AN ORDINANCE TO PROVIDE FOR THE APPLICATION OF SECTION 5(1)(C) OF THE RETIRING ALLOWANCES (LEGISLATIVE SERVICE) ORDINANCE TO CHIEF MINISTERS WHO RETIRED PRIOR TO 2003 AND DID NOT BENEFIT FROM INCREASE IN RETIRING ALLOWANCE.
ENACTED by the Legislature of the Turks and Caicos Islands.
Short title and commencement 1. This Ordinance may be cited as the Retiring Allowances (Legislative Service) (Special Provisions) Ordinance 2015 and shall come into operation on such day as the Governor may appoint by Notice published in the Gazette.

Application of section 5(1)(c) of Retiring allowances (Legislative Service) Ordinance 2. (1) Subject to section 3, section 5(1)(c) of the Retiring Allowances (Legislative Service) Ordinance shall apply to a Chief Minister who retired prior to 2004. (2) The section shall apply from the date of commencement of the Retiring Allowances (Legislative Service) (Amendment) Ordinance 2004, which is 3 January, 2005.
Limitation of section 2 3. Section 2 shall not apply to a Chief Minister who though retired prior to 2004, benefited from the increase in the retiring allowance provided in the Retiring Allowances (Legislative Service) (Increase) Ordinance, 2004.
Back pay of affected Chief Minister authorised 4. It is authorised that any Chief Minister affected by section 2 shall be paid back the difference of the amount he has received, or is receiving, with the amount which would have been payable in terms of section 5(1)(c) of the Retiring Allowances (Legislative Service) Ordinance. __________
