Gear Up for the 2015 Riding Season We have what we think is a terrific issue for you this month. Not only did we test the new BMW S 1000 XR Sport Adventure motorcycle, we also rode the Zero RS electric motorcycle. Check our comprehensive review of each in these pages. Random Ramblings of a Rare Bird columnist, Mike Mekinda, reviewed the Scorpion Passport Riding Suit for this issue. According to Mike, there’s much to like in this suit but the news isn’t all good. Read his latest contribution to get the full picture. Franz “The Preacher” Hoffer and his crew opted out of a trip to Sturgis this year and instead toured both the upper and lower peninsula’s of Michigan. If you’re looking for a wide-ranging tour that can be completed in five days, this might be it. Be sure to check out The Preacher’s column in these pages. There’s much more in this issue including upcoming events. Thank you for reading. We hope you enjoy this latest issue. Feel free to share it with your riding friends. Please patronize our advertisers. By supporting them you’re also supporting this publication. Have fun. Ride safe. See you on the road or at and event,

2016 BMW S 1000 XR Adventure – Yes, Dirt - No by Ray Peabody
John Horner, owner of BMW Motorcycles of Southeast Michigan, provided his demo XR for this test. The XR offers much of the same technology as the R 1200 RS we tested a couple months ago, including ABS brakes, Automatic Stability Control (ASC), Rain and Road driving modes, electronic cruise control, ride-by-wire throttle control, and Shift Assist Pro (which allows clutchless shifting beyond second gear.) Like the RS, the XR is equipped with cartridge-style forks instead of the telelever front suspension found on most BMWs. However, instead of a driveshaft, a chain delivers the engine power to the rear wheel on the XR. The test bike was also accessorized with hard bags and an Akrapovic exhaust system. Prior to the test, I had heard that the XR was 33rd Annual especially tall. What I found when I settled into the 33.1 inch high Motorcycle & Car Show and Swap Meet saddle was that I could Motorcycle Classes place both feet flat on 1. The S 1000 XR is the latest new model from BMW. Positioned as a “sport adventure” motorcycle, it’s powered by a 160-horsepower, water-cooled, fuelinjected, four-cylinder, superbike engine. The XR definitely has the “sport” element nailed. Tall, with little bodywork and a small windscreen, it looks the “adventure” part, too. The main question before beginning this test was whether the XR could successfully function as both a sporting road bike and a adventure-oriented off-road enduro. My pre-ride thinking was that a 160-horsepower, high-revving, four-cylinder might have a little too much juice for riding around in the dirt.
impressive. It revs high and fast with accompanying speeds. I noticed a vibration in my hands and feet at several points as I increased my speed. Several tests indicated that it was most noticeable in the 4,500 rpm range in lower gears and would appear at a slightly higher rpm in the higher gears finishing at approximately 5,500 rpms in sixth gear. The vibration was short lived in each gear and didn’t distract much from the ride. If you were to cruise in the rpm zone in which the vibration occurs, it would likely be more than a distraction. Following John Horner’s advice, I rode in the “Rain” traction mode much of the time; especially when the roads were rough. The reasoning: when you hit a bump, it’s easy to inadvertently twist the throttle slightly which, with the ride-by-wire throttle, could generate some unanticipated acceleration immediately after the bump. It was good advice. The “Rain” mode didn’t hinder the XR’s acceleration when I wanted it. I suspect that, if someone was to ride the XR as a true adventure bike in the dirt, the combination of “Rain” mode and ASC might prevent the engine from putting too much power to the rear wheel and spinning all the time.

