IMMIGRATION (AMENDMENT) (NO.2)REGULATIONS 2013 (Legal Notice 49 of 2013) MADE by the Acting Governor under section 78 of the Immigration Ordinance.
Citation and commencement 1. These Regulations may be cited as the Immigration (Amendment) (No.2) Regulations 2013 and shall come into operation on 1st November 2013.
Interpretation 2. In these Regulations “principal Regulations” means the Immigration Regulations.
Amendments of Schedule 4 3. Schedule 4 to the principal Regulations is amended— (a) in Part A, by inserting after paragraph 7 the following new paragraph— “7A. (1) An application for an extension or renewal of a work permit by a self employed person must be made 30 days before the expiration of the existing permit. (2) Where an application for an extension or renewal of a work permit is made after the work permit expires the applicant shall be liable to pay a penalty fee of $250 in addition to the fee for the work permit.”; (b) in Part B, by inserting after paragraph 17 the following new paragraph— “18. (1) An application for an extension or renewal of a work permit by an employed person must be made 30 days before the expiration of the existing permit. (2) Where an application for an extension or renewal of a work permit is made after the work permit expires the applicant shall be liable to pay a penalty fee of $250 in addition to the fee for the work permit.”.
Amendments of Schedule 8 4. Schedule 8 to the principal Regulations is amended— (a) in paragraph 2—

(i)
in subparagraph (2)(da) by deleting “$300” and substituting “$500”; and
(ii) in subparagraph (2)(db) by “$150”and substituting “$300”;

(b) by deleting paragraph 3 and substituting the following— “3. There shall be payable upon the issue of a Temporary Work Permit, the following fees— (a) for groups performing at commercial entertainment events……….$250 per member; (b) for groups performing at religious, charitable or civic events…………..$25 administrative fee; (c) in all other cases……..$700.”. (c) in paragraph 4— (i)
in subparagraph (a) by deleting “$300” and substituting “$500”; and
(ii) in subparagraph (b) by deleting “$300” and substituting “$500”; and (d) by deleting paragraph 8 and substituting the following— “8. (1) There shall be payable upon the issue of a visa pursuant to regulation 8, the following fees— (a) for a single entry ……………..$150;

(b) for a one year multiple entry business visa ………$500; (c) for a student visa …….$300; (d) for a seaman’s visa……$300; (e) for a visa to attend charitable, sporting or religious event ……..$25(per person). (2) In addition to the fee specified in subparagraph (1) (a), (b) and (c), there shall be payable a non-refundable application fee of $100.”; (e) by inserting after paragraph 12 the following new paragraph— “Fee for expedited processing of Work Permit

13. Where a request is made for the processing of an application for a Work Permit within seven days of the making of the application, an expedited processing fee of $500 shall be payable.�. _____________

EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Immigration Regulations— (a) to provide that an application for an extension or renewal of a work permit by a self employed person or employed person must be made 30 days before the expiration of the existing permit. If the application is made after the expiry of the work permit a penalty fee of $250 is payable; (b) to increase the fee for accompanying dependents of the holder of a Work Permit from $300 for the spouse and each child to $500; (c) to increase the fee for a residence permit for spouse of a Belonger from $300 to $500 and from $150 to $300 for each child; (d) to introduce new types of entry visas and the fees payable; (f) to introduce a fee of $500 where a request is made for the processing of an application for a work permit within 7 days of the making of the application.
