Spring Arrives for the Resale Market (May 6, 2013 – Hamilton, Ontario) The REALTORS® Association of HamiltonBurlington (RAHB) reported sales, listings and the average sale price for all property types listed through the RAHB Multiple Listing Service® (MLS®) in April showed increases over the same month last year. There were 2,202 properties listed in April, a 6.5 per cent increase over April of last year. All property sales numbered 1,521, representing a 5.5 per cent increase over the same month last year. The average sale price of $382,682 was an increase of 1.8 per cent from the previous April. “Spring has arrived for the resale real estate market,” said RAHB CEO Ross Godsoe. “We started seeing more listings and sales come through the MLS® system first thing in April. All property sales are not only higher than last year, but are the second highest in an April for the last 20 years.” Seasonally adjusted* sales of residential properties were 4.5 per cent lower than the same month last year, with the average sale price up 2.4 per cent for the month. Seasonally adjusted numbers of new listings were 2.2 per cent lower than the same month last year. Actual overall residential sales were 5.1 per cent higher than the previous year at the same time. Residential freehold sales were five per cent higher than last year while the condominium market saw an increase in sales of 5.6 per cent. The average sale price

of freehold properties showed an increase of 1.9 per cent over the same month last year; the condominium market, however, saw a decrease of 8.6 per cent when compared to the same period last year. The average sale price is based on the total dollar volume of all residential properties sold. Average sale price information can be useful in establishing long term trends, but should not be used as an indicator that specific properties have increased or decreased in value. The average days on market increased from 38 days to 40 days in the freehold market and from 41 days to 42 for condominiums. “Listings are up from last year, but there are still fewer listings on the market than there were a year ago,” noted Godsoe, “and the number of listings is still below the average for the last ten years. The seller’s market which has existed in our market area continues, even though we saw some signs of a more balanced market at the end of the first quarter.” Year to date, listings are down 2.9 per cent compared to the same period last year, while sales are seven per cent lower. The average sale price for the first four months of the year is 5.7 per cent higher than the same period last year.

St. John Ambulance Ontario endorses the product and it has been featured on CTV National News, CHCH Morning Live, in the Toronto Star, Zoomer Magazine, Best Health, 680 News, and was the Editor’s Pick in the February issue of Canadian Living. The Grimsby Lincoln News, Welland Tribune and St. Catharines Standard have also featured Key to Life in their publications. Response from the community has been incredible, with customers reaching out to share their experiences and well wishes for the cause. Two people have contacted Andrew and Brett to share that they have used the ASA in their Key to Life and fortunately, survived their heart attacks. Key to Life was featured in the October 10, 2012 edition of the Real Estate Market Watch just 10 days after the two Beamsville brothers, Andrew (25) and Brett Beaulieu (19) launched their potentially lifesaving product. Real Estate Partnerships Require Careful Planning of the partners. Who signs the cheques? Signing authority and how distributions are made to the partners is also a concern. I suggest that cheques up $1,000 or $2,000 can have one signature, but anything more needs at least two. There should be a separate account devoted to the investment, so there is no confusion about personal cheques being used to pay bills. When is reporting to be done? The partner who is managing the property should be required to submit monthly reports to the partners about the rents received and the expenses paid each month. There should be an annual report as well. This way each partner can make the appropriate income and expense reporting to the Canada Revenue Agency when filing separate tax returns. How are disputes settled? If things go to court, only lawyers win. Agree on a detailed and expedited arbitration process. That way the arbitrator’s decision is final, with no right to go to court, where it will inevitably get delayed and become expensive. What if one partner dies? There should be a process where the property is appraised and the partner who survives has to buy out the estate of the deceased partner at fair market value.

Critical Illness Insurance for Living Not Dying!!!! by Gianni Leonetti, Leonetti Consulting The generalization about life insurance is that it’s only good at death. And then it’s too late to enjoy the game. Not so with critical illness insurance. People are living longer, and medical technology now provides the potential for someone who would have died only 30 years ago from a critical illness such as a heart attack or stroke, to survive. According to the Heart and Stroke Foundation, in Canada more than 75,000 people have a heart attack each year, but well over 80% survive the attack. The same applies to 70% of the 50,000 who have strokes. The Canadian Cancer Society states that the death rate from cancer has fallen to only 1 in every 3,000 cases. Many survivors return to work, but not necessarily the same job and sometimes earning less money. Critical Illness Insurance is the financial safety net should you suffer from a critical illness. Critical illness coverage provides benefits that are paid upon the diagnosis of a critical illness such as cancer, heart attack, stroke, Alzheimer’s disease and others. In other words, critical illness coverage provides a living benefit that pays-directly to the policyholder-when they have a critical illness. For example, if someone with $100,000 of critical illness coverage were suddenly stricken with malignant cancer, he or she would receive a $100,000 payment. The attractiveness of this product is