Continued from previous page The handling is exemplary. The wide, off-road style handlebars provide effortless, precise control. The 502 pound wet weight is evenly distributed; the bike is well balanced not only at slow speeds but also while ripping through the curves. It’s not often that we would consider a tall motorcycle a sport bike but this one fits the bill, both performance and handling wise. The adjustable suspension, stiff with the factory settings, can be set up to provide both a comfortable ride by absorbing the frost heaves and potholes while also retaining the tension necessary for precise handling. Obviously, when you set up for comfort, some of the stiffness necessary is to precise handling is lost and vice versa. The key is finding that adjustment that provides sufficient performance for both. The seating position is quite comfortable. The rider sits almost straight up with only a slight forward lean to the handlebars. The footpegs are higher than you might find on another touring bike but not even close to a sportbike crouch. The higher pegs allow for greater ground clearance. The saddle is firm but not hard. The upright seating position allows the rider to see well in all directions. The transmission is just what you would expect in a superbike. Light effort, short throw, snick-snick-snick through the gears. The Shift Assist Pro feature that I used sparingly during RS test got a lot more use on the XR. Shifting up or down without the clutch is smooth once you get above second gear. The wind protection is what you would expect from an adventure motorcycle. The windscreen and small bodywork provide more protection than what you would get from a naked bike but less than that of an R 1200 RS or R 1200 RT. Since I like less bodywork and a smaller windscreen, the wind protection was more than adequate for me. In the cold of the late fall or early spring, I might prefer something more. Other technologies such as the heated grips, selfcanceling directional signals, and electronic cruise control help to make this more appealing as a sport touring motorcycle than an adventure bike. In the end, I didn’t end up taking the XR off-
road nor did we even venture onto dirt roads. The BMW S 1000 XR is not an adventure motorcycle in the traditional sense of the phrase. There is no doubt that some riders will adapt the XR to handle off-road duty but it will likely require significant modifications. The stock wheel and tire set – front and rear - are 17 inchers – not exactly optimal for off-road riding. Combine that with only 5.9 inches of suspension travel up front and 5.5 inches out back and any dreams of off road glory are dashed. (Modern off-road motorcycles typically have 12+ inches of suspension travel, front and rear.) If you’re considering the XR and want to compare it with similar motorcycles, the Ducati Multistrada is probably the most similar. Adventure motorcycles like the KTM 1190 or 1290 Adventure are more closely similar to the R 1200 GS in their off-road riding capabilities. Riding the XR on the street was a blast. The awesome highperformance engine is thrilling if not occasionally “buzzy.” Handling is exemplary. Between the near perfect balance and the wide handlebars, the XR flows effortlessly through the curves and at slow speeds. The ride modes and ASC help prevent the tires from breaking loose under power or on slippery roads. The stock suspension setup is perfect for street riding but would take some significant adjustments for dirt work. If you’re looking for seriously fast fun and prefer a comfortable ride to the pain of the sportbike crouch, the XR might be the perfect motorcycle for you. Many thanks to John Horner and his crew at BMW Motorcycles of Southeast Michigan (BMWMCSEM) for providing the S 1000 XR for this test. BMWMCSEM is located at 14855 N. Sheldon Road in Plymouth, Michigan. You can visit the store, call them at (734) 453-0500 or check them out at www.bmwmcsem.com. The BMW S 1000 XR is available at all BMW motorcycle dealerships. 2015 Zero SR, Charged Up Torque Monster by Ray Peabody You’re not going to be able to ignore the electric motorcycle market much longer. Electrics have all of the control, handling, and braking features of an internal-combustion-powered bike. They’re torquey and fast. They’re also cheaper to operate. One of the few weaknesses – riding range between recharges – is being overcome with new battery technologies. As range increases, so do the sales of electric motorcycles and scooters. According to a report from Navigant Research, worldwide sales of electric motorcycles and scooters are expected to grow from 5.3 million units annually in 2015 to nearly 6 million by 2024. As evidence of the burgeoning market, some of the biggest names in the motorcycle industry are either developing electrics in house or purchasing companies that have already developed the technology. Examples are abundant. Harley-Davidson announced its Live Wire electric motorcycle project last year. Polaris recently acquired Brammo and already has their Empulse TT