Short title and commencement 1. This Ordinance may be cited as the Dogs (Control) (Amendment) Ordinance 2014 and shall come into operation on such day as the Governor may appoint by Notice published in the Gazette.

Interpretation 2. In this Ordinance the “principal Ordinance” means the Dogs (Control) Ordinance.

Section 2 amended 3. Section 2 of the principal Ordinance is amended by inserting in the appropriate alphabetical position the following definition— ““dangerous dog” means— (a) a dog that has bitten, inflicted injury upon, assaulted or otherwise attacked a human being or domestic animal without provocation on private or public property; or

(b) a dog with a known propensity or disposition to attack or otherwise endanger the safety of human beings or domestic animals;”.

Section 20 substituted 4. The principal Ordinance is amended by repealing section 20 and substituting the following section—

“Prohibited breed dogs” 20. (1) The following dogs are prohibited to be imported into the Islands— (a) Dogo Argentino; (b) American Pit Bull Terrier; (c) American Stafffordshire Terrier; (d) American Bull dog; (e) Japanese Tosa; (f) Canary dog; (g) Perro de Presa Canario; and (h) Fila Brasiliero. (2) The Department may refuse to grant an import licence for any dog which it considers dangerous. (3) The Minister may by notice published in the Gazette amend subsection (1). (4) A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine of $50,000 or to imprisonment for two years, or to both.

Section 20A inserted 5. The principal Ordinance is amended by inserting after section 20 the following section—

“Restricted breed dogs 20A. (1) The following dogs are considered restricted breeds— (a) Allenzeller; (b) Aryan Molossus; (c) Bandog; (d) Beauceron;

(e) Belgian Mastiff; (f) Bull Mastiff; (g) Danish Broholmer; (h) Dogue de Bordeaux (Bordeaux Bull dog); (i) Great Swiss Mountain dog; (j) Jindo; (k) Kuvasz; (l) Leonberger; (m) Moscow Watch dog; (n) Neapolitan Mastiff; (o) Perro de Presa Mallorquin; (p) Roman fighting dog; (q) Rottweiler; (r) South African Boerboel; and (s) Tibetan Mastiff. (2) The owner of a restricted breed dog shall— (a) ensure that the premises on which the dog is kept are secured by a fence or wall of suitable height and that such fence or wall is so constructed and maintained as to prevent the escape of the dog; (b) post “Warning/Beware: Dangerous Dog” warning signs at the entrance to the premises where the dog is located; and (c) ensure that the dog is sterilised and is microchipped. (3) A person must be twenty-one years or older to own or be in charge of a restricted breed dog. (4) The Minister may by notice published in the Gazette amend subsection (1). (5) A person who contravenes subsection (2) or (3) commits an offence and is liable on summary conviction to a fine of $5,000 or to imprisonment for twelve months, or to both.

Transitional provisions 6. The Minister may make Regulations prescribing such provisions, as he considers necessary, convenient or expedient for

savings, transitions or transitional purposes in connection with the coming into operation of section 20A. _____________
