TURKS AND CAICOS ISLANDS FISHERIES PROTECTION (AMENDMENT) REGULATIONS 2014 (Legal Notice 19 of 2014) MADE by the Governor under section 3 of the Fisheries Protection Ordinance.
Citation and commencement 1. These Regulations may be cited as the Fisheries Protection (Amendment) Regulations 2014 and comes into operation on 1st July 2014.
Interpretation 2. In these Regulations “principal Regulations” means the Fisheries Protection Regulations.
Regulation 14 amended 3. The principal Regulations are amended in regulation 14(2) by deleting paragraph (c) and substituting the following— “(c) turtles— (i) hawksbill turtle (eretmochelys imbricata) a minimum curved shell measurement of 18 inches in length and a maximum curved shell measurement of 24 inches, measured from the anterior (front) edge of the nuchal scute to the posterior (back) tip of the longest supracaudal scute; (ii) green turtle (chelonia mydas) a minimum curved shell measurement of 18 inches in length and a maximum curved shell measurement of 24 inches, measured from the anterior (front) edge of the nuchal scute to the posterior (back) tip of the longest supracaudal scute;”.
Regulation 17 amended 4. The principal Regulations are amended in regulation 17—

(a) by deleting the period at the end of paragraph (b) and inserting a semi-colon; (b) by inserting after paragraph (b) the following— “(c) take any turtle of the species kemp’s ridley turtle (lepidochelys kempii), leatherback turtle (dermochelys coriacea), loggerhead turtle (caretta caretta) and olive ridley turtle (lepidochelys olivacea); (d) export any turtle or any turtle product from the Islands, except for scientific research purposes and with the a valid CITES permit from the Director; or (e) keep any species of turtle in captivity, except where rescue or rehabilitation are essential to preserve the life of the turtle.”; and (c) by inserting following—

“(1A) Any person taking a turtle shall ensure that the turtle remains alive and in whole condition after being taken, until landed at that place in the Islands where it is to be sold, processed or used for personal consumption or consumption in the home.”.
Regulation 17A amended 5. The principal Regulations are amended in regulation 17A— (a) by inserting before the existing provision, the subregulation designation “(1)”; (b) by inserting after the word “export” the word “queen”; and (c) by inserting following—

“(2) The restriction imposed by subregulation (1) shall not apply to the export of shells or pearls, or pearls or shells worked into jewellery or shell craft items, if the shells or pearls were harvested outside the period specified in that subregulation and are intended for non-commercial or personal purposes.”.

EXPLANATORY NOTE (This Note is not part of the Regulations) These Regulations amend the Fisheries Protection Regulations. Regulation 3 amends regulation 14 to provide new minimum and maximum measurements in respect of hawksbill and green turtles. Regulation 4 amends regulation 17 to provide further restrictions relating to the taking of turtles. Regulation 5 amends regulation 17A to restrict the export of queen conch during 15th July to 15 October in each year. The restriction does not apply to the export of shells or pearls or pearls or shells worked into jewellery or shell craft items, if the shells or pearls were harvested outside the specified period and are intended for non-commercial or personal purposes.
