Wear Hi Viz Riding Gear

Fall is my favorite time of the year to ride and this fall has been especially good. For me, riding in the cool, clear days before the snow falls is like the dogs getting out into the first snows of the year. I can’t say whether it’s the cold air in their lungs or the transition from a bland brown and yellow outdoors to bright white snow but they’re energized. They romp and play together like no other time during the year. They run, jump and explore, occasionally picking up a mouthful of snow to stay hydrated. I am happy and excited just watching them. This is precisely the way I feel as I cruise on my bike in the fall with cool air slipping under the helmet and through small intentional gaps – a not fully zipped zipper on my arms or chest, for example - in my gear. It’s cool but not uncomfortable. I can’t say exactly why it has that affect on me but I know that it puts me in a “flow” state that I can only find otherwise while racing or snow skiing. I mention this only because we’re less than two weeks away from Thanksgiving and today is a beautiful clear day with a temperature right at 60 degrees. As I write this, I can see and hear a small group of Harley riders crossing a short bridge a quarter mile from my living room window. Were it not for the imminent deadline for putting this issue to bed, I would be out riding myself. I hope you’re taking advantage of these nice days near the end of our season because, unfortunately, the forecast is not so good. Rather than 60 and clear, clouds, wind, precipitation, and temperatures decreasing into the 40s during day and

30s at night will be the norm. Unfortunately, we’re nearing the end of what has been an exceptional 2015 riding season. Yes, some will continue to ride no matter the weather but I hope those who put their bikes away when the weather turns gray and cold are taking advantage of these last few days. It’s a great way to set those memories to maintain the enthusiasm until the snow melts, the roads clear and we can once again get out for our fix.

It’s the Holiday season and this issue reflects the time of year. Included in this issue is our Holiday Gift Guide with motorcycle-related gift ideas for every rider. The Live It Right Dream Ride

18 Dreams Come True by Jay Wilgus

In a remote corner of southwestern Bolivia, beneath cloudless blue skies and a snowcapped volcano, we find ourselves atop the most massive expanse of whiteness either of us has ever seen, chasing faint black lines into a curved horizon that teases us with the promise of an island set just out of sight. Once the base appears below the now visible peak, we’ll chase it down as well and camp there for the night - with only the stars and critters as our company. During the two and a half years of frugal living we spent saving for this trip, dreaming of days like this sustained our momentum. Now we’re

living what we imagined and we’re convinced the beauty we find between the surreal salt flats of Bolivia’s Salar de Uyuni and the lush vineyards and red-rock corridors of the iconic Ruta 40 in northern Argentina is more spectacular than anything we envisioned.

South of the Salar, a 300-mile section of sand, gravel, and washboard leads to high alpine lakes where flamingoes paint pink streaks across turquoise lagoons and where llamas graze on green and yellow grasses beneath brown rocky outcroppings and gray moraine fields far above

the tree line. The only other traffic we see between the occasional settlement is either a Land Cruiser carrying sightseers from San Pedro de Atacama or vicuna running away from us as gracefully as an antelope would in the western United States. Russell always wanted to be a motorcycle police officer and, at age 21, he was hired by the Tampa police force. After several years in a patrol car, he advanced to motorcycle police officer. One of Russell’s proudest accomplishments had to be the formation of the Tampa motorcycle police training course. This training course became one of the most respected in the nation and the training that the officers received helped keep them safe while riding. Russell’s police career came to an end when his patrol car was rear ended by a drunk driver. His injuries forced him to retire. But his life in the motorcycle world was far from over. His riding with friends and family continued with great enthusiasm. After spending several years looking for the best place to retire, Russell purchased the land inside the Croom Motorcycle Riding Park just North of Tampa where he continues to ride and write. I was impressed with Russell’s ability to look at life, see what is really important, and put a humorous twist to the things that are not. Tales of the Moonlight Rider is an easy book to read for the average motorcyclist because we can all relate to the many stories, both the humorous and sad. Riding Arizona with Parts Unlimited by Blane Kamp Most people in the motorcycle business give up their passion to work in the industry. We’re always the busiest when the weather is best for riding. Occasionally, though, you get a chance to go to a warmer climate during a slow time of the year and ride. Parts Unlimited, a distributor of ours, organized their first ever Parts Unlimited Street Touring Ride in Scottsdale, Arizona. We qualified for this trip in the spring when we placed a big order with them. They gave us two rooms for three nights and took care of our meals and some drinks along the way. They had mapped out six different routes north of Scottsdale into the mountains that we could ride. The four of us met at the hotel on Friday, October 2nd. Phil Mann and Bob Burns set out on Monday, September 28th on their bikes and rode the 1,900 miles in three and a half days. That’s not bad for 82 and 87 year olds. Phil holds the record for the number of miles traveled in 6 months (113,000 miles) and Bob’s been putting on 20,000 miles a year since I met him 30 years ago. A couple of tough old boys, that’s for sure. My brother, Bruce, and I took off in the van, with motorcycles loaded in back on September 30th and made it down to Scottsdale on October 1st. The first night, Parts Unlimited had a big

