Albert’s view was that he was entitled to a 50 per cent ownership until his death, when the property would go to Andy. Albert sued Andy to confirm that he owned 50 per cent of the property and Andy countersued claiming 100 per cent, based on his financial contributions. At the trial in 2012, judge Peter Rogers of the B.C. Supreme Court ruled that Andy became the beneficial owner of 100 per cent of the property as a result of the 2002 agreement, based on all the evidence that he heard. A key piece was an alleged statement by Albert that “the house is yours if you agree to come back and live with me and pay my debts.” Judge Rogers concluded that Albert did not contribute to the purchase of the Captain’s Way property and was not expected to pay for its upkeep. The case was appealed to the BC Court of Appeal. In her June 28, 2013 decision, Madame Justice Daphne Smith had issues with the fact that the supposed 2002 agreement was not written down and may have just been gratuitous promises that were not binding on Albert. She did, however, leave open the possibility that Albert may have been unjustly enriched by remaining the 50 per cent owner without contributing his share of the upkeep. She sent the case back for another trial to determine if Andy should recover more than his 50 per cent ownership based on his contributions to the property. It is hard to imagine the legal fees involved in both the initial trial and appeal, as well as what may become a second trial. All of this could have been avoided if a clear written agreement had been entered into at the time title was taken in the first place. When family members take title, and it is intended that only one member will pay all expenses and effectively be entitled to 100 per cent ownership, it is important that all of this be carefully documented right at the beginning. amily members often decide to take title to properties together for various reasons, sometimes for estate planning purposes, but primarily when one family member alone cannot qualify for a mortgage. However, if there is no written agreement regarding ownership and who is making the payments, it can become very expensive to change the title later. A continuing legal dispute in B.C. is an example of when things went wrong: In 1990, Yuk Chun Suen, known as Albert Suen, moved to Vancouver from Hong Kong with his wife, two daughters and son, Andy. He bought a home with his wife, sold it and bought a new home on Pender St. in Richmond B.C. Andy graduated from University in 1998 and started contributing $1,000 per month to the family expenses. In 2000, Andy’s girlfriend Angela, later his wife, moved into the home on Pender St. and cared for her mother-in-law, until her death in 2001. Thereafter, Albert became the sole owner of the Pender St. property. Based on evidence presented during a civil suit, Albert could not control his spending and started going into debt. In 2002, again based on evidence presented during the suit, Albert agreed to transfer half of the Pender St. house to his son in exchange for Andy looking after the expenses. The agreement was not put in writing and Andy was never registered on the title. The Pender St. property was sold and a new home was purchased on Captain’s Way in Richmond, partly with the proceeds of the sale of Pender St., and partly with Andy’s money. Title to this property was registered in both Albert and Andy’s names. Then problems arose after Albert continued piling up debt, according to evidence presented at trial. It was Andy’s position that since he had made the payments on the Pender St. property as well as the Captain’s Way home, his father Albert’s portion of the Captain’s

Know your Rights when you Share a Property If you buy a home with your spouse or another person this year, you will have to decide how to take title together. It can be either as a joint tenancy or tenancy in common. It is important that you first understand the main difference between these two options before making your decision. In a tenancy in common, if one of the owners passes away, they can leave their share of the property to anyone they choose. However, in a joint tenancy, there is a principle called survivorship. What this means is that if two owners are joint tenants and one dies, their share automatically passes to the surviving joint tenant upon death. They cannot leave it to anyone else in their will. There are some tax advantages in holding property as joint tenants as it can reduce estate taxes. David Ramnarine and his common law partner, Meera Ragoo, bought a home together at 840 Eighth Street in Mississauga in September 2007 and took title as joint tenants. David passed away in July 2010. His share of the home automatically transferred to Meera, by the principal of survivorship. However, his mother, Joyce Ramnarine, produced an agreement that was apparently signed by David in 2009, where he said that he was holding all of his property in trust for his mother. Joyce claimed that this agreement broke the joint tenancy, since it proved that David never intended to hold the property solely with Meera. Meera claimed that she never was told about the agreement, it was only produced after David passed away and that the signature was a forgery. The agreement was never registered against title to the property. In trying to figure out the answer to this case, the judge had to look at whether it was possible to break a joint tenancy once it was already created. In 1987, in the case of Horne v Evans, an unhappily married couple owned a family home as joint tenants. The hus-