electric motorcycle in the market. KTM offers two electrics; the FreeRide E off-road motorcycle (launched in 2014) and the new E-Speed scooter (available this year). Yamaha is planning to release two electric motorcycles to the market in 2016. Several other major manufacturers are working on electric vehicle development, too. Considering these investments in the development of the electric motorcycles, it’s clear that electric motorcycles are here to stay. The timing seemed right for us to revisit the electric motorcycle market with a test of the 2015 Zero RS. We last tested a Zero electric motorcycle – the Zero S - for our November 2012 issue. Dave Reynolds, owner of Life Cycle in Kalamazoo, provided the bike for that test and also offered the RS for this test. During our conversation, Dave told me that a range of 100 to 150 miles is within the range most motorcyclists typically ride on any given day. According to a survey by Total Motorcycle.com (http:// www.totalmotorcycle.com/BBS/
viewtopic.php?f=40&t=22229), he might be right. The survey indicates that only about 14% of riders ride more than 150 miles in a day; 70% report riding 100 miles or less on the average ride. Granted, the survey sample is quite small and those who participated self selected so the results might vary in a scientifically conducted survey. Before we get into our review, it is worthwhile to compare the S model we tested in 2012 and the RS model used for this test. That 2012 S model weighed in at 297 pounds and had an estimated 112 mile range. The 2015 RS weighs 414 pounds (458 pounds with the Power Tank accessory) and has an estimated range of 151 miles (185 miles with the Power Tank accessory). We assume that a larger battery pack accounts for the additional weight. The S model we tested three years ago had two operating modes: “Economy” and “Sport.” The 2015 RS offers those two modes plus a customizable third mode. Owners can customize that third mode with a smart phone and an app available from Zero. The 67horsepower RS can reach 60 mph in 3.9 seconds and has an estimated top speed of 102 mph. In Sport mode, it offers a maximum of 106 foot pounds of torque; more torque than the BMW S 1000 RR (83 ft lbs at 9,750 rpms) and just 7/10 of a ft lb less than the 2015 Ducati Panigale 1299. Dave took a few minutes to review the operation of the RS before I hit the road. Most of the switches work exactly the same as you would find on other motorcycles. The significant difference is
the way the rider starts a Zero. Simply turn the key to the “On” position. That’s it. No pushing the starter button. No noise at all. Just twist the throttle and you’re off. Dave had me start off in “Economy” mode but it wasn’t long before I switched to “Sport” mode. There’s nothing weak about “Economy” mode; the RS accelerates plenty fast enough in that setting. The bonus of “Economy” is that you don’t use up the battery so quickly. In “Sport” mode, the head-snapping torque of the electric powerplant is unleashed but the battery discharges more quickly. On the road, the RS is noiseless except for the wind whooshing past. Handling feels slightly heavy at slow, near walking speeds but once the RS hits eight to 10 mph, the heavy feel vanishes. The adjustable Showa forks out front and single Showa monoshock in the rear provide stable, controlled handling whether puttering along or ripping through curves. Twist the throttle hard from a dead stop in “Sport” mode and you’d better be hanging on tight; the RS is a rocket. The same can be said when you roll on the throttle at 50 mph. It’s exhilarating! When you ride fast, you have to be able to stop fast and under control. The RS comes equipped with disk brakes front and rear. ABS comes standard. For those worried about having to replace the battery, don’t. The Zero battery comes with a 100,000 mile warranty and an expected life of

Step Down Provision by Dondi Vesprini Webster’s dictionary has defined “accident as “an undesigned and unforeseen occurrence of an afflictive or unfortunate character. Accidents are events not done on purpose, and while most motorcycle accidents involve complete strangers, occasionally accidents occur involving family members. We have all heard of instances where a motorcyclist with a family member on the back of the bike gets in an accident that the motorcyclist caused. I have personally seen cases where the motorcycle operator had been drinking, driving too fast for conditions or simply not been paying attention and as a result has caused an accident. In these situations, the operator surely did not intend on getting in an accident, but accidents do happen and sometimes the negligence of the operator causes injury to the family member who was riding on the back of the bike. In these types of instances, the injured family member has a right to make a claim for pain and suffering damages against the operator just as they would if the operator were a complete stranger. However, unlike a claim made against a complete stranger, some insurance policies contain a “step down provision which significantly limits available insurance coverage if the claim is being made against a family member by a family member. For example, let’s say a husband is operating his motorcycle with his wife riding passenger on the back. The husband had too much to drink and negligently drives off the road and strikes a telephone pole, causing the wife to sustain significant personal injuries. The wife then makes a negligence claim with her husband’s motorcycle insurance policy and seeks the full $100,000.00 policy limits that the
