December 2012 Housing Starts in Canada

TTAWA, January 9, 2013 — Housing starts in Canada were trending at 212,282 units in December, according to Canada Mortgage and Housing Corporation (CMHC). The trend is a six-month moving average of the monthly seasonally adjusted annual rates (SAAR) of housing starts. The standalone monthly SAAR was 197,976 units in December, down slightly from 201,376 in November. The actual housing starts for 2012 are being verified and will be reported in the January edition of Monthly Housing Statistics, which will be available before the end of the month. “As expected, housing starts remained below their recent trend in Canada. The decrease recorded in December was due to a decline in rural starts, while urban starts remained stable. Housing starts were below their trends in all regions except Ontario,” said Mathieu Laberge, Deputy Chief Economist at CMHC. CMHC uses the trend measure as a complement to the monthly SAAR of housing starts to account for considerable swings in monthly estimates and obtain a more complete picture of the state of the housing market. In some situations, analyzing only SAAR data can be misleading in some markets, as they are largely driven by the multiples

segment of the markets, which can be quite variable from one month to the next. The seasonally adjusted annual rate of urban starts remained relatively stable in December (-0.1 per cent), reaching 178,870 units. Single urban starts rose by 8.6 per cent to 67,419 units, while multiple urban starts fell by 4.7 per cent to 111,451 units. December’s seasonally adjusted annual rates of urban starts decreased in the Prairies (-23.9 per cent), Quebec (-11.8 per cent) and British Columbia (8.2 per cent). Urban starts remained relatively unchanged in Atlantic Canada (-1.6 per cent) and increased in Ontario (+33.4 per cent). Rural starts were estimated at a seasonally adjusted annual rate of 19,106 units in December. Should Home Seller Disclose if Someone Died in the House?

Buying a home: Dealing with the death house stigma

I

n November the Toronto Star reportedthat a Bowmanville couple is suing their real estate agent and the people from whom they bought their house for not disclosing that there had been a double murder there 15 years earlier — including that of a 6-year-old girl. Two years ago in Orangeville, a homebuyer was able to get out of his deal after learning that the house was owned by a nurse who had been murdered nearby. These cases, and others like it, raise interesting legal issues about what should or shouldn’t be disclosed when a house is sold. Should sellers be required to say that there has been a murder or suicide in the house? If yes, how far back should you go? One year, five years, 10 years? About half of American states require disclosure if the death happened within three years. In Canada, there are no laws governing these situations. For buyers and sellers, the question is whether disclosing this information will affect the value of the property. Toronto real estate agent and appraiser Barry Lebow believes it does.

Lebow, who has 45 years in the business including giving expert evidence on property stigmas, says a “death house” carries a stigma that will almost always negatively affect its value. In many cases, the home has to be demolished and the address changed. In other cases, even if it does not bother a current buyer, it will bother a future buyer when they try and sell it later. In 1974, Hungarian-born real estate developer Peter Demeter was convicted of arranging the murder of his wife at their Mississauga home. He later couldn’t sell the home so he arranged for someone to burn it down in 1983. He was later convicted of arson. Not a good plan. The home on Bayview Ave. in St. Catharines that Paul Bernardo used to commit his sexual assaults and tortures was later demolished. The new home built there was given a different street address, to further distance it from what had occurred in the past. In Lebow’s opinion if you live near a murder house, the stigma will typically not affect the value of neighbouring properties. But even so, what goes on next door can be an issue. In a 1998 case from Kelowna, BC, Ron and Marlene Allen made an offer to buy a beachfront house. They asked the sellers, Ken and Dorothy Summach about the empty lot next door. The Summachs said it was a public beach, neglecting to say it was a nude beach. The Allens refused to close. Now some might think a nude beach would add value to the home, but the Allens didn’t. Five years later, the B.C. Court of Appeal decided the Summach’s did not need to disclose that fact, as the ‘defect’ was not occurring on their property. close that the house across the street was owned by a man convicted of possessing child pornography. The buyers sued and the sellers brought a motion to have the case thrown out. They argued they weren’t under an obligation to disclose the fact. In a decision dated March 3, 2010, Judge Alexandra Hoy let the suit go ahead. She said: “The buyers’ claim is novel. And it raises policy issues, including the protection of children and whether, if successful, the claim will have the effect of making the re-integration of persons convicted of certain crimes into society more difficult.” The buyers never moved in. They subsequently resold the home at a loss and settled the case out of court with the sellers. So we will not learn what the final decision might have been. In Ontario, real estate agents must disclose any material fact that they are aware of under the rules of their Code of Ethics. In my opinion this includes

