oes your house have any secret passages? Wouldn’t it be cool if it did? Would you believe that some houses actually do have secret passages? it’s true! Throughout history, all sorts of homes have been built with secret passageways, hidden rooms, and storage spaces out of plain sight. For some people, the reasons for these secret places are practical. Perhaps they fear they will one day need a place to hide from invaders. Or maybe they have valuables that need a secure storage spot. For others, secret areas may be nothing more than a whimsical preference. Bourne built a five-story castle on Dark island in the middle of the St. Lawrence River in New York. Filled with secret passageways, Singer Castle, as it is known now, was used by Bourne to host elaborate parties. So why the secret passageways? According to legend, Bourne liked to sneak out of his own parties so he could spy on his guests to find out what
they would say about him when he wasn’t around! Doug Carlston, founder of gaming software company Broderbund, created a home that was like one of his gaming worlds brought to life. The home contained over 1,700 feet of secret passageways and 1,100 square feet of hidden catacombs. Traveling through this maze of secret corridors, one can find treasure chests, caves, and even a “room of doom” that can only be escaped by swimming through a chute or jumping through a waterfall! in 1710, Captain Jonathan Hunt built a house in Northampton, Massachusetts. He included a secret passageway as a family hiding spot, because he feared attacks from local Native Americans. Today, the house is a residence hall on the campus of Smith College. Every year, college students enjoy searching for the secret passageway! The Octagon House in Fond du Lac, Wisconsin, was built in 1856 by trader isaac Brown. The 12-room house was built like a fort with nine secret passageways and a hidden room, because Brown feared Native American attacks since the area was on the frontier at that time. Over time, the secret passageways and hidden room were put to good use as a stop on the Underground Railroad. They were a perfect place to hide runaway AfricanAmerican slaves headed north.

Disclose problems if you’re selling a house: Caveat emptor is a good rule to follow if you are buying a home. But seller must be careful to disclose structural defects.
B
uyer beware, or Caveat Emptor, is a phrase used to describe the outcome when you buy something and later find a problem with it. in plain English it means tough luck – you’re buying the thing ‘as is’ with all the defects in it. Pedlar contacted the Region of Peel and learned they had been out to the property twice in 2010 to inspect and clean out a blockage from the same sewage line. The Region sent a letter to McDevitt after the second visit in July, 2010 suggesting other repairs be done. in some cases involving the purchase of a house, it’s not as easy as that for a seller to get off the hook. if you know there’s something seriously wrong with your house, something that might not be found in a home inspection and you don’t disclose it, you can be successfully sued later. Here’s why: in October, 2011, Jason Pedlar and Mary Kalbfleisch agreed to buy a 35year-old home in Caledon from Daniel McDevitt and Elizabeth Jakobczak. The couple had a home inspection done before they put in an offer, and the inspection found that the drainage on the
property was adequate. The deal closed in mid-December. Two months later on Feb. 20, Pedlar found sewage backing up into the basement bathtub and sink. Roto Rooter cleared the drain, but could not get past a certain point in the pipe. A TV scope showed water pooling inside the pipe. A quote of $6,000 plus HST was given to repair the problem. Pedlar contacted his insurance company and the work took longer to do and cost more because the basement had 36 inches of concrete. The buyers had to move out while the repairs were being done because of the dust and noise from the jack hammering. Kalbfleisch was also pregnant. The insurance company paid for them to stay in a hotel while the repairs were completed. Related: How to save thousands on your mortgage renewal Pedlar and Kalbfleisch sued for $14,945, which were the additional costs not covered by their insurance to repair the problem. They asked for $5,000 more in aggravated damages, because they had to move out and have their baby while outside the home.
McDevitt admitted in court that he had a problem with the basement bathroom but that after the Region came out and cleared the blocked area, they told him that if he had no further problems for six months, he would be good to go. McDevitt also said in court that the basement bathroom every day and did not have any problems from July 2010, until the sale in 2011. He stated in court that he did not mention this to the buyers because he felt that this was no longer a problem. in a decision released this month , Deputy Judge John Rose of the Barrie Small Claims Court used the law of hidden defects to reach his decision. He said that if the seller knows about a defect that has caused any loss of use or enjoyment of a meaningful part of the premises, then it must be disclosed to the buyer. The Region inspectors testified that they discussed the potential sewer pipe problem with McDevitt. This together along with the letter convinced the Judge that McDevitt knew about a structural problem with the pipe which should have been disclosed. He awarded the buyers $10,500 for the repairs to the pipes but nothing for aggravated damages as the sellers did not do
this with any ill motive and there was no evidence of mental distress. The buyers were fortunate to have uncovered the evidence from the Region of Peel to support their position. Without it, it would have been difficult to prove that the sellers knew anything about this. Here are lessons: •Buyers might consider a separate test for the drainage system as part of any home inspection with older homes, even if this costs an extra $200 to $300. •Sellers should disclose any structural problems to avoid getting sued later. Six things to know about real estate deposits When you make an offer on a house you have to put down a deposit. Here are some things to keep in mind.
B
efore you get to the happy moment of getting the keys to your new house, there are plenty of stressful moments. Mark Weisleder helps you navigate the path. Here are some answers to common questions about deposits when you are buying a house. When must a deposit be paid? in Ontario, the standard real estate contract gives the buyer two choices; you can pay the deposit immediately when you make an offer, or you can agree to pay it within twenty four hours after the seller accepts it. Most buyers prefer the second option. if you are in a bidding war, you will be encouraged to come up with the deposit immediately, to show good faith to the seller. Can the buyer get out of a deal by refusing to pay the deposit? No. Once the deal is accepted, you can’t change your mind. if you do, the seller can sell the property again and if he gets less money than you were going to
pay the seller can sue you for the difference, plus legal fees. What happens if the deposit is paid late? The seller has the right to cancel the deal. This is because all time limits matter in a real estate contract and if you are late, even by a few minutes, the seller can try and cancel. i have seen this happen many times, especially when the seller knows that there is another buyer out there who will pay more money. if you need more time to come up with your deposit, say so in your offer. How much should a buyer pay as a deposit? This is a tough question, and will largely depend on where your home is located. in Toronto, deposits are now usually up to 5 per cent of the sale price. in Brampton, it is closer to 2 per cent. in some areas of Ontario, deposits can be as little as a few hundred dollars. Why does the deposit go to the seller’s real estate agent and not the seller?

if the seller goes bankrupt or disappears with the deposit, the buyer is not protected. When the deposit is held by the real estate brokerage, it is in trust and is also protected by insurance so even if the brokerage goes bankrupt, the buyer can get their money back. if the buyer is unhappy with their home inspection, can the seller refuse to return the deposit? This happens more than you think. A deposit cannot be released unless both the buyer and seller agree. if a seller believes the buyer did not act in good faith in trying to satisfy their condition, whether it is
a home inspection, financing or a condominium status certificate review, they can refuse to release the deposit. This means it stays in the broker’s trust account until a judge decides who gets it, which can take years. As a precaution, buyers should consider making two deposits in their offer, a small one of say one per cent when the offer is accepted, and a second larger deposit once the condition is satisfied.
