Think carefully before suing your neighbour If you are considering suing your neighbour, think about a few things first.
M
any times, what starts off as an innocent disagreement between neighbours can escalate into something major. It can be a spat about noise, boundary issues, trees or fences. But if you are considering suing your neighbour, think about a few things first. Whatever hard feelings there are now, they will get much worse if you go to court. So here are a few tips: Try to settle it as diplomatically and amicably as possible. Remember, the worst settlement, is in my opinion, better than the best lawsuit. Consider checking the title of your neighbour’s property first, to see how big their mortgage is and whether they can pay if you win your case; Maybe it is better to just move than start a fight. You don’t know how the person may react to a lawsuit. Here’s an illustration of why you want to avoid a suit at all costs: In 2007, Pickering homeowners Bill and Anna Squires became involved in a boundary dispute with their neighbour David Fitzpatrick. The dispute quickly escalated. On November 12, 2007, Squires found the bloody carcass of a coyote on the hood of his pickup truck. Police were called and Fitzpatrick was charged. The case was later thrown out because it could not be proved that
Fitzpatrick put the coyote on the car. A video camera installed by the Squires had been disabled the night before. Fitzpatrick sued for malicious prosecution and also sued his sister, Shelley Orwin, who he alleged was conspiring with the Squires against him. In a decision dated June 18, 2012, Justice David Stinson of the Ontario Superior Court
dismissed Fitzpatrick’s case and awarded the Squires damages of almost $340,000 for among other things, mental distress, legal costs, and punitive damages. He awarded Ms. Orwin almost $70,000 in legal costs. The judge found that based on all the evidence, it was Fitzpatrick who either placed the coyote on the truck or caused someone else to do

it. Fitzpatrick appealed the decision against the Squires and lost. In a published report, the Squires said that while they’re glad they won the case, they may never see any money. In the meantime, the Squires had to pay all their own legal costs. This was a difficult situation, since the Squires did not start this lawsuit. They had to defend against one started by their neighbour. A related issue is whether a seller needs to disclose to a buyer about a neighbour who is peculiar. Most lawyers will say no. For example, I have seen streets closed down on Halloween when someone puts up a huge ghoulish display for weeks, bringing onlookers from all over the City. Do you want to live next door to that house? This is another reason why you should do research before you buy a home to make sure there are no odd neighbours on the street. Knock on doors. For example, check to see if any neighbour has video surveillance equipment near their front door. This is not usual. Do the right research before you buy and avoid surprises after closing. Meet Rob...
H
ow do you go from trying to find your life’s calling to becoming number one in a field that you truly love?
Lots and lots of trial and error. Just ask Rob Golfi. As a realtor with Remax Escarpment Realty, Golfi is the perfect case study in how to find career success: You go looking for it. And often, that search will take you on a roundabout route that’s two steps forward and one back. From his shy and quiet days as a high school student when he was earned big money as a disc jockey to later selling jewellery, importing trinkets from China and publishing a business journal, the long-time Grimsby resident has tried his hand at a good number of livelihoods including stints at GM, Bell Mobility and Canadian Liquid Air. “My education was those businesses I became involved in,” Golfi says. “They helped me grow to what I am today.” A leader is residential real estate sales today, Golfi was always highly motivated even as a youngster. His entrepreneurial flair first emerged as an 11-year-old when he started his own lawn-cutting service in Niagara Falls, where he was born and raised. In high school, as a disc jockey putting on semi formal teen dances he’d sometimes net as much as $3,000 for one gig. Following a year of business college after high school, Golfi reluctantly decided to bite the bullet and try working at GM, where his father worked. It would turn out to be a lesson in working at something for which you have no affinity. “I knew it wasn’t for me,” says the 48-year-old married father of four. “But the money was good and my dad encouraged me to give it a try. But I wasn’t satisfied and was always looking for something better.” While at GM, Golfi’s Type A personality prompted him to launch his own landscaping business. Given the good money he was pulling in, he began investing in real estate in Hamilton and Vancouver. On his breaks at the plant, he’d go through a roll of quarters doing business from the lunch-room pay phone while his fellow factory workers rolled their eyes or got annoyed with him hogging the line. It was during this period that Golfi became enamoured of motivational business and life coaches such as Tony Robbins. He’d spend his free time reading or attending workshops on positive thinking and growing your wealth. After three years and three months at GM, Golfi knew it was time to strike out on his own. He said goodbye to factory life and went into exporting gadgets such as electric razor blades and key locators from China. He sold earrings to beauty salons on consignment, which would eventually lead him to owning and operating his own beauty supply business. But Golfi struggled with this endeavour because the economy soured, people stopped paying their bills and he was holding a large amount of inventory. In the early nineties, after closing his Burlington warehouse space, Golfi decided to seek a business that was less product based. So in his late twenties, he went into publishing and launched the Hamilton-Burlington Business to Business Journal. Golfi nearly ran himself ragged working as the publication’s sales manager, publisher, editor and layout person so he took on a partner who ended up embezzling money from the company. The partner was later jailed for his part in other scams. Golfi dissolved the publication and started a direct mail coupon book, which he sold a short time later. He would work at other sectors trying to find his niche until he hit on the real estate industry, a career his uncle had long-suggested he should try. He got his realtor’s license in just three months and started with a Stoney Creek broker before joining Remax Escarpment Realty in January of 1999.
Golfi and the Remax broker Tom Randall immediately hit it off. Golfi would soon become the top selling agent. Within 18 months he hired a part time administrative assistant and slowly built his sales team one agent at a time. Today, the Golfi team is ranked 10th for teams among Remax Canada’s 19,000 sales reps. His 10-member team is currently ranked number one for sales in the Hamilton-Burlington and surrounding area. As a realtor for the past 15 years, Golfi isn’t going anywhere anytime soon. He’s happy to rise at 5:30 or 6 a.m. to start his day. Golfi loves meeting new people and encountering different cultures, but perhaps more importantly, he loves negotiating and winning. “I always feel I can do better and improve. It’s something in my personality. I’m an Aries and we’re very goal oriented. We must be number one. What really motivates me is negotiating. I love winning negotiations. We’re aggressive negotiators. I believe we sell more because we do more for the client.” The Golfi team – which includes Golfi’s two eldest sons Jeffrey, 25 and Daniel, 23 – sells over 300 properties a year. Golfi has been married for 26 years to Susan, who has supported him in all his endeavours. They have four children, including Philip, 20 and 19year-old Lauren. A resident of Grimsby for 24 years, Golfi is a generous community supporter, having donated thousands to the Children’s Miracle Network, sponsored several sports teams and helped collect thousands of pounds of food for the food bank. To relax, Golfi enjoys a bit of golf with his sons or just hanging around the house watching reality TV shows such as Pawn Stars, American Restoration or Canadian Pickers and Dragon’s Den. “I could watch these shows all day long,” he says with a chuckle. “I think I enjoy watching them negotiate their deals.” Golfi prides himself on his loyalty and compassion. Known as Mr. Nice Guy in high school, Golfi is quick to help out friends in need. He drives to Niagara Falls every Sunday morning to have breakfast with his Italianimmigrant parents, who raised him and his three sisters to belief in their dreams. As his father approaches 80, Golfi enjoys listening to the stories he tells about the old country, which are repeated now with greater frequency. Golfi credits his father for his success, saying he’s always had his back. “My mom would say get a job and my dad would always support me and say let him do what he wants to do,” Golfi says. “He knew I was driven.”
