Official Rules & Regulations for YETI Raffle A raffle is being conducted by R&P Hospitality for the Alzheimer’s Association, a non-profit charitable organization to raise funds to support Alzheimer’s awareness and to further Alzheimer’s research to find a cure for this disease. The official rules and regulations for this Raffle are listed below. By purchasing a Raffle ticket (a “Ticket”), the purchaser acknowledges that they are aware of, and agrees to be bound by, these Official Rules and R&P Hospitality’s interpretation of any such Official Rules. R&P Hospitality shall be responsible for interpreting and applying the Official Rules. R&P Hospitality interpretation and application of such rules shall be final. 1. Eligibility: This Raffle is open only to those who participate in person at the time of the purchase of the Ticket (August 31, 2020 through September 18, 2020) and who are 18 years and older as of the date of entry. The Raffle is only open to legal residents of the United States of America and is void where prohibited by law. The Raffle is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. 2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of R&P Hospitality as final and binding as it relates to this Raffle. 3. Raffle Period: Entries will be accepted in person starting on August 31, 2020 and ending September 18, 2020. 4. How to Enter: Raffle tickets may be purchased for five dollars ($5) for one ticket or twenty dollars ($20) for five tickets. Only one (1) eligible person may be entered in the Raffle per Ticket sold. If the name of more than one (1) person is provided on a Ticket entry form and that Ticket is selected as a winning ticket, then the person named first will be deemed as the holder of record of that Ticket and declared the winner. The division of any prize among a group of persons purchasing a Ticket in common shall be the sole responsibility of the person named as the holder of record of that Ticket should that Ticket be selected as a winner. R&P Hospitality is not responsible for resolving any disputes that may arise from different individuals listed on a winning Ticket. Tickets will not be sold after September 18, 2020. An individual can purchase as many Tickets as they may wish, subject to availability. All entries must include payment by check or cash. R&P Hospitality reserves the right to reject any entry form that is submitted without proper payment or payment that does not constitute “good funds.” No refunds will be made. All checks must be made out to “Runk & Pratt”. Any physically altered entry form, or entry form received without proper or sufficient payment, will be immediately disqualified by R&P Hospitality. Neither R&P Hospitality nor its directors, officers, employees, agents or other representatives assumes any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible or undelivered entries, or any other failure to receive entries, or any failure to deliver a receipt of purchase prior to the drawing deadlines. 5. Prize Drawings: Prize drawings will be conducted by a representative of R&P Hospitality on September 18, 2020 at the Alzheimer’s Golf Tournament at Ivy Hill Golf Club. Entrants need not be present to win. Winners will be selected at random. All orders for Tickets must be received and/or purchased by the indicated deadline to be eligible for the applicable drawing. R&P Hospitality assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. 6. Notification of Winners: Winners will be notified according to the contact information provided to R&P Hospitality at the time of Ticket purchase. If a selected winner is unable to be contacted or located after a period of one (1) month from the draw date of the applicable raffle drawing, the prize or its cash equivalent will be deemed to have been donated to R&P Hospitality. In order to collect a prize, a winner must sign and deliver to R&P Hospitality: (a) such written information as is required by any applicable tax and/or real estate laws, including, without limitation, Social Security Number; (b) proof of identity in forms satisfactory to the R&P Hospitality showing that the person claiming the prize is the same person who is named on the winning Ticket. A list of winners will be posted on the Runk & Pratt Facebook and the Ivy Hill Facebook page within one week of the applicable drawing. 7. Terms & Conditions: R&P Hospitality reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Raffle should virus, bug, non-authorized human intervention, fraud, or other cause beyond R&P Hospitality’s control corrupt or affect the administration, security, fairness, or proper conduct of the Raffle. In such case, R&P Hospitality may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by R&P Hospitality. R&P Hospitality reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Raffle or website or violates these Terms & Conditions. 8. Limitation of Liability: By entering, You agree to release and hold harmless R&P Hospitality and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Raffle and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of
the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries. 9. Disputes: THIS Raffle IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND VIRGINIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Raffle, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Raffle, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Virginia having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Raffle). Participant further waives all rights to have damages multiplied or increased. 10. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Runk & Pratt, PO Box 2489 Forest, VA 24551. The Raffle hosted by R&P Hospitality is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram. 13. By entering the contest, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