reception with 28 different vendors giving away everything from tires to brake pads and even seats. During the three days there, Parts Unlimited made sure that everyone attending won something. They also gave us a set of tires, brake pads and other accessories at deep discounts before we left . Our group got a set of tires that averaged $100 each! A very nice perk. It was a great night of dinner, drinks and prizes covered by Parts Unlimited and their vendors. Saturday morning, we decided to ride up toward Payson. Bob has two

sons, David and Bob Jr., who joined us for the ride. We Rest stop headed out 87 toward Payson with David in the lead. It’s a road with big sweepers that cuts through the mountains. David commented that he used to ride with a group of K1200RS riders who would average 100 mph all the way to Payson. We stayed in the 10-over range just in case the Sheriff was waiting around a corner. Next, we hit 260 toward Cottonwood; a technical road through the mountains. We all enjoyed it immensely.

87-year-old Bob Burns with a friend. When we got back to the hotel, they took us out by bus to a Fiesta Party. There was great authentic Mexican food at a ranch out in the middle of the desert. A great way to end the day. After breakfast the next day, we went to Prescott by way of back roads. Once we turned onto 89 going into Prescott, we were in heaven. The road went up into the mountains. Its surface was that course asphalt that the tires stick to like glue. We got to the top of the mountain to find it had just rained. This slowed our ride considerably all the way into Prescott. We just touched the surface and had some spectacular rides in Arizona. We missed Jerome and Sedona, not to mention some roads snaking around Flagstaff. So many good roads and only so much time. Parts Unlimited had a big dinner that night and gave away more prizes. They did a great job putting on the event and making everyone feel special. It’s just what was needed after a long summer in the motorcycle industry. A special thanks to Lisa and Kathy for organizing the event.

Dram Shop Law by Dondi Vesprini It is hard to believe that we are already approaching the end of 2015. It seems like it was not that long ago that motorcyclists across our great State were waking their bikes up from hibernation after last winter and getting them road ready for the riding season. Nonetheless, it will soon be time to winterize the bikes again and put them away for this winter. The hope of most riders is that we get some borrowed time from Mother Nature that lets the diehards take advantage of a few more rides in December before the temperatures dive and the roads become covered in ice and snow. However, cold temperatures and slippery roads aren’t the only hazards to be wary of if you venture out for a ride during the holiday season. It is no secret that once December comes, holiday parties abound which increases the chances of sharing the road with motorists who have had a little too much “holiday cheer� and are driving under the influence of their favorite intoxicating beverage. Michigan law has special rules that apply to hold responsible the last restaurant, bar, hotel or other retail licensee that sold, gave or furnished alcohol to the drunk driver that causes an accident. These laws are sometime referred to as “dram shop� laws, referencing back to liquor establishments that served alcohol by the “dram� which was a unit of measurement used during the colonial period in the United States. Under Michigan’s dram shop laws, a retail licensee is prohibited from selling, furnishing or giving alcohol to a person who is “visibly intoxicated.� If alcohol is provided to such a person, and that person injures someone by reason of the unlawful providing of the alcohol, the injured person may bring a claim against the retail licensee who, by unlawfully providing the alcohol, caused or contributed to the intoxication of the wrongdoer. In 2006, the Michigan Supreme Court made clear that the injured person must prove that the retail licensee served the liquor while the person was “visibly intoxicated� meaning that the fact that the person was intoxicated would have been apparent to an ordinary person. This means that it is not enough to rely on the person’s blood alcohol level and arguments that

someone with that high of a level must have been drunk. It is an objective standard in that it must be affirmatively proven that the person’s intoxication was apparent to ordinary persons at the time the person was served the alcohol. Also, there is a shorter statute of limitations that applies to dram shop cases. Unlike the statute of limitations that may apply to a claim against the drunk driver, you must file a lawsuit against the liable retail licensee within two years of the date of the personal injury caused by the drunk driver. Further, it is worth keeping in mind that an injured person is required to give written notice to all potential Defendants within 120 days after entering into an attorney-client relationship for the purpose of pursuing a dram shop claim. Failure to give such written notice within that time is grounds for dismissal of the case unless it can be proven that sufficient information for determining that a retail licensee might be liable under this section was not known and could not reasonably have been known within that time period. I wish you and those that you hold dear a very happy holiday season. I hope your season is filled with family, good friends, good food, and a couple unseasonably warm days to get your last fix of riding in before you shut it down for the winter! BMW SEM Launches 7th Toys for Tots Campaign Plymouth, MIchigan - John Horner, owner of BMW Motorcycles of Southeast Michigan (BMWSEM), has announced that his dealership is once again accepting donations for the Toys for Tots drive this Christmas season. This year’s drive will mark the seventh year in which the dealership has participated.