no surprise when one considers what it offers the potential buyer. A lump sum of non-taxable cash, while the insured is living, upon the diagnosis of a covered condition, thus alleviating the additional stress which financial pressure would bring. Particularly since the critical illness survivor would then be able to afford the medical treatment and other expenses not covered by his or her private or provincial medical plans. They could then afford to continue to pay the mortgage or other bills in the event they were without income for any length of time. CI coverage effectively addresses these and many other financial issues. While fairly new to Canada, critical illness insurance is one of the most widely sold insurance products. Since its introduction in Canada in 1994, CI coverage has rapidly grown to a $200 million dollar market. This is evidence of the consumer need for critical illness insurance and the need for financial security in life as well as death. As Dr. Barnard says, “Critical Illness insurance gives you financial independence when you need it most. You need insurance not only because you are going to die but because you are going to live.” This is a product designed to give you CHOICES...

If you invest in real estate with partners, there are important things you need to discuss in advance. What if one partner wants to sell and the other partners do not? There should be a similar process where the partners who do not wish to sell have to buy out the partner who wants to sell at fair market value, to be determined by an appraisal. What if one partner doesn’t pay their share of expenses? If one partner is not paying their share, then they should lose their right to make any decisions about the property. There should also be a formula so that the non-defaulting partners can buy out the share at a reduced value.

If you invest in real estate with partners, there are important things you need to discuss in advance. This will protect you later from costly legal or accounting fees. Here are some of the main things to consider: Who is going on title? If it is your first investment, I suggest that all partners be on title to the property, in their personal names, as opposed to a corporation. A lender will want all the partners to sign personally for the mortgage, so there is little advantage to spending the extra money to incorporate, with additional bookkeeping fees and tax returns. You can always get insurance to protect against claims related to liability. How are decisions going to be made? Key decisions include who to accept as a tenant and which renovations to undertake. Most of them should have majority approval, but in some cases, you may require decisions to be unanimous, to protect all

It is hoped that every real estate investment will lead to a profitable result and that no one will have the need to look at a partnership agreement. However, if things do not work out, it is good to know that the answer can be quickly found, without having to resort to costly legal or accounting procedures. By having the right legal and accounting advice before entering into a real estate investment with partners, you can ensure peace of mind for all partners involved. Giving Power Of Attorney To Friend: A Cautionary Real Estate Tale If you suspect someone who is elderly, or otherwise unable to take care of themselves, is being taken advantage of in their financial affairs, you should encourage them to get legal advice. Here’s an example of what can happen. In 2006, Gary Shular inherited his mother’s home on Jacobs Ave., in St. Catharines. Shular had a history of mental illness and suffered bouts of depression and lived in the house for two years with his partner. After they split up, Shular moved to an apartment on Parliament St. in Toronto and the St. Catharines property was neglected. In Toronto, he renewed his acquaintance with an old friend, Michelle Ferraton, whom he’d known for years. She suggested that she and her common law spouse could help him fix the St. Catharines property and sell it. In exchange, she wanted half the sale price. Shular agreed and signed a sales agreement prepared by Ferraton to give her half the money. A court later heard that Ferraton put $2,115 into the property and then convinced Shular to give her a power of attorney so that she could list and sell it. In 2008, she signed an agreement to sell it for $156,000. Shular still had to sign the closing papers.

After deducting fees and expenses, Shular received $140,000. Ferraton expected to get $70,000. Shular had a change of heart and refused to pay the $70,000, but did give Ferraton $2,115, plus $20,000 for helping him out. Ferraton sued for the remainder. At trial in November 2012, Shular’s ex-partner testified that Shular had a history of mental illness. He also told the court Shular was vulnerable to exploitation. Shular confirmed to the court that he was very depressed in the summer of 2008. Ferraton confirmed in court she knew Shular’s vulnerabilities which was why she had helped him with financial matters when he couldn’t earn a living or take care of himself. By the time of the trial, Shular was on welfare, and he told court all the money from the property sale was gone. In a decision of the Ontario Superior Court of Justice dated November 26, 2012, Judge J. Wilson decided that the contract was unconscionable and unenforceable. He said an agreement giving Ferraton 50 per cent of the sale was unfair and since she was not a real estate agent, she could not be paid for services related to selling the house. Since Shular had insisted at the trial that Ferraton be

Here is what the judge said: “Ms. Ferraton was well aware of Mr. Shular’s emotional frailties and history, and took advantage of his passivity and listless attitude towards the property during a period of deep depression. What appears to have begun as an act of friendship, matured into a plan to profit from the situation and to take advantage of Mr. Shular’s

emotional state and apathy.” Do not give out a power of attorney or sign any other legal document over any of your property without first obtaining legal or other professional advice.
