Prices and Specifications
Prices and specifications are subject to change without notice. All prices quoted will be FOB our factories. If applicable, sales tax will be based on ship-to destination. Rottet Collection reserves the right to make changes in dimensions, construction, price lists, or product literature without prior notice. All measurements and weights are approximate and subject to change without notice.
Order Entry
All orders are subject to final acceptance by Rottet Collection. Receipt of our acknowledgment indicates acceptance of your order subject to the terms set forth on the acknowledgment.
Changes / Cancellation
All orders in production are considered firm orders and are not subject to changes or cancellation
Shipping
Rottet Collection will ship in accordance with customer instructions whenever possible. For convenience, Rottet Collection offers a guaranteed freight program (GFP).Rottet Collection will make our best effort to meet requested delivery dates. Transportation lead-times and delays including equipment problems, weather, general traffic, traffic accidents, customer warehouse space, labor disputes, customer changes, etc., that occur on a carrier will not be the responsibility of Rottet Collection. Furthermore, Rottet Collection will not be responsible for additional costs incurred due to delays.
Freight Damage and Claims
Rottet Collection is not liable for any damage to products that occur during transit or storage. The carrier assumes all responsibility upon acceptance of product. It is the customer’s responsibility to inspect products upon receipt and file any claims with the carrier. No product should be refused. If products are received damaged, a written exception should be made on the bill of lading and an immediate inspection be requested of the carrier. Concealed damage must be reported to the carrier within 10 business days from date of delivery. Failure to make claims shall constitute acceptance of the products and waiver any claims of defects, errors or shortages.
Returns / Refunds
Once an order has been confirmed and the transaction has been processed, we only accept cancellations to your order up to 24hrs after the order has been placed.
Our products are made to order; they are non-refundable and once an order is placed this is considered final sale.
If a product or piece has one or more of the following issues, we will offer immediate resolutions on a case by case basis, and in a timely manner. We value our customers' satisfaction and will do everything we can to make sure you are happy with your purchase.
• The wrong product was sent to you.
• The product is defective.
• The product has arrived to you damaged. Each order that leaves our warehouse undergoes a complete inspection, so that it arrives safely to you. If you believe the product is defective or has been damaged in shipping, photographs must be taken and shared with us immediately.
If credit has been approved, the standard terms for all Rottet Collection products are 50% deposit at time of order and/or remit the balance before shipment is released. If credit has not been approved, a 100% prepayment is required prior to production and Rottet Collection will invoice freight charges upon shipping. Acceptable forms of payment include a certified check or electronic bank transfer. For information on where to send check/ electronic bank information contact our Accounting Department. If a dealer or company check is submitted, three (3) weeks should be allowed for the clearance of the check. If electronic bank transfer is submitted, one (1) week should be allowed for the clearance of the electronic bank transfer. The order is subject to cancellation if payment in full is not received within three (3) weeks from the acknowledgment date. Unpaid service charges Past-due notices may result in orders being held until the situation is resolved. This credit hold could prevent orders from being placed into production or shipped. Orders not in production that are placed on credit hold for three (3) weeks will be subject to cancellation. Terms and Credit
Pricing and terms of sale apply to orders accepted by Rottet Collection, and no terms, stipulations, or conditions contained in the dealer's submitted purchase orders shall have any force or effect. Rottet Collection requires a completed and signed credit application from every dealer. Rottet Collection also requires dealers to provide a Blanket Certificate of Resale/Use containing valid sales tax exemption number(s) for their respective state(s).
LR Collection LLC, dba Rottet Collection (the “Company”) warrants its products to be free from defects in material and workmanship under normal use and service for a period of three (3) years from the date of the initial shipment to a Company authorized dealer, however certain components of such are subject to shorter warranty periods as described below.
This limited warranty applies exclusively to the benefit of the original purchaser of the product under conditions of normal residential usage only and will terminate in the event of resale or commercial use. Any product modifications by dealer or consumer, voids the warranty. The warranty does not apply to damage resulting from (a) normal wear and tear; negligence, abuse or misuse; (c) inadequate or improper maintenance, cleaning or care; (d) exposure to sunlight; (e) exposure to chemicals and/ or other liquids; (f) accidents; (g) any use for which the product was not designed; (h) commercial usage, which includes rental, business, institutional or any other non-residential use; or (i) transportation or delivery.
This limited warranty protects you only when you purchase a product from a Company authorized dealer and must be initiated through the dealer from which the product was purchased. All warranty claims must be accompanied by the original dated proof of purchase and contain a brief description, including pictures, of the defect in question.
The Company may examine the product and will decide, at its sole discretion, if it is covered under this limited warranty. If considered covered, the Company will either repair the defective product or provide an appropriate replacement. If the Company decides to replace a product it no longer sells, the Company will provide an appropriate replacement of equal or lesser value. It is the Company that determines, at its sole discretion, whether a product should be repaired or replaced and what constitutes an appropriate replacement. Any product repaired or replaced will itself be warranted only for the remainder of the warranty period of the original product. If it is covered by this limited warranty, the Company will pay the costs of repairs, spare parts, labor and travel for repair staff that the Company incurs, provided that the product is accessible for repair without special expenditure. All repair work must be authorized by the Company in advance.
Natural Materials
Certain products of the Company are made with a variety of materials found in nature. These include, but are not limited to, various wood and plant species, stones and minerals, shells and certain animal by-products. The Company warrants such materials to be free from defects in material and workmanship for a period of one (1) year from date of shipment to the dealer. However, certain changes in these materials over time are expected and are not considered defects and are not covered by the limited warranty. For example, Differences in grain character and color are naturally occurring variations and are not considered defects. Highly figured veneers are taken from areas of the tree that grow in different directions. This natural characteristic of the veneer causes tension and pulls the fiber of the wood, which can result in hairline cracks over and are not considered defects. Natural color changes, variations, or movement in lumber or veneer products, and exposure to extreme temperature changes and/or direct sunlight, may cause color and/or surface changes which are not considered defects
Fabrics /Leathers /Upholstery Materials
Certain products of the Company contain components that include fabrics, leathers, cushions and other filling materials. These materials may be found in upholstered beds, upholstered components, dining chairs, benches and stools. The Company warrants such components to be free from defects in material and workmanship for a period of one (1) year from date of shipment to the dealer. However, the following are certain exceptions to this warranty:
Wrinkles, scratches, insect bites, healed scars and other natural markings or color variations that occur in certain leathers are natural and are not considered defects
Exposure to extreme temperature changes and/or direct sunlight, may cause color and/or surface changes that are not considered defects. Some fabrics are washed to achieve a more relaxed appearance and softer feel. Wrinkling, puckering and shade variations are natural results of washing and should not be considered defects.
WARRANTY LIMITATIONS AND EXCLUSIONS
ANY AND ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE EXPRESS WARRANTY ON THIS PRODUCT, AND ON THE PARTICULAR PORTION OR PART OF THE PRODUCT IN QUESTION. THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL OR WRITTEN, EXPRESSED OR IMPLIED. IN NO EVENT WILL THE COMPANY BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE THIS PRODUCT.
Some states do not allow limitations on how long an implied warranty will last or the exclusion or limitation of incidental or consequential damages or provide other specific legal rights, so the above limitation may not apply to you.
Design and Patent Rights
All of the products shown in Rottet Collection catalogs and described in Rottet Collection’s price lists are, and remain, the property of Rottet Collection, with the sole right reserved to manufacture and to distribute. Some of the product designs shown are patented in the United States and will remain the property of Rottet Collection. Any reproduction of the products constitutes an infringement of patented copyright laws and will be subject to prosecution.