husband purchased to cover him in the event he injures someone in an accident. If the husband’s insurance policy had a step down provision buried somewhere in the small print of the policy, the wife’s maximum recovery will be reduced to the state mandated minimum of $20,000.00, irrespective of the nature of her injuries or degree of negligence of the husband. These types of step down provisions are not usually found in the declarations page which sets forth the various coverages that are applicable to the policy. The provision is usually tucked away in the policy language itself and will usually state something along the lines that liability coverage is reduced to $20,000.00 if the claim is brought by a relative living in the same household as the insured. Insurance companies have argued such provisions are necessary to guard against fraudulent claims being made between plotting family members. While perhaps a valid concern, in many of the claims that I have handled, there are independent witnesses to the accident who would testify exactly how the accident happened which completely eliminate any prospect of the claim being fraudulent. Unfortunately, these step down provisions are a hard and fast reduction of the claim, regardless of the evidence that exists to extinguish any doubts about fraud. Motorcyclists should review their motorcycle insurance policies to see if it includes a step down provision. If it does, while accidents are accidents, it will be the injured loved one on the back of the bike who pays the price. As always, if anyone has any questions or if I can be of legal assistance to you or anyone you know who has been injured in a motorcycle accident, please don’t hesitate to contact me as I deal with these types of claims on a daily basis on behalf of injured motorcyclists statewide. Further, for those readers who are members of any motorcycle organiAugust 31, 2015 zations, clubs or groups, if you would like to have me come out to your group to speak or give a presentation on the legal rights of an injured motorcyclist or on any specific topic that your group may be curious about, please don’t hesitate to give me a call at (248-569-4646) or shoot me an e-mail at Dondi@buckfirelaw.com. Continued from page 8 - Zero RS 415,000 miles. Consider that the ZERO costs only about one cent per mile to operate and compare that with the cost of fuel for an internal combustionpowered bike. You can save up all of the money you would be spending on fuel to buy your next bike. Admittedly, I’ve been something of a critic when considering electrics. Short range was my biggest complaint. Now that electrics can travel
Continued from page 12 - Mekinda and the suit far too roomy. Scorpion’s Passport has plenty of length in the sleeves and legs, and is actually cut thinner than most “off the shelf” suits I’ve worn. The fit problem, strangely enough, is in the shoulder to crotch sizing. In this case, my torso is apparently longer than average for the size L. Even with the liner out, the crotch tends to lift and separate the manly bits, leaving them in the perfect positon to be crushed when sitting on the bike seat. Needless to say, this is not the ideal for a short ride, and excruciating for a longer excursion! While the fit may work for most, this is a serious deal-breaker (among other things) for me, and this suit is going back in its shipping box and on to a truck heading home. I believe the Scorpion Passport riding suit is a tremendous value, especially at closeout prices. It’s decent

150 miles between recharges, I’m changing my mind. The performance of electrics like the RS matches or exceeds that of a regular motorcycle. No, you won’t likely be taking long distance trips on electrics in the near future (although some people have.) For single day rides, an electric motorcycle or scooter might just be the right choice for fun, fast, inexpensive tours. MSRP: $15,995 ($18,490 with the Power Tank accessory). Dave has two of his 2015 demo models for sale at prices less than MSRP. looking, well designed, very well constructed and, as I’ve found with the many Scorpion products I’ve owned, will likely last a very long time. I would easily recommend this suit, but I’d either buy it where you can try it on first, or, if ordered online, be sure it can be returned if it doesn’t’ fit. I try to support my local vendors and dealerships, even if it costs a couple bucks more, but I always shop around. Occasionally, l find that internet deal that simply cannot be beat, and with this Passport, the price was incredible. Unfortunately, buying without trying just didn’t work out so well this time, and I’m eating the cost of return shipping - and bummed because a really nice commuter suit won’t be hanging in my garage, begging me to put it on and go for a ride. Sorry Scorpion, but this is one nice bit of kit that, while recommended, just won’t be added to my gear collection. Be seen, ride smart, stay safe and I’ll see you on the road! - mike