band, shortly before his death, transferred his share of the property to himself, without telling his wife. He did this to try and break the joint tenancy, so that he could leave his share of the home to someone else. The reason this breaks the joint tenancy is that an important element of a joint tenancy is that you acquire your interest in the property at the same time as your partner. By transferring the property to yourself, you have now technically acquired your interest at a different time, so this breaks the joint tenancy. In Ontario, you are permitted to transfer property to yourself, even though the concept is hard to understand. However, also under Ontario family law, you cannot sell or transfer your share of a family home without your married spouse’s permission. This is why Horne’s wife challenged the transfer, saying that since she did not give her permission, it shouldn’t count. The judge disagreed, saying that people should have the right to change the way they hold title, if it is permitted under Provincial law. After looking at these and other cases, Justice J. Seppi ruled on July 20, 2011 that there was no evidence that could reasonably support Joyce’s claim. David and Meera were still living together at the time of his death and there was no witness to the agreement that he apparently signed. The judge stated that they were still joint tenants at the time of his death, so she inherited his share of the property. The real lesson here is that before you agree to ever take title as joint tenants, understand the consequences, so that you do not have to try and figure out how to break it later if you change your mind. August real estate market experiences increases in listings, sales, average price

he REALTORS® Association of Hamilton-Burlington (RAHB) reported 1203 properties sold through the RAHB Multiple Listing Service® (MLS®) in August. This represents an 8.8 per cent increase in the number of sales over August of last year. The average sale price of $383,561 was an increase of five per cent over the previous August. There were 1640 properties listed in August, an increase of eight per cent over August of last year. End-of-month listing inventory is 2.6 per cent lower than last year. “We saw more new listings than we did last year at the same time,” said RAHB CEO Ross Godsoe. “yet new listings are still below average for the month. Sales, however, are about one per cent higher than the ten-year average.” Seasonally adjusted* sales of residential properties were 8.8 per cent higher than the same month last year, with the average sale price up three per cent for the month. Seasonally adjusted numbers

of new listings were 8.8 per cent higher than the same month last year. Actual overall residential sales were 8.5 per cent higher than the previous year at the same time. Residential freehold sales were 13.7 per cent higher than last year while the condominium market saw a decrease of 11.2 per cent in sales. The average sale price of freehold properties showed an increase of one per cent over the same month last year; the condominium market saw an increase of 13.6 per cent when compared to the same period last year. The average sale price is based on the total dollar volume of all residential properties sold. Average sale price information can be useful in establishing long term trends, but should not be used as an indicator that specific properties have increased or decreased in value. The average days on market remained constant at 45 days in both the freehold and condominium markets. Year to date, listings are down less than one per cent compared to the same period last year, while sales are 1.2 per cent lower. The average sale price for the first half of the year is 7.7 per cent higher than the same period last year.

How Much Life Insurance Do I really Need??? by Gianni Leonetti, Leonetti Consulting Many consumers struggle with determining how much insurance they need. Even after they’ve spoken to an insurance agent or broker it may still not be clear why they’ve purchased the amount they have. Is it enough? Is it too much? Is $100,000 enough? Is $1,000,000 too much? For most of us, we want to maintain our dependents’ standard of living should we die. And it’s that standard of living that we should focus on. Not the mortgage, not the children’s education, not buying groceries. None of those qualify as catastrophic losses. In addition, most of us want to make sure we’re not overinsured. This begs the question – how are we maintaining our current standard of living? How is the mortgage being paid? Money for the children’s future education? Groceries? For most of us the answer is our paycheque. We maintain our standard of living from

our paycheque. And it’s our paycheque we lose in the event of our death. From a strictly financial perspective, that’s all most of us are – our paycheque. If we replace the buying power of our paycheque upon our death, I think it’s a safe assumption that our dependents can continue to maintain their current standard of living. No one will be insurance rich, but we’re not leaving them in the poor house either. They continue to pay the mortgage, and still save for the children’s education. With an income stream over a period of time we now have a very straightforward present value calculation we can do. What is the lump sum of capital needed to reproduce an income over a period of time? That lump sum of capital we assume is the amount of life insurance we need.

Let’s look at an example. Take an income earner who is 35, making $75,000 per year. Assume 5% interest and 3% inflation. Let’s further assume that we don’t need the full 75,000 to continue the standard of living. With one income I normally use a rule of thumb of 80% replacement, with two incomes I generally assume 60% replacement. In this case lets use 60% of the $75,000. A million dollars. That million dollars produces an indexed income of $45,000 for 30 years with nothing left over. Nobody got rich here, but we didn’t leave the dependents short either. Focusing on the million dollars as a large number is an emotional decision not a financial one, and could leave your dependents short. Since all of these calculators are at best estimates of future needs, I prefer to have use a range instead of one absolute number. The second way to look at this is to assume a

replacement income just until the kids are out of the house. At that point we assume the surviving partner would be financially independent and on their own. If we rerun the same case as above but with 20 years instead of 30, we end up with $754,336.02. That amount of capital produces the $45,000 of income for 20 years with nothing left over. So in this case we should be looking at total insurance coverage in the range of $750,000 to 1,000,000. Anything less and we would be potentially underinsured. In conclusion, all situations are different however it makes sense to work the numbers in reverse to get the true value of that insurance policy you have purchased.