whether a murder or suicide had occurred on the property and could also include certain neighbourhood conditions. Buyers can always Google the property address which will likely turn up articles about prior violent crimes. Before you buy, you can always tour the neighbourhood, speak to people and ask questions about the home. In addition, put a clause in your offer where the seller states that they are not aware of any murder or suicide ever being committed on the property in the past. If sellers are asked, they must respond truthfully. It is time for government to give guidance on what stigmas need to be disclosed, so that buyers, sellers and real estate agents are better prepared for this very difficult issue when buying or selling a home. Whistler Real Estate: a Bargain?

C

ould it be that Whistler has become more than a ski and party destination, and is now a place to hang your hat year round? While the drive time has shortened with the improved highway, the dropoff in property prices also makes Whistler a draw. Years ago, Whistler was the playground for west-side skiers who kept a second home there for winter weekends. Now, the ski resort town’s realtors are hoping that with easier access and some additional draws – such as developer-philanthropist Michael Audain’s up-and-coming art museum – Lower Mainland residents will start to view Whistler as an extension of Vancouver. People already commute between

Vancouver and Squamish, either solo or in van pools. Whistler as a commuter town is the natural next step. Whistler real estate prices are better than prices in the Lower Mainland, which, despite doom-and-gloom forecasts, have held steady compared with the rest of the country. The benchmark price for all Vancouver properties last year was $590,800, according to a new report by the Real Estate Association of Greater Vancouver. Whistler, by comparison, had a benchmark of $457,500. “Whistler is good value right now,” says Pat Kelly, president of Whistler Real Estate Co. Mr. Kelly has been a Whistler realtor for 30 years. “It’s the reverse of Vancouver. And in light of some of the new developments, it’s not only a good investment from a buyer’s point of view, but it’s also reasonable to

live here full time. The new highway changed the drive. “You can get pretty good housing for $1-million or less that’s only a relaxing one-hour, 20-minute drive away.” If Whistler is a relatively good deal these days, it’s in large part because it’s been dependent on the U.S. economy. Many of the Americans who once fuelled the condo-hotel market in Whistler have pulled out, what with the financial crisis and the rise of the Canadian dollar. Now that the average American is in penny-pinching mode, the luxury of having an occasional vacation getaway that they own outright simply doesn’t make sense. As well, the American who purchased a decade ago will do well on the sale of their property now, even if the price has fallen 20 per cent. “The Americans were a real driver of real estate transactions here in Whistler, but they have gone from being buyers to sellers, and in some cases, I don’t think they have tried to hold on for the top price,” says Mr. Kelly. “If they wanted to sell, they sold. “There are almost 5,000 units in that condo-hotel style in the Whistler area, and there probably aren’t as many buyers for that today as there are for lifestyle product,” he says, referring to homes to be lived in, as opposed to investment properties. “Our buyer now comes mostly from the Lower Mainland, and that unit

was aimed at somebody, for instance, from Toronto, flying in for a week. You just don’t do as many transactions in that category. And combined with performance problems due to the financial crisis, lack of discretionary income, and lack of credit – you can’t borrow on those units as easily – it has all led to that market being hit.” He estimates that more than 80 per cent of all homes in Whistler are less than $1-million. The market dropped around mid-2009, and mostly stayed down throughout 2011 and 2012. Landcor Data Corp. data shows the current median price of a Whistler condo at around $358,500, at the same level as 2001 prices. Overall, volume of sales has plummeted in the last couple of years, with a minor spike in 2010, during the Olympics. Landcor president Rudy Nielsen, the largest owner of recreational property in B.C., believes Whistler will hold its own in terms of desirable property. If he were to purchase in the next few months, he’d choose Whistler over the Lower Mainland, he says. He thinks the improved highway and the faster commute may even be responsible for slowing the recreational property market in Whistler. “I think that might have some of the effect on why houses haven’t been selling like in the past, because people know they don’t need a second house.