Why Bikers Should Go Back to School by Jason Waechter, Esq. about their rights or the laws that apply to them on the roads is… well, kind of boring. As The Motorcycle Lawyer, of course I would have to disagree. Motorcycle laws are the tools I use every day in order to protect bikers’ rights and get them the help they need after a crash. I always feel that knowledge is empowerment. Knowing the laws that apply to you as a motorcyclist could affect how, where, and when you ride, and potentially help keep you safe. That’s why my team and I are so committed to providing free information about motorcycle laws and bikers’ rights. It’s that time of year again… Time for new backpacks, new textbooks, and the expanding of the minds of kids across the country. Here in the Midwest, back to school isn’t necessarily just about heavier traffic, school bus delays, and more pedestrians; it’s the time of year when everyone is focused on and excited about learning. All the backto-school talk got me thinking about learning opportunities for motorcyclists: from familiarizing ourselves with our rights and motorcycle laws, to improving our road skills, to learning what to do in the event of the crash, there are plenty of ways motorcyclists can get a higher education. Often, motorcyclists assume that learning

training course, and I liked their program so much I actually donated one of my own motorcycles to MSF last year, to be used for rider training. If you think you want to brush up on some skills, or learn some new ones, check them out at www.msf-usa.org. If you think you have good riding skills, let me ask you this: do you know how to manage the scene of a motorcycle crash? Do you know basic first aid? Do you know when and how to properly move a downed biker, or their bike? If not, I recommend taking a Bystander Assistance Class by Accident Scene Management, Inc. (ASMI). For the record, I’m not formally affiliated with Accident Scene Management, Inc., and neither is my firm. However, I like their program and think it’s so important, I regularly provide classroom space free of charge to host these classes, and I provide information for a legal portion of the Bystander Assistance Course. In fact, I think the information in the Bystander Assistance Course is so valuable that I put a member of my team, Debbie Parinello, through EMT school so that she could become an ASMI instructor and teach Bystander Assistance. The goals of the course are to lower the number of people, including rescuers, injured or killed at motorcycle crash scenes, and increase first responders’ effectiveness by training bystanders to tend the injured and manage the crash scene until EMS arrives. I know we are all busy and I also know that, as the motorcycling season starts winding down, it’s hard to commit to motorcycle education when you want to be out riding. Still, I encourage all motorcyclists to make some time and take advantage of the learning opportunities available. You could always wait until the season ends, and then extend your riding season by focusing on motorcycle education until the weather gets better. Empowering yourself with education could make your next riding season that much better, and could potentially help save a motorcyclist’s life… maybe even your own! The Preacher Speaks About ...
Pure Michigan
Harley-Davidson
by Franz Hoffer Since we decided not to go to Sturgis this year, we put together a “Pure Michigan” tour covering some 1,800 miles over five days in this beautiful state. I have a penchant for naming rides and called this one the “Don Peyok Pure Michigan Memorial Run.” Don was the father-in-law of one of our ride participants…or as they call themselves, “The Preacher’s Disciples.” Don passed away last year after a long illness. He was an avid Harley rider. His 2006 Heritage Softtail has 70,000 miles on it; all Michigan miles. Don’s son-in-law procured the bike, took it to Jerry B’s for a good once over, and, voila!, a new Harley enthusiast was born just in time for our ride. (Once he got that Harley, he parked his Yamaha V-Star; I think he’s using it for coat rack or a plant holder.) We left Sterling Heights on Monday morning, July 29th at 6 a.m. There were four of us as we headed up I-75. We picked up Disciple #5, and then stopped to pick up Disciple #6 (aka Jimbo) in Grand Blanc. We arrived at around 8:30 a.m. Jimbo and his wife, Carolyn, had a nice spread for breakfast. After gorging ourselves, we got back to I-75 and headed north for about 100 miles before exiting. We took US-23 North along the east coast of Michigan, also called the “Sunrise Side.” We passed through