaid beyond the closing date. Discuss your financing options with a REALTOR®, your banker or a financial advisor.