Seeing 2015 In My Rearview Mirror by Jason Waechter, Esq. When I sat down to write this month’s article, I was taken aback to realize it’s already December. How 2015 managed to slip by so quickly, I have no idea. In the Midwest, this is the season for putting motorcycles to bed for the winter, celebrating with friends and family, looking back at the year gone by and looking forward to what the next year will bring. Through my work as The Motorcycle Lawyer, and along with my amazing team of lawyers, paralegals, and administrative staff, I get to do a lot of cool stuff during the year… The most important of which is helping injured motorcyclists get justice after a crash. Every year, we look for ways to give back to the biker community more generally, and this year was no exception. Of course, we are always promoting motorcycle awareness and safety through our bumper stickers, Biker Discount Card, participation in swap meets and biker events, and, of course, sharing important legal and safety information in articles, on social media, and through press releases. This summer, we also became the exclusive sponsor of the ABATE Awareness Program here in Michigan. ABATE Awareness is an educational program that goes into driver education classes and teaches young drivers about motorcycle awareness and safety. We, like our friends at ABATE of Michigan, believe that driver education is the most important method we can use to try to prevent motorcycle crashes, injuries, and deaths. And speaking of giving back to the community, last month we got to participate in a great event for children at the Methodist Children’s Home Society (MCHS). We had a wonderful time meeting kids, parents, and volunteers and just being a part of this great community. This year was interesting from a legal perspective for motorcyclists. In Michigan, Nathan’s Law took effect, requiring that all driver education programs in the State of Michigan include education on motorcycle (and bicycle) awareness and safety. Ownership laws changed slightly as well in Michigan; now, a motorcycle owner includes “a person renting a motorcycle or having use of a motorcycle under a lease for a period that is greater than 30 days, or otherwise for a period that is greater than 30 consecutive days,” (MCL 500.3101). Previously, the owner was the person on the bike’s title. Another Bill in Michigan could affect local and out-of-State bikers: SB 527 would amend part of the Michigan Vehicle Code (MCL 257.658) and force all motorcyclists (including passengers) to wear a helmet, without exception, when they’re on a motorcycle. Of course, Michigan became a helmet-optional state (under certain conditions) back in 2012, so this is quite an aboutface. We will be watching (and reporting on) the progress of this Bill as it moves through the Legislature. Nationally, lane-splitting was a hotly debated issue, especially in California. A major research study by UC-Berkeley seemed to show that lane-splitting can be a safe practice for savvy bikers, and a Bill was introduced to try to make it legal. Ultimately, the bill was struck down, and lanesplitting remains not legal, but also not illegal, in California (for now). Other states have also been examining lane-splitting safety, and I’m certain that

The Harley-Davidson Death Wobble by Franz Hoffer The Harley Wobble, or as it is now commonly called the “Harley-Davidson Death Wobble,” is something I’ve heard about for years but never really looked into it. I have owned two Harley-Davidson motorcycles: a 2001 Electra Glide Standard and my current ride, a 2011 Road Glide Ultra. I owned the Electra Glide for 10 years and put 46,000 miles on it, including several trips to the Sturgis Rally. I never experienced any kind of wobble despite having run it up to 105 mph on a lonely highway in Wyoming. I have 27,000 miles on my Ultra including trips to Gatlinburg, two trips to Sturgis, an east coast trip, Rolling Thunder, and our latest trek just this year through Upper and Lower Michigan. I have had that bike up to 98mph and experienced no wobble whatsoever. I can’t say I even know anyone that has experienced the wobble or crashed due to it. So, what exactly is it, why does it happen and just how dangerous is it? I think it’s something of which all riders, not just Harley riders, should be aware. Everything I’ve read suggests that this is not a problem of the bike owner doing improper maintenance or a driver riding wrong. It can cause the rider to lose control of the bike. HarleyDavidson has admitted that some bikes are susceptible to a wobble or weave, but has qualified that statement by saying it depends on the bike’s speed, does not cause accidents in and of itself and also happens on other bikes produced by other manufacturers. Harley-Davidson has also said that the wobble can also be caused by bike owners adding certain aftermarket parts and owners ignoring sections of the owner’s manual. The “wobble” problem has been described as centering on the swing arm, the rear suspension mounting, the transmission, and engine mounting to the frame of the motorcycle. When the engine is not properly seated due to manufacturing defect, customization, or worn out parts, it can develop what is termed an elastic or jumping back and forth motion between the swing arm

and frame. According to articles I read, the problem can result in a loss of control and cause serious injuries. Riders have experienced and observers have seen this wobble effect and the impact it has on the rider’s ability to control the motorcycle. The right way to address the wobble should it occur is to completely roll off the throttle to decrease speed. Applying the brakes will exacerbate the wobble and make the bike unmanageable. If the rider hits the brakes, he/ she will likely be thrown off the bike as the wobble will get extreme. I asked Jerry Battaglia, owner of Jerry B’s Cycle Works on Harper in St. Clair Shores, Michigan, about this issue. “I’ve learned a few things over the years about this wobble,” said Jerry. “This problem exists in most makes, not just Harleys. Some models come with steering dampers which can drastically reduce the problem. Older touring models are more likely to experience the wobble due to worn motor mounts. The rear tire, swingarm, transmisson, and motor are connected together and float in the frame via rubber motor mounts and two stabilizer links. The rear tire can move side to side if the mounts or stabilizers are worn. Soft sidewall tires, low air pressure, loose fork bearing adjustment, and worn steering neck bearings can also contribute to the wobble.” There you have it my friends: the opinion and experience of an expert.