many small towns and villages while having the majestic blue Lake Huron as the backdrop almost the entire way. When we stopped for gas in Alpena, an elderly woman who had just finished gassing up her cage pulled up next to me, rolling down her window. I thought she was going to ask me for directions. Instead, she held up a patch that read, “John Cousins 1990 / 2013.” Then she said, “Thanks for wearing your helmets. My grandson didn’t and it cost him his life.” A tear trickled down her weather-worn face as she drove off. We rode on and crossed the Mackinaw Bridge at around 2 pm. Construction on the bridge forced us to ride in the center lane; the part that is grated. Riding the grating makes your front end flutter and, looking down through the grating, you see the confluence of Lake Michigan and Lake Huron swirling 248 feet below. It did not look friendly down there. While not everyone liked it, I thought it was cool. Once across the bridge, we continued north, stopping only for a short rest and gas. station told us that I-75 was closed about 5 miles ahead and suggested we take Mackinaw Trail into Sault St. Marie. Since our next stop was the Soo Locks, this was good advice. We reached the Soo about 45 minutes later. What an engineering marvel the Soo Locks are, moving ships from the level of Lake Huron via the St. Mary’s river to the level of Lake Superior and vice versa. We were lucky enough to see a huge freighter crawling through. We then turned west on US123 towards our day-one destination of Paradise, Michigan. We arrived there about 7 p.m. We had a good meal, plenty to drink and spent the night at Curlee’s Motel; not exactly four stars but good enough for six tired and inebriated bikers. Our day-two destination was about 272 miles away in Silver City at the entrance to the Porcupine Mountains on the western edge of the Upper Peninsula. The weather was muggy. Before long, the skies opened up and baptized us in one of those all-day, steady rains that vacillated between a light drizzle and incredible downpours. We stopped at Whitefish Point and spent time at the shipwreck museum – worth the stop. We headed west and visited the Lower Tahquamenon Falls but decided to skip the Upper Falls. It was raining steadily. The mosquitoes were rabid and as big as small birds. We continued on US-123 to US-28 in Munising where we stopped for lunch at the “Dog Patch.” We then rode US-41 through Marquette where we caught Highway-38. The rain finally stopped and the sun came out. We followed Highway-64 (also known as the 107th Engineers Hwy) into Silver City, arriving around 6:30 p.m. We stayed at the American Inn, a very nice place located on the shore of Lake Superior. The Inn offered all the essentials: a bed, a restaurant, a bar, and a beautiful view.

Continued from previous page On day three, we headed into Porcupine Mountain State Park and visited the “Lake of the Clouds.” A rugged rock cliff overlooks the lake at about 500 feet. It’s called the Lake of the Clouds because of the way the clouds reflect and shimmer off of it. We spent a good hour there and, to be honest, I could have spent another hour enjoying “God’s Great Church of the Outdoors.” Next, we rode up the Keweenaw Peninsula, which juts out into Lake Superior, to Copper Harbor. It was a reflective, scenic ride. We took a quick side trip to Gay, Michigan to have our pictures taken in front of the “Gay Bar.” There were about 20 or so other bikers with the same idea.
Once in Copper Harbor, we had a refreshing lunch at the Tamarack Inn. You haven’t lived till you’ve had UP Pasties with gobs of rich gravy. The next stop was Brockway Mountain Parkway which rises several hundred feet above Copper Harbor and Lake Superior with many scenic outlooks. It was a little scary. The parkway was under construction. We rode over long patches of gravel road with hills and curves with steep drop offs on the shoulder but we all made it. Our day-four destination was Petoskey, Michigan in the Lower Peninsula, approximately 351 miles away. Weather could have been a bit warmer; temps were in the low 70’s. Once across the Mighty Mac, we headed down I-75 for about 20 miles then cut west to catch M-119 and ride the “Tunnel of Trees.” M-119 runs through an area along Lake Michigan with beautiful homes and majestic forests acting as a canopy over the road for about 35 miles. We spent the night in Petoskey, a beautiful northern Michigan town. On day five, which also happened to be July 3rd,, we rode the final 370-miles home. Traffic going south was light. The north-bound traffic was congested and frequently came to a dead stop. I pulled into my driveway about 5 p.m. I cracked a cold one, relished the memories of our just completed “Don Peyok Pure Michigan Run”and then washed my bike. I skipped the 2015 Sturgis Rally - the 75th Anniversary - this year due to the expected mass of one million people and extremely high prices. I did follow the Rally and, as is my tradition, present the following stats: -1.0+ Million attendees. -1,501 Moving violations -4,557 Warnings issued
